67The size of <strong>the</strong> two shares shall be determined by <strong>the</strong> Principal Controller ofDefence Accounts (Pensions) in consultation with <strong>the</strong> local civil authorities and, pendingsuch determination, half of <strong>the</strong> <strong>pension</strong> and gratuity shall be paid to <strong>the</strong> dependants of <strong>the</strong><strong>pension</strong>er.Note:For <strong>the</strong> purpose of resuming payment to <strong>the</strong> <strong>pension</strong>er on his regaining sanity,certificate of a Magistrate to that effect shall be obtained. His signature/thumb &finger impressions will be records by <strong>the</strong> Pension Disbursing Authority onDescriptive roll (IAFA-369)(d) The person receiving <strong>the</strong> ordinary family <strong>pension</strong> as a guardian of such son ordaughter or such son or daughter not receiving <strong>the</strong> ordinary family <strong>pension</strong> throughguardian, shall produce a certificate, from a Medical Board comprising of a MedicalSuperintendent or a Principal or a Director or Head of <strong>the</strong> Institution or his nominee asChairman and two o<strong>the</strong>r members, out of which at least one shall be a Specialist in <strong>the</strong>particular area of mental or physical disability including mental retardation once, if <strong>the</strong>disability is permanent and if <strong>the</strong> disability temporary, once in every five years to <strong>the</strong>effect that he/she continues to suffer from disorder or disability of mind or continues tobe physically crippled or disabled.Note-A certificate of guardianship issued in respect of persons with Autism, CerebralPalsy, Mental retardation and multiple disabilities issued under National TrustAct by local level Committee is acceptable.PAYMENT OF FAMILY PENSION IN RESPECT OF MENTALLY RETARDEDCHILDREN87. (a) The family <strong>pension</strong> in respect of mentally retarded son or daughter shall bepayable through a person nominated by <strong>the</strong> Armed Forces Personnel or <strong>pension</strong>er, as <strong>the</strong>case may be, in case no such nomination has been furnished by <strong>the</strong> Armed ForcePersonnel or <strong>pension</strong>ers during his life time, through <strong>the</strong> persons nominated by <strong>the</strong> spouseof <strong>the</strong> deceased personnel or <strong>pension</strong>er. Such personnel or <strong>pension</strong>er can also appointlegal guardian through Local Level Committee in terms of <strong>the</strong> National Trust <strong>for</strong> <strong>the</strong>Welfare of Persons with Autism, Cerebral Palsy Mental Retardation & MultipleDisabilities Act, 1999 and Rules 2000.(b) Nomination <strong>for</strong>m <strong>for</strong> receiving family <strong>pension</strong> on behalf of mentally retardedchild to whom family <strong>pension</strong> is payable is as per Appendix XX to <strong>the</strong>se Regulations.ORDINARY FAMILY PENSION WHERE JOINTLY NOTIFIED IN PPO OFTHE PENSIONER87-A On <strong>the</strong> death of <strong>the</strong> <strong>pension</strong>er widow will submit death certificate of her husbandtoge<strong>the</strong>r with a certificate that she is not in receipt of any o<strong>the</strong>r family <strong>pension</strong> and <strong>the</strong>Pension Regulations <strong>for</strong> <strong>the</strong> Army, Part II (2008)
