67The size of the two shares shall be determined by the Principal Controller ofDefence Accounts (Pensions) in consultation with the local civil authorities and, pendingsuch determination, half of the pension and gratuity shall be paid to the dependants of thepensioner.Note:For the purpose of resuming payment to the pensioner on his regaining sanity,certificate of a Magistrate to that effect shall be obtained. His signature/thumb &finger impressions will be records by the Pension Disbursing Authority onDescriptive roll (IAFA-369)(d) The person receiving the ordinary family pension as a guardian of such son ordaughter or such son or daughter not receiving the ordinary family pension throughguardian, shall produce a certificate, from a Medical Board comprising of a MedicalSuperintendent or a Principal or a Director or Head of the Institution or his nominee asChairman and two other members, out of which at least one shall be a Specialist in theparticular area of mental or physical disability including mental retardation once, if thedisability is permanent and if the disability temporary, once in every five years to theeffect that he/she continues to suffer from disorder or disability of mind or continues tobe physically crippled or disabled.Note-A certificate of guardianship issued in respect of persons with Autism, CerebralPalsy, Mental retardation and multiple disabilities issued under National TrustAct by local level Committee is acceptable.PAYMENT OF FAMILY PENSION IN RESPECT OF MENTALLY RETARDEDCHILDREN87. (a) The family pension in respect of mentally retarded son or daughter shall bepayable through a person nominated by the Armed Forces Personnel or pensioner, as thecase may be, in case no such nomination has been furnished by the Armed ForcePersonnel or pensioners during his life time, through the persons nominated by the spouseof the deceased personnel or pensioner. Such personnel or pensioner can also appointlegal guardian through Local Level Committee in terms of the National Trust for theWelfare of Persons with Autism, Cerebral Palsy Mental Retardation & MultipleDisabilities Act, 1999 and Rules 2000.(b) Nomination form for receiving family pension on behalf of mentally retardedchild to whom family pension is payable is as per Appendix XX to these Regulations.ORDINARY FAMILY PENSION WHERE JOINTLY NOTIFIED IN PPO OFTHE PENSIONER87-A On the death of the pensioner widow will submit death certificate of her husbandtogether with a certificate that she is not in receipt of any other family pension and thePension Regulations for the Army, Part II (2008)
