40(v). If as a result of Government decision takensubsequent to retirement/discharge of theindividual, the amount of retirement gratuityalready paid on his retirement/discharge isenhanced on account of:(1). Grant of emoluments higher than theemoluments on which retirement gratuity alreadypaid was determined.(2). Liberalisation in the provisions of the rulesfrom a date prior to the date ofretirement/discharge of the individual concerned.(vi). In cases of permanent absorption in PublicSector Undertaking /Autonomous Bodies:-Payment of interest on delayed payment of gratuityin these cases may also be decided in the samemanner as prescribed in clause (iii) above.(vii). Individual declared as missing while inservice:- In case, where individual has beendeclared as missing while in service and the familyhas been paid the death gratuity not exceeding theamount of retirement gratuity, the period of 3months referred to in sub-rule (i) above shall betaken from the date of applicationInterest on arrears of retirement gratuitymay be paid if the payment of arrear ofgratuity is delayed beyond three monthsfrom the date of receipt of revision claimby the Principal Controller of DefenceAccounts (Pensions) submitted by theclaimant/Record Office after the issue ofinstructions framed by the PrincipalController of Defence Accounts (Pensions)in the light of Government ordersliberalising the award of gratuityIf the payment of gratuity has been delayedbeyond 6 months from the date ofpermanent absorption the interest may beallowed for the period of delay beyond 6months.The interest shall be paid only if theretirement gratuity is not paid within 3months from the date of application.Provided that the delay in thepayment was not caused on account offailure on the part of the serviceOfficer/personnel or the claimant to complywith the procedure laid down in this regard.Pension Regulations for the Army, Part II (2008)
41SECTION-4 : Procedure for Commutation of PensionAPPLICATION FOR COMMUTATION50. (a) An Individual who could not express his desire to commute a portion of hispension before 3 months of his date of retirement/discharge while furnishinginformation/documents for grant of retiring/service pension and also those who arereleased /invalided out of service, shall submit an application for commutation of pensionon Form-A as per Annexture-1 to Appendix XII to these Regulations to the Authoritiesmentioned below.(b) The individual may nominate a person if he so desire under Regulation 52 toreceive commuted value of pension on his demise as in Appendix XIII to theseRegulations.(c) In order to ensure that the payment is made at the rate shown for the specifiedage, it is essential that the commutation application of those residing in India shouldreach Principal Controller of Defence Accounts (Pensions) at least 2 months before thedate on which the applicant will attain such age.
