22COMPENSATION IN LUMP SUM IN LIEU OF THE DISABILITY ELEMENTOF DISABILITY PENSION OR WAR-INJURY ELEMENT OF WAR-INJURYPENSION-32. The following procedure shall be followed for the payment of compensation inlump sum in lieu of the disability element of disability pension or war-injury element ofwar-injury pension.(a) Integrated Headquarters of Ministry of Defence (Army), Adjutant’s GeneralBranch (MP-5) shall forward the Compensation Medical Board proceedings in AFMSF-15B duly approved by next higher medical authority and decision of the competentauthority regarding attributability to/aggravation of the disability by military servicetogether with-(i) option from the Officer that he opts for lump sum compensation in lieu ofdisability element/war injury element as in Annexure-I to Appendix-VIIand;(ii) an undertaking from the Officer as per Annexure-II to Appendix –VII tothese Regulations.(b) The Principal Controller of Defence Accounts (Pensions) on receipt ofsanction of the competent authority regarding attributability and Disability CompensationMedical Board proceeding shall calculate capitalised value of disability element or warinjury element taking into account the age next birth day with reference to the date of onsetof disability with loading in age, if any, and date of birth as per Audited Army Listand issue to the Controller of Defence Accounts (Officers) an authority letter indicatingtherein lump sum amount in lieu of disability element or war-injury element of pensionthat would be payable to the Officer. The Controller of Defence Accounts (Officers) shallmake payment to the Officer and make suitable endorsement in his service record toavoid double payment.DISABILITY ELEMENT WHEN DISABILITY MANIFESTS AFTERRETIREMENT OR SUBSTANTIAIL INCREASE IN DISABILITY33. In case where disability manifests after retirement of Officer or substantialincrease in the disability is claimed under Regulation 86 or Regulation 92 of PensionRegulations for the Army, Part-I (2008), as the case may be, the following procedureshall be followed:-(a) The Officer concerned shall send an application, together with a medicalcertificate with clinical notes, if any, from a Registered Medical Practitioner who lastattended upon the Officer, indicating the nature of disease, to the Adjutant GeneralBranch (MP-5) Medical Personnel Record Service (Officers)/ Territorial ArmyDirectorate of Integrated Head Quarters of Ministry of Defence (Army).(b) The aforesaid Branch of Directorate on receipt of the application and themedical certificate etc. referred to in sub-clause (a) above, shall, examine within a periodPension Regulations for the Army, Part II (2008)
23of two months, and decide, in consultation with the Director General of Armed ForcesMedical Services, where necessary, whether a prima facie justification for bringing theclaimant before a Review Medical Board, exists or not. If it is decided to bring theclaimant before a Review Medical Board, the Director General Armed Forces MedicalServices shall make necessary arrangements for the same.(c) On receipt of the Review Medical Board proceedings as per sub-clause (b)above Directorate shall forward Review Medical Board proceedings to the PrincipalController of Defence Accounts (Pensions) within 3 months for increase/decrease/discontinues in disability element, if any or sanction disability element in addition topension already notified if, the disability has been accepted as attributable to oraggravated by military service and the disability is 20 percent or more as assessed byReview Medical Board.ORDINARY FAMILY PENSION SPECIAL FAMILY PENSION, LIBERALISEDFAMILY PENSION AND DEPENDANT PENSION WHEN DEATH OCCURREDIN SERVICE34. (a) Officer who die while in service, the Integrated Headquarters Ministry ofDefence (Army), Adjutant General’s Branch (MP-5&6) Medical Personnel RecordService (Officers)/ Territorial Army Directorate of Integrated Head Quarters of Ministryof Defence (Army) in the case of service officer, Director General Armed Forces MedicalService, in the case of Army Medical Corps, Army Dental Corps and Military NursingService and Territorial Army Directorate in the case of Territorial Army shall publish thecasualty report and forward a copy thereof to the-(i) next of kin of the deceased Officer, along with the blank applicationform for family pension (MPB-501) for completion and submition to thePrincipal Controller of Defence Accounts (Pensions) under intimation toabove mentioned Directorate as the case may be.(ii) the Controller of Defence Accounts (Officers), asking him to send theLast Pay certificate and No Demand Certificate in respect of thedeceased Officer, direct to the Principal Controller of Defence Accounts(Pensions).(iii) the Principal Controller of Defence Accounts (Pensions) along with –(1)the nomination made by the deceased for death gratuity.(2)in case of death due to injury/accident-I. Injury report (IAFZ-2006), if any,II. Finding of the Court of Inquiry, if any, with the opinion of thecompetent authorityIII. Death Certificate (AFMSF 93 Part I)IV.
