76Section Officer (Accounts) Upto an amount notexceeding Rs. 50/-(c) In cases where the whole or any portion of the payment in itself, is not exactlycovered by rule or for want of authority or full proof that it has been paid has not beenprovided (for example, there may be an absence of one or more sub vouchers), thefollowing Officers of Principal Controller of Defence Accounts (Pensions) office maywaive an audit objection upto the limit noted against each provided the conditionsmentioned at (i), (ii) and (iii) are satisfied:-AuthorityPrincipal Controller of Defence Accounts/Controller ofDefence Accounts/ Additional Controller of DefenceAccounts if in the independent chargeAdditional Controller of Defence Accounts /JointController of Defence AccountsFinancial limitUpto an amount notexceeding Rs. 3000/-Upto an amount notexceeding Rs. 1500/-Deputy Controller of Defence Accounts/ AssistantController of Defence Accounts holding group chargeUpto an amount notexceeding Rs. 1000/-(i)(ii)that the expenditure is not of an intrinsically recurring nature; andwhere the objection is based on insufficiency of sanction, that he issatisfied that the authority empowered to sanction the expenditure wouldaccord sanction, if required; or(iii) where the objection is based on insufficiency of proof of payment, that heis of opinion that undue trouble would be caused if the submission of thefull proof of the expenditure having been incurred were insisted upon, andhe sees no reason to doubt that the payment has actually been made.OVERPAYMENT DUE TO FAILURE OF AUDIT97. Should the circumstances in which overpayment has been made in any case revealany serious irregularity or defect in procedure or serious failure of audit for which thestaff of the Defence Accounts Department is responsible, a full report of the case shall bemade by the Principal Controller of Defence Accounts (Pensions) to the ControllerGeneral of Defence Accounts, who shall take such action as may be necessary.OVERPAYMENTS DUE TO ERRONEOUS GRANT OF MORE THAN ONEFAMILY PENSION98. Overpayments made consequent on the erroneous grant of more than one familypension in respect of the same individual and to the same pensioner, may be written offPension Regulations for the Army, Part II (2008)
77by the competent authority provided that it is established that the overpayments weremade in good faith and that there has been no attempt to defraud.OVERPAYMENTS DUE TO FALSE CERTIFICATES OF WIDOWHOOD ORNON-MARRIAGE99. Overpayment of pension received by female pensioner due to suppressing the factof re-marriage by widow and son/daughter and presentation of false certificate shall,irrespective of the amount involved, be referred to the competent authority for orders asto the manner in which the sum fraudulently drawn by the alleged widow/widower or sonor daughter shall be recovered.WITHHOLDING AND RECOVERY OF DISABILITY PENSION100.
