29.1 The Employer will evaluate and compare only the Bids determined to be substantially responsive inaccordance with Clause 26.29.2 In evaluating the Bids, the Employer will determine for each Bid the evaluated Bid Price by adjusting the BidPrice as follows:(a)(b)(c)making any correction for errors pursuant to Clause 27; ormaking an appropriate adjustments for any other acceptable variations, deviations; andmaking appropriate adjustments to reflect discounts or other price modifications offered inaccordance with Sub Clause 22.5.29.3 The Employer reserves the right to accept or reject any variation, deviation, or alternative offer. Variations,deviations, and alternative offers and other factors which are in excess of the requirements of the Biddingdocuments or otherwise result in unsolicited benefits for the Employer shall not be taken into account in Bidevaluation.29.4 The estimated effect of the price adjustment conditions under Clause 47 of the Conditions of Contract, duringthe period of implementation of the Contract, will not be taken into account in Bid evaluation.29.5 If the Bid of the successful Bidder is seriously unbalanced in relation to the Engineer's estimate of the cost ofwork to be performed under the contract, the Employer may require the Bidder to produce detailed priceanalyses for any or all items of the Bill of Quantities, to demonstrate the internal consistency of those priceswith the construction methods and schedule proposed. After evaluation of the price analyses, the Employermay require that the amount of the performance security set forth in Clause 34 be increased at the expense ofthe successful Bidder to a level sufficient to protect the Employer against financial loss in the event of defaultof the successful Bidder under the Contract.30. Award of Contract31.1 Subject to Clause 32, the Employer will award the Contract to the Bidder whose Bid has been determined tobe substantially responsive to the Bidding documents and who has offered the lowest evaluated Bid Price,provided that such Bidder has been determined to be (a) eligible in accordance with the provisions of Clause3, and (b) qualified in accordance with the provisions of Clause 4.31.2 If, pursuant to Clause 12.2 this contract is being let along with other contracts, the lowest evaluated Bid Pricewill be determined when evaluating this contract in conjunction with other contracts to be awardedconcurrently, taking into account any discounts offered by the bidders for the award of more than onecontract.32. Employer's Right to Accept any Bid and to Reject any or all Bids32.1 Notwithstanding Clause 31, the Employer reserves the right to accept or reject any Bid, and to cancel theBidding process and reject all Bids, at any time prior to the award of Contract, without thereby incurring anyliability to the affected Bidder or Bidders or any obligation to inform the affected Bidder or Bidders of thegrounds for the Employer's action.17
