34.1 If the Eng<strong>in</strong>eer-<strong>in</strong>-charge r <strong>in</strong>structs the Contractor to carry out a test not specified <strong>in</strong> the Specification tocheck whether any work has a Defect and the test shows that it does, the Contractor shall pay <strong>for</strong> the testand any samples. If there is no Defect the test shall be a Compensation Event.35. Correction of Defects35.1 The Eng<strong>in</strong>eer-<strong>in</strong>-charge shall give notice to the Contractor of any Defects be<strong>for</strong>e the end of the DefectsLiability Period, which beg<strong>in</strong>s at Completion and is def<strong>in</strong>ed <strong>in</strong> the Contract Data. The Defects LiabilityPeriod shall be extended <strong>for</strong> as long as Defects rema<strong>in</strong> to be corrected.35.2 Every time notice of a Defect is given, the Contractor shall correct the notified Defect with<strong>in</strong> the lengthof time specified by the Eng<strong>in</strong>eer’s notice.36. Uncorrected Defects36.1 If the Contractor has not corrected a Defect with<strong>in</strong> the time specified <strong>in</strong> the Eng<strong>in</strong>eer’s notice, theEng<strong>in</strong>eer will assess the cost of hav<strong>in</strong>g the Defect corrected, and the Contractor will pay this amount.Note: Where <strong>in</strong> certa<strong>in</strong> cases, the technical specifications provide <strong>for</strong> acceptance of works with<strong>in</strong> specifiedtolerance limits at reduced rates, Eng<strong>in</strong>eer will certify payments to Contractor accord<strong>in</strong>gly.37. Bill of QuantitiesD. Cost Control37.1 The Bill of Quantities shall conta<strong>in</strong> items <strong>for</strong> the construction, <strong>in</strong>stallation, test<strong>in</strong>g, and commission<strong>in</strong>gwork to be done by the contractor .37.2 The Bill of Quantities is used to calculate the Contract Price. The Contractor is paid <strong>for</strong> the quantity ofthe work done at the rate <strong>in</strong> the Bill of Quantities <strong>for</strong> each item.38. Changes <strong>in</strong> the Quantities38.1 If the f<strong>in</strong>al quantity of the work done differs from the quantity <strong>in</strong> the Bill of Quantities <strong>for</strong> the particularitem by more than 25 percent, provided the change exceeds 1% of Initial Contract Price, the Eng<strong>in</strong>eershall adjust the rate to allow <strong>for</strong> the change.38.2 The Eng<strong>in</strong>eer-<strong>in</strong>-charge shall not adjust rates <strong>for</strong> changes <strong>in</strong> quantities if thereby the Initial ContractPrice is exceeded by more than 15 percent, except with the Prior approval of the Employer.38.3 If requested by the Eng<strong>in</strong>eer-<strong>in</strong>-charge, the Contractor shall provide the Eng<strong>in</strong>eer-<strong>in</strong>-charge with adetailed cost breakdown of any rate <strong>in</strong> the Bill of Quantities.39. Variations39.1 All Variations shall be <strong>in</strong>cluded <strong>in</strong> updated Programmes produced by the Contractor.40. Payments <strong>for</strong> Variations40.1 The Contractor shall provide the Eng<strong>in</strong>eer-<strong>in</strong>-charge with a quotation (with breakdown of unit rates) <strong>for</strong>carry<strong>in</strong>g out the Variation when requested to do so by the Eng<strong>in</strong>eer-<strong>in</strong>-charge. The Eng<strong>in</strong>eer-<strong>in</strong>-chargeshall assess the quotation, which shall be given with<strong>in</strong> seven days of the request or with<strong>in</strong> any longerperiod stated by the Eng<strong>in</strong>eer-<strong>in</strong>-charge and be<strong>for</strong>e the Variation is ordered.40.2 If the work <strong>in</strong> the Variation corresponds with an item description <strong>in</strong> the Bill of Quantities and if, <strong>in</strong> theop<strong>in</strong>ion of the Eng<strong>in</strong>eer, the quantity of work above the limit stated <strong>in</strong> Sub Clause 38.1 or the tim<strong>in</strong>g ofits execution do not cause the cost per unit of quantity to change, the rate <strong>in</strong> the bill of Quantities shall beused to calculate the value of the Variation.
