44. Compensation Events44.1 The follow<strong>in</strong>g are Compensation Events unless they are caused by the Contractor:(a)(b)(c)(d)(e)(f)(g)(h)(i)(j)(k)(l)The Employer does not give access to a part of the Site by the Site Possession Date stated <strong>in</strong> theContract Data.The Employer modifies the schedule of other contractors <strong>in</strong> a way which affects the work of thecontractor under the contract.The Eng<strong>in</strong>eer-<strong>in</strong>-charge orders a delay or does not issue draw<strong>in</strong>gs, specifications or <strong>in</strong>structionsrequired <strong>for</strong> execution of works on time.The Eng<strong>in</strong>eer-<strong>in</strong>-charge <strong>in</strong>structs the Contractor to uncover or to carry out additional tests uponwork which is then found to have no Defects.The Eng<strong>in</strong>eer-<strong>in</strong>-charge unreasonably does not approve <strong>for</strong> a subcontract to be let.Ground conditions are substantially more adverse than could reasonably have been assumedbe<strong>for</strong>e issuance of Letter of Acceptance from the <strong>in</strong><strong>for</strong>mation issued to <strong>Bid</strong>ders (<strong>in</strong>clud<strong>in</strong>g the SiteInvestigation Reports), from <strong>in</strong><strong>for</strong>mation available publicly and from a visual <strong>in</strong>spection of theSite.The Eng<strong>in</strong>eer-<strong>in</strong>-charge gives an <strong>in</strong>struction <strong>for</strong> deal<strong>in</strong>g with an un<strong>for</strong>eseen condition, caused bythe Employer, or additional work required <strong>for</strong> safety or other reasons.Other contractors, public authorities, utilities or the Employer does not work with<strong>in</strong> the dates andother constra<strong>in</strong>ts stated <strong>in</strong> the Contract, and they cause delay or extra cost to the Contractor.The advance payment is delayed.The effect on the Contractor of any of the Employer’s Risks.The Eng<strong>in</strong>eer-<strong>in</strong>-charge unreasonably delays issu<strong>in</strong>g a Certificate of Completion.Other Compensation Events listed <strong>in</strong> the Contract Data or mentioned <strong>in</strong> the Contract.45. Tax44.2 If a Compensation Event would cause additional cost or would prevent the work be<strong>in</strong>g completed be<strong>for</strong>ethe Intended Completion Date, the Contract Price shall be <strong>in</strong>creased and/or the Intended CompletionDate is extended. The Eng<strong>in</strong>eer-<strong>in</strong>-charge shall decide whether and by how much the Contract Price shallbe <strong>in</strong>creased and whether and by how much the Intended Completion Date shall be extended.44.3 As soon as <strong>in</strong><strong>for</strong>mation demonstrat<strong>in</strong>g the effect of each Compensation Event upon the Contractor's<strong>for</strong>ecast cost has been provided by the Contractor, it is to be assessed by the Eng<strong>in</strong>eer-<strong>in</strong>-charge and theContract Price shall be adjusted accord<strong>in</strong>gly. If the Contractor's <strong>for</strong>ecast is deemed unreasonable, theEng<strong>in</strong>eer-<strong>in</strong>-charge shall adjust the Contract Price based on Eng<strong>in</strong>eer-<strong>in</strong>-charge’s own <strong>for</strong>ecast. TheEng<strong>in</strong>eer-<strong>in</strong>-charge will assume that the Contractor will react competently and promptly to the event.44.4 The Contractor shall not be entitled to compensation to the extent that the Employer's <strong>in</strong>terests areadversely affected by the Contractor not hav<strong>in</strong>g given early warn<strong>in</strong>g or not hav<strong>in</strong>g cooperated with theEng<strong>in</strong>eer-<strong>in</strong>-charge.45.1 The rates quoted by the Contractor shall be deemed to be <strong>in</strong>clusive of all sales and other taxes that theContractor will have to pay <strong>for</strong> the per<strong>for</strong>mance of this Contract. The Employer will per<strong>for</strong>m such duties<strong>in</strong> regard to the deduction of such taxes at source as per applicable law.46. Currencies46.1 All payments shall be made <strong>in</strong> Indian Rupees.45
