In case it isnot sanctioned in period allowed <strong>to</strong>authority for sanction <strong>of</strong> tender, nexthigher authority for sanction <strong>of</strong> tender,next higher authority shall be competent<strong>to</strong> sanction within time prescribed for him.Note:-3. These powers are subject <strong>to</strong> thecondition that the contrac<strong>to</strong>r's tenderedamount do not exceed the amount <strong>of</strong> 'G'Schedule as per sanctioned estimatesamount by more than 20% and also thatthe overall monetary limits <strong>of</strong> financialpowers mentioned above against eachauthority are not exceeded.Note:-4. Thus both the conditions shouldbe, satisfied (i) that contrac<strong>to</strong>r's tenderamount must be within limits prescribedabove and (ii)tender premium /percentage <strong>of</strong> contrac<strong>to</strong>r's tenderedamount over sanctioned estimatedamount <strong>of</strong> 'G' Schedule is within 20% Incase there in any condition havingfinancial implication then tenderedamount will be calculated includingfinancial implication <strong>of</strong> the condition.Note:-5 If the tendered amount <strong>of</strong> thecontrac<strong>to</strong>r exceeds the estimated amount<strong>of</strong> the work by more than 20% the powerswill be exercised by the next higherauthority. Where 'G' <strong>schedule</strong> is based ona previous year's BSR and tendersreceived when evaluated <strong>to</strong> the current6

The competentauthority who originally sanctioned thetender may negotiate with other qualifiedtenderers <strong>to</strong> get the work done conditionsor below after taking action as, per rules.If none <strong>of</strong> the tenderers is ready <strong>to</strong>execute the work on sanctioned ratesafter negotiations as above, thecompetent authority may award the workon same sanctioned rate <strong>to</strong> any eligibleand experienced registered non-tenderercontrac<strong>to</strong>r after recording reasons.Note:-8 In case after adopting procedureas per note 7, no tenderer is ready <strong>to</strong>execute the work on lowest sanctionedrate, then authority next higher <strong>to</strong> tendersanctioning authority may award the workat the rates up<strong>to</strong> <strong>of</strong> second lowest <strong>of</strong> up<strong>to</strong>2% above lowest sanctioned ratewhichever is lower after following theprocedure laid down in note 7,Note:- 9 In case <strong>of</strong> tender other than <strong>of</strong>the lowest . Next higher authority will becompetent <strong>to</strong> sanction. Negotiations shall be conductedsubject <strong>to</strong> following conditions:-i.Negotiations shall be undertaken inexceptional circumstances. Negotiationswill not make original <strong>of</strong>fer made by thetenderer inoperative. The competentauthority will have option <strong>to</strong> consideroriginal <strong>of</strong>fer in case the tendererdecides <strong>to</strong> increase rates originallytendered or imposes new terms andconditions. this may be made clear inwriting while informing for negotiation.ii. Negotiation before advertisement fortender may be resorted <strong>to</strong> in case <strong>of</strong>small works.iii. Negotiations after tenders should bediscouraged. It may however beundertaken only with the lowest thendererin following circumstances:(a) When ring rates / pooled rates havebeen quoted by the tenderers.(b) When the rates vary considerably andconsidered much higher than theprevailing market rate at the time <strong>of</strong>opening <strong>of</strong> tenders.iv. Procedure <strong>of</strong> negotiations :-(a)Before recommending / conductingnegotiation, full justification should berecorded in writing giving comparative trend<strong>of</strong> rates <strong>of</strong> such tenders. Contac<strong>to</strong>rs shouldbe briefed <strong>of</strong> reasons <strong>of</strong> negotiations <strong>to</strong>make it success.(b) Result <strong>of</strong> negotiation shall be recordedin the proceedings.(c) Negotiations will be conducted with thelowest tenderer only.(d) The lowest Tenderer (s) shall beinformed in writing either throughmessenger if they are local and byregistered letters in case they belong <strong>to</strong>outstation. A minimum time <strong>of</strong> 7 days incase <strong>of</strong> tenderers being <strong>of</strong> outstations, and3 days in case <strong>of</strong> local tenderers shall begiven prior <strong>to</strong> negotiations. in case <strong>of</strong>urgency the competent authority mayreduce this time provided the lowesttendere has received the intimationregarding holding <strong>of</strong> negotiations, Reasonsin such cases will be recorded.Note:-In case <strong>of</strong> non - satisfac<strong>to</strong>ryachievement <strong>of</strong> rates from lowest tenderer,the competent authority may choose <strong>to</strong>9


make a written counter <strong>of</strong>fer <strong>to</strong> the lowesttendered and if this is not accepted by him,the competent authority may decide <strong>to</strong>reject and reinvite tenders or <strong>to</strong> make thesame counter-<strong>of</strong>fer first <strong>to</strong> the secondlowest tenderer, then <strong>to</strong> the third lowesttenderer and so on in the order <strong>of</strong> initialbidding and work order be awarded <strong>to</strong> thetendered who accepts the counter- <strong>of</strong>fer.(e) In case (on unacceptable rates) therates even after negotiations are very high,fresh tenders should invited .16. To issue work order for original or repair Resident Engineer Up<strong>to</strong> Rs. 30.000/- in each case subject <strong>to</strong>Works up<strong>to</strong> Basic Schedule <strong>of</strong> Ratesan annual limit <strong>of</strong> Rs 1.50 lacs.without inviting tender.Note:-1 Such powers should be exercisedfor recorded reasons. It is furtherstipulated that the powers for issuing workorders will not be exercised in normalcases but will be exercised either inemergent cases or where exercise <strong>of</strong> suchpowers is beneficial <strong>to</strong> <strong>Board</strong> .Note:-2 It is important <strong>to</strong> check the validity<strong>of</strong> the rates from time <strong>to</strong> time by invitingtenders for sufficiently large items <strong>of</strong> workscovered by these rates .Note:-3 Copy <strong>of</strong> work order besimultaneously endorsed <strong>to</strong> next higherauthority.Note:-4The rules for execution <strong>of</strong> "workson work order" as mentioned in AppendixVII <strong>of</strong> P.W.F. & A.R shall be followedstrictly.17. To sanction running rate contract for Additional Chief Engineer Full powers <strong>to</strong> sanction division wise rateworks <strong>to</strong> be executed under piece workcontracts for one year at a timesystem on 'Piece Work Agreement' aftercalling division wise tenders for theNote:-1The procedure mentioned in Rulespecific purpose323 <strong>of</strong> P.W.F. & A.R. shall be followedstrictly and agreement will be executed inprescribed from.18. Engineer reduced proportionately whilewithdrawing work.37. To dispense with earnest money when 1. Chief Engineer / Full powersplant & machinery are either supplied Addl. Chie Engineeror erected by firms <strong>of</strong> undoubted orfinancial standing and repute.2. Dy.<strong>Housing</strong> Commissioner Full powers Provided that not more than90% <strong>of</strong> the contracted value is paid ondelivery <strong>of</strong> the material -at-site and notless than 10% is retained until the period<strong>of</strong> maintenance has been satisfac<strong>to</strong>rilycompleted. Further that decision for suchexemption should be taken before invitingtenders <strong>to</strong> make it a common condition.15
