CONDUCT AND DISCIPLINEThe responsibility for fostering desirable standards of conduct in the Bakersfield City School District is shared by theBoard of Education, parents and students. The Board has adopted uniform policies and procedures for student conductand discipline with the goal of promoting a school atmosphere conducive to learning and to the safety and welfare ofstudents and staff. In addition to complying with the District policies and procedures, each school has the option todevelop a supplementary set of rules consistent with the District’s conduct rules. Together, these rules make up the“student discipline code.”The student discipline code applies to all students attending school in the Bakersfield City School District including thefollowing circumstances: (1) while on any school grounds; (2) while going to or coming from any school; (3) duringthe lunch period, whether on or off the school campus; and (4) during, going to, or coming from a school-sponsoredactivity.The student discipline code also applies to: (1) all school-related trips and excursions approved according to governingboard standards; and (2) optional District educational programs such as: (a) ) summer school; (b) after-schoolprograms and (c) pre-kindergarten or preschool programs. At the principal’s discretion, a student with documenteddiscipline problems not requiring expulsion may be removed from the remainder of an optional educational program.Before a removal occurs, the parent will receive a written notice and an opportunity to be heard in front of the principalor principal’s designee.A student may be subject to disciplinary action up to and including expulsion if that student uses medication in amanner other than prescribed by written statements from both the student's authorized health care provider and theparent/legal guardian.These procedures were developed to establish a uniform discipline code for the district; it is expected that this codewould be followed and consistently enforced in the same manner throughout the Bakersfield City School District. Inthe application of this code, all staff members are to assure due process for students and are to consider the followingfactors and alternatives prior to suspension:1. Age, health and maturation of the student2. Teacher/student conference3. Parent/teacher conference4. Counselor/student conference (if available)5. Parent/counselor conference6. Administrator/student conference7. Administrator/parent conference8. Referral for psychological assistance and counseling9. In-school denial of privileges10. Restitution11. Community service12. Detention after school13. Referral to appropriate agency14. Referral for education/psychological evaluation15. Conduct a Team for Student Success (T.S.S.) meeting16. Referral to anger management program17. Education on civility, respect, tolerance, diversity, aggression replacement, and/or conflict resolution46
