County Commissioners Associ<strong>at</strong>ion,Greensboro, <strong>North</strong> <strong>Carolina</strong>Nearly everyone today accepts theIdea th<strong>at</strong> organized public health serviceIs one <strong>of</strong> the fundamental responsibilities<strong>of</strong> government in our society.It is true th<strong>at</strong> opinions differ as towh<strong>at</strong> proportions <strong>of</strong> public health responsibilityshould properly be borneby Federal, by st<strong>at</strong>e, by county, andby municipal government. However, thebasic theory <strong>of</strong> governmental responsibilityfor protecting the public healthhas advanced in practice to the pointth<strong>at</strong> modern American government <strong>at</strong>every level is now engaged in some part<strong>of</strong> the work—the Federal governmentthrough the United St<strong>at</strong>es Public<strong>Health</strong> Service and rel<strong>at</strong>ed agencies,the st<strong>at</strong>e government through theSt<strong>at</strong>e Board <strong>of</strong> <strong>Health</strong>, and the localunits through district, county, andsometimes municipal health departments.Development <strong>of</strong> St<strong>at</strong>e GovernmentalResponsibility for <strong>Health</strong>In <strong>North</strong> <strong>Carolina</strong><strong>The</strong> first substantial piece <strong>of</strong> healthlegisl<strong>at</strong>ion applicable to the territorywhich is <strong>North</strong> <strong>Carolina</strong> was enactedin 1712 by the "General Assembly" <strong>of</strong>the Province <strong>of</strong> <strong>Carolina</strong> and was entitled"An Act for the More EffectualPreventing <strong>of</strong> the Spread <strong>of</strong> ContagiousDistempers." It was <strong>of</strong> course a maritimequarantine law and appointed a"Commissioner for Enguireing into theSt<strong>at</strong>e <strong>of</strong> <strong>Health</strong>" <strong>of</strong> persons arriving <strong>at</strong>ports in the province, particularly <strong>at</strong>Charleston.In the 241 years between the GeneralAssembly <strong>of</strong> 1712 and the GeneralAssembly <strong>of</strong> 1953 hundreds <strong>of</strong> pieces <strong>of</strong>health legisl<strong>at</strong>ions, most <strong>of</strong> them aimed<strong>at</strong> "<strong>The</strong> more effectual preventing" <strong>of</strong>one or another <strong>of</strong> a myriad <strong>of</strong> thre<strong>at</strong>sto the public health, were spread uponthe st<strong>at</strong>ute books <strong>of</strong> <strong>North</strong> <strong>Carolina</strong>during its progress from crown colonyto sovereign st<strong>at</strong>e.<strong>The</strong> early st<strong>at</strong>ute in the field <strong>of</strong>maritime quarantine regul<strong>at</strong>ion wasfollowed during the next century anda half by other st<strong>at</strong>utes on the samesubject, but the seed thus planted didnot quickly ripen into general recognition<strong>of</strong> governmental responsibilityfor public health. In terms <strong>of</strong> sheervolume and number, compar<strong>at</strong>ively few<strong>of</strong> our st<strong>at</strong>utes enacted prior to theCivil War had anything to do with
