selectmen <strong>of</strong> each member town shall include in the warrant for the next annual town meeting, ora special town meeting called for this and/or other purposes, an article which states the proposedamendment or the substance there<strong>of</strong>. Such amendment shall take effect upon its acceptance by all<strong>of</strong> the member towns, acceptance by each town to be by a majority vote at a town meeting asaforesaid.Finance Committee, Board <strong>of</strong> Selectmen and Ayer <strong>Shirley</strong> Regional School District Committeewere in favor <strong>of</strong> the article.Hand Vote: Moderator declared unanimous vote in favor; Motion passed.Article 12.Accept Lake View Drive as Public WayDavid Swain moved that the <strong>Town</strong> vote to accept as a public way a certain road shown as LakeView Drive on a subdivision plan entitled “Definitive Subdivision <strong>of</strong> Land in <strong>Shirley</strong>, Mass.,Prepared for J & A Realty Trust, Scale 1”=80’, dated January, 2000, revised July, 2000, DavidE. Ross Associates, Inc., Civil Engineers – Land Surveyors”, approved by the Planning Board, acopy <strong>of</strong> which is on file in the <strong>of</strong>fice <strong>of</strong> the <strong>Town</strong> Clerk; and authorize the <strong>Town</strong> to acquire, bygift, purchase, or eminent domain, for highway purposes, the fee and any lesser interests,including easements for drainage or otherwise, in, on, over, under, through, or appurtenant tosaid way. Seconded by Armand Deveau.Jonathan Greeno <strong>of</strong> the Planning Board advised that the Planning Board had voted favorably onthe article. They had also voted to withhold $33,000 in case any problems arose with trees andplantings since they were newly installed.Nancy Askin <strong>of</strong> the Conservation Commission advised that the Commission had beencommunicating with the Planning Board and agreed with their decision to withhold the extrafunds. The concern would be whether the new plantings would take hold since they were put into avoid erosion. The Commission was in favor <strong>of</strong> the article.Finance Committee and Board <strong>of</strong> Selectmen advised that they were in favor <strong>of</strong> the article.Hand Vote: Moderator declared unanimous vote in favor; Motion passed.Article 13.Transfer to the Stabilization Fund for FY2012David Swain moved that the <strong>Town</strong> vote to raise and appropriate the sum <strong>of</strong> $209,983.30 to theStabilization Fund. Seconded by Armand Deveau.Mr. Swain advised that the following funding sources were due to be received to fund the article:State reimbursement – MCI <strong>Shirley</strong>: $94,371.30(mitigation monies to be received as confirmed by the state)State reimbursement – FY2012 State Act: $80,238.00(supplemental non-reoccurring state aid)Additional new growth: $35,374.00.(as calculated by the Board <strong>of</strong> Assessors)Total: $209,983.3050
