APPENDIX A – ARTICLE 3Nashoba Valley Technical School DistrictChelmsford, Groton, Littleton, Westford, Pepperell, <strong>Shirley</strong>, <strong>Town</strong>send, Ayerfiscal year for which the apportionment is determined bears to the total pupil enrollment from allsuch towns in the district school on the same date, such town shall be deemed to have anenrollment <strong>of</strong> five pupils in the district schools. In computing the apportionment under thisparagraph the “persons” referred to in subsection IV (F) shall be excluded.Capital costs incurred on or subsequent to July 1, 2005 relating to the addition to the districtschool authorized by a vote <strong>of</strong> the Committee passed October 11, 2011 shall be apportionedamong such <strong>of</strong> the town <strong>of</strong> Ayer as shall accept this agreement on the basis <strong>of</strong> their respectivepupil enrollment in the district school. Such town’s share <strong>of</strong> such capital costs for each fiscalyear shall be determined by computing the ratio which its pupil enrollment in the district schoolon October 1 <strong>of</strong> the fiscal year next preceding the fiscal year for which the apportionment isdetermined bears to the total pupil enrollment from all such towns in the district school on thesame date, except that it there is an enrollment <strong>of</strong> less than five pupils from any such town in thedistrict school on such date, such town shall be deemed to have an enrollment <strong>of</strong> five pupils in thedistrict school. Notwithstanding the foregoing, in apportioning such capital costs for the fiscalyear beginning July 1, 2012, such capital costs shall be apportioned on the basis <strong>of</strong> estimatedpupil enrollments from each such town in the district school for such year, such estimate to bemade by the Committee. In computing the apportionment under this paragraph, the “persons”referred to in subsection IV (F) shall be excluded.Capital costs incurred on or subsequent to July 1, 2012 to which the preceding paragraph is notapplicable shall be apportioned among the member towns on the basis <strong>of</strong> their respective pupilenrollments in the district school. Each member town’s share <strong>of</strong> such capital costs for each fiscalyear shall be determined by computing the ratio which itspupil enrollment in the district school on October 1 <strong>of</strong> the fiscal year next preceding the fiscalyear for which the apportionment is determined bears to the total pupil enrollment from allmember towns in the district school on the same date, except that if there is an enrollment <strong>of</strong> lessthan five pupils from any member town in the district school on such date, such town shall bedeemed to have an enrollment <strong>of</strong> five pupils in the district school. Notwithstanding theforegoing, apportioning such capital costs for the fiscal year beginning July 1, 2012, the pupilenrollments, for such <strong>of</strong> the town <strong>of</strong> Ayer, as shall accept this agreement, used in making suchapportionment shall be the estimated pupil enrollments from each such town in the district schoolfor such year, such estimate to be made by the Committee. Notwithstanding the foregoing, in apportioning operating costs for the fiscal yearbeginning July 1, 2012 the pupil enrollments, for such <strong>of</strong> the town <strong>of</strong> Ayer as shall accept theagreement, used in making such apportionment shall be the estimated pupil enrollments fromsuch town in the district school for such year, such estimate to be made by the Committee. Incomputing the apportionment under this paragraph, the “persons” referred to in subsection IV (F)shall be excluded.E. Subsection IV(F) <strong>of</strong> the agreement is amended to read:(F) Special Operating CostsThe Committee shall determine the operating costs for each fiscal year <strong>of</strong> any evening tradeextension courses or any other types <strong>of</strong> courses which are <strong>of</strong>fered by the District to persons otherthan the pupils attending the regular day regional vocational school. Each member town’s share<strong>of</strong> such operating costs shall be determined by computing the ratio which that town’s enrollment<strong>of</strong> persons in such courses on November 30 <strong>of</strong> the fiscal year next preceding the fiscal year forwhich the apportionment is determined bears to the total enrollment <strong>of</strong> persons such courses fromall the member towns on the same date.
