<strong>Guam</strong> EPATitle V Federal Operating <strong>Permit</strong>Layon Municipal <strong>Solid</strong> <strong>Waste</strong> Landfill, Inarajan, <strong>Guam</strong><strong>Permit</strong> No. FO-OOSIII.D.S The permittee shall promptly report to USEPA Region 9 deviations from perniitor start-up, shut-down malfunction plan requirements, including those attributableto upset conditions as defined in this permit, the probable cause of suchdeviations, and any corrective actions or preventive measures taken. "Prompt" isdefined as follows: [40 CFR §7l.6 (a)(3)(iii)]a. Any definition of "prompt" or a specific timeframe for reportingdeviations provided in an underlying applicable requirement as identifiedin this pennit; orb. Where the underlying applicable requirement does not define prompt orprovide a timeframe for reporting deviations, reports of deviations will besubmitted based on the following schedule:(1) For emissions of a hazardous air pollutant or a toxic air pollutant(asidentified in the applicable regulation) that continue for more than anhour in excess of permit requirements, the report must be made within24 hours of the OCCUlTence.(2) For emissions of any regulated pollutant excluding a hazardous airpollutant or a toxic air pollutant that continue for more than two hoursin excess ofpermit requirements, the report must be made within 48hours.(3) For all other deviations from permit requirements, the report shall besubmitted with the semi-annual monitoring report required inparagraph III.C.l.a of this permit.III.D.6 If any of the section m.D.S reporting requirements are triggered, the source mustnotify USEPA Region 9 by telephone, facsimile, or electronic mail sent tor9.aeo@epa.gov, based on the timetable listed. A written notice, certifiedconsistent with paragraph TILD.7 of this permit section must be submitted within10 working days of the occurrence. All deviations reported under section III.Dmust also be identified in the 6-month report required under paragraph TILD.4.[40 CFR § 71.6 (a)(3)(iii)]III.D.7 Any application form, report, or compliance certification required to besubmitted by this permit shall be certified by a responsible official as to the truth,accuracy, and completeness of the submittal. All certifications shall state that,based on information and belief formed after reasonable inquiry, the statementsand information in the document are hue, accurate, and complete.
