GENERAL CONDITIONS OF THIS POLICYThe general conditions below apply to all sections of the policy. You must comply strictlywith these conditions. If you do not, the insurer may refuse to cover your claim and/orreclaim any benefit already paid to you and will be entitled to cancel your policy.1.Claims the insurer will not cover4.Time limit on claims and rejected claims2.The insurer will not cover you for any loss, damageor injury that you or any person acting on yourbehalf causes deliberately or that results from anyinvolvement in unlawful activities or for any claimwhich is in any respect fraudulent (dishonest). Youwill lose all benefits in respect of this policy.Procedure to follow when you make a claimIf you suffer any loss, damage or injury for which youwould like to claim, you must follow the procedurebelow:a.b.c.Notify the insurer of the potential claim as soonas you become aware of the event or loss.Provide details of any other insurance that mayalso cover the event or loss.Report any claim involving any of the followingto the police as soon as possible after the eventor loss5.No claim will be paid more than 24 months after anevent unless the insurer agrees to extend this period,or if the claim forms part of pending legal action or if theclaim is in respect of your legal liability to a third party.If the insurer rejects your claim, you have 90 days inwhich to submit a written objection or make furtherrequests to the insurer.If you do not act within the 90 days, you have afurther 180 days in which to institute legal actionagainst the insurer.The insurer will control all proceedingsThe insurer has sole discretion in deciding on how orwhether to proceed with the institution of defenceof any legal action for the recovery of your propertyor settlement of your claim and no action may betaken without the insurer’s prior consent in writing.3.d.e.f.g.h.i.• bodily injury, theft or any other criminal act• a motor accident• loss of property.Take all practical steps to identify and determinethe whereabouts of the guilty party and torecover the stolen or lost property.Submit the full details of your claim to the insurerin writing within a maximum of 30 days afterthe event or loss.Do not respond to any letter, claim or other legalprocess instituted against you in connectionwith any insured event. You must submit thesedocuments to the insurer as soon as you receivethem. Failure to do so will result in the insurerrejecting your claim.Give the insurer any proof, information andsworn declarations which they may require orwhich is necessary to assess your claim.Give the insurer proof of ownership and of thevalue of any item(s) for which you are claiming.Give the insurer proof that the driver of a vehiclewas in possession of a valid driver’s licence atthe time of the event. The form of proof mustcomply with provisions of the Road Traffic Actor any act that replaces it.Helping the insurer identify found or recoveredpropertyIf the insurer has settled your claim and yourproperty is later found or recovered, you must assistthe insurer to identify the property. The insurer willpay the reasonable costs that you may incur in orderto assist in identifying the property.6.7.8.9.Neither you nor your representative may admit toany blame or take liability or make any offer, promiseor payment in relation to any aspect of any eventwhich may result in a claim under this policy.Overlapping or duplicated coverIf an event occurs and there is overlapping orduplicated cover under different sections of yourpolicy for the same loss, damage or liability, youmust decide under which section you will submit theclaim. You may not submit separate claims underdifferent sections of the policy for the same event.Notify the insurer of other insuranceIf an event occurs for which you have any otherexisting insurance which provides cover for thesame loss, damage or legal liability, then, you mustgive the insurer full details of that other insurance atthe time of submission of your claim. The insurer willnot pay or contribute more than their proportion ofthe legal liability in respect of the claim.Conditions for meeting claims: terms met andstatements true and completeYour claim will only be paid if all information,statements and answers provided by you, includinginformation given in your proposal and claim formsare true and complete.Actions the insurer may takeIf an event occurs, the insurer or their appointedrepresentative may do the following withoutincurring any legal liability or in any way lessening orwaiving any of their rights:a.Take, enter or keep possession of any damageditem, its parts or accessories, and deal with these8 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


GENERAL EXCLUSIONS OF THIS POLICY9.10.d. damage to property arising from any use ofasbestos, ore. in any other way attributable to the harmfulnature of asbestosAny legal liability, loss, damage or destructionthat results directly or indirectly from any miningoperationAny loss or destruction of or damage to any property(including a computer) or any loss or expenseresulting or arising froma.b.any legal liability of any natureany consequential loss directly or indirectlycaused or contributed to by, or consisting ofor arising from the incapacity or failure of anycomputer, correctly or at all• to treat any date as the correct date or truecalendar date• to recognise, manipulate, interpret, process,store, receive or respond to any data orinformation correctly or appropriately• to carry out any command or instructionin regard to or in connection with any suchdate; or• to capture, save, retain or process anyinformation or code as a result of theoperation of any command which has beenprogrammed into any computer, and theincorrect functioning of that commandcauses the loss of data or failure to capture,save, retain or correctly process that data;or• to capture, save, retain or process anyinformation or code owing to• program errors• incorrect entry• the inadvertent cancellation orcorruption of data and/or programs; or• to capture, save, retain or process any dataas a result of the action of any computervirus, other corrupting, harmful or otherwiseunauthorised code or instruction or anyother destructive or disruptive code, mediaor program or interference.A computer includes• any computer, data processing equipment,microchip, integrated circuit or similar devicein computer or non-computer equipment,or• any computer software, tools, operatingsystem, or• any computer hardware or peripherals and• the information or data electronically orotherwise stored in or on any of the above,whether it is your property or not.12 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


RIOT AND STRIKE EXTENSION OF THIS POLICYThis extension excludes cover which may be provided by the South African SpecialRisks Insurance Association (SASRIA Limited) or the Namibian Special Risks InsuranceAssociation.This extension operates despite anything to the contrarycontained in the general exclusions.1.2.This policy is extended to cover loss of or damageto property or injury to your body directly caused byor as a result ofa.b.civil commotion, labour unrest, riot, strike orlockoutthe act of any lawful authority to control, prevent,suppress or in any other way deal with any eventlisted in 1.a. above.This extension does not cover loss of or damage toproperty or injury to your body thata.occurs either within the Republic of South Africaor Namibia, or beyond any national boundariesspecified in the policyb.c.d.results from you totally or partly stopping work,or slowing or ending any process or operationis caused by any lawful authority permanentlyor temporarily confiscating, commandeering orrequisitioning your propertyis related to or caused by any event referred toin General Exclusion 5.a., 5.b., 5.c., 5.d., 5.e. or5.f. or the act of any lawful authority to control,prevent, suppress or in any other way deal withany such event.If an event occurs and the insurer maintains that,according to subsection 2.a., 2.b., 2.c. and/or 2.d.,this extension does not cover loss of or damage toyour property or injury to your body, then you mustprove that it does.SASRIA COVERYou have automatic SASRIA cover for unrest, riot, strikeor public disorder in respect of those sections for whichit is available. SASRIA cover is provided according to theterms of the SASRIA coupon. You may request a copyof the SASRIA coupon. Section 1 : BuildingsSPECIFIC DEFINITIONS FOR THIS SECTION1. Buildings: Permanent structures that you primarilyuse for or associate with your domestic life whichyou either own or are legally liable for. Buildingsincludea. private dwellings, garages, guest cottages,domestic employees’ quarters, studios, stables,change rooms, garden sheds, greenhousesb. your or your tenants’ permanent fixtures, fittingsand improvementsc. fitted furniture, fitted appliances and climatecontrol systemsd. permanently installed swimming pools, hot tubs,spas, saunas, ornamental ponds and fountains,permanently installed garden watering systems,garden lights and lighting systemse. walls, retaining walls, fences, gates, driveways,footpaths, steps, terraces, patios, all-weathertennis courts and floodlightsf. underground service pipes, cables, sewers,drains, tanks, inspection hatches and covers,domestic boreholes, pumps, motors and fixedgeneratorsg. fixed radio and television antennae, satellitedishes, their fittings and masts,but specifically excludei. earthen walls, earthen and gravel driveways andearthen structuresii. dam wallsiii. piers, jetties, bridges and culverts.2. Fixed equipment: Fixed filters, pumps, motors forgates and doors, fire and burglar alarm systems,electric fence energisers, hoists, lifts, escalators,generators, air-conditioning plants.3. Pests: Rats, mice, wasps’ nests, hornets’ nests andbees and other animal infestations.4. Subsidence, landslip or ground heaveSubsidence is the downward movement of astructure when the soil on which it was built canno longer support it.Examples are underground mining (specificallyexcluded), clay shrinkage (especially due tothe action of tree roots) and erosion caused bywater passing underneath the upper layers ofsoil. The compaction of make-up ground or infillis not defined as subsidence.Landslip is the massive movement of the toplayer of soil down a slope.Ground heave is the upward movement orexpansion of the site caused by load beingremoved from it or by actions from inside thesite itself; but excludes• settlement, which is the movement of asite as a result of loading placed on it by abuilding. (Settlement is not covered in termsof subsidence cover.)5. Tenants’ improvements: These are improvements,alterations and decorations that you or a previousoccupier as the tenant has undertaken and for whichyou are legally responsible.6. Unoccupied: At the time of the loss of or damageto buildings, the home, although furnished, had notbeen lived in for more than 60 consecutive days,or, if not sufficiently furnished for normal livingpurposes, for more than 30 consecutive days.14 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


WHAT THE INSURER OFFERS1.Your cover3.Cover during building changesThe insurer will cover you against loss or damagefrom a cause other than those listed in the generalexclusions of the policy and the specific exclusionsof this section while you are at the insured address.The insurer may decide whether to replace, restore,repair or rebuild your building or to pay you out, orany combination of these up to the insured amountas stated in your schedule.Depending on the insured amount (and providedthat costs do not go beyond the amount as statedin your schedule), the insurer will also pay anyreasonable and necessary cost you incur followingthe loss or destruction of or damage to the dwellingin respect ofa. demolishing the building, removing rubble fromthe site and erecting the board fence requiredfor building operationsb. architects’, quantity surveyors’ and consultingengineers’ feesc. local authorities’ inspection fees.The insurer is not responsible for paying• costs or fees connected with any undamagedparts of the building• costs you may incur in meeting any conditionrequired by the government or local authorityof which they notified you before the damageoccurred.4.When you are renovating, adding or extending yourbuilding(s) and the insurer has agreed to cover youduring these changes, the insurer will not cover you ifthere is loss or accidental damage caused by storm,wind, water, hail or snow and this is aggravated bythese renovations, additions or extensions.Cover during property transferIf you have bought a new property and advised theinsurer about your purchase, and you have paid theinsurer the premium that is due, the insurer will coveryou according to the terms of Section 1: Buildings,during the time between your signing the Deed ofSale and the transfer of the property into your nameby the Deeds Office. The insurer will not pay foralternative accommodation or loss of rent.The insurer will, however, not cover your newproperty ifa. the seller or his agent has insured your newlybought propertyb. you or your broker has more specifically insuredthe property.Liability to the publicIf your building is covered by this section, the insurercovers you for personal legal liability under Section4: Personal Liability as far as it applies to your liabilityas the owner of the property.No excess payableYou will not pay• the basic excess stated in your schedule whereyou are over 55 years of age, or• any excess if your claim is more than R100 000.However, any voluntary excess that you chose willapply first to every claim.Priority of interested partiesIf you have borrowed money from any bank or otherfinancial institution to pay for your building and this isstated in your schedule, you agree that their interestwill rank above yours if you claim under this policy.The insurer will pay out or pay the bank or financialinstitution according to the amount that you owethem in respect of the property concerned at thetime any claim is settled, or the insured amount asstated in your schedule, whichever is the lower.If you do anything that may jeopardise this insuranceor make it invalid, the interest of the bank or financialinstitution will not be affected provided that thebank or financial institution5.6.2.Reinstatement coverThis cover is limited to the amount for which youare insured that is stated in your schedule and iscalculated according to the cost of replacing thelost or damaged building or part of it with a newbuilding of a similar type, but not superior to or moreextensive than the originally insured property.The building may be replaced on the same site orany other site as you may require provided that thisdoes not result in the insurer’s legal liaiblity beingincreased.The reinstatement work must start and be carriedout as soon as possible, as no payment will be madeif an additional amount becomes payable as a resultof unreasonable delay in starting or completing thebuilding works.The insurer will not be legally liable for payment ofany amount until you have incurred the expense inrepairing or replacing the building.You have 6 months from the date of the damageto notify the insurer of your intention to replace orreinstate the building.7.<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 15


WHAT THE INSURER OFFERSa. did not know that you behaved in a way thatmay have made this insurance invalidb. informs the insurer about your actions or failureto act as soon as they become aware of it.You must pay any additional instalment or paymentowed to the financial institution.8. Inflation protectionThe maximum amount for which you are insured willbe adjusted each month in line with the building costindex rate, as calculated and provided by the SouthAfrican Bureau of Economic Research, to cater forthe effect of inflation. You will not be charged anyadditional premium during the period of insurance,but your premium will be automatically recalculatedaccording to the adjusted maximum amount forwhich you are insured at the anniversary date ofyour policy.9. Subsidence, landslip or ground heave (if these areincluded in your schedule)The insurer will cover you, according to the maximumamount for which you are insured as stated in yourschedule, for any destruction or damage to yourbuildings caused by subsidence or ground heaveof the land supporting the buildings, or landslip, butexcludinga. destruction or damage to drains, water courses,boundary walls, garden walls, retaining walls,gate posts, fences, driveways, paving andswimming pool surroundings, tennis courts,patios and terracesb. damage which existed when the policy startedc. damage caused as a result of or made worseby faulty design, material or workmanship, orinadequate (poor/not enough) compacting offilling, normal settlement or construction, or theremoval or weakening of support to any buildingspecified in your scheduled. damage caused as a result of altering, adding toor repairing the insured iteme. damage caused as a result of excavations on orunder the land other than mining operations.If you are asked to do so, you must prove that theloss or damage you are claiming for was caused bysubsidence or landslip or ground heave.16 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


AUTOMATIC EXTENSIONS OF COVERThese extensions of cover are in addition to the cover detailed above. If you claim undermore than one extension, the combined total that the insurer will pay out will not exceed25% of the total amount for which you are insured. The excess that is stated in your scheduledoes not apply to claims under these extensions, but any voluntary excess that you chose willapply first to every claim.1.2.3.Alternative accommodation/rentIf you are not insured for this elsewhere in this policyor in another policy, the insurer will pay the necessaryand reasonable costs of other accommodation foryou and your pets if, as a direct result of damage forwhich you are insured,• people cannot live in the buildings or• a local or police authority will not allow you toenter your home as a direct result of damage toa neighbouring property.The insurer will also pay for the loss of actual rentthat you would have received provided that a validlease agreement is presented to the insurer.The following conditions apply to the above cover:• The maximum period for this cover to be inforce is 2 years or such time as is reasonablyneeded to replace, restore, repair or rebuild thebuildings.• The insurer will decide on the alternativeaccommodation by considering the rental thatit would be reasonable to charge for a buildingof the same or similar value and location as theaddress stated in your schedule.You will be paid the reasonable costs for temporaryaccommodation in a guesthouse or hotel for not morethan 14 nights while you organise your alternativeaccommodation.Changes to your home because of physical injuryThe insurer will pay the fair and reasonable costs,up to the amount stated in your schedule, towardsessential changes to your home that you needto make because of a permanent and identifiablephysical disability which• is caused directly by a sudden and unexpectedaccident• occurs during the period for which you areinsured• results in your having to rely on a wheelchair formoving around.Costs of preparing claimsThe insurer will pay you out for reasonable costs upto the amount as stated in your schedule that you4.5.6.7.8.incur in providing and obtaining proof of any detailsthat they may need in order to consider any claimsyou may submit.Cover after building changesThe insurer will pay for damage to or loss of capitaladditions or completed extensions to the buildingsprovided that you let the insurer know in writingwithin 60 days of the start of such additions oralterations, and that you pay any extra premium thatyou owe them.Electrical and mechanical breakdownThe insurer will cover you for the sudden andunexpected electrical or mechanical breakdown offixed equipment that you use solely for domesticpurposes at the address stated in your schedule.The insurer will pay you for the reasonable cost ofrepairing or replacing it, up to the amount stated inyour schedule.Fire extinguishing chargesThe insurer will cover you for the cost of extinguishinga fire if you have a fire in your building(s), or forpreventing imminent fire damage to the buildings,provided that these costs are reasonable.Hiring of security guards/watchmenThe insurer will cover you against the costs youreasonably incur for employing watchmen after youhave experienced a loss for which you are insuredprovided the loss gives rise to a valid claim.In an emergency, you may agree to a hiring fee upto the amount stated in your schedule, without firstobtaining permission from the insurer.Metered water leakageThe insurer will cover you for extra metered watercharges for which you are legally liable owing toleaks, breaks or bursts in your water mains system.You are covered up to the amount stated in yourschedule.a.If the quarterly reading of the water you use is50% or more above the average of the previousfour quarterly readings, the insurer will coveryou for the cost of the additional water used.The insurer will not be liable for more than2 separate incidents in a period of 12 months.b.<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 17


AUTOMATIC EXTENSIONS OF COVERc. If you discover a leak (either from physicalevidence or by receiving an abnormally highwater account), you must take immediate stepsto repair the affected pipe(s).d. This extension does not cover the cost of fixingthe problem, including repairs to the affectedpipe(s).9. New fixtures and fittingsThe insurer will pay up to the amount as stated inyour schedule for which the building is insured fordamage to new fixtures and fittings, fitted furnitureand fitted appliances that are installed at the addressstated in your scheduleprovided that• you let the insurer know in writing within 21 daysof these new fixtures or fittings being installed• you pay any additional premium you owe theinsurer.10. Pest contaminationThe insurer will pay the reasonable costs foremergency professional extermination (getting ridof) and control of pests, on condition that it is asudden and unexpected infestation of the buildingsthata. is a risk to your health, orb. can lead to the loss of or damage to the buildingsand any of your contents that are normally partof or kept in the buildings, orc. makes it impossible for you to live in thebuildings.The insurer will not pay for extermination in respectof buildings that have been unoccupied for morethan 60 consecutive days.11. Reinstatement of gardens after damage to homeIf your insured home is damaged by fire, lightning,explosion, theft, attempted theft, impact by vehiclesand aircraft, vandalism (deliberate destruction) ormalicious (intentional) acts, the insurer will pay thecost of relandscaping the garden up to the amountstated in your schedule for which the building isinsured.12.13.14.15.16.Removal of fallen treesThe insurer will pay the reasonable costs of removingfallen trees on the insured property. Where the fallentrees do not damage the insured building(s), yourcover will be limited to the amount stated in yourschedule for the removal of fallen trees.Reward for informationThe insurer has sole discretion in deciding to pay areward up to the amount stated in your schedule toany person or organisation (but excluding you orthe police) for information that helps them recoverthe item, and helps the police arrest and convict anyperson who committed a crime which resulted inloss or damage for which you are insured and canclaim.Temporary removal of fixturesIf you claim for damage to permanent fixtures thatare temporarily removed from the building to berepaired or restored, the insurer will pay up to theamount as stated in your schedule• for damage for which you are insured• that occurs while your insurance is in force.The permanent fixtures may not have been removedfor more than 60 consecutive days.Tracing of leaksThe insurer will pay the fair and reasonable costs, upto the amount stated in your schedule, towards thecost of tracing the source of escaping water, gas oroil from any fixed water or fixed heating appliance inyour insured home.The insurer will also pay for any resultant andnecessary remedial repairs to floors, walls andceilings, provided that the first sign of the leakoccurred only after the start of your policy.Underground services and servitudesThe insurer will pay the fair and reasonable cost ofrepairing or replacing underground service cables,pipes, sewers and drains for which you are legallyliable following accidental damage.18 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


SPECIFIC EXCLUSIONS FOR THIS SECTIONThe insurer will not cover the following:1.2.3.4.5.6.The excess as stated in your scheduleThe first R5 000 for any loss or damage that arisesfrom theft or attempted theft, malicious damage orthe escape or leaking of water when the building isunoccupiedLoss, damage or breakdown which is or would, inthe absence of this contract of insurance, have beeninsured by a guarantee, service contract, purchasecontract or other purchase agreementThe costs you incur for maintaining, decorating,extending, refurbishing or improving your buildingsor the costs of the tenants’ improvements to yourbuildingsLoss or damage that arises from or is aggravateddirectly or indirectly by changes to the structure ofthe building (including demolishing it) or any buildingworks including extending, altering, renovating,contstructing, cleaning, restoring or repairing thebuildings unless the insurer has agreed to cover youduring these changesDamage caused by or as a result ofa. inherent fault, faulty design, poor workmanship,use of faulty material, misuse of the building oryour deliberate actionsb. rot, rising damp, a rise in the water table, fungus,mould, damage caused by infestation, insects orvermin7.8.9.10.c.weeds or rootsd. chewing, scratching, tearing and fouling bydomestic petse. chipping, scratching, spoiling or discolouringf. settlement, shrinkage, warping, corrosion, wearand tear or other gradual processes includingrust, oxidation, smoke, smudge and anydeterioration of the buildingsg. subsidence, landslip or ground heave (unlessstated as included in your schedule)Loss or damage you incur by any tenant or subtenantof yours or by the family or servants of your tenantor subtenant stealing or misappropriating (takingdishonestly) your propertyItems that fail while still under their manufacturer’sguarantee and/or warranteeCosts you incur for removing any part of a tree(s)that is buried below ground and/or for restoring thesiteAny loss or damage you incur that arises directlyor indirectly from not complying with the NationalBuilding Regulations (or any statute that replacesit, or provincial or local legislation or regulation thatapplies to building standards or maintenance)<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 19


Section 2 : House ContentsSPECIFIC DEFINITIONS FOR THIS SECTION1. Business equipment: Any computers, laptops,software, printers, scanners, fax machines,photocopiers, typewriters, telecommunicationequipment and furniture that you own or for whichyou are legally liable, and which is kept at the insuredaddress stated in your schedule.2. Contents: The contents of the buildings at theinsured address stated in your schedule includinga. household goods and equipment, furnishings,business equipment, refrigerated, frozen andother food and drink, and domestic heating oilb. personal belongingsc. outdoor and garden itemsd. remote-controlled power-driven toys ande.modelsmoneyf. which you own or for which you are legallyliable,but excludingi. tenants’ improvements, fitted furniture, fittedappliances, fixtures and fittingsii. motor vehicles, motorcycles and watercraftexcept remote-controlled power-driven toysand modelsiii. aircraft including remote-controlled power-driven toy and model aircraftiv. caravans and trailersv. pets, bloodstock, livestock, insects.3. Forcible and violent entry: This describes a person’suse of force (which might be minimal) to enter yourproperty. It makes the person’s attempt to entermore obvious (e.g. broken window or door). If onetakes into account all the circumstances, the actioncan be considered as violent. Violence or threats ofviolence to persons to gain entry are regarded asforcible and violent entry.4. Jewellery and watches: This includes items whichpeople wear or use to decorate themselves or theirclothes. They are made of gold, silver, platinum orother precious metals and set with precious or semipreciousstones.5. Money: Your personal money including your cash,Kruger Rands, cheques, traveller’s cheques, postalorders, money orders, travel and other tickets, giftvouchers and current postage stamps.6. Pests: Rats, mice, wasps’ nests, hornets’ nests andbees and other animal infestation.8. Specified valuable items: Individual items, andcollections and sets which are valuable from an artisticand/or historical point of view, or are unique, rare,of good quality and in good condition (such as, butnot limited to, fine arts, antique furniture or jewellery,furs, collectable items and wine collections) whichbelong to you or for which you are liable. They havea value that cannot be insured at replacement cost,but the insurer will insure them at a value that youand the insurer agree to. In this policy, your specifiedvaluable items will each be listed under the Contentssection of the policy and insured for the value onwhich your and the insurer agree. You must inform the insurer in writing beforeyou place your contents in storage.b. The loss or damage must be caused directly byfire, explosion, smoke, storm, floodwater, theft,attempted theft, collision, impact, vandalism(deliberate destruction) or a malicious(intentional) action.c. AUTOMATIC EXTENSIONS OF COVERThese extensions of cover are in addition to your Contents cover. If you claim under morethan one extension, the total that the insurer will pay you out will not be more than 25% ofthe total amount for which you are insured for Contents. The excess that is stated in yourschedule does not apply to claims under these extensions, but any voluntary excess that youchose will apply first to every claim.1.up to the amount stated in your schedule, towardsessential changes to your home that you needto make because of a permanent and identifiablephysical disability whicha. is caused directly by a sudden and unexpectedaccidentb. occurs during the period for which you areinsuredc. results in your having to rely on a wheelchair tobe able to move around.Costs of preparing claimsThe insurer will pay you out for reasonable costs upto the amount stated in your schedule that you incurin providing and obtaining proof of any details thatthey may need in order to consider any claims youmay submit.Cover for contents while not at the address givenin your scheduleThe insurer will cover you against loss of or damageto your contents while they are temporarily removedfrom the address stated in your schedule andcontained in a building anywhere in the Republicof South Africa. This cover is limited to 10% of theamount for which you are insured in this section ofyour policy (Contents).The following conditions apply to this cover:a. You must take reasonable steps to protect yourcontents and ensure that every item is given thecare and protection that is in line with its value.b. Your contents are not insured anywhere else.You will be responsible for an additional excess ofR1 000 for every claim.Fatal injury and trauma counsellingThe insurer will pay you the following:a. R50 000 if you are fatally injured (i.e. you die)as a result of either a fire or an attack by violentintruders at the address stated in your scheduleb. R5 000 for the costs of trauma counsellingfollowing a fire or the actions of violent intrudersat the address stated in your schedule4.5.2.3.Alternative accommodation/rentIf you are not insured for this elsewhere in this policyor in another policy, the insurer will pay the necessaryand reasonable costs of other accommodation foryou and your pets if, as a direct result of damage forwhich you are insured,• people cannot live in the buildings, or• a local or police authority will not allow you toenter your home as a direct result of damage toa neighbouring property.The insurer will also pay for the loss of actual rentthat you would have received, provided that a validlease agreement is presented to the insurer.The following conditions apply to the above cover:• The maximum period for this cover to be inforce is 2 years or such time as is reasonablyneeded to replace, restore, repair or rebuild thebuildings.• The insurer will decide on the alternativeaccommodation by considering the rental thatit would be reasonable to charge for a buildingof the same or similar value and location as theaddress stated in your schedule.You will be paid the reasonable costs for temporaryaccommodation in a guesthouse or hotel for not morethan 14 nights while you organise your alternativeaccommodation.Business equipmentThe insurer will cover you for loss of or damage toyour business equipment that you keep at the insuredaddress stated in your schedule. The cover will belimited to the amount stated in your schedule.The following conditions apply to this cover:a. If you claim for loss or damage that arises fromtheft or attempted theft, there must be forcibleor violent entry into the buildings.b. Fire extinguishing chargesThe insurer will cover you for the cost of extinguishinga fire if you have a fire in your building(s), or forpreventing imminent fire damage to the buildings,provided that these costs are reasonable.8. Guests’ and domestic employees’ personalbelongingsThe insurer will cover you for the loss of or damageto the contents and personal belongings of guestsor domestic employees who live permanently at theaddress stated in your schedule. This cover will belimited to the amount stated in your schedule.The following conditions apply to this cover:a. The contents and personal belongings of theguests or domestic employees are not insuredin any other way.b. The loss of or damage to these contents andpersonal belongings occurs at the addressstated in your schedule.9. Hiring of security guards/watchmenThe insurer will cover you against the costs youreasonably incur for employing watchmen after youhave experienced a loss for which you are insuredand for which you can claim.In an emergency, you may agree to a hiring fee upto the amount stated in your schedule, without firstobtaining permission from the insurer.10. Hole-in-one and full-housea. The insurer will pay you R10 000 if you score ahole-in-one on any recognised golf course in theworld, during a game played according to theofficial rules of golf,b. The insurer will pay you R5 000 for your firstlawn bowls full-house in an official singlescompetition or league match,11.12.provided that the secretary of the golf or lawnbowls club has confirmed your achievement inwriting to the insurer.LaundryThe insurer will cover you up to the insured amountas stated in your schedule for the loss of or damageto your laundry on a washing line at the insuredaddress.Metered water leakageThe insurer will cover you for extra metered watercharges for which you are legally liable owing toleaks, breaks or bursts in the water mains system.This cover is in line with the amount stated in yourschedule.13.14.15.16.a.b.c.d.If the quarterly reading of the water you use is50% or more above the average of the previousfour quarterly readings, the insurer will coveryou for the cost of the additional water used.The insurer will not be responsible for more than2 separate incidents in a period of 12 months.If you discover a leak (either from physicalevidence or by receiving an abnormally highwater account), you must take immediate stepsto repair the affected pipe(s).This extension does not cover the cost of fixingthe problem, including repairs to the affectedpipe(s).MoneyThe insurer will cover you for loss of or damage tomoney kept at the insured address as stated in yourschedule. This cover is limitedto the insured amount stated in your schedule.Personal baggage insuranceThe insurer will cover your luggage from airport toairport throughout the world. AUTOMATIC EXTENSIONS OF COVERThe insurer will not pay for extermination in respectof buildings that have been unoccupied for morethan 60 consecutive days.17. Replacing locks and keysThe insurer will cover you for costs you mayreasonably and necessarily incur in replacing lostor damaged keys (including carkeys and remotecontrol devices) for your home, safe(s) or securityalarms.18. Restoring data on computersThe insurer will cover you against the loss of ordamage to data or records stored on your personalor business computer which is kept at the insuredaddress stated in your schedule. The cover will bethe reasonable and fair cost of restoring the lostdata onto the computer, and limited to the amountstated in your schedule.19. Restoring documentsThe insurer will cover you for the reasonableprofessional fees to replace lost or damaged legaland financial documents, provided that these arelost or damaged at the insured address stated inyour schedule or while in safekeeping with yourattorney or bank. The cover will be limited to theamount stated in your schedule.20. Reward for informationThe insurer has sole discretion in deciding to pay areward of up to the amount stated in your scheduleto any person or organisation (excluding you or thepolice) for information that helps them recover aninsured item, and helps the police arrest and convictany person who committed a crime which resultedin damage for which you are insured and can claim.21.Spoiling of food and drinkThe insurer will cover you for food and drink inrefrigerators and freezers at the address stated inyour schedule that spoils (goes rotten) providedthat this isa.b.c.caused by the refrigerator or freezer failing, orbeing damaged accidentally, orthe power supplied by the public authoritiesfailing accidentally or through scheduled powercuts.22. Swimming pool, borehole and other motors23.The insurer will cover you for loss of or damage upto the amount stated in your schedule to the motorsand machinery of saunas, spas, swimming pools,garage doors, security systems, electronic gatesand domestic boreholes which are installed at theinsured address as stated in your schedule.The loss or damage must result froma. accidental external causesb. electrical or mechanical breakdown.The insurer will not coveri. loss or damage caused by wear and tear, gradualdeterioration or rustii. loss or damage to automatic swimming poolcleaning equipment or windmillsiii. damage that is insured elsewhere in this oranother policy.Veterinary expensesThe insurer will cover you for the cost of using aveterinary surgeon (animal doctor) if your pet isinjured in a road accident. Section 4 : Personal LiabilitySPECIFIC DEFINITIONS FOR THIS SECTION1. It doesnot include any legal liability for loss or damage,including costs and expenses of legal processes, ifthese arise from the claimant instituting legal actionagainst you in a court outside of the Republic ofSouth Africa.2.AUTOMATIC EXTENSIONS OF COVER1.Tenants3.Liability to domestic employees2.If you become legally liable as the tenant and not asthe owner for damage to the building of a privateresidence and its domestic outbuildings (includingfixtures and fittings) occupied by you as the tenantor by members of your household, the insurerwill cover you up to the amount as stated in yourschedule for any one accident or series of accidentsarising out of one insured event.Wrongful arrestIf you become legally liable to pay for damagesresulting from the wrongful arrest or alleged wrongfularrest which arises out of your activities as a memberof a neighbourhood watch or a block watch groupor a similar voluntary non-profit organisation, theinsurer will cover you up to the amount as statedin your schedule for any one valid claim or seriesof valid claims arising out of one insured event,including legal costs and expenses.The insurer will cover you for legal liable up tothe amount as stated in your schedule where youbecome liable due to the death of or bodily injuryto your domestic employee which arises from andin the course of his/her service during the period ofinsurance. SPECIFIC EXCLUSIONS FOR THIS SECTIONThe insurer will not cover you for legal liabilities relatingto or arising from or in any way associated with1.2.3.4.5.6.7.8.9.loss of or damage to property belonging to you,family members permanently residing with you oryour domestic employees, or in your possession orunder your controlany family member permanently residing with you orfinancially dependent on you or any person actingin the course of his/her employment with you at thetime of the accidentyour directors, members, trustees or beneficiaries,or their family members permanently residing withthem if you are a company, close corporation ortrustany employment, trade, apprenticeship, business,professionthe use of or interference with support to land,buildings or any other propertyliability or claim that arises from any legal liabilityyou may have as the result of having entered acontract or agreement, unless such liability would inany event have ensued without entering into suchcontractwilful, dishonest, fraudulent, criminal or maliciousacts or damagedamages awarded against you in any judgment orcost and expenses of litigation recovered by anyclaimant who institutes action in a court outside ofthe Republic of South Africa, except a judgmentconfirmed or cost and expenses of litigationrecovered by any claimant in a court of the Republicof South Africacosts and expenses incurred after you or the claimanthas accepted an offer by the insurer to settle theclaim in full, or for a lesser amount than the insurerbelieves the claim can be settled for, or the maximumamount for which the insurer is legally liable10.11.12.13.14.15.16.17.18.any penalties or fines, or for any criminal offences orcriminal judgment against youthe ownership, possession, use or handling of anyfirearm including air gunsloss of or damage to or attributable to animals, otherthan domesticated animals, including horses, ownedby you or in your possession or controlany condition directly or indirectly caused by orassociated with Human Immune Virus (HIV) or anymutations, derivatives or variations thereof or inany way related to Acquired Immune DeficiencySyndrome (AIDS) or any syndrome or condition ofa similar kindpassing on an infectious or other diseasearising from seepage, pollution or contamination; thecost of removing, nullifying or cleaning up seeping,polluting or contaminating substances, unless theseepage, pollution or contamination is caused bya sudden, unintended and unexpected accidentaleventthe ownership, possession, use or handling of anymotor vehicle, caravan, trailer (other than unattachedtrailers), aircraft or watercraft (other than modelaircraft, surfboards or paddle skis) owned by orin the custody or control of you or your domesticstaffloss or damage covered by any other insurancepolicyloss or damage which forms the subject of anycompulsory statutory insurance.<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 33


Section 5 : Liability PlusChartis South Africa Limited (referred to in this sectionas ‘Chartis’) provides insurance for this section andundertakes to cover you for the events listed in thissection of your policy. <strong>MUA</strong> (representing Compass andcollectively referred to as ‘the insurer’) will act as thecontact point between policyholders and Chartis for thesubmission, settlement and negotiation of your claims orconfirmation of policy or claim information and in otherrelated matters.SPECIFIC DEFINITIONS FOR THIS SECTION1. Insured event: Death, injury, sickness or disease ordeath sustained by a person resulting from suchinjury, sickness or disease including mental injury,mental anguish and shock or physical damage to,loss of use or destruction of tangible propertyWHAT CHARTIS OFFERS1.Your covera.b.Chartis will cover you for any one event notexceeding the amount as stated in your schedule.This cover includes any costs and expensesthat you may incur with their written consentand any costs and expenses that any claimantmay recover from you after deduction of anypayments or awards made and due to be paidunder Section 4: Personal Liability or Section 10:Legal Liability to Third Parties of your policy.Chartis will cover you for more than the limitprovided under Section 4: Personal Liability andunder Section 10: Legal Liability to Third Partiesof your policy, but not for more than the amountas stated in your schedule that you are legallyliable to pay by law or that you undertook to payunder any contract in the event of death, bodilyinjury or property damage that is not covered bySection 4: Personal Liability or Section 10: LegalLiabilities to Third Parties, provided thati.ii.iii.no legal liability will be accepted by Chartisunless and until you have paid or been heldlegally liable to pay the full amount as statedin your schedule.under no circumstances will the combinedliability cover of Chartis and the insurerexceed the amount(s) as stated in yourschedule (for Liability Plus). The limit of legalliability under this section shall be reducedby any sum paid or payable by either Chartisor by the insurer under your policy.in the event of a claim that is likely to exceedthe amount as stated in your schedule,you may not incur any costs withoutChartis’s written consent. You must ensurethat Chartis be given the opportunity tocooperate in the settlement of claims in2.3.which Chartis is interested. Should the claimbecome adjustable before going into courtor judgment be entered for an amountof not more than the amount as stated inyour schedule, no costs shall be payable byChartis under this section.iv. if by reason of the payment of any claimor claims by the insurer during the periodof insurance and the cover provided bySection 4: Personal Liability or Section 10:Legal Liability to Third Parties is• partially reduced, then this cover willapply in excess of the reduced amount ofSection 4: Personal Liability and Section10: Legal Liability to Third Parties for theremainder of the period of insurance• totally exhausted, then this cover willstay in force as your liability cover untilexpiry of your policy.Territorial limitsa.b.In respect of Section 10: Legal Liability to ThirdParties, this section of the policy covers aninsured event happening in any sub-SaharanAfrican country.In respect of Section 4: Personal Liability, thissection of the policy covers an insured eventhappening anywhere in the world, but not inrespect of any judgement, award, payment orsettlement made within the United States ofAmerica or Canada (or any order made anywherein the world to enforce such judgement, award,payment or settlement, either in whole or in part).JurisdictionThis section is subject to the laws of the Republic ofSouth Africa.34 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


SPECIFIC CONDITIONS FOR THIS SECTION1.2.Reinstatement of cover after lossChartis will not reduce the amount insured if they paya claim, but they may charge an additional premiumfrom the time of the loss or damage or from the timeof the replacement of the lost or damaged propertyto the expiry date of the policy, based on the amountof the loss.Breach of conditionsThe conditions of this section apply individually toeach of the risks insured and not collectively to them,so that any breach makes the subsection null andvoid (invalid) only for the risk to which the breachapplies.SPECIFIC EXCLUSIONS FOR THIS SECTIONChartis will not cover you for legal liabilities relating tothe following:1.2.Any insured event arising out of the ownership,maintenance, operation, use, loading or unloading ofany watercraft of more than 8 metres in length orany aircraft owned by the you or rented to the youAny insured event resulting from the use of anyregistered motor vehicle owned by or in yourphysical legal control or in respect of which insuranceis required by virtue of any legislation relating tomotor vehiclesprovided thata. this exclusion shall not apply where cover isprovided under your policy relating to the useof motor vehicles.b. Chartis will not pay for so much of anycompensation or claim as falls within thescope of any compulsory motor vehicleinsurance enactment. This exception shall applynotwithstanding that no insurance under suchenactment is in force or has been effected.<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 35


Identity TheftSPECIFIC DEFINITIONS FOR THIS SECTION1. You and your: These words refer to you, the personnamed in your schedule, and your legal spouseor dependent children under the age of 21 whopermanently reside with you.2. ATM: Automatic teller machine3. Business: Your employment, trade, profession oroccupation4. Payment card: An ATM card, credit card, or debitcard issued by a registered financial institution orqualified retail shop5. Identity theft: The unauthorised and/or illegal useof your personal information such as your nameor identity number to obtain a loan or open creditaccounts6. Relative: Someone who is related to you, includingbut not limited to spouses, siblings, children andparents7. Suit: A civil proceeding seeking monetary damagesas a result of identity theft, or a criminal proceedingin which you are charged with illegal acts committedby any person other than you while they were usingyour identity8. Extended claim period: The 12-month periodfollowing the end of the period of insurance or suchother time that Chartis may agree to in writingWHAT CHARTIS OFFERSYour coverIn the event of identity theft which takes place anywherein the Republic of South Africa during the period ofinsurance and after 30 days has passed from the startdate of your policy, Chartis will cover you up to theamounts as stated in your schedule for1.2.reasonable legal expenses that you incur as a directresult of identity theft ina.b.c.defending any suit brought against you by acreditor or collection agency or someone actingon their behalfremoving any civil or criminal judgmentwrongfully entered against you andchallenging the accuracy or completeness ofany information in your consumer credit report,provided this information is inaccurate andfalsely provided to the credit agency or financialinstitution.income you lost solely because of the time takenfrom your profession to resolve any identity theftexcept if you are self-employed. This does notinclude compensation for whole or partial unpaidworkdays, nor vacation days or sick days providedthat these unpaid workdays are taken during theperiod of insurance or within 12 months of thispolicy’s expiration date.3.4.your actual loss owing to your legal obligation topay a creditor if, as part of your identity theft, anypayment cards, bank accounts, and other creditaccounts were opened in your name without yourauthorisation.miscellaneous expensesa. costs you incur for refiling applications forloans or other credit or debit accounts thatare rejected solely because the lender receivedincorrect informationb. costs for notarising documents related to youridentity theft, long-distance telephone calls, andcertified mail reasonably incurred as a resultof your efforts to report an identity theft or tocorrect your financial and credit records thathave been alteredc. costs you incur to contest (debate) the accuracyor completeness of any information contained inyour credit historyd. costs you incur for a maximum of 4 creditreports from an entity approved by Chartis. Thecredit reports will be requested during the policyperiod or the extended claim period. SPECIFIC CONDITIONS FOR THIS SECTION1.2.The account must have been opened in your namewithout your authorisation.You must notify your local law enforcement agenciesand file a police report within 24 hours of discoveringthe theft.6.7.You mustnotify your bank(s), payment card company(ies),financial institution(s) and other account holders ofthe identity theft within 24 hours of discovering theidentity theft.3.Any false charge or withdrawal must be verified byyour financial institution. Cover for false charges islimited to the amount for which you are held liableby the financial institution subject to the amountstated in your schedule.a.if you make a claim for lost wages, submitproof from your employer that you took unpaiddays off, and you must have this informationrecorded. You must also provide proof that itwas necessary to take time off work.4.5.Chartis will be allowed to inspect your books andfinancial records.You will cooperate with Chartis and help themto enforce any legal rights you or they may havein relation to your identity theft including yourattendance at depositions, hearings and trials,and giving evidence as necessary to resolve youridentity theft.b.c.send the insurer copies of any demands, notices,summonses, complaints, or legal papers receivedin connection with a covered loss.take all reasonable and prudent action to preventfurther damage to your identity.SPECIFIC EXCLUSIONS FOR THIS SECTIONChartis will not cover the following:1.2.any claim under R250any expenses or loss as a result ofa.b.c.d.any dishonest, criminal, malicious or fraudulentacts committed by you or a relative, or that youor a relative had knowledge of or planned, or ifyou withhold information or conceal materialfacts related to this policy or to your identitytheftlosses that result from business pursuitsfraudulent payment card charges and banktransfer charges if they are not related to youridentity theftany physical injury, sickness, disease, disability,e.f.g.shock, mental anguish and mental injury includingrequired care, loss of services or deathidentity theft that occurred or commencedbefore the start of your policy periodthe reimbursement of fees for stolen paymentcards if you have not complied with all terms andconditions under which the cards were issuedmonetary losses other than the out-of-pocketexpenses related to resolving the identity theft ascontemplated by this policy including fraudulentpayment card charges.<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 37


Section 6 : MotorSPECIFIC DEFINITIONS FOR THIS SECTIONThe specific definitions below also apply to Section 7: Motorcycles, Section 8: Caravans andTrailers and Section 9: Classic Motors, where relevant and applicable.1.2.Agreed valueThe value for which the insurer agrees to insure yourvehicle and which is stated in your schedule. Theoption of agreed value applies only to classic cars.Comprehensive motorIf your vehicle is insured under this type of cover, theinsurer will pay you out for3.a.b.any loss of or damage caused by you or thedriver of the insured vehicle as a result of aninsured event, including the amounts for whichyou are legally liable to any third party if thelegal liability is related to the insured vehicleloss of or damage to any vehicle (and itspermanently fitted accessories and spare parts)that you hire, lease or temporarily use in place ofyour vehicle which is out of use for an overhaulor for upkeep and/or repair by a business in themotor trade. The amount the insurer will payis the reasonable retail value of your insuredvehicle.Comprehensive motor, excluding theft and hijackingIf your vehicle is insured under this type of cover,the insurer will cover you for any loss of or damageto the vehicle caused by an insured event, but notoccurring as a result of theft or hijacking or anyattempt at theft or hijacking of the insured vehicleor any part of it.The insurer will also pay the amounts for which youare legally liable to a third party if the legal liability isrelated to the insured vehicle, but does not arise as aresult of theft or hijacking or any attempt at theft orhijacking of the insured vehicle or any part of it.The insurer will pay for loss of or damage tothe insured vehicle (and its permanently fittedaccessories and spare parts) that you hire, lease ortemporarily use in place of your vehicle which is outof use for an overhaul or for upkeep and/or repair bya business in the motor trade, caused by an insuredevent, but not as a result of theft or hijacking or anyattempt at theft or hijacking of the insured vehicleor any part of it.The insurer will cover you up to the reasonableretail value of your insured vehicle as stated in yourschedule.Laid-up coverIf your vehicle is insured under this type of cover,the insurer will cover you only for the loss of ordamage to the vehicle which results from fire,lightning, explosion or from self-ignition, or by theftor attempted theft when you or anyone permittedto drive the insured vehicle is not using it and it is ina secure place.If your vehicle will be out of use for a continuousperiod of 60 days and more, and this is not as aresult of any loss or damage covered by this policy,the insurer may suspend the cover and refund youpart of the premium for the laid-up period.The insurer will pay this refund when you ask for thecover to start again.If you want the insurer to suspend cover, you mustrequest them to do so in writing.During the period when cover is suspended, theinsurer will continue to provide cover for loss ordamage caused by fire or theft while the vehicle is ina locked private garage.The cover is not available if your vehicle is a caravanor mobile home.The insurer will not pay fora. loss of use, reduced value, wear and tear, ormechanical, electrical or computer breakdowns,failures or breakagesb. loss of value following repairc. loss or damage arising from theft while theignition keys of your vehicle have been left in oron the vehicled. damage by pests.Territorial limitsThe insurer will cover you in the Republic of SouthAfrica, Namibia, Mozambique, Lesotho, Botswana,Swaziland, Zimbabwe, Malawi, Tanzania, Zambia,Kenya, Angola and Uganda.Third party, fire and theft onlyIf your vehicle is insured under this type of cover,the insurer will pay only for the loss or damage forwhich you are legally liable to a third party if thelegal liability arises from an insured event involvingthe insured vehicle, or for loss of or damage to theinsured vehicle which results from fire, lightning,explosion or self-ignition, or from theft or attemptedtheft.Third party onlyIf your vehicle is insured under this type of cover,the insurer will pay only for the loss or damage forwhich you are legally liable to a third party if thelegal liability arises from an insured event involvingthe insured vehicle.4.5.6.7.38 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


SPECIFIC CONDITIONS FOR THIS SECTIONThe specific conditions below also apply to Section 7: Motorcycles, Section 8: Caravans andTrailers, Section 9: Classic Motors and Section 10: Legal Liability to Third Parties, whererelevant and applicable.1.2.3.You must take all reasonable steps to protect theinsured vehicle from loss or damage.You must keep the insured vehicle in good runningorder and a roadworthy condition.If the insured vehicle or any part of it does notcomply with or in any way meet any of the requiredconditions for roadworthiness as set out in theRoad Traffic Act (or any law that replaces it, or anyprovincial or local laws which apply to your motorvehicle), then all benefits (payouts) from any claimyou may make under this policy will fall away andthe insurer will have no legal liability to you or anyother party in respect of any claim under the Motorsection of this policy.The insurer must be able to examine your insuredvehicle at any time.If, while your vehicle is insured under this policy,your driver’s licence or that of any person whodrives your insured vehicle is endorsed, suspendedor cancelled, or if you or any person who drivesyour insured vehicle is charged with or convictedof negligent, reckless or improper driving, you mustnotify the insurer in writing immediately. In thesecircumstances the insurer may choose to eitherendorse or cancel the policy.6.4.5.7.If, after an insured loss or damage has occurred,a. a part, accessory or fitment needed to repairyour vehicle is not availableb. the repairers have made every reasonableattempt to obtain the necessary part for at least60 days from the date you made the claimthe insurer will pay you an amount equal to the valueof the part at the time of loss or damage.The insurer will pay for the part at the price stated inthe most recent price list that applies to your vehicle,plus any increase in the price due to inflation fromthe date of the price list to the date of settlement ofyour claim.If your schedule states that your vehicle has atracking device or other security device, then theinsurer will not cover you for any claim relatingto theft or hijacking of your insured vehicle if thedevice is not in full working order at the time thatthe loss occurs, unless you can prove that the devicehas been adequately maintained and tested by thesecurity company that installed it.<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 39


WHAT THE INSURER OFFERS1.Your cover2.If your vehicle or any part of it is lost or damaged,the insurer may decide either to pay to repair orreplace it, or pay you an amount equal to the lossor damage. If you bought your vehicle on a hirepurchase or similar agreement, then the insurerwill pay the owner of the vehicle in terms of theagreement, and once the owner has been paid, youhave no further claims against the insurer.The maximum amount that the insurer will pay forloss of or damage to your insured vehicle will be thelowest of the amounts• stated in your schedule, or• the listed retail value, or• the agreed value (whichever one applies) of thevehicle.The insurer will pay the lowest of these amountsand this will depend on the type of cover you havechosen as stated in your schedule.The following cover types are available under thissection and are defined under Section 6: Motor,Specific definitions:• Comprehensive3.• Comprehensive, excluding theft and hijack• Third party, fire and theft only• Third party only• Laid-up, fire and theft only.The insurer will cover you only if the insured eventoccurs in any of the countries listed under Section 6:Motor, Specific definitions, Territorial limits.The insurer will not cover you where the insuredevent that gives rise to a claim occurs outside theRepublic of South Africa, if your vehicle has beenoutside the Republic of South Africa for longer thana continuous period of 30 days.The insurer will not cover you for loss or damagewhich occurs outside of the Republic of South Africa,if you have used the insured vehicle outside of SouthAfrica for more than a total of 90 days during anyperiod of insurance.The insurer will cover you against loss of or damageto the vehicle while it is being transported by sea orair, between ports or places in the countries in whichthe cover under this policy is valid, including duringloading and unloading.New vehiclesIf within one year of your insured vehicle first beingregistered as a new vehicle or of it first being used,it isa. stolen or hijacked and not recovered andreturned to you within a reasonable period, orb. damaged and the cost of the repairs is more than70% of the reasonable retail value, including taxat the date of the damage occurring,then the insurer will eithera. replace your vehicle with a new one, orb. pay the cost of purchasing a new vehicle of thesame or similar make and model, up to the lesserof the reasonable retail value of the insuredvehicle at the date of loss or the amount statedin your schedule.If your vehicle is lost or damaged more than oneyear of your insured vehicle first being registered asa new vehicle or of it first being used, the maximumamount the insurer will pay you will be the retailvalue of the insured vehicle at the time of loss ordamage.No excess payablea. You will not pay the basic excess stated in yourschedule for any claim wherei. you, your spouse or life partner, or any drivernamed in your policy is driving the vehicle orit is in your/their care and controlii. as long as the driver is 55 years of age orolderiii. has been a licensed driver for 5 or moreyears.b. You will not pay a basic excess, except if youhave chosen to pay a voluntary excess, for anyclaim wherei. the vehicle is less than 12 months old fromthe date it was first registered, andii. you, your spouse or life partner or maindriver (stated in your schedule) is the driverand it is in your or his/her control,provided that there is no endorsement (a noteindicating a change) in your policy schedulewhich overrides (takes the place of) thisbenefit.c. You will not pay a basic excess if you havehad an approved tracking system installed inyour insured vehicle and it is stolen or hijacked,provided that the tracking system has beenadequately maintained and regularly tested.40 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


AUTOMATIC EXTENSIONS OF COVERThese extensions of cover are automatically part of the comprehensive motor cover optionand the comprehensive motor cover option excluding theft and hijacking.1.Authorising emergency repairsprovided that2.3.4.If your claim is valid under this section, the insurer willcover you for emergency repairs up to the amountstated in your schedule to enable you to continueyour journey.You may give permission for these repairs to be donewithout first obtaining permission from the insurer,provided that you send a full, itemised invoice to theinsurer.Changes to your vehicle because of physical injuryThe insurer will pay the fair and reasonable costs,up to the amount stated in your schedule for theinsured vehicle, towards essential changes you needto make to the insured vehicle as a result of yourpermanent and identifiable physical disability which• is caused by a sudden and unexpected accident• occurs during the period for which you areinsured• results in your having to rely on a wheelchair formobility when you are out of a vehicle.Child seatIf you have a child seat fitted in your insured vehicleand your insured vehicle is involved in an accident oris damaged by fire or theft/hijacking, and the childseat is either lost or damaged, the insurer will paythe amount as stated in your schedule or replace thecar seat.Delivery after repairsThe insurer will cover you for the reasonable costs ofhaving your insured vehicle delivered to your insuredaddress as stated in your schedule once the repairsagreed to have been completed.Difference in excess for a hired vehicleIf your vehicle is the subject of a valid claim whichis pending under this policy and you have rented asubstitute vehicle while your insured vehicle is beingrepaired or replaced, and the rented vehicle is stolenor damaged while you are using it, the insurer willcover you for the difference in excess, if the excessfor the hired vehicle is higher than the excess payablein respect of your insured vehicle under this section.This cover will apply only if you have taken up theinsurance offered by the car hire company that theinsurer appoints and is subject to the amount asstated in your schedule.Fire extinguishing chargesThe insurer will pay the reasonable costs ofextinguishing or fighting a fire,7.a. the costs are not more than the amount asstated in your scheduleb. you are legally liable for these costsc. the insured vehicle was on fire or was in imminentdanger of being damaged by fire.Four x FourThe extensions listed below apply only to 4x4,2x4 (with differential lock) or all-terrain vehicles(other than motorcycles or quad bikes) which arestated in your schedule and which are insured forcomprehensive motor cover. If the insured vehicleis outside the Republic of South Africa, cover isrestricted to damage to this insured vehicle only.Return of vehicle to South Africaa. If your claim is valid under this section, theinsurer will cover you for emergency repairsup to the amount as stated in your schedule toenable you to continue your journey. You maygive permission for these repairs to be donewithout first obtaining permission from theinsurer, provided that you send a full, itemisedinvoice to the insurer.b. If is it uneconomical to repair the insured vehicleand you do not return it to the Republic ofSouth Africa, you will have to prove in a manneracceptable to the insurer that it is not economicalto repair the insured vehicle before the insurerwill accept your claim.The insurer will calculate the value of thewreckage at 20% of the amount for which thevehicle is insured as stated in your schedule.The insurer will first subtract this amount fromany benefit that is due to you under the policyand the reduced amount will be paid to you. Youwill have no further claim against the insurer.It is important to note that the insurer does notcover your legal liability to third parties outsidethe Republic of South Africa under this section.5.6.Winching equipmentThe insurer will cover you for damage to the vehicledue to the sudden and unexpected mechanical orelectrical breakdown, failure or breakage of thewinching equipment up to the amount as stated inyour schedule.This cover excludes breakdown and failure orbreakage in the following circumstances:a.Where it is linked to faulty design, faulty partsor faulty repair, or to operating the winching<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 41

AUTOMATIC EXTENSIONS OF COVER14.Replacing your vehicleThe insurer will replace your insured vehicle witha vehicle of the same or a similar make and modellimited to the amount as stated in your schedule,under the following conditions:a.You have a valid claim under this policy.b. The insurer has decided it is not economical torepair your vehicle.c. Your vehicle has been stolen and has not beenrecovered within a reasonable period.d. The same or similar vehicle is available on thelocal vehicle market.If you wish the insurer to pay you out instead ofreplacing your insured vehicle, the insurer maydecide to do so, but their payment to you will not bemore than the cost of the replacement vehicle thatthey have sourced.15. Reward for informationThe insurer has sole discretion in deciding to pay areward of up to the amount as stated in your scheduleto any person or organisation (but excluding youor the police) for information that helps the policearrest and convict any person who committed acrime which resulted in loss or damage for whichyou are insured and can claim.16. Transport coverThe insurer will cover you against loss of or damageto the vehicle while it is being transported by sea orair, between ports or places in the countries in whichthe cover under this policy is valid, including duringloading and unloading.17. Tracking deviceIf you have a tracking system in good working orderin your vehicle and the vehicle is damaged andcannot be repaired or stolen and not recovered, theinsurer will pay you for the actual cost of an approvedvehicle tracking company installing a tracking systemin your replacement vehicle, provided that• the cost of the tracking device includinginstallation is not more than the amount asstated in your schedule• the insurer gives their permission for theinstallation.18. Tow-in costs and vehicle protectionIf you have a valid claim for your vehicle under thispolicy, the insurer will pay the reasonable costs torecover and safeguard your vehicle and move it tothe closest repairer.19.Vehicle transfer cover (for any vehicle you buy)The insurer will cover the loss of or damage to avehicle you have purchased for the first 72 hoursafter you have taken possession of the vehicle,provided that the following conditions exist:a.b.c.d.e.You purchase the vehicle from a registeredmotor dealer.The seller has no insurance that covers thevehicle.You have at least one vehicle insured forcomprehensive cover under this policy.You must add the new vehicle to your existingcomprehensive cover policy before the insurerwill accept the claim.The cover will be limited to loss or damagecaused while the vehicle is in the care of or beingused by you, your spouse or any other insureddrivers as stated in your schedule.If you claim and the insurer decides that it isuneconomical to repair your vehicle, the paymentthe insurer will make to you will not be more thanthe lowest of• the reasonable retail value of the vehicle youbought• the amount for which you insured the vehicle asstated in your schedule• the cost of replacing the vehicle with one of thesame or similar make and model.Cover is limited to the lower of R750 000 or thehighest insured value of the existing insured vehicle.20. Window glassThe cover for damage to or loss of any permanentwindow glass fitted to an insured vehicle is limitedto the amount stated in your schedule unless thereis simultaneous loss or damage to other parts of theinsured vehicle resulting from the same cause.If the glass is repaired and not replaced, then you willnot have to pay the basic excess.Your claim-free group is not affected by a claim forwindow glass only.21. OPTIONAL EXTENSIONS OF COVERThese extensions are optional and will be stated in your schedule if you chose to includethem. An additional premium will apply to these extensions.1.Cover for credit shortfallThe insurer will pay the difference between the valueof the insured vehicle as stated in your scheduleand the outstanding amount you owe in terms ofthe credit agreement or finance contract that youentered into, up to a maximum of 10% of the amountfor which your vehicle is insured.The insurer will pay this difference only if you havea valid claim and• they consider the vehicle to be beyond economicrepair after loss or damage, or• the vehicle is stolen and not recovered within areasonable period.The credit agreement that you entered into mustbe a valid credit agreement in terms of the NationalCredit Act (Act No. 34 of 2005).The insurer will pay any amount still outstanding onyour credit agreement, lessc.d.The insurer will supply the hired car to you for aperiod no longer than the number of days statedin your policy schedule. The hire period will endas soon as any of the following takes place:• The date on which the vehicle is repaired, ifthe insurer has authorised its repairs• The date on which the insurer settles yourclaim• The date on which the insurer replaces thevehicleThe car hire option includes• a vehicle of your choice as stated in yourschedule from the various options theinsurer has available• unlimited kilometres• car accident damage cover• car theft covera.b.c.any instalments in arrears (earlier instalmentsthat you did not pay) or rentals, including theinterest you must pay on the arrearsall refunds of your premium due to you for thecancellation of any insurance cover relating tothe vehiclethe increased instalments or rentals that youwould have had to pay to ensure that there wasno capital value due at the end of the financeperiod. These are worked out to the month inwhich the insurer settles the claim.This applies if the credit agreement provided foryou to pay lower instalments at the beginning of thecredit/loan period and higher instalments later on. Inthis case, the insurer will not cover you for the balancethat you owe. They will cover you only for what youstill would have owed if you had arranged to payback the loan in equal instalments over the periodof the loan. The insurer is not legally responsible forany remaining amount that is recorded in the financeagreement.e.• airport surcharge• tourism levy• free delivery or collection for up to 25kilometres from the nearest car hire companywith which the insurer has a contract• any two named drivers.The insurer will not pay for the following:i. OPTIONAL EXTENSIONS OF COVER3.f.g.h.i.j.k.You must have a valid credit card issued in yourname with which to pay the car hire companyfor the above fees and excess.You must determine all costs for which you willbe legally liable before you take delivery of thehired car.You will be supplied with a hired car only in theRepublic of South Africa.If you need a hired car in Namibia, Lesotho,Botswana, Swaziland, Zimbabwe, Malawior Mozambique, you may hire a car from arecognised car hire company in those countries.You must pay for the hire yourself and send theinsurer a copy of the invoice. The insurer willpay you upon receipt of your invoice for thereasonable car hire costs incurred daily, up to theamount for which they would have been legallyresponsible per day had you hired a vehicle inSouth Africa.Where you hire a vehicle abroad, the insurer willnot be legally liable for paying for the loss of ordamage to the hired car and you must ensurethat you take up the rental company’s insurancecover.The insurer will not be legally liable for car hireexpenses that you incur where there is loss orbreakage of or damage to• the window glass arising from an accidentthat does not cause other damage to theinsured vehicle as stated in your schedule• radios, tape decks, compact discs, MP3Players, DVD players and other audio oraudiovisual equipment by theft or attemptedtheft or malicious (intentional) damage• keys or remote-control devices• child seats.Increased limit for window glassThe insurer will increase the limit of any claim forreplacing window glass to the amount that is statedin your policy schedule under this extension.<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 45

SPECIFIC EXCLUSIONS FOR THIS SECTION11.12.An insured event that gives rise to a claim and whichhappens outside the Republic of South Africa, if yourvehicle has been outside the Republic of South Africafor longer than a continuous period of 30 days.Loss or damage which occurs outside the Republicof South Africa, if you have used the insured vehicleoutside of the Republic of South Africa for morethan a total of 90 days during any 12-month periodof insurance.LEGAL LIABILITY TO THIRD PARTIESThe cover provided under Section 10: Legal Liabilityto Third Parties affected by an insured event appliesto Section 6: Motor<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 47


Section 7 : MotorcyclesWHAT THE INSURER OFFERS1.Your cover2.If your vehicle or any part of it is lost or damaged,the insurer may decide either to pay to repair orreplace it, or pay you an amount equal to the lossor damage. If you bought your vehicle on a hirepurchase or similar agreement, then the insurerwill pay the owner of the vehicle in terms of theagreement, and once the owner has been paid, youhave no further claims against the insurer.The maximum amount that the insurer will pay forloss of or damage to your insured vehicle will be thelowest of the amounts• stated in your schedule, or• the listed retail value, or• the agreed value (whichever one applies) of thevehicle.The insurer will pay the lowest of these amountsand this will depend on the type of cover you havechosen as stated in your schedule.The following cover types are available under thissection and are defined under Section 6: Motor,Specific definitions:• Comprehensive3.• Comprehensive, excluding theft and hijack• Third party, fire and theft only• Third party onlyThe insurer will cover you only if the insured eventoccurs in any of the countries listed under Section 6:Motor, Specific definitions, Territorial limits.The insurer will not cover you where the insuredevent that gives rise to a claim occurs outside theRepublic of South Africa, if your vehicle has beenoutside the Republic of South Africa for longer thana continuous period of 30 days.The insurer will not cover you for loss or damagewhich occurs outside of the Republic of South Africa,if you have used the insured vehicle outside of SouthAfrica for more than a total of 90 days during anyperiod of insurance.The insurer will cover you against loss of or damageto the vehicle while it is being transported by sea orair, between ports or places in the countries in whichthe cover under this policy is valid, including duringloading and unloading.c.New vehiclesIf within one year of your insured vehicle first beingregistered as a new vehicle or of it first being used,it isa. stolen or hijacked and not recovered andreturned to you within a reasonable period, orb. damaged and the cost of the repairs is more than70% of the reasonable retail value, including taxat the date of the damage occurring,then the insurer will eithera. replace your vehicle with a new one, orb. pay the cost of purhacing a new vehicle of thesame or similar make and model, up to the lesserof the reasonable retail value of the insuredvehicle at the date of loss or the amount statedin your schedule.If your vehicle is lost or damaged more than oneyear of your insured vehicle first being registered asa new vehicle or of it first being used, the maximumamount the insurer will pay you will be the retailvalue of the insured vehicle at the time of loss ordamage.No excess payablea. You will not pay the basic excess stated in yourschedule for any claim whereii. you, your spouse or life partner, or any drivernamed in your policy is driving the vehicle orit is in your/their care and controliii. as long as the driver is 55 years of age orolderiv. has been a licensed driver for 5 or moreyears.b. Section 8 : Caravans and TrailersWHAT THE INSURER OFFERS1.Your coverIf your vehicle or any part of it is lost or damaged,the insurer may decide either to pay to repair orreplace it, or pay you an amount equal to the lossor damage. If you bought your vehicle on a hirepurchase or similar agreement, then the insurerwill pay the owner of the vehicle in terms of theagreement, and once the owner has been paid, youhave no further claims against the insurer.The maximum amount that the insurer will pay forloss of or damage to your insured vehicle will be thelowest of the amounts• stated in your schedule, or• the listed retail value, or• the agreed value (whichever one applies) of thevehicle.The insurer will pay the lowest of these amounts andthis will depend on the type of cover you chose asstated in your schedule.The following cover types are available under thissection and are defined under Section 6: Motor,Specific definitions:• Comprehensive• Third party, fire and theft onlyThe insurer will cover you only if the insured eventoccurs in any of the countries listed under Section 6:Motor, Specific definitions, Territorial limits.The insurer will not cover you where the insuredevent that gives rise to a claim occurs outside theRepublic of South Africa, if your vehicle has beenoutside the Republic of South Africa for longer thana continuous period of 30 days.The insurer will not cover you for loss or damagewhich occurs outside the Republic of South Africa, ifyou have used the insured vehicle outside of SouthAfrica for more than a total of 90 days during anyperiod of insurance.The insurer will cover you against loss of or damageto the vehicle while it is being transported by sea orair, between ports or places in the countries in whichthe cover under this policy is valid, including duringloading and unloading.AUTOMATIC EXTENSIONS OF COVERThese extensions of cover are automatically part of the comprehensive motor cover option.1.2.Authorising emergency repairsIf your claim is valid under this section, the insurer willcover you for emergency repairs up to the amountas stated in your schedule to enable you to continueyour journey.You may give permission for these repairs to be donewithout first obtaining permission from the insurer,provided that you send a full, itemised invoice to theinsurer.Delivery after repairsThe insurer will cover you for the reasonable costsof having your insured vehicle delivered to yourinsured address as stated in the schedule once therepairs agreed to have been completed.Locks and keysThe insurer will cover you for the cost of replacinglocks and keys, including cardkeys and remotecontrols, and, if necessary, the reprogramming of4.any coded security system of your vehicle up to theamount as stated in your schedule as a result ofa.b.c.damage to locksthe theft or disappearance of keys or remotecontrolsthe reasonable belief that an unauthorisedperson may have a duplicate key, cardkey orremote control.The excess stated in your schedule for locks andkeys will apply.Your claim-free group is not affected by a claim forlocks and keys.Reward for informationThe insurer has sole discretion in deciding to pay areward of up to the amount as stated in your scheduleto any person or organisation (but excluding youor the police) for information that helps the police3.52 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


AUTOMATIC EXTENSIONS OF COVER5.arrest and convict any person who committed acrime which resulted in loss or damage for whichyou are insured and can claim.Tow-in costs and vehicle protectionIf you have a valid claim for your vehicle under thispolicy, the insurer will pay the reasonable costs torecover and safeguard your vehicle and move it tothe closest repairer.6.Wreckage removal costsThe insurer will pay the reasonable costs andexpenses to clean up and remove the debris orwreckage resulting from an accident which results ina valid claim under this policy.OPTIONAL EXTENSIONS OF COVERThese extensions are optional and will be stated in your schedule if you chose to includethem. An additional premium will apply to these extensions.1.Cover for credit shortfallThe insurer will pay the difference between the valueof the insured vehicle as stated in your scheduleand the outstanding amount you owe in terms ofthe credit agreement or finance contract that youentered into, up to a maximum of 10% of the amountfor which your vehicle is insured.The insurer will pay this difference only if you havea valid claim and• they consider the vehicle to be beyond economicrepair after loss or damage, or• the vehicle is stolen and not recovered within areasonable period.The credit agreement that you entered into mustbe a valid credit agreement in terms of the NationalCredit Act (Act No. 34 of 2005).The insurer will pay any amount still outstanding onyour credit agreement, lessEXCLUSIONS FOR THIS SECTIONa.b.c.any instalments in arrears (earlier instalmentsthat you did not pay) or rentals, including theinterest you must pay on the arrearsall refunds of your premium due to you for thecancellation of any insurance cover relating tothe vehiclethe increased instalments or rentals that youwould have had to pay to ensure that there wasno capital value due at the end of the financeperiod. These are worked out to the month inwhich the insurer settles the claim.This applies if the credit agreement provided foryou to pay lower instalments at the beginning of thecredit/loan period and higher instalments later on.In this case, the insurer will not cover you for thebalance that you owe. They will cover you only forwhat you still would have owed if you had arrangedto pay back the loan in equal instalments over theperiod of the loan. Section 9 : Classic MotorSPECIFIC DEFINITIONS FOR THIS SECTIONTerritorial limits: The insurer will cover you in theRepublic of South Africa and for a period not exceeding30 consecutive days in Lesotho and Swaziland.WHAT THE INSURER OFFERS1.Your coverThe insurer will cover you for any loss, damage,death, injury or liaibilty to a third party arising inconnection with the occurrence of an insured eventin relation to the insured vehicle.The insurer may decide whether to repair, reinstateor replace your vehicle or any part of the vehicle orits permanently fitted accessories or spare parts.Alternatively, the insurer may compensate you incash for the amount of the loss or damage, but willnot pay you more than the agreed value stated inyour schedule, less any excess which is payable.If you bought the vehicle on a hire purchase or similaragreement, then the insurer will pay the owner ofthe vehicle in terms of the agreement, and once theinsurer has paid the owner, you can make no furtherclaims against the insurer.The following cover type is available and is definedunder Section 6: Motor, Specific definitions:• ComprehensiveNamed driver clauseThe insurer will cover the vehicle only while it is beingdriven by you or your spouse, or any driver named inyour schedule, or by a mechanic who is carrying outrepairs or maintenance.Restricted mileage clauseThe vehicle may do only 5 000 miles or 8 300kilometres per year, unless it is stated differently inyour schedule.4.The mileage is worked out from the date on whichyour policy starts each year and at each anniversarydate after that.Once the vehicle has done the allowed mileage andyou drive it further, all cover and benefits automaticallyend unless you have made an arrangement with theinsurer before the vehicle reached its mileage limitand you have paid an extra premium.No excess payablea. You will not pay the basic excess shown in yourschedule for any claim where• you, your spouse or life partner, or any drivernamed in your policy is driving the vehicle orit is in your/their care and control• as long as the driver is 55 years of age orolder• has been a licensed driver for 5 or moreyears.b. You will not pay a basic excess if you havehad an approved tracking system installed inyour insured vehicle and it is stolen or hijacked,provided that the tracking system has beenadequately maintained and regularly tested.2.3.5.Fire extinguisher clauseTo qualify for cover in case of fire you must carry aSABS-approved fire extinguisher in the vehicle at alltimes.54 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>


AUTOMATIC EXTENSIONS FOR THIS SECTION1.Authorising emergency repairs6.Imported parts2.3.4.5.If your claim is valid under this section, the insurer willcover you for emergency repairs up to the amountas stated in your schedule to enable you to continueyour journey.You may give permission for these repairs to be donewithout first obtaining permission from the insurer,provided that you send a full, itemised invoice to theinsurer.Cherished remainsYou will have the first option to purchase the salvageor remains of your vehicle if the insurer declares that itis not economical to repair the vehicle. (This happenswhen the reasonable cost of repair is more than 70%of the agreed value stated in your schedule.) In thiscase, the purchase price of the salvage will be 25%of the agreed value, or 5% of the agreed value if thevehicle is burnt out by fire.It is important to note that you will lose this optionif your vehicle is underinsured to the extent that thereasonable retail value is more than 20% above theagreed value as stated in your schedule.Delivery after repairsThe insurer will cover you for the reasonable costs ofhaving your insured vehicle delivered to your insuredaddress as stated in your schedule once the repairsagreed to have been completed.Fire extinguishing chargesThe insurer will pay the reasonable costs ofextinguishing or fighting a fire,provided thata. the costs are not more than the amount statedin your scheduleb. you are legally responsible for these costsc. the insured vehicle was on fire or was in imminentdanger of being damaged by fire.Head, tail or spotlight damageThe insurer will cover you for the costs of replacingany head, tail or fitted spotlights that are damagedby accident, even if there is no damage to thevehicle.The insurer will pay up to the amount as stated inyour schedule.The excess stated in your schedule for window glassclaims also applies to damaged head, tail or fittedspotlights.Your claim-free group is not affected by a claim forhead, tail or fitted spotlights that are damaged.7.8.9.If a part that the repairers need to repair your vehicleafter it has suffered loss or damage is not availablein the Republic of South Africa as a standard part,the insurer will pay the cost of air freighting orimporting the part up to the amount as stated inyour schedule.The insurer will not pay any additional costs thatyou might incur as a result of any delay in the repairof your vehicle owing to the part not being readilyavailable.Protection during removal and deliveryIf you have a valid claim for the repair of your vehicleunder this policy, the insurer will pay the reasonablecosts to safeguard your vehicle and move it to theclosest repairer after it has suffered loss or damage.The insurer will also pay for the reasonable costs ofdelivering your vehicle from the place authorised torepair it or the place of safe storage to your addressas stated in your schedule.Replacing your vehicleThe insurer will replace your insured vehicle witha vehicle of the same or a similar make and modellimited to the amount as stated in your schedule,under the following conditions:a.You have a valid claim under this policy.b. The insurer has decided it is not economical torepair your vehicle.c. Your vehicle has been stolen and has not beenrecovered within a reasonable period.d. The same or similar vehicle is available on thelocal vehicle market.If you wish the insurer to pay you out instead ofreplacing your insured vehicle, the insurer maydecide to do so, but their payment to you will not bemore than the cost of the replacement vehicle thatthey have sourced.Temporarily detached partsThe insurer will pay you for the loss of or damageto parts that were temporarily removed or detachedfrom your insured vehicle as long asa.b.c.the value of the temporarily detached partsdoes not exceed 25% of the agreed value of yourinsured vehicle as stated in your schedulethe parts were removed or detached from yourinsured vehicle for service or repairthe parts were in your care or control or with arecognised repairer and were kept in a lockedgarage or, if in transit to the repairer, the partswere adequetly stowed.<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 55

Section 10 : Legal Liability To Third PartiesSPECIFIC DEFINITIONS FOR THIS SECTIONInsured event: death or bodily injury of any person oraccidental loss of or damage to tangible property of anyperson for which you become legally liable to pay fordamages, as well as the claimants’ costs and expensesarising out of or in connection with the ownership oruse of the insured motor vehicle, including the towingof any single insured vehicle, loading and unloading, orother vehicle (other than for reward) occurring duringthe period of insurance.WHAT THE INSURER OFFERS1.1. Your coverThe insurer will cover you for claims up to theamount as stated in your schedule for any insuredevent including the costs and expenses you incuror are incurred on your behalf or for which youbecome legally liable, including the costs you incurin the defence of any action brought against youfor an insured event, provided that such costs andexpenses are incurred with the insurer’s prior writtenconsent.If you are involved in an insured event, theinsurer willa. cover youb. cover any person who is temporarily driving orusing the insured vehicle with your express orimplied permission provided that the personc.d.• is not entitled to cover under any otherpolicy• complies with and fulfils all obligationsunder this policy and is subject to the terms,conditions and exclusions of this policy asthough he/she were you• to your knowledge has not been refused anymotor vehicle insurance or renewal thereofcover any passenger in the insured vehicleagainst all sums including claimant costs andexpenses for which you or they become legallyliable as a result of an insured event resultingfrom their occupancy of the insured vehiclecover you for insured events while you aretemporarily driving a vehicle other than theinsured vehicle (with a carrying capacity notexceeding 10 persons) or goods vehicle (with agross mass not exceeding 3 500kg):2.3.• not owned by you; and• not leased or hired or being purchased byyou under a credit or similar agreement.Damages to the motor car are excluded.The insurer will also pay the costs and expenses youincur with their prior written consent which relate tothe defence of any civil or criminal action broughtagainst you and for obtaining representation for youat any inquest or fatal accident enquiry as a result ofan insured event, provided that the total combinedlegal liable of any claim and such associated costs willbe limited to the amount as stated in your schedule.Territorial limits for legal defence and associatedcostsThis section of the policy is subject to an insured eventhappening anywhere in the Republic of South Africaor, while for a period not exceeding 30 consecutivedays, the insured vehicle is in Mozambique, Namibia,Lesotho, Botswana, Swaziland, Zimbabwe, Malawi,Tanzania, Zambia, Kenya and Uganda.JurisdictionThe insurer will not accept any legal liable in respectof any judgment or cost order awarded against youwhere the insured event giving rise to the claimagainst you occurs outside of Republic of SouthAfrica unless such judgment or cost order is obtainedthrough a court of the Republic of South Africa.<strong>Executive</strong> <strong>Policy</strong> <strong>MUA</strong> 57


SPECIFIC EXCLUSIONS FOR THIS SECTIONThe insurer will not cover you for legal liable relating toor arising from or in any way associated with1.2.3.4.5.6.7.compensation which falls within the scope of anycompulsory motor vehicle insurance law in any ofthe territories where this cover applies, even whereno such compulsory insurance is maintaineddamage to property belonging to or held in trustby or in the custody or control of you, your family,the driver of the insured vehicle, or any personcovered by the policy while such property is beingtransported or loaded or unloadedyou having entered a contract or agreement, unlesssuch liability would in any event have ensuedwithout you entering into such contract, or fromany fraudulent act or misrepresentation by anotherpersondeath of or bodily injury to members of your familypermanently residing with you, or, if the vehicle isbeing driven by someone other than you, suchdriver’s family members permanently residing withthemdeath of or bodily injury to any person in youremployment, or, if the vehicle is being driven bysomeone other than you, such driver’s employee,other than a domestic employee, and which arisesout of, and in the course of, such employmentdeath of or bodily injury to persons carried in or onor getting on or off any caravan or trailerdeath of or bodily injury to persons carried in or onor getting on or off any vehicle being towed by theinsured vehicle8.9.10.11.12.13.14.15.16.death of or bodily injury to persons carried outsidethe passenger compartment of the insured vehicleat the time of the insured eventdeath of or bodily injury to passengers (otherthan excluded by exclusion 4. above) in or on anymotorcycle or attached sidecar for any claim inexcess of R100 000 resulting from any one accidentor series of accidents arising out of one eventdeath of or bodily injury to any passengers on a quadbike or off-road bikeamounts exceeding the amount of R500 000 fordeath, bodily injury and damage to property if thequad bike or off-road bike is being driven by aperson under the age of 16 yearsany amount exceeding R500 000 for death, bodilyinjury and damage to property if the golf caddy/cart/lawnmower is being driven by a person underthe age of 16 yearsthe use of watercraft, if the total length of thewatercraft exceeds 8 metresany vehicle while it is being used for racing, speedtesting, hill climbs or trialsDeath or injury to any person getting onto or off themotorcycleLoss of or damage to property being carried in or onthe motorcycle58 <strong>MUA</strong> <strong>Executive</strong> <strong>Policy</strong>
