The quorum was determinedby <strong>the</strong> presence <strong>of</strong> Dr. Conard, Dr. Paletta, Dr. Eckley, Dr. Edwards, Dr. Gerber, and Mrs. Stevens. There<strong>for</strong>e, <strong>the</strong> meeting<strong>of</strong> <strong>the</strong> West Virginia Board <strong>of</strong> Dental Examiners was called to order.The first order <strong>of</strong> business was <strong>the</strong> meeting notice to <strong>the</strong> Secretary <strong>of</strong> State which was distributed <strong>for</strong> in<strong>for</strong>mationpurposes only.The next order <strong>of</strong> business were <strong>the</strong> minutes from <strong>the</strong> January 2012 meeting. Upon motion by Dr. David G.Edwards, and properly seconded by Mrs. Beverly Stevens, and unanimously passing, <strong>the</strong> minutes were approved.At this time, guest Richard Stevens, spoke to <strong>the</strong> Board concerning <strong>the</strong> Board <strong>of</strong> Pharmacy’s article in a recentnewsletter in regards to accuracy <strong>of</strong> records in <strong>the</strong> Controlled Substance Monitoring Program Database and <strong>the</strong>ir Board’srule concerning <strong>the</strong> same.The next order <strong>of</strong> business were minutes <strong>of</strong> <strong>the</strong> WV Association <strong>of</strong> Licensing Boards meetings from January andFebruary 2012 and a letter concerning <strong>the</strong> retirement <strong>of</strong> Grady Bowyer, which were taken <strong>for</strong> in<strong>for</strong>mation purposes only.The next order <strong>of</strong> business was Attorney General advise to <strong>the</strong> WV Medical Imaging and Radiology TechnologyBoard concerning <strong>the</strong> Division <strong>of</strong> Personnel Fees, which was taken <strong>for</strong> in<strong>for</strong>mation purposes only.The next order <strong>of</strong> business was an opinion <strong>of</strong> <strong>the</strong> WV Ethics Commission concerning Board members andExecutive Directors having memberships or holding <strong>of</strong>fices <strong>of</strong> pr<strong>of</strong>essional associations, which was taken <strong>for</strong> in<strong>for</strong>mationpurposes only.The next order <strong>of</strong> business was an annual <strong>report</strong> from <strong>the</strong> American Board <strong>of</strong> Dental Examiners and a <strong>report</strong> <strong>of</strong><strong>the</strong>ir House <strong>of</strong> Representatives from November 2011. At this time <strong>the</strong> Board discussed <strong>the</strong> different <strong>board</strong> examinationsand will be checking into whe<strong>the</strong>r or not <strong>the</strong> Western Regional Examination Board is planning to move to portfolio-styleexaminations.The next order <strong>of</strong> business was a legal case from <strong>the</strong> State <strong>of</strong> Texas against <strong>the</strong> Texas Board <strong>of</strong> Dental Examiners,38
Texas Dental Association and American Dental Association in regards to a Denturist, which was taken <strong>for</strong> in<strong>for</strong>mationpurposes only. Also, a copy <strong>of</strong> a letter from members <strong>of</strong> <strong>the</strong> United States House <strong>of</strong> Representatives to <strong>the</strong> Federal TradeCommission (FTC) concerning <strong>the</strong> FTC’s direct interference with <strong>the</strong> state regulation <strong>of</strong> <strong>the</strong> practice <strong>of</strong> medicine anddentistry. This led to <strong>the</strong> discussion <strong>of</strong> teeth whitening investigations. The Board will continue to investigate illegal teethwhitening operations and seek court ordered injunctions against <strong>the</strong>m.The next order <strong>of</strong> business were letters from various State Boards to <strong>the</strong> American Dental Association and <strong>the</strong>irresponses to those Boards concerning portfolio-style examinations, which were taken <strong>for</strong> in<strong>for</strong>mation purposes only.The next order <strong>of</strong> business were discussions concerning <strong>the</strong> following legislative related items.Implementation <strong>of</strong> <strong>the</strong> Board’s fee rule (part <strong>of</strong> HB 4139) currently awaiting <strong>the</strong> Governor’s signature.Upon motion by Dr. C. Richard Gerber, and properly seconded by Dr. Diane M. Paletta, andunanimously passed, unless vetoed by <strong>the</strong> Governor, <strong>the</strong> effective date <strong>of</strong> <strong>the</strong> rule will be April 15th,2012.A Well being and Recovery Program was discussed by <strong>the</strong> Board <strong>for</strong> dentists practicing in <strong>the</strong> State<strong>of</strong> West Virginia. The Board President stated <strong>the</strong> <strong>dental</strong> and hygiene associations need to come upwith how much money should be designated <strong>for</strong> this type <strong>of</strong> program. Richard Stevens, Director <strong>of</strong><strong>the</strong> West Virginia Dental Association, stated <strong>the</strong> Dental Association would only want money to gotowards costs <strong>of</strong> administration <strong>of</strong> such program, not to cover <strong>the</strong> costs <strong>of</strong> <strong>the</strong> program <strong>for</strong> recoveringaddicts.The next order <strong>of</strong> business was in<strong>for</strong>mation from <strong>the</strong> Joint Commission on National Dental Examinationsconcerning <strong>the</strong> delay <strong>of</strong> National Board scores, which was taken <strong>for</strong> in<strong>for</strong>mation purposes.The next order <strong>of</strong> business was in<strong>for</strong>mation from <strong>the</strong> National Practitioner Data Bank concerning electronic <strong>report</strong><strong>for</strong>warding. The Board discussed future mandatory electronic health records <strong>for</strong> practitioners and <strong>the</strong> current incentivesby medicaid and medicare <strong>for</strong> eligible pr<strong>of</strong>essionals who currently use electronic records.The next order <strong>of</strong> business were newsletters from <strong>the</strong> following organizations: American Association <strong>of</strong> DentalBoards, Dental Assistant National Board, National Practitioner Data Bank, Nebraska Board <strong>of</strong> Dentistry, Oregon Board<strong>of</strong> Dentistry, Western Regional Examining Board, WV Board <strong>of</strong> Medicine & West Virginia Dental Association, which weredistributed <strong>for</strong> in<strong>for</strong>mation purposes.The next order <strong>of</strong> business were future meetings <strong>of</strong> <strong>the</strong> Council <strong>of</strong> Interstate Testing Agencies and West VirginiaBoard <strong>of</strong> Dental Examiners. The Board will conduct it’s Fall meeting in Morgantown on November 8, 9 & 10th at <strong>the</strong> WestVirginia University, School <strong>of</strong> Dentistry. The Board’s Winter meeting will be January 17, 18 & 19th in Charleston, WV.The next order <strong>of</strong> business were <strong>the</strong> purchasing card and financial <strong>report</strong>s, which were accepted as distributed.At this time, <strong>the</strong> Board went back to legislative issues where <strong>the</strong> following items were discussed in regards tosuggestions changes to <strong>the</strong> <strong>dental</strong> practice act:Allowing <strong>for</strong> members <strong>of</strong> academia to be members <strong>of</strong> <strong>the</strong> Board;Setting <strong>for</strong>th new requirements <strong>for</strong> teaching permits;Specialty licensure requirements; andFailure to <strong>report</strong> a DUI in <strong>the</strong> disciplinary section.The next order <strong>of</strong> business were <strong>the</strong> elections <strong>of</strong> Officers. Dr. George D. Conard, Jr., nominated Dr. Diane M.Paletta <strong>for</strong> President. Upon motion by Dr. C. Richard Gerber, and properly seconded by Dr. David G. Edwards, andunanimously passed, <strong>the</strong> nominations <strong>for</strong> President were closed. Dr. David G. Edwards nominated Dr. Craig L. Meadows<strong>for</strong> Secretary. Upon motion by Dr. Diane M. Paletta, and properly seconded by Dr. David G. Edwards, <strong>the</strong> nominations<strong>for</strong> Secretary were closed. Effective July 1, 2012, Dr. Diane M. Paletta will become President and Dr. Craig L.
