CH.3 – 52]CIVIL AVIATIONAppeal toSupreme Court.Function of theFlight StandardsInspectorate.flight and on conviction on indictment to a fine orimprisonment for a term not exceeding two years or both.10. (1) An appeal shall lie to the Supreme Courtfrom any decision of the Minister that a person is not a fitperson to hold a licence to act as an aircraft maintenancetechnician, member of a flight crew of an aircraft, or as themanagement of an approved maintenance or trainingorganization, or the management of an air operator, and ifthe court is satisfied on the evidence submitted to theMinister he was wrong in so deciding, the court mayreverse the Minister’s decision and the Minister shall giveeffect to the court’s determination:Provided that an appeal shall not lie from a decisionof the Minister that a person is not qualified to hold thelicence by reason of a deficiency in his knowledge,experience, competence, skill, physical or mental fitness.(2) <strong>The</strong> respondent to any appeal under this regulationshall be the Attorney General of <strong>The</strong> <strong>Bahamas</strong>.(3) For the purposes of any provision relating to thetime within which an appeal may be brought, theMinister’s decision shall be deemed to have been taken onthe date on which the Minister furnished a statement of hisreasons for the decision to the applicant for the licence, oras the case may be, the holder or former holder of it.PART IIFLIGHT STANDARDS INSPECTORATE11. <strong>The</strong> Minister shall establish a Flight StandardsInspectorate comprised of technically qualified aviationsafety inspectors to conduct the necessary technicalevaluations, inspections and investigations required to meet<strong>The</strong> <strong>Bahamas</strong>’ ICAO responsibilities for safety oversightfor:(a) registration of aircraft;(b) airworthiness of aircraft;(c) personnel licensing;(d) operations of aircraft;(e) aerial work;(f) commercial air transport;(g) carriage of dangerous goods; and(h) accident investigation.STATUTE LAW OF THE BAHAMAS LRO 1/2002
