CH.3 – 60]CIVIL AVIATIONRegistration ofaircraft.(b) some other country in relation to which there isin force an agreement between the Governmentof <strong>The</strong> <strong>Bahamas</strong> and the Government of thatcountry which makes provision for the flightover <strong>The</strong> <strong>Bahamas</strong> of aircraft registered in thatcountry:Provided that this paragraph shall not apply to anykite or captive v balloon.(2) If an aircraft flies over <strong>The</strong> <strong>Bahamas</strong> in contraventionof paragraph (1) of this regulation in such manneror circumstances that if the aircraft had been registered in<strong>The</strong> <strong>Bahamas</strong> an offence against these <strong>Regulations</strong> wouldhave been committed, the like offence shall be deemed tohave been committed in respect of that aircraft.25. (1) <strong>The</strong> Minister shall, subject to the provisionsof this Part, register aircraft in <strong>The</strong> <strong>Bahamas</strong> and for thispurpose shall cause a register to be kept and may recordtherein the particulars specified in paragraph (7).(2) Subject to the provisions of this regulation, anaircraft shall not be registered or continue to be registeredin <strong>The</strong> <strong>Bahamas</strong> if it appears to the Minister that —(a) the aircraft is registered outside <strong>The</strong> <strong>Bahamas</strong>and that such registration does not cease byoperation of law upon the aircraft being registeredin <strong>The</strong> <strong>Bahamas</strong>;(b) an unqualified person holds any legal orbeneficial interest by way of ownership in theaircraft or any share therein;(c) it would be inexpedient in the public interest forthe aircraft to be or to continue to be registeredin <strong>The</strong> <strong>Bahamas</strong>; or(d) the aircraft does not qualify for the issue of acertificate of airworthiness in accordance withthe provisions of regulation 28.(3) <strong>The</strong> following persons and no others shall bequalified to hold a legal or beneficial interest by way ofownership in an aircraft registered in <strong>The</strong> <strong>Bahamas</strong> or ashare therein —(a) the Government of <strong>The</strong> <strong>Bahamas</strong>;(b) a citizen or permanent resident of <strong>The</strong> <strong>Bahamas</strong>or other such persons as the Minister shallapprove;STATUTE LAW OF THE BAHAMAS LRO 1/2002
