CH.3 – 64]CIVIL AVIATIONaircraft, unless the appropriate authority of thatcountry has sanctioned the bearing of suchmarks.Type Certificate.PART VAIRWORTHINESS OF AIRCRAFT27. (1) A Type Certificate with respect to anaircraft, engine or propeller means a document issued bythe manufacturer, and approved by the appropriateauthority of the State of manufacture, certifying that thetype design of the aircraft, engine or propeller and of thevariants specified on the Type Data Sheet, comply with thecertification basis to which the certificate refers. <strong>The</strong> TypeCertificate includes; the type certificate data sheet, the typedesign, the operating limitations and any other conditionsor limitations prescribed for the aircraft.(2) Any person who intends to operate an aircraft tobe registered in <strong>The</strong> <strong>Bahamas</strong> for commercial air transportor aerial work purposes shall apply to the Minister for theissue, acceptance or validation of a Type Certificate asprovided in Schedule 4 for that aircraft, in accordance withthis regulation and the requirements of the Minister fromtime to time.(3) An applicant for a Type Certificate of anaircraft, or for the acceptance or validation thereof, shallsubmit with the application detailed data identifying theairworthiness standards to which the aircraft was designedand data which describes the design, construction andperformance of that aircraft.(4) <strong>The</strong> Minister shall accept or validate a TypeCertificate, in respect of any aircraft, engine or propellerthat is imported into <strong>The</strong> <strong>Bahamas</strong>, subject to suchconditions or limitations as it shall consider appropriateand in accordance with Schedule 4, provided that —(a) the airworthiness authority of the State ofmanufacture has issued a Type Certificate on thebasis of Federal <strong>Aviation</strong> <strong>Regulations</strong> or JointAir <strong>Regulations</strong>; and(b) the Type Certificate approval basis meets theairworthiness requirements laid down by theMinister;STATUTE LAW OF THE BAHAMAS LRO 1/2002
