<strong>SRK</strong> <strong>Consulting</strong>: Project No: 434719 New Denmark Colliery coal de-stoning plant Page 71 Background and IntroductionThe Anglo American Thermal Coal (AATC) New Denmark Colliery (NDC), situated in the Highveldcoalfields 30km north of Standerton, Mpumalanga, is one of the deepest coal mines in South Africaand is one of the few in South Africa to employ the longwall mining method. Commissioned in 1982,it extracts four seam coal from its Central and Okhozini shafts, producing five million tonnes of coalper annum for Eskom’s Tutuka Power Station.As primary supplier of coal to Eskom’s Tutuka Power Station, NDC continuously strives to improvethe quality of coal being used at the power station. By removing impurities such as stone and shalefrom the raw coal, NDC will meet Eskom’s requirement for improved quality coal resulting in betterash control, reduced ash loading at the power station and improved emissions control for the TutukaPower Station.In order to provide consistent quality coal to the Tutuka Power Station, NDC proposes to establish acoal De-stoning Plant and associated discard disposal site to remove the impurities from the rawcoal. The proposed site for construction of the De-stoning plant, new discard dump for discardmaterial and associated infrastructure such as water supply and storm water management will all belocated on Eskom owned land adjacent to existing mining operations and infrastructure.Before NDC may commence with the proposed project, certain environmental authorisations andlicense amendments need to be undertaken. These are:• An Environmental Impact Assessment (EIA) in terms of the National EnvironmentalManagement Act (NEMA, Act 107 of 1998) for the construction and operation of a coal DestoningPlant and associated discard disposal site, for submission to the MpumalangaDepartment of Economic Development, Environment and Tourism (MDEDET);• An amendment to the NDC’s Environmental Management Programme <strong>Report</strong> (EMPR) asrequired under the Mineral Resources and Petroleum Act (MPRDA, Act 28 of 2002), forsubmission to the Department of Mineral Resources (DMR): and• A review and update of the Integrated Water Use Licence (IWULA) and accompanyingIntegrated Waste and Water Management Plan (IWWMP) under the National Water Act (NWA,Act 36 of 1998), for submission to the Department of Water Affairs (DWA).The stakeholder engagement process as part of the environmental authorisation process isconducted in terms of NEMA (as amended) which provides clear guidelines for stakeholderengagement during an EIA. Chapter 1 of the NEMA outlines the principles of environmentalmanagement, several pertaining to public consultation (e.g. Chapter 1, subsections (2), (3), (4)(f),(g), (h), (k), (q) and (r). The amended EIA Regulations promulgated in June 2010 in GN R543,Chapter 6, section 54-57 specify the minimum requirements for stakeholder engagement in an EIAunder the NEMA. In October 2012, The Minister of Water and Environmental Affairs published interms of section 24J of the NEMA, Public Participation Guidelines which guide the publicparticipation process and specify minimum requirements.The stakeholder engagement process undertaken is also conducted in terms of the MPRDA. TheDMR published Guidelines for Consultation with Communities and Interested and Affected Parties asrequired in terms of section 10(1)(b), 16(4)(b), 22(4)b, 27(5)(b) and 39 of the MPRDA.All the above guidelines have been incorporated into this stakeholder engagement process.DEEL/MAVA<strong>Stakeholder</strong> <strong>Engagement</strong> <strong>Report</strong> for DSR

This application must be submitted to the Department of Mineral Resources (DMR)Mpumalanga Regional Office, Mpumalanga Department of Economic Development, Environmentand Tourism (MDEDET) and the Department of Water Affairs (DWA) for authorisation. Commentingauthorities include the Gert Sibande District Municipality and Lekwa Local Municipality.This document represents the <strong>Stakeholder</strong> <strong>Engagement</strong> <strong>Report</strong> of the Scoping Phase for NewDenmark’s proposed coal-destoning plant and associated discard disposal site and outlines thestakeholder engagement undertaken to date, as part of the environmental authorisation process.2 Location of projectNew Denmark Colliery (NDC) underground mine, is located in the north eastern portion of the AngloAmerican Group’s Standerton coalfield. The site for the proposed coal de-stoning plant andassociated discard disposal site is situated on Eskom-owned land, i.e. Portion 1 of the farmRacesbult 352 IS, in the Ward 12 of the Lekwa Local Municipality, Mpumalanga Province. It fallswithin the boundaries of the Gert Sibande District Municipality between the towns of Standerton,Bethal and Evander (See Figure 1 for the regional setting of New Denmark Colliery).3 Approach to stakeholder engagement<strong>Stakeholder</strong> <strong>Engagement</strong> is the involvement of all parties who potentially have an interest in adevelopment or project, or may be directly or indirectly affected by the proposed development. It is aprocess leading to a joint effort by stakeholders, technical specialists, the authorities and theproponent/developer who work together to produce better decisions than if they had actedindependently.The stakeholder engagement process for the environmental authorisation process is discussedbelow and the key steps of the process are presented in Figure 2. The approach followed is focusedon:• Obtaining most issues, including those from stakeholders early on in the process, with the latterhalf of the process designed to provide environmental and technical evaluation of these issues;• Personal contact with directly affected Interested and Affected Parties (I&APs), taking intoaccount cultural and language sensitivity;• Using the languages of choice of I&APs in meetings, and providing selected documents as perthe requirements of the MPRDA, NEMA and NWA;• Raising a diversity of perspectives and opinions rather that forcing consensus among I&APs. Thisapproach also minimises project risks by building trust with I&APs;• Building capacity of I&APs to participate;• Utilise existing consultation forums and opportunities to minimise stakeholder fatigue withextensive consultation events where practically appropriate, and• Clarifying I&APs’ roles and responsibilities at the start of the process, sanctioned by theauthorities, in terms of where and when decisions will be made and by whom.DEEL/MAVA<strong>Stakeholder</strong> <strong>Engagement</strong> <strong>Report</strong> for DSR

Since 1992, as an existingoperation NDC has a comprehensive social management system in place which provides aframework for the management of social and environmental issues, community engagement anddevelopment.Significant insight and experience have been gained in gauging and understanding the stakeholderenvironment within which NDC operates. It is vital that the existing stakeholder environment berecognised as this will provided the context for the public consultation process being undertaken aspart of the environmental authorisation process for the proposed de-stoning plant project. Thissection provides a broad overview of the characteristics of the stakeholder environment, based onthe NDC Social Management Plan 2013 and the Socio-Economic Assessment Toolkit (SEAT) 2010<strong>Report</strong>.4.1 Overview of neighbouring communitiesAs indicated in paragraph 3 NDC falls within Ward 12 of the Lekwa Local Municipality and thecommunities in this area are shown in Table 1 indicating the type of community and distance fromthe colliery. The municipality includesStanderton, which serves as the urban node, while Morgenzon, 45km north-east of Standerton,serves as a satellite node. <strong>SRK</strong> <strong>Consulting</strong>: Project No: 434719 New Denmark Colliery coal de-stoning plant Page 12Lekwa is highly urbanised with 65% of the population residing in urban areas and 35% in rural areas.According to current demographics reflected in the Lekwa Integrated Development Plan (IDP) (NDCSEAT 2 2010 <strong>Report</strong>, p.16), the area is pre-dominantly inhabited by Nguni-speaking people, and themajor languages spoken in the area are English, isiZulu and Afrikaans. Recognition of the culturaldiversity and languages spoken in the area has been taken into consideration in the approach andmethodology of the stakeholder engagement process being undertaken as part of the environmentalauthorisation process.4.2 Understanding stakeholder issues and potential impactsThe NDC Social Management Plan, 2013 provides a synthesis of baseline issues and potentialimpacts on stakeholders, including potential cumulative impacts that provide context to the existingstakeholder environment and the potential issues that could be identified and addressed during thisprocess. <strong>SRK</strong> <strong>Consulting</strong>: Project No: 434719 New Denmark Colliery coal de-stoning plant Page 13Figure 3 NDC proposed de-stoning plant project lifecycle stages in relation to NDC's ongoingstakeholder engagement process and the environmental authorisation processundertaken by the EAP (after Anglo Environment Way, 2009, p 10)NDC’s approach to stakeholder engagement has been taken into consideration in the stakeholderengagement required for the environmental authorisation process and includes the followingelements:• Planning the engagement forward as one would any complex activity, with a schedule andsufficient staff with appropriate capabilities;• Focusing efforts on those stakeholders most affected by the project, whether because ofproximity or vulnerability to change;• Demonstrating that people’s opinions and ideas receive serious consideration, whether by“designing-in” additional local economic or social benefits, or incorporating the views ofstakeholders in testing the feasibility of various design and risk management options of theproposed project;• Working within existing engagement forums such as the Lekwa Municipality’s IDP forums as wellas the Local Farmer’s Forum when consulting interested and affected parties to minimisestakeholder fatigue with extensiveThe approach has the following key components:• Guidance for stakeholder engagement will take place in the context of the environmentalauthorisation process, which itself has a number of stages (i.e. Scoping, Impact Assessment andDecision-making). <strong>Stakeholder</strong> engagement will be planned and facilitated by an independentassessment service provider (<strong>SRK</strong> <strong>Consulting</strong>); and• Guidance for stakeholder engagement in further phases (i.e. life-of-mine phases) will be basedon AATC NDC’s existing <strong>Stakeholder</strong> <strong>Engagement</strong> Policy. Here the management ofengagement is entirely an NDC responsibility, although suggestions will be made in theDEEL/MAVA<strong>Stakeholder</strong> <strong>Engagement</strong> <strong>Report</strong> for DSR

In terms of Section 24 0 (2) of NEMA, specific State departments were identified andrecognised as commenting authorities on aspects of this EIA. Representatives from thesedepartments are included in the stakeholder database.The <strong>SRK</strong> stakeholder engagement office started the stakeholder identification process by utilising anexisting database linked to existing New Denmark Colliery stakeholder engagement processes.Existing stakeholder details were verified and incorporated into the stakeholder database developedfor the proposed New Denmark Colliery Project.Communities and I&APs were identifiedthrough a process of discussions with NewDenmark Colliery, meetings withstakeholders, networking and previousrelationships developed with keystakeholders.The NEMA Regulations (GN R543)distinguishes between I&APs and registeredI&APs – refer Box 1.A register of I&APs has been opened andcontains the names of all I&APs as definedby the NEMA Regulations and will beupdated throughout the process.In May 2013, during announcement of theproject, there were 80 stakeholders on thedatabase with verified contact details.Table 3 shows that these stakeholdersrepresent a broad spectrum of sectors ofsociety. The current stakeholder database isattached as Annexure 1 and will be updatedthroughout the process. The site for the proposed coal de-stoning plantand associated discard disposal site is situatedon Eskom-owned land, i.e. Portion 1 of the farmRacesbult 352 IS and portion 4 of the farm Slagkraal 353 IS. AATC NDC’s proposed coal De‐stoning Plant project 5PROJECT DESCRIPTIONNDC proposes to establish a coal de-stoning plant and associated discard disposal site within NDC’sauthorized mining rights boundary. The size of the proposed footprint of the coal de-stoning plant facility isestimated to be about 25 hectares, with the footprint of the discard facility estimated to be about 90 hectares.The proposed coal de-stoning plant is expected to have a processing capacity of up to 10.2 million tons ofcoal per annum which is the feed requirement for the Tutuka power station. A typical beneficiation process isshown in Figure 3Presently, raw coal from NDC is only crushed prior to being fed to Tutuka. Raw coal contains variousquantities of stone and shale, which is very hard and abrasive, and contains no heat value. This causesincreased maintenance in the power station, and is therefore the cause of load, or power losses to thenational electricity grid. De-stoning the raw coal, by a well proven method of dense medium separation, is anaccepted way of increasing the quality of coal to the power station, therefore reducing maintenance costs, andincreasing the overall efficiency of power generation.The beneficiation process includes screening coal into specific sizes, and ‘washing’ the larger fraction toremove the stone contamination. The finer fraction is then combined with the ‘clean’ coarse coal ontostockpiles. Coal is crushed to the required size before being conveyed to the Eskom stockyards. The stoneand shale contaminant is then transported and deposited at the nearby discard disposal site.Figure 3 Diagram of the process that will be followed at the proposed coal de‐stoning plant


AATC NDC’s proposed coal De‐stoning Plant project6Components of theProjectThe proposed coal de-stoning plant and associated infrastructurewill be developed within the NDCauthorisedmining boundaryadjacent toexisting operations and infrastructure. The keycomponentsof the proposed project comprise:• A coal de-stoning plant, with estimated footprint of 25 hectares,and processing capacity of up to 10.2 million tons of coal peryear;• A discard disposal site with estimated footprint of 90 hectaresand a height of 30mfor disposal of waste material from the de-tostoning process;• Construction and upgrade of water supply infrastructurehandle a peak throughput of 856litres per second; and• Construction of storm-water management infrastructure.ElectricityThe electricity supply forthe proposed coal de-stoning plant will beobtained from the existing supply at the mine and no additionaltransmissionn infrastructure is required.Water supplyThe proposed project at average throughput design rate of 5. .3Mt/yr. will require 848 630 litres of water perday and it will be sourcedfrom Eskom(Roshcon dam). Water infrastructure will be built and upgraded tohandle a peak throughput of 18.6 litres per second. The water supply pipeline will require authorisation basedon its estimated capacityof a peak throughput of18.6l/s and an internal diameter of storm water pipeline (m)0.2m. Stormwater control infrastructure will also be constructed. All waste will be managed in line with existing waste management procedures of NDC.Environmental Management and ClosureOnce environmental authorisationhas been obtained forthe New Denmark Colliery from the variouscompetent authorities, an Environmental Control Officer will be appointed to implement the approvedEnvironmental Management Programme (EMP)during the construction, operational and closure phases ofthe project. A performance assessment will be undertaken once every two years toassess thecompliancewith the conditions contained within the EMP andpossible additional requirements from the authorities.A Rehabilitation Plan is to be developed during the next phase of the project that is, in the Draft Closure Plan(at 15 - 10 years) or preferably sooner followingthe pre-feasibility planning phase of the mine, once designdetails have been finalised. Progressive rehabilitation planning should be emphasised.ENVIRONMENTAL AUTHORISATIONThe environmental authorisation andassociated stakeholder engagement process for the proposed NDC coalde-stoning Project is being undertaken as follows:• An EIA in terms of the National Environmental Management Act (NEMA, Act 107of 1998);• An amendment to the NDC’s Environmental Management Programme <strong>Report</strong> (EMPR) as equired underthe Mineral Resources and Petroleum Act (MPRDA, Act28 of 2002) ; and


AATC NDC’s proposed coal De‐stoning Plant project7• A reviewand update of the Integrated Water Use Licence (IWULA) and accompanying Integrated Wasteand Water Management Plan (IWWMP) under the National Water Act (NWA, Act36 of 1998) ).This process comprisess two phases; a scopingphase andan impact assessmentphase. During scoping,issues for investigationduring the impact assessment phase are identified and the scope ofthe studiessdefined. This informationn is compiled into a Draft Scoping <strong>Report</strong>, and will be available for public comment.Once the comments from the stakeholder engagement process are received, thescoping report will befinalised andsubmitted to the relevant authoritiesfor decision-making with regard to the remainingprocess forthe EIA.During the impact assessment phase, the potential impacts are determined and management measures areproposed tomitigate negative impacts and enhance positive impacts. An EIA and EMP <strong>Report</strong> will beproduced and made available for public comment. The report will be finalised andsubmitted to DMR andMDEDET, who will in consultationwith other authorities at national, provincial and local levels, make adecision about the proposed project. AATC NDC’s proposed coal De‐stoning Plant project8<strong>Stakeholder</strong> <strong>Engagement</strong>The stakeholder engagement process as part of the environmental authorisationprocess is conducted interms of NEMA (as amended) which provides clear guidelines for stakeholder engagement during an EIA.Chapter 1 of the NEMAoutlines the principles of environmental management, several pertaining to publicconsultation. The amended EIA Regulations promulgated in June 2010 inGN R543, Chapter 6, section 54-57specify the minimum requirements for <strong>Stakeholder</strong> engagement in an EIA under theNEMA. Thestakeholderengagementprocess undertaken is also conducted in terms of the MPRDA and in particular the Guidelines forConsultationn with Communities and Interested and Affected published by the DMR.This process offers stakeholders the opportunity to learn about the project, to raise issues that they areconcerned about, and to make suggestions for enhanced project benefits. The technical specialists andproject teamwill evaluate relevant issues and suggestions during the EIA process. All non-technicaldocuments for public comment will be available in English, isiZulu and Afrikaans. Figure 4 alsoprovides anoverview of the stakeholder engagement activities associatedwith this environmentalauthorisation processPotential impacts and proposedspecialist studiesThe impact assessment phase includes specialist studies that investigate the project area and potentialnegative andpositive issues. The specialist studies envisaged to be undertaken maybe subject to change onthe basis of the issues identified through the stakeholder engagement process, are asfollows:Air Quality:To assess the current and predictedd air quality constraints.Biodiversity: Assess theimpacts onplants (flora) and animals (fauna) inthe area.Cultural Heritage: Evaluate the impacts on historically and culturally significant areas.Soil and Land Use Capability: To understand if arable landis lost and how the soils will be impacted by thedevelopment.Geo-hydrology: Assesses the groundwater condition and characteristics.Hydrology: Evaluates the surface water quality.Noise: Calculates who will be impacted by noise produced bythe plant.Closure: plans for the long term implications once the plant closes.Proposed timelineThe proposed timeline (Figure 5) for implementing the NDC Coal De-stoning delays with approval processess from AngloAmerican, Eskom and the Governmental Authorities at various stages of the project.project is a total of 36 – 42months. This timeframee may increase as result of potentialCurrently theEnvironmental authorisation processes are underway, andwill take between 18 to 24 months(from February 2013) to complete. Thereafter once all authorisationsand approvals have been granted,construction will commence with an expected completion date early 2016.
