<strong>SRK</strong> <strong>Consulting</strong>: 430521 Comment and Response Report Page 11 Introduction and Scope of ReportThe stakeholder engagement process forms an important part of <strong>the</strong> Scoping Phase of a project.The Public Participation Process (PPP) is primarily aimed at affording Interested and AffectedParties (I&APs) and Stakeholders <strong>the</strong> opportunity <strong>to</strong> gain an understanding of <strong>the</strong> project. <strong>SRK</strong> <strong>Consulting</strong>: 430521 Comment and Response Report Page 23 Public Participation ProcessThe Public Participation Process (PPP) was initiated by notifying identified I&APs and stakeholdersof <strong>the</strong> application enabling <strong>the</strong>m <strong>to</strong> raise any issues or concerns at <strong>the</strong> outset of <strong>the</strong> authorisationprocess. An I&AP register was opened and maintained whereby I&APs contact details werecaptured.Public Participation during <strong>the</strong> Scoping Phase mainly revolved around announcing <strong>the</strong> project bymeans of:The proposed project was advertised in in two languages, Afrikaans and English. Itappeared in two newspapers, The Rustenburg Herald and Kwevoel Newspaper on <strong>the</strong> 25and 26 of January 2013 respectively. Refer <strong>to</strong> Appendix C 1 for a copy and proof of <strong>the</strong>newspaper advertisements;Sites notices (Size A2: 594 mm X 841 mm) notifying I&APs of <strong>the</strong> proposed activity; wereplaced in and around <strong>the</strong> project area (Appendix C 2). The site notices were written inEnglish, Afrikaans and Tswana. The notices were placed at <strong>the</strong> following areas on <strong>the</strong> 25thof January 2013.ooThe two Main Entrance and exit gates <strong>to</strong> <strong>the</strong> <strong>Union</strong> Mine;Community Supermarket in Northam.The Bakgatla-Ba-Kgafela Traditional Community did not want <strong>the</strong> notices put up in <strong>the</strong>irarea, but after <strong>Union</strong> Mine’s representative engaged with <strong>the</strong> community, <strong>the</strong> notices wereplaced at <strong>the</strong> following areas on <strong>the</strong> 14th of February 2013, in English and Tswana.oSites notices Bakgatla-Ba-Kgafela Traditional Community Village officesBackground Information Documents (BIDs) (See Appendix C 3) were emailed <strong>to</strong> I&AP’s(See Appendix C 6) ; and key stakeholders on <strong>the</strong> 14th of February 2013.I&AP’s whom no e-mail address could be located were sent a Short Message Service (SMS)notifying <strong>the</strong>m of <strong>the</strong> proposed project (14th of February 2013), and contact number of <strong>SRK</strong><strong>Consulting</strong> personnel, whereby additional information could be obtained.3.1 Identification of I&APs and I&AP DatabaseA comprehensive I&APs database was provided by AP & RPM (<strong>Union</strong> <strong>Section</strong> JV). This wasformulated from previous studies undertaken in <strong>the</strong> project area. <strong>SRK</strong> <strong>Consulting</strong> amalgamated thislist with an existing database in order <strong>to</strong> consolidate identification and contact with relevant IAP’s andstakeholders. The database formed <strong>the</strong> basis of all communication and correspondence <strong>to</strong>stakeholders. Lists of IAPs are presented in Appendix C 6Directly affected land-owners were identified by means of a deeds search on all properties within <strong>the</strong>mining rights area and adjacent <strong>to</strong> <strong>the</strong> mine boundary.The I&AP database include, but are not limited <strong>to</strong>: Affected communities in <strong>the</strong> project area (<strong>Section</strong> 3.1.1); Landowners (Bakgatla-Ba-Kgafela ) (<strong>Section</strong> 3.1.2); Land Claimants (<strong>Section</strong> 3.1.3); Land occupier (Bakgatla-Ba-Kgafela) (<strong>Section</strong> 3.1.4); The Department of Land Affairs;NELL / HINM 430521.2013.03.07.Comments and Response Report 24 April 2013


<strong>SRK</strong> <strong>Consulting</strong>: 430521 Comment and Response Report Page 3Identified o<strong>the</strong>r persons (including on adjacent and non-adjacent properties) whose socioeconomicconditions may be directly affected by <strong>the</strong> proposed project;The Local Municipality (Moses Kotane Local Municipality);The relevant Government Departments (including The Department of Land Affairs (DLA),The Department of Water Affairs (DWA) and The Department of Department EconomicDevelopment, Environment, Conservation and Tourism (DEDECT), agencies and institutionsresponsible for <strong>the</strong> various aspects of <strong>the</strong> environment and for infrastructure which may beaffected by <strong>the</strong> proposed project (See Appendix C 6).An advertisement was also placed in <strong>the</strong> two newspapers, The Rustenburg Herald and KwevoelNewspaper on <strong>the</strong> 25 and 26 of January 2013 respectively, in two languages, Afrikaans and English.In <strong>the</strong> advertisement, people were invited <strong>to</strong> register as I&APs. Refer <strong>to</strong> Appendix C 1 for a copyand proof of <strong>the</strong> newspaper advertisements;The I&AP database will be maintained and updated throughout <strong>the</strong> project and will be used <strong>to</strong> notifyI&APs of <strong>the</strong> availability of reports for public review.3.1.1 Host Communities/Traditional AuthorityThe nearest neighbouring communities <strong>to</strong> <strong>the</strong> project include <strong>the</strong> villages of Ga-Ramosidi, Sefikileand Zwartklip which are situated on <strong>the</strong> mine surface lease area, while Mmantserra are situated in<strong>the</strong> surrounding areas. Headmen of <strong>the</strong> different villages were contacted throughout all phases of<strong>the</strong> project <strong>to</strong> ensure that <strong>the</strong> villages are kept informed about <strong>the</strong> proposed development (AppendixC 7).Figure 3-1 illustrates <strong>the</strong> proximity of <strong>the</strong> local communities in relation <strong>to</strong> <strong>the</strong> AP & RPM (<strong>Union</strong><strong>Section</strong> JV) Mine.The villages of Mokgalwana, Disake, Matlametlo, and Matsinyane are also located in <strong>the</strong> MosesKotane Local Municipality.3.1.2 LandownersThe surface area that might be affected by <strong>the</strong> proposed projects and Title Deed description aregiven in Table 3-1. <strong>SRK</strong> <strong>Consulting</strong>: 430521 Comment and Response Report Page 63.2.5 Authorities MeetingThe authority meeting was held with <strong>the</strong> Department of Minerals and Resources (DMR) on <strong>the</strong> 22 ndAugust 2012 at <strong>the</strong> AP & RPM (<strong>Union</strong> <strong>Section</strong> JV) offices.The aim of <strong>the</strong> meeting was <strong>to</strong> inform <strong>the</strong> DMR of <strong>the</strong> proposed project, giving <strong>the</strong>m technicalbackground on <strong>the</strong> activities proposed <strong>to</strong> take place and <strong>the</strong> environmental process that will befollowed. Meeting minutes are attached in Appendix C 5.4 Issues raised by I&APsTable 4 1 summarises prominent issues, brought <strong>to</strong> light by I&APs during <strong>the</strong> commenting periodand also project team’s response <strong>to</strong> <strong>the</strong>se matters. P u r p o s e o f t h i s d o c u m e n tThe purpose of this Background Information Document (BID)is <strong>to</strong> provide Stakeholders with initial information regarding<strong>the</strong> proposed construction and operation of a new ventilationShaft at Anglo Platinum Rustenburg Platinum Mine (RPM) –<strong>Union</strong> <strong>Section</strong> Spud Shaft (South Mine), North West Province.An Environmental Management Programme (EMPR)amendment and associated public participation process willbe conducted in terms of <strong>Section</strong> 102 of <strong>the</strong> MineralsPetroleum Resources Development Act (Act No. 28 of 2002)(MPRDA) and Regulation 48 – 52. <strong>SRK</strong> <strong>Consulting</strong> has beenappointed as <strong>the</strong> independent environmental consultants forthis project.The Scoping and Environmental Impact Assessment (EIA)/Environmental Management Plan (EMP) reports will besubmitted <strong>to</strong> <strong>the</strong> lead decision-making authority; <strong>the</strong>B a c k g r o u n d a n d i n t r o d u c t i o nDepartment of Mineral Resources (DMR), on behalf of <strong>the</strong>applicant, RPM.Stakeholders now have <strong>the</strong> opportunity <strong>to</strong> register as anInterested and Affected Party (I&AP) and provide <strong>the</strong>ircomments by completing <strong>the</strong> attached form and returning itvia email or fax <strong>to</strong> <strong>the</strong> responsible personnel as indicated inthis document.Comments on any aspect of <strong>the</strong> proposed project will help <strong>to</strong>focus <strong>the</strong> studies, <strong>to</strong> ensure that relevant issues areevaluated in <strong>the</strong> EIA process, and will assist <strong>the</strong> authorities<strong>to</strong> make an informed decision.Please complete <strong>the</strong> enclosed registration and commentsheet, write a letter, provide a written submission, call oremail <strong>the</strong> Public Participation Office with your contributions,by <strong>the</strong> 25 th February 2013.The proposed ventilation shaft is a vertical passage that willbe connecting <strong>the</strong> underground workings with surfaceatmosphere, functioning <strong>to</strong> move fresh air underground <strong>to</strong>ensure a safe working environment for <strong>the</strong> underground mineworkers.<strong>Union</strong> Mine's infrastructure consists mainly of two verticalshafts, namely Richard Shaft (now North Mine) and SpudShaft (now South Mine). The operating depth of <strong>the</strong> currentworkings is between 150 m and 1,500 m below surfaceL o c a t i o nThe ventilation shaft at Spud Shaft (South Mine) is required<strong>to</strong> enable Spud Shaft <strong>to</strong> continue mining at <strong>the</strong> requiredproduction rate. The Spud Shaft’s UG2 operation will extend<strong>the</strong> profitability and life of <strong>the</strong> RPM, and in return createadditional employment. Failure <strong>to</strong> have this ventilation shaftin time will result in a loss of production and <strong>the</strong> possible joblosses.The mine is situated in both <strong>the</strong> Limpopo and <strong>the</strong> North Westprovinces of South Africa, approximately 210 km north wes<strong>to</strong>f Johannesburg and 15 km west of <strong>the</strong> Limpopo <strong>to</strong>wn,Northam. The mine forms part of <strong>the</strong> North-western Limb of<strong>the</strong> Bushveld Complex. (See Figure 0-1).The Ventilation shaft is located ± 35 km from <strong>the</strong> PilanesbergNational Park on <strong>the</strong> farm Haakdoorn 6 JQ, within <strong>the</strong> MosesKotane municipal area.O<strong>the</strong>r villages in <strong>the</strong> area are Sefikile, 6 km <strong>to</strong> <strong>the</strong> east,Mantserre, 6 km <strong>to</strong> <strong>the</strong> north east, and <strong>the</strong> <strong>Union</strong> mineresidential development, which is 6 km <strong>to</strong> <strong>the</strong> north from <strong>the</strong>WHO TO CONTACT ABOUT THIS PROJECT?proposed ventilation shaft. See Figure 0-2 for <strong>the</strong> arialpho<strong>to</strong>graph showing <strong>the</strong> villages in relation <strong>to</strong> <strong>the</strong> VentilationShaft.Ventilation shafts are positioned at specified locations along<strong>the</strong> underground workings <strong>to</strong> optimise ventilation capacity,whilst considering energy demands and disturbance that mayaccrue <strong>to</strong> attempt <strong>to</strong> ventilate over prolonged distances.Therefore this exact position was recommended. Pr o j e c t D e s c r i p t i o nThe Ventilation Shaft project will include <strong>the</strong> following:• A upcast raiseboring ventilation shaft which will bedrilled <strong>to</strong> a depth of approximately 590m. The shaftdiameter will be 4.2 m, which will supply fresh airunderground for <strong>the</strong> Spud Shaft workings;• The associated civil and structural installations onsurface;• A 4 m wide gravel access road, <strong>to</strong> <strong>the</strong> Raiseboringventilation shaft will be built from an existingtarred road with in <strong>the</strong> <strong>Union</strong> mine.During <strong>the</strong> construction period, <strong>the</strong> construction area will befenced off with a 30 x 30m (900m²) security fence. The sitewill include <strong>the</strong> proposed ventilation Shaft, including <strong>the</strong>access area, surface parking facilities for employees, siteoffices, change house, temporary settler ponds, opera<strong>to</strong>r’scabin, main substation, power pack s<strong>to</strong>re and <strong>the</strong> drill pipestacking area.The raiseboring ventilation shaft footprint area will beapproximately 30 x 30 m (900 m²) including <strong>the</strong> concreteplatform surrounding it. The area will be fenced off afterconstruction. All disturbed areas will be rehabilitated back<strong>to</strong> <strong>the</strong>ir pre-mining land capability after closure. The shaft’soutlet will not be less than approximately 5.0 m high andhave a diameter of 4.2 m.The raiseboring process entails two different processes:1) Pre cementation process;2) Raiseboring process.The main project elements are depicted in Figure 0-3 <strong>to</strong>Figure 0-10.The raisebore machine needs a proper foundation <strong>to</strong> drill.The foundation is constructed on pillions of concrete thatwill be installed around <strong>the</strong> shaft position. During <strong>the</strong> Precementation process 36 x 370 mm holes are drilled around<strong>the</strong> shaft position with a drill rig (See Figure 0-3 and Figure0-4). Concrete is pumped in<strong>to</strong> <strong>the</strong>se drilled holes <strong>to</strong> form aconcrete plug around <strong>the</strong> shaft. This process is used <strong>to</strong> sealof <strong>the</strong> area around <strong>the</strong> ventilation shaft position <strong>to</strong> prevent<strong>the</strong> ingress of groundwater.The raiseboring process involves drilling a 4.2 m verticalupcast ventilation shaft, <strong>to</strong> a depth of approximately386 m. First a 381 mm hole will be drilled from surface <strong>to</strong><strong>the</strong> ventilation shaft position underground. The reamer headwill <strong>the</strong>n be attached <strong>to</strong> <strong>the</strong> drill steel at <strong>the</strong> bot<strong>to</strong>m of <strong>the</strong>ventilation shaft underground. The raisebore machine slowlyturns and pulls <strong>the</strong> reamer <strong>to</strong> surface. The drill chips (rock)will fall <strong>to</strong> <strong>the</strong> bot<strong>to</strong>m of <strong>the</strong> shaft from where <strong>the</strong>underground machines will remove it.Consideration was given <strong>to</strong> install <strong>the</strong> fan drive mechanismsunderground <strong>to</strong> fur<strong>the</strong>r alleviate noise levels. This willprovide added environmental advantage of reducing <strong>the</strong>visual impact.RPM currently have an approved Environmental ManagementProgramme (EMPR) authorized by <strong>the</strong> DMR.An EIA/EMP process will be conducted as part of thisamendment.RPM <strong>Union</strong> sectionFigure 0-1: Locality Plan, showing <strong>the</strong> <strong>Union</strong> mine

S p e c i a l i s t s t u d i e sDuring <strong>the</strong> EIA Phase of <strong>the</strong> project, <strong>the</strong> specialists,engineers and scientists, with appropriate knowledge andexperience in evaluating <strong>the</strong> proposed expansion anddevelopment on <strong>the</strong> socio-environmental context of <strong>the</strong>project, evaluate and identify potential environmental andsocial impacts <strong>the</strong> project may have and propose mitigationand management measures. Mitigation and managementmeasures are proposed <strong>to</strong> minimise negative impacts andenhance benefits, within <strong>the</strong> context of <strong>the</strong> projectsituational analysis.The findings of <strong>the</strong> specialist studies are recorded in anEnvironmental Impact Report (EIR) and an EMP, which will bepresented <strong>to</strong> I&AP’s for <strong>the</strong>ir comment. Thereafter, <strong>the</strong>documents will be updated and submitted <strong>to</strong> DMR for adecision and authorisation regarding <strong>the</strong> project.E n v i r o n m e n t a l A u t h o r i z a t i o n Pr o c e s sThe EIA process will be conducted in terms of <strong>Section</strong> 102 of<strong>the</strong> Minerals Petroleum Resources Development Act (Act No.28 of 2002) and Regulation 48 – 52.<strong>Section</strong>102:“A reconnaissance permission, prospecting right, miningright, mining permit, retention permit, technical corporationpermit, reconnaissance permit, exploration right andproduction right work programme; mining workprogramme, environmental management programme, andenvironmental management plan may not be amended orvaried (including by extension of <strong>the</strong> area covered by it or by<strong>the</strong> addition of minerals or a share or shares or scams,mineralised bodies, or strata, which are not at <strong>the</strong> time <strong>the</strong>subject <strong>the</strong>reof) without <strong>the</strong> written consent of TheMinister”The owner of mining authorisation is Rustenburg PlatinumMines Ltd. They have authorisation for <strong>the</strong> mining ofPlatinum group metals. The licence is subject <strong>to</strong> certainprovisions. An amendment <strong>to</strong> <strong>the</strong> current EMPR is required<strong>to</strong> incorporate <strong>the</strong> specific details of <strong>the</strong> proposedventilation shaft at RPM Spud Shaft (South Mine).The key competent authority is <strong>the</strong> DMR.Anglo Platinum Rustenburg Platinum Mine (RPM) – <strong>Union</strong><strong>Section</strong>, is required by law <strong>to</strong> appoint independentconsultants <strong>to</strong> undertake an EIA and prepare an EMPRamendment <strong>to</strong> assess <strong>the</strong> potential biophysical and socialimpacts of <strong>the</strong> proposed project.<strong>SRK</strong> <strong>Consulting</strong> will evaluate and identify potentialenvironmental and social impacts of <strong>the</strong> project andprovide mitigation and management measures <strong>to</strong>minimise negative impacts and enhance benefits, within<strong>the</strong> context of <strong>the</strong> project situational analysis.The process that will be followed <strong>to</strong> deliver an EMPRamendment will include:MPRDA <strong>Section</strong> 102 Application;An Environmental Impact Assessment (EIA)application (Figure 0-12); andA <strong>Joint</strong> Public Participation Process.P u b l i c Pa r t i c i p a t i o n Pr o c e s s a n d Pr o j e c t S c h e d u l i n gPublic Involvement is seen as an integral part of <strong>the</strong>Environmental Authorization Process and will aim <strong>to</strong> includeI&AP’s in <strong>the</strong> process by notifying <strong>the</strong>m of <strong>the</strong> proposedproject and encouraging <strong>the</strong>m <strong>to</strong> raise <strong>the</strong>ir issues andconcerns. This will aid <strong>the</strong> Environmental AssessmentPractitioner (EAP) <strong>to</strong> ga<strong>the</strong>r local knowledge on <strong>the</strong> area andN o t i f i c a t i o nidentify <strong>the</strong> common concerns. The following section details<strong>the</strong> methodology <strong>SRK</strong> proposed <strong>to</strong> undertake <strong>the</strong> PublicParticipation Process during <strong>the</strong> Environmental ImpactAssessment Process.Should <strong>the</strong> DMR authorize <strong>the</strong> EIA Report, RPM proposes <strong>to</strong>initiate construction in approximately December 2013.Advertisements have been lodged in <strong>the</strong> following manner: Rustenburg Herald newspaper on <strong>the</strong> 24 th ofJanuary 2013. Kwevoel paper, 25 th of January 2013; andThis was conducted in order <strong>to</strong> ensure broad spectrums ofstakeholders are notified of <strong>the</strong> proposed project.In addition, I&AP’s will be notified of <strong>the</strong> project andopportunities for interaction by means of:The placement of site notices;Distribution of BID’s (this document) <strong>to</strong> identifyI&AP’s.The commencement of <strong>the</strong> public meeting will becommunicated <strong>to</strong> all registered I&AP’s followingconfirmation of <strong>the</strong> time and date with RPM.


I n t e r a c t i o n w i t h I & A P ’sIt is important that <strong>the</strong> I&AP’s are afforded <strong>the</strong> opportunity<strong>to</strong> understand <strong>the</strong> technical issues associated with <strong>the</strong>project so <strong>the</strong>y can add valuable contributions <strong>to</strong> <strong>the</strong>Environmental Impact Assessment Process. The following isproposed:Invitation <strong>to</strong> all identified I&AP’s <strong>to</strong> register;Draft Scoping Report and EIA will be madeavailable for public review and comment for a30 day review;Comments received during this period will beconsidered and incorporated in<strong>to</strong> <strong>the</strong> Draft Scopingand EIA Report respectively and submitted <strong>to</strong> <strong>the</strong>DMR.The following entities have been identified as <strong>to</strong> date askey stakeholders in <strong>the</strong> project:Moses Kotane municipality;Bojanala District Municipality;Land owners;Land occupiers; andNon-governmental organisations.Written comments will be received from <strong>the</strong> following:North West Department Economic Development,Environment, Conservation and Tourism (NW-DEDECT);Department of Agriculture, Forestry & Fisheries(DAFF); andDepartment of Water Affairs (DWA).Additional I&AP’s will be identified during <strong>the</strong> course of<strong>the</strong> Public Participation Process.F e e d b a c kFeedback will be provided <strong>to</strong> registered I&AP’s via letters,emails and fax. <strong>SRK</strong> <strong>Consulting</strong> Page 2MH explained that <strong>SRK</strong> confirmed at <strong>the</strong> previous meeting, held 11 th July 2012, that<strong>the</strong>y will arrange with authorities <strong>to</strong> meet on site.The objectives of <strong>the</strong> Authorities meeting was <strong>the</strong> following:1.1 To introduce <strong>the</strong> proposed project <strong>to</strong> <strong>the</strong> DMR;1.2 To provide overview of <strong>the</strong> proposed project;1.3 To identify requirements of Authorities;1.4 To discuss matters for clarification; and1.5 To include a site visit with <strong>the</strong> Authorities representative.<strong>SRK</strong> also had some concerns regarding <strong>the</strong> position of <strong>the</strong> proposed Vent Shaft, andsome possible studies <strong>the</strong>y identified, that may be required.2 Confirmation of AgendaThe Agenda was confirmed by everyone present.3 Approval of previous minutesThe minutes of <strong>the</strong> meeting held on 11 July 2012, was approved by everyone present.AllAll4 IntroductionDL gave a brief introduction <strong>to</strong> <strong>the</strong> project, and explained that <strong>the</strong> proposed ventilationshaft is a vertical passage that will be connecting <strong>the</strong> underground workings withsurface atmosphere, functioning <strong>to</strong> move fresh air underground <strong>to</strong> ensure a safeworking environment for <strong>the</strong> underground mine workers.DL explained that <strong>the</strong> positioning of <strong>the</strong> ventilation shaft is limited by <strong>the</strong> currentunderground mining operations. Ventilation shafts are positioned at specifiedlocations along <strong>the</strong> underground workings <strong>to</strong> optimise ventilation capacity, whilstconsidering energy demands and disturbance that may accrue <strong>to</strong> attempt <strong>to</strong> ventilateover prolonged distances. Therefore this exact position was recommended.The working crews from <strong>the</strong> underground operation’s <strong>to</strong>p levels are gradually movingdown <strong>to</strong> UG2 reef below level 12. Extra ventilation shafts will be required <strong>to</strong> supplyfresh air <strong>to</strong> <strong>the</strong>se mining operations.The construction of <strong>the</strong> shaft is planned for 2014.5 The Vent Shaft meeting objectives5.1 Requirements of Authorities;5.1.1 EMP amendmentMH explained that, at this stage, an Environmental Management Programme (EMPR)amendment and associated public participation process will be conducted in terms of<strong>Section</strong> 102 of <strong>the</strong> Minerals Petroleum Resources Development Act (Act No. 28 of2002) (MPRDA) and Regulation 48 – 52.The process followed is <strong>the</strong> following:Background information document;The Scoping Report andEnvironmental Management Plan (EMP) reportWill be submitted <strong>to</strong> <strong>the</strong> lead decision-making authority; <strong>the</strong> DMR, on behalf of <strong>the</strong>applicant, <strong>Union</strong> Mine.ININININStakeholders will have <strong>the</strong> opportunity <strong>to</strong> register as an Interested and Affected Party(I&AP) and provide <strong>the</strong>ir comments. <strong>SRK</strong> does however still require a stakeholder list.(see information required).MH explained that no listed activities have so far been identified, that could potentiallybe triggered in terms of The National Environmental Management Act (107 of 1998)NELL/COES 430521.2012.08.22.Minutes DMR Meeting1.docx 02 March 2012


<strong>SRK</strong> <strong>Consulting</strong> Page 3Government notices No R.544, 545 and 546.PN confirmed that this is <strong>the</strong> correct process <strong>to</strong> follow.5.2 Matters for clarification;5.2.1 RezoningMH explained that, as per information received from <strong>Union</strong> Mine, <strong>the</strong> proposed siteposition chosen for <strong>the</strong> ventilation shaft falls on <strong>the</strong> neighbouring farm, which isoutside <strong>the</strong> current mining right. MH confirmed that <strong>SRK</strong> discussed <strong>the</strong> above with aTown and Regional Planner and confirmed that as we need <strong>to</strong> extend <strong>the</strong> mining right<strong>to</strong> <strong>the</strong> neighbouring farm, we will need <strong>to</strong> rezone <strong>the</strong> farm from <strong>the</strong> current Agricultural<strong>to</strong> Mining. Rezoning will take about 6 – 8 Months.MH distributed a court judgement, dated 23 August 2010. This court judgement is alsoattached as Appendix B.PN confirmed that he knows about <strong>the</strong> court judgement, but <strong>the</strong> DMR does not dealwith rezoning.JK confirmed that he will take it up with <strong>the</strong> <strong>Union</strong> Mine head office.JK5.2.2 Site possibly within 1:100 m floodlineDiscussions during <strong>the</strong> meeting based on <strong>the</strong> Map (Appendix C). The map was done,using <strong>the</strong> geographic co-ordinates supplied by <strong>Union</strong> Mine (24 th of July 2012).MH explained that a Water Use Licence is required for activities taking place within<strong>the</strong> 1:100 m floodline or within 100 m from <strong>the</strong> river whichever is <strong>the</strong> fur<strong>the</strong>st.According <strong>to</strong> <strong>the</strong> map done by <strong>SRK</strong>, <strong>the</strong> existing Vent Shaft point falls within ±150mdistance from a stream. <strong>SRK</strong> does not have <strong>the</strong> flood lines for this stream, and as <strong>the</strong>area is level, <strong>the</strong> floodlines can be potentially be very wide, and more than 100m from<strong>the</strong> centre of <strong>the</strong> river.MH expressed <strong>SRK</strong> biggest concern is that if <strong>the</strong> site does fall within <strong>the</strong> flood line,which according <strong>to</strong> <strong>the</strong> National Water Act (NWA, Act 36 of 1998), require a WaterUse Licence (WUL).This particular water use authorisation will be in terms of section 21(c) and (i) of <strong>the</strong>NWA. <strong>Section</strong> 21(c) involves <strong>the</strong> impeding or diverting <strong>the</strong> flow of water in a watercourse and <strong>Section</strong> 21(i) involves altering <strong>the</strong> bed, banks, course or characteristics ofa water course. This authorisation is a long dragged out process with many licenceconditions which should be avoided if possible.The Geologist, OC, confirmed that he will verify on his maps <strong>the</strong> stream.MH confirmed that <strong>the</strong> determination of <strong>the</strong> floodlines is not covered under <strong>the</strong> scopeof this appointment that <strong>SRK</strong> will provide a quotation <strong>to</strong> do <strong>the</strong> necessary surveyrequired <strong>to</strong> determine <strong>the</strong> floodlines if <strong>Union</strong> Mine surveyor cannot supply <strong>the</strong>required data.OCJKMH6 Information RequiredMH explained <strong>SRK</strong> forwarded a list of minimum information required after <strong>the</strong>previous meeting. The Court specifically dealt with and disposed of <strong>the</strong> notion that <strong>the</strong> socalledlisted activities in terms of <strong>the</strong> EIA Regulations were not applicable <strong>to</strong> mining areas.The Court also held that land intended for mining required <strong>the</strong> appropriate zoning in terms of <strong>the</strong>Land Use Planning Ordinance 15 of 1985 (LUPO) before such mining commenced. The Court heldthat that LUPO’s application <strong>to</strong> mining was congruent with <strong>the</strong> constitutional scheme of concurrentpowers and that national legislation (in this instance <strong>the</strong> Mineral and Petroleum ResourcesDevelopment Act 28 of 2002 (MPRDA)) did not trump provincial legislation (which in this instanceis administered by local government). These processeswill be conducted in compliance with <strong>the</strong> Minerals and Petroleum Resources Development Act (Act No.28 of 2002).Public participation processAs an integral part of <strong>the</strong> environmental studies, a public participation process will be undertaken <strong>to</strong> obtain <strong>the</strong>comments and concerns of all interested and affected parties (I&AP's). As a potential I&AP you will be invited <strong>to</strong>participate through public participation procedures, which will be set up in <strong>the</strong> coming months.
