SRK Consulting Page 2MH explained that SRK confirmed at the previous meeting, held 11 th July 2012, thatthey will arrange with authorities to meet on site.The objectives of the Authorities meeting was the following:1.1 To introduce the proposed project to the DMR;1.2 To provide overview of the proposed project;1.3 To identify requirements of Authorities;1.4 To discuss matters for clarification; and1.5 To include a site visit with the Authorities representative.SRK also had some concerns regarding the position of the proposed Vent Shaft, andsome possible studies they identified, that may be required.2 Confirmation of AgendaThe Agenda was confirmed by everyone present.3 Approval of previous minutesThe minutes of the meeting held on 11 July 2012, was approved by everyone present.AllAll4 IntroductionDL gave a brief introduction to the project, and explained that the proposed ventilationshaft is a vertical passage that will be connecting the underground workings withsurface atmosphere, functioning to move fresh air underground to ensure a safeworking environment for the underground mine workers.DL explained that the positioning of the ventilation shaft is limited by the currentunderground mining operations. Ventilation shafts are positioned at specifiedlocations along the underground workings to optimise ventilation capacity, whilstconsidering energy demands and disturbance that may accrue to attempt to ventilateover prolonged distances. Therefore this exact position was recommended.The working crews from the underground operation’s top levels are gradually movingdown to UG2 reef below level 12. Extra ventilation shafts will be required to supplyfresh air to these mining operations.The construction of the shaft is planned for 2014.5 The Vent Shaft meeting objectives5.1 Requirements of Authorities;5.1.1 EMP amendmentMH explained that, at this stage, an Environmental Management Programme (EMPR)amendment and associated public participation process will be conducted in terms ofSection 102 of the Minerals Petroleum Resources Development Act (Act No. 28 of2002) (MPRDA) and Regulation 48 – 52.The process followed is the following:Background information document;The Scoping Report andEnvironmental Management Plan (EMP) reportWill be submitted to the lead decision-making authority; the DMR, on behalf of theapplicant, Union Mine.ININININStakeholders will have the opportunity to register as an Interested and Affected Party(I&AP) and provide their comments. SRK Consulting Page 3Government notices No R.544, 545 and 546.PN confirmed that this is the correct process to follow.5.2 Matters for clarification;5.2.1 RezoningMH explained that, as per information received from Union Mine, the proposed siteposition chosen for the ventilation shaft falls on the neighbouring farm, which isoutside the current mining right. MH confirmed that SRK discussed the above with aTown and Regional Planner and confirmed that as we need to extend the mining rightto the neighbouring farm, we will need to rezone the farm from the current Agriculturalto Mining. Rezoning will take about 6 – 8 Months.MH distributed a court judgement, dated 23 August 2010. This court judgement is alsoattached as Appendix B.PN confirmed that he knows about the court judgement, but the DMR does not dealwith rezoning.JK confirmed that he will take it up with the Union Mine head office.JK5.2.2 Site possibly within 1:100 m floodlineDiscussions during the meeting based on the Map (Appendix C). The map was done,using the geographic co-ordinates supplied by Union Mine (24 th of July 2012).MH explained that a Water Use Licence is required for activities taking place withinthe 1:100 m floodline or within 100 m from the river whichever is the furthest.According to the map done by SRK, the existing Vent Shaft point falls within ±150mdistance from a stream. SRK does not have the flood lines for this stream, and as thearea is level, the floodlines can be potentially be very wide, and more than 100m fromthe centre of the river.MH expressed SRK biggest concern is that if the site does fall within the flood line,which according to the National Water Act (NWA, Act 36 of 1998), require a WaterUse Licence (WUL).This particular water use authorisation will be in terms of section 21(c) and (i) of theNWA. Section 21(c) involves the impeding or diverting the flow of water in a watercourse and Section 21(i) involves altering the bed, banks, course or characteristics ofa water course. This authorisation is a long dragged out process with many licenceconditions which should be avoided if possible.The Geologist, OC, confirmed that he will verify on his maps the stream.MH confirmed that the determination of the floodlines is not covered under the scopeof this appointment that SRK will provide a quotation to do the necessary surveyrequired to determine the floodlines if Union Mine surveyor cannot supply therequired data.OCJKMH6 Information RequiredMH explained SRK forwarded a list of minimum information required after theprevious meeting.
