CHAMPAIGN POLICE DEPARTMENTPOLICY and PROCEDURE POLICY NUMBER: 1.9SUBJECT: BIAS BASED PROFILING EFFECTIVE DATE: 10/01/09REVISED DATE: 1/26/12REFERENCE ILEAP: ADM.02.05REFERENCE CALEA: 1.2.9INDEX AS:1.9.1 BIAS BASED PROFILING PROHIBITED1.9.2 TRAINING AGENCY PERSONNEL1.9.3 REPORTING REQUIREMENTS1.9.4 DATA COLLECTIONPURPOSE:The purpose of this policy is to establish policiesregarding the treatment of people based on race, religion,ethnicity, age, gender or sexual orientation.DEFINITIONS:Detention: The act of stopping or restraining anindividual’s freedom to walk away, approaching andquestioning an individual outside the realm of aconsensual encounter, or stopping an individualsuspected of being involved in criminal activity.Bias Based Profiling: The detention, interdiction, or otherdisparate treatment of an individual on the basis of race,religion, ethnicity, age, gender or sexual orientation.POLICY:1.9.1 BIASED BASED PROFILING PROHIBITIONA. Bias based profiling of individuals by members of theChampaign Police Department is strictly prohibited.1. In the absence of a specific report, the race orethnicity of an individual will not be a factor indetermining the existence of probable cause toplace in custody or arrest an individual, or inconstituting a reasonable articulable suspicionthat an offense has been, is being, or is about tobe committed so as to justify the detention of anindividual, seizing assets or the investigatorystop of a motor vehicle.2. In response to a specific credible report ofcriminal activity, race and ethnicity of anindividual will not be the sole factor indetermining the existence of probable cause toplace in custody or arrest an individual.B. Stops, detentions, or seizing assets based upon race,ethnicity, age, gender, sexual orientation, or any otherprejudicial basis by any member of the ChampaignPolice Department are prohibited.1. The detention of any individual that is not basedupon factors related to an investigation of aviolation of a federal law, Illinois statutes, Cityordinances, or any combination thereof isprohibited.2. No officer shall stop, detain, search, or seizeassets from any person when such action ismotivated by race, religion, color, ethnicity, age,gender, or sexual orientation.1.9.2 TRAINING AGENCY PERSONNELA. The department shall provide training and continuingeducation to officers concerning cultural diversity,including sensitivity toward racial and ethnicdifferences.1. Training and continuing education shall include,but not be limited to, an emphasis on the factthat the primary purpose of enforcement of theIllinois Vehicle Code is safety and equal anduniform enforcement under the law.1.9.3 REPORTING REQUIREMENTSA. Members of the Champaign Police Department failingto report any observed or known violations of thisorder may be subject to disciplinary action.B. Complaints of discriminatory practices or bias basedprofiling will be handled in accordance with Policies26.1, 52.1, and 52.2.1. A supervisor shall promptly respond to anincident when requested by an officer advisingthat a person is making a complaint allegingprofiling or other improper conduct.2. If necessary, and/or if the matter can not beresolved, the responding supervisor shall takethe complaint and provide the complainant with aCitizen Complaint Fact Sheet.3. After the supervisor has summarized anddocumented the complaint, the complaint shallbe forwarded to the Deputy Chief of ProfessionalStandards.C. The Chief of Police or his designee will beresponsible for completing an annual administrativereview of agency practices to include:1. A listing of each complaint.2. An explanation of action(s) taken.3. Recommended training needs.4. Recommended policy changes.1.9.4 DATA COLLECTIONPage 1 of 2
A. The Champaign Police Department will participate inthe traffic stop/field contact statistical study.1. Whenever an officer issues a Uniform TrafficCitation or warning citation for an allegedviolation of the Illinois Vehicle Code, he shallcomplete the Traffic Stop Data Sheet / StopCard.B. Data Compilation.1. Standardized forms for data collection shall beprovided by the department and utilized by theofficer making the stop.2. Once completed, forms shall be forwarded in thesame manner as traffic citations. Shiftsupervisors and District Commanders shallconduct periodic audits of traffic stops andcompleted forms in order to ensure compliance,completeness, and consistency.3. The data collected shall be transmitted to theIllinois Department of Transportation (IDOT) in aformat approved by IDOT in accordance with 625ILCS 5/11-212.4. Information related to the data collected asrequired by the Public Act 93-209 and this orderis not subject to the Freedom of Information Actand shall not be released to the public or otherorganization(s) unless required by law or order ofthe court.C. Driving Population Data Collection.1. In order to obtain accurate driving populationdata, officers completing traffic crash reports willnote their subjective determination of the race ofeach driver. The person’s race shall be selectedfrom the following list: Caucasian, African-American, Hispanic, Native American / Alaskan,or Asian/Pacific Islander.Page 2 of 2
