New Diversion Funding in <strong>the</strong> 80 th , 81 st and No Reductions in 82 nd <strong>Texas</strong> Legislature Diversion FundingIn 2007, <strong>the</strong> <strong>Texas</strong> Legislature implemented a significant series of reforms at TYC. To support <strong>the</strong>se reforms,community-based probation programs and services took on an even more important and critical role in <strong>the</strong>rehabilitation of youthful offenders. To address <strong>the</strong> complex needs of juvenile offenders and to maintain <strong>the</strong>legislative goal of continuing <strong>the</strong> reforms initiated in 2007, new funding was appropriated and has been maintainedduring <strong>the</strong>se difficult economic conditions. This new and continued funding was targeted to <strong>the</strong> following functions:To assist local juvenile probation departments in diverting youth <strong>from</strong> commitment to <strong>the</strong> <strong>Texas</strong> Youth<strong>Commission</strong> (TYC);To establish a contract between TJPC and <strong>the</strong> <strong>Texas</strong> Council on Offenders with Mental and MedicalImpairments (TCOOMMI) for <strong>the</strong> provision of mental health services to juveniles under <strong>the</strong> jurisdiction of<strong>the</strong> juvenile probation departments; (This contract is maintained in FY12 on a volunteer basis.)To develop and now maintain <strong>the</strong> <strong>Juvenile</strong> Case Management System (JCMS), a web-based casemanagement system which allows juvenile probation departments to share case file information betweenTJPC, TYC and local juvenile probation departments (see Appendix H); andTo assist juvenile probation departments in serving misdemeanor offenders who can no longer becommitted to TYC.Annual Report to State LeadershipEffective fiscal year 2010, TJPC was required by Rider 16 to produce an annual <strong>report</strong> to Legislative Leadership thatincludes detailed monitoring, tracking, utilization and effectiveness information on funds appropriated in eachbudget strategy in Goals A (Basic <strong>Probation</strong>) and B (Community Corrections). This is <strong>the</strong> third annual <strong>report</strong> to fulfillthis new requirement. This <strong>report</strong> includes <strong>the</strong> impact of <strong>the</strong> new initiatives such as residential placements,community-based services for serious and chronic felons, and community-based services for misdemeanor offendersno longer eligible for commitment to TYC.Per Rider 11 of <strong>the</strong> FY 2012–2013 General Appropriations Act. Reporting Requirements to <strong>the</strong> Legislative BudgetBoard (LBB).From funds appropriated above, <strong>the</strong> <strong>Juvenile</strong> <strong>Probation</strong> <strong>Commission</strong> (JPC) shall maintain a specific accountabilitysystem for tracking funds targeted at making a positive impact on youth. JPC shall implement a tracking andmonitoring system so that <strong>the</strong> use of all funds appropriated can be specifically identified and <strong>report</strong>ed to <strong>the</strong>Legislative Budget Board. In addition to any o<strong>the</strong>r requests for information, <strong>the</strong> agency shall produce an annual<strong>report</strong> on <strong>the</strong> following information for <strong>the</strong> previous fiscal year to <strong>the</strong> LBB by December 1 st of each year.a. The <strong>report</strong> shall include detailed monitoring, tracking, utilization, and effectiveness information on all fundsappropriated in Goals A and B. The <strong>report</strong> shall include information on <strong>the</strong> impact of any new initiatives andall programs tracked by JPC. Required elements include, but are not limited to residential placements,enhanced community-based services for serious and chronic felons such as sex offender treatment, intensivesupervision, and specialized supervision, community-based services for misdemeanants no longer eligible forcommitment to <strong>the</strong> Youth <strong>Commission</strong>, and <strong>the</strong> Community Corrections Diversion Program.2 TEXAS JUVENILE PROBATION COMMISSION, DECEMBER 2011
