Processes around UNCRC and ACRWC <strong>in</strong> <strong>Kenya</strong>The Government of <strong>Kenya</strong> ratified the United Nations Convention on the Rights of the Child(UNCRC; here also called “the Convention”) <strong>in</strong> 1990 and the African Charter on the Rights andWelfare of the Child (ACRWC) <strong>in</strong> 2000. This chapter exam<strong>in</strong>es the processes that led to <strong>Kenya</strong>’sratification of these two crucial human <strong>rights</strong> <strong>in</strong>struments and the role played by the <strong>child</strong>ren sector<strong>in</strong> their implementation.3.1 United Nations Convention on the Rights of the Child3.1.1 A Historical perspective on the UNCRCThe adoption of the UNCRC by the UN General Assembly <strong>in</strong> 1989 was preceded by long advocacyundertaken to improve the situation of <strong>child</strong>ren <strong>in</strong> the world.The follow<strong>in</strong>g are some key milestones <strong>in</strong> the histo<strong>ry</strong> of <strong>child</strong> <strong>rights</strong>: 1914 to 1918: The 1 st World War witnessed a lack of preparedness by many countries tocope with the pa<strong>in</strong> and suffer<strong>in</strong>g of <strong>child</strong>ren and women as a result of the war. 1923: Eglantyne Jebb (founder, Save the Children) drafted the Declaration on the Rights ofthe Child to address <strong>child</strong>ren’s plight dur<strong>in</strong>g war and other emergencies and the right of the<strong>child</strong>ren to access essential services. 4 1924: The Declaration on the Rights of the Child was adopted by the League of Nations. 5 1948: The UN General Assembly adopted the Universal Declaration of Human Rights(UDHR) which provides that all human be<strong>in</strong>gs are equal, further re<strong>in</strong>forc<strong>in</strong>g the Declarationon the Rights of the Child. 1939 to 1945: Dur<strong>in</strong>g the 2 nd World War the scale of suffer<strong>in</strong>g by <strong>child</strong>ren and women washigher than dur<strong>in</strong>g the 1 st World War. After the war ended effort was made to ensure<strong>child</strong>ren were protected <strong>in</strong> a more susta<strong>in</strong>able manner. This led to formation oforganisations such as UNICEF and Plan International. 1959: The UN adopted the 2 nd Declaration on the Rights of the Child. 1966: The International Covenant on Civil and Political Rights (the Political Covenant) wasadopted by the UN, after long discussions amidst the polarization of the Cold War. Respect4The Declaration on the Rights of the Child stated that the <strong>child</strong> must be given the means to develop normally, both materially andspiritually; the <strong>child</strong> that is hung<strong>ry</strong> must be fed, the <strong>child</strong> that is sick must be helped, the <strong>child</strong> that is backward must be helped, thedel<strong>in</strong>quent <strong>child</strong> must be reclaimed, and the orphan and the waif must be sheltered and succoured; the <strong>child</strong> must be the first toreceive relief <strong>in</strong> times of distress; the <strong>child</strong> must be put <strong>in</strong> a position to earn a livelihood, and must be protected aga<strong>in</strong>st eve<strong>ry</strong> form ofexploitation; and the <strong>child</strong> must be brought up <strong>in</strong> the consciousness that its talents must be devoted to the service of its fellow men.5The League of Nations was to later become the United Nations.16
