mobilization of all stakeholders to participate; and collaboration with local and <strong>in</strong>ternationalagencies which work <strong>in</strong> HIV and AIDS control and prevention.4.6 Lessons LearnedCollaboration between the government and CSOs dur<strong>in</strong>g the enactment and subsequent review ofthe Children Act has resulted <strong>in</strong> a better law for <strong>child</strong>ren. In the <strong>in</strong>itial stages when the parties actedas competitors and antagonized each other the pass<strong>in</strong>g of the law was delayed for years to thedetriment of <strong>child</strong>ren. Lessons learnt with regard to enactment and implementation of the ChildrenAct and other laws relevant to <strong>child</strong>ren <strong>in</strong>clude: Participation by CSOs <strong>in</strong> law review has built their ownership <strong>in</strong> the process. CSO <strong>in</strong>put <strong>in</strong> draft<strong>in</strong>g of laws <strong>in</strong>clud<strong>in</strong>g development of Bills raises the probability of theissues lobbied for be<strong>in</strong>g enshr<strong>in</strong>ed <strong>in</strong> law. Lack of coord<strong>in</strong>ation among CSOs contributes to delay <strong>in</strong> enactment and review of laws asthey are not able to lobby effectively. Law mak<strong>in</strong>g <strong>in</strong> a charged political climate calls for <strong>in</strong>novative lobby<strong>in</strong>g and advocacy skillsby CSOs. Effective implementation of laws must be supported by national policies and programmes. Communities need to understand what makes practices retrogressive before they(communities) can become part of the solution. Media plays a big role <strong>in</strong> creat<strong>in</strong>g awareness about laws before, dur<strong>in</strong>g and afterenactment and can ensure stakeholders are <strong>in</strong>formed adequately.5. Child Rights <strong>in</strong> Constitution mak<strong>in</strong>gIntroductionThe current Constitution of <strong>Kenya</strong> was promulgated <strong>in</strong> August, 2010. It provides for a Bill of Rights,def<strong>in</strong>ed national values, citizenship, the rule of law, unity, devolution of power, equity and equality,<strong>in</strong>tegrity and the pr<strong>in</strong>ciples of people <strong>in</strong>volvement and effective participation. All these provisionshave either a direct or <strong>in</strong>direct effect on <strong>child</strong>ren. The Bill of Rights embraces social, economic andcultural <strong>rights</strong> of <strong>child</strong>ren, youth, persons with disability, marg<strong>in</strong>alized groups and older members ofsociety. The Constitution has also acknowledged the special needs of <strong>child</strong>ren; with Article 53articulat<strong>in</strong>g the <strong>rights</strong> of <strong>child</strong>ren which are also <strong>in</strong> l<strong>in</strong>e with the provisions of <strong>in</strong>ternational andregional <strong>in</strong>struments that <strong>Kenya</strong> has ratified <strong>in</strong>clud<strong>in</strong>g the UNCRC and the ACRWC. It is the firsttime that the Constitution <strong>in</strong> <strong>Kenya</strong> has provided for the <strong>rights</strong> of the <strong>child</strong>.The <strong>child</strong>ren sector was actively <strong>in</strong>volved <strong>in</strong> the process lead<strong>in</strong>g to the enactment of theConstitution of <strong>Kenya</strong>, 2010 through activities carried out by <strong>child</strong>ren and different civil societymembers.5.1 Background43
