The provision was <strong>in</strong>serted <strong>in</strong> the Children Actdue to <strong>in</strong>tense lobby<strong>in</strong>g by legislators to apparently shield men from exercis<strong>in</strong>g their rightful duty toprovide for their <strong>child</strong>ren.Children are further protected under the Bill of Rights <strong>in</strong> Article 21 (3) which makes it an obligationon all state organs and officers to “address the needs of vulnerable groups with<strong>in</strong> society, <strong>in</strong>clud<strong>in</strong>gwomen, older members of society, persons with disabilities, <strong>child</strong>ren, youth, members of m<strong>in</strong>ority ormarg<strong>in</strong>alized communities, and members of particular ethnic, religious or cultural communities”.Challenges When the constitutional review process commenced most organisations <strong>in</strong> the <strong>child</strong>rensector lacked adequate awareness on constitutional issues to effectively engage <strong>in</strong> anotherwise political process. The <strong>child</strong>ren sector has not lobbied adequately to have a representative <strong>in</strong> any of theconstituted Constitutional Commissions. The sector has not had any structured civic education target<strong>in</strong>g organisations <strong>in</strong> the sectorunlike other sectors.5.4 Lessons learned Constitution mak<strong>in</strong>g is a process that requires all sectors of society, <strong>in</strong>clud<strong>in</strong>g the <strong>child</strong>rensector to participate strategically to ensure that their <strong>in</strong>terests are catered for. The formation of the Children Caucus for Constitutional Reform was timely as it promotedmean<strong>in</strong>gful <strong>child</strong> participation <strong>in</strong> the Constitution mak<strong>in</strong>g process. Strategic lobby<strong>in</strong>g and synergy from members of the NGO Child Rights Committeeensured that the sector was represented <strong>in</strong> the Reference Group. Information, Education and Communication materials on <strong>child</strong> <strong>rights</strong> and the Constitutiondeveloped by the Children Caucus for Constitutional Reform and the <strong>Kenya</strong> NationalCommission on Human Rights were an important lobby<strong>in</strong>g tool as they were <strong>in</strong> simplelanguage and therefore easily understood by <strong>child</strong>ren.6. Child Participation <strong>in</strong> <strong>Kenya</strong>IntroductionThe process of <strong>child</strong> participation has been described as one of <strong>child</strong> development that provides anopportunity for <strong>child</strong>ren to be <strong>in</strong>volved <strong>in</strong> decision mak<strong>in</strong>g on matters that affect their lives and toexpress their views <strong>in</strong> accordance with their evolv<strong>in</strong>g capacities. It recognizes that <strong>child</strong>ren are nota passive, powerless target group, but rather capable communicators, who can effectively engage<strong>in</strong> activities with<strong>in</strong> their communities. 57 The right of all <strong>child</strong>ren to be heard and taken seriouslyconstitutes one of the fundamental values of the ACRWC and the UNCRC, and the degree andmodality of participation varies <strong>in</strong> accordance with a <strong>child</strong>’s age and capacity.
