3.1.3.4 Key issues from the Conclud<strong>in</strong>g ObservationsConclud<strong>in</strong>g Observations from the UN Committee on the Rights of the Child are based on the eightthematic clusters and are aimed at ensur<strong>in</strong>g adequate follow up and dissem<strong>in</strong>ation of State Partyreports. The follow<strong>in</strong>g are highlights of the Conclud<strong>in</strong>g Observations from the 2 nd UNCRC <strong>Kenya</strong>State Party report: 25- General Measures of Implementation: corporal punishment and <strong>child</strong> labour; the delay<strong>in</strong> hav<strong>in</strong>g a National Plan of Action and sett<strong>in</strong>g up the office of an Ombudsman for <strong>child</strong>ren.- Def<strong>in</strong>ition of a <strong>child</strong>: lack of a legal m<strong>in</strong>imum age of marriage.- General Pr<strong>in</strong>ciples: cont<strong>in</strong>ued discrim<strong>in</strong>ation of girls, m<strong>in</strong>orities, refugee <strong>child</strong>ren and<strong>child</strong>ren of asylum seekers.- Civil <strong>rights</strong> and freedoms: low levels of birth registration.- Family Environment and Alternative Care: support for needy families still low; risk of<strong>child</strong> traffick<strong>in</strong>g as a result of irregular <strong>in</strong>ter count<strong>ry</strong> adoption processes; and lack ofadequate mechanisms to address cases of <strong>child</strong> abuse.- Basic Health and Welfare: <strong>in</strong>adequate services for <strong>child</strong>ren with disabilities, adolescentsand <strong>child</strong>ren aged under 5 years; <strong>in</strong>crease <strong>in</strong> numbers of AIDS orphans and <strong>child</strong> headedhouseholds; cont<strong>in</strong>ued wide practice of female genital mutilation; and high numbers of<strong>child</strong>ren affected by poverty.- Education, Leisure and Cultural Activities: low levels of enrolment of <strong>child</strong>ren <strong>in</strong> early<strong>child</strong>hood development centers and seconda<strong>ry</strong> schools; and the stra<strong>in</strong> on different sectorsas a result of the free prima<strong>ry</strong> school education.- Special Protection Measures: lack of disaggregated <strong>in</strong>formation on refugee, displacedand asylum seek<strong>in</strong>g <strong>child</strong>ren; ris<strong>in</strong>g numbers of <strong>in</strong>ternally trafficked <strong>child</strong>ren and those onthe streets; <strong>child</strong>ren engag<strong>in</strong>g <strong>in</strong> sex tourism; a justice system that does not function aseffectively as it should; high numbers of <strong>child</strong>ren <strong>in</strong> harmful work due to high poverty levels;lack of domestic regulations to address the issue; limited access to basic health andsanitation and education for <strong>child</strong>ren of m<strong>in</strong>orities, <strong>in</strong>digenous groups and absolute poor;and the effects of HIV and AIDS on <strong>child</strong>ren and families.3.1.4 Key milestones <strong>in</strong> the 3 rd , 4 th and 5 th State Party Report<strong>in</strong>gProcess<strong>Kenya</strong> is scheduled to submit a comb<strong>in</strong>ed 3 rd , 4 th and 5 th UNCRC State Party report by September,2012. The three reports were comb<strong>in</strong>ed at the request of the UN Committee on the Rights of theChild which cited a huge backlog of State Party reports from different countries which were due forreview. The report<strong>in</strong>g process for the comb<strong>in</strong>ed report started <strong>in</strong> 2009 with the sett<strong>in</strong>g up of aNational Steer<strong>in</strong>g Committee under the auspices of the NCCS.
