ORDINARY MEETING OF COUNCIL 19 CITY OF VINCENT<strong>26</strong> JULY <strong>2011</strong> MINUTESGiven the proposed hours <strong>of</strong> operation, after 4pm on Monday to Sunday, for the small barelement <strong>of</strong> the site, the most pressure on the car parking within the vicinity would beweekdays between 12 noon and 5pm. It is noted that after 5pm, the majority <strong>of</strong> businessesalong Oxford Street would be closing for the day. It is considered that the proposed Small Barwould be able to utilise the greater proportion <strong>of</strong> the on-street and public car parking baysavailable after this time for clientele.The <strong>City</strong>'s Policy relating to Parking and Access suggests that the Council may determine toaccept a cash-in-lieu payment where the shortfall is greater than 0.5 car bays, to provideand/or upgrade parking in other car parking areas. The policy stipulates that:“Cash-in-lieu provisions are only to be permitted in localities where the <strong>City</strong> already provides<strong>of</strong>f-street public car parking which has spare capacity, or the <strong>City</strong> is proposing to provide or isable to provide a public car park (including enhanced or additional on-street car parkingwhere appropriate) in the near future, within 400 metres <strong>of</strong> the subject development;’Whilst taking this provision <strong>of</strong> the Policy into account, the premises are located within50 metres <strong>of</strong> the Oxford Street Car Park located to the south <strong>of</strong> the subject site, with accessvia a laneway. The Oxford Street Car Park includes thirty-two (32) free car parking bays. Inaddition, to the north west <strong>of</strong> the site within 400 metres, <strong>of</strong>f Scarborough Beach Road, is theFlinders Street Car Park which also provides thirty (30) car parking bays. It is noted that whilstthe small bar entrance is from Oxford Street, the six (6) car parking bays provided on-site areaccessed via the rear <strong>of</strong> the site and, therefore, do not visually detract from the publicenvironment or character <strong>of</strong> the area.Clause 22 (ii) <strong>of</strong> the <strong>City</strong>’s Parking and Access Policy, states that in determining whether thisdevelopment should be refused on car parking grounds, the following percentage should beused as a guide:“If the total requirement (after adjustment factors have been taken into account) is11- 40 bays, a minimum <strong>of</strong> 15 per cent <strong>of</strong> the required bays is to be provided.”If a shortfall in car parking were to be supported, cash-in-lieu payment would be required. Thecash-in-lieu payment required would be $3,100 per bay based on the <strong>2011</strong>/12 fees; $9,858 inthis instance.In light <strong>of</strong> the above, the proposal satisfies the Parking and Access Policy for cash-in-lieu, andit is not considered that the small bar’s scale and nature will have an undue impact on theamenity <strong>of</strong> the area.Accordingly, it is recommended that the application be approved as per the OfficerRecommendation.MINUTES OF MEETING HELD ON <strong>26</strong> JULY <strong>2011</strong> TO BE CONFIRMED ON 9 AUGUST <strong>2011</strong>
