推 動 體 系 Promotional System◎ 政 府 部 門 Government Agencies消 費 者 保 護 工 作 , 在 我 國 行 政 部 門 是 中 央 與 地 方 政 府 共 同 推 動 的 事 務 。 中 央 政 府 , 除 行 政 院消 費 者 保 護 處 ( 以 下 簡 稱 本 處 ) 負 責 綜 理 全 國 消 費 者 保 護 推 動 事 務 外 , 並 由 中 央 主 管 部 會 分 別 就其 所 掌 事 務 推 動 相 關 消 費 者 保 護 業 務 之 法 令 與 政 策 ; 至 地 方 政 府 , 則 負 責 執 行 。 透 過 本 處 的 監 督與 協 調 , 建 立 我 國 行 政 部 門 消 費 者 保 護 業 務 之 水 平 整 合 、 制 定 消 費 者 保 護 政 策 及 計 畫 ; 並 透 過 定期 對 中 央 及 地 方 主 管 機 關 推 動 消 費 者 保 護 業 務 的 績 效 考 核 , 檢 討 及 策 定 改 進 作 為 。The task of consumer protection in Taiwan is an affair carried out jointly by agenciesat both the central and local government levels. At the central government level, inaddition to the Department of Consumer Protection (DCP) responsible for conductingthe enhancement of consumer protection duties nationwide, Ministries of the centralgovernment, in their respective areas of governance, make relevant laws and policies tocarry out consumer protection works. As for the local governments, they are responsiblefor implementing. Through the supervision and coordination, DCP establishes horizontalintegration of various administrative agencies responsible for consumer protectionworks, and enacts consumer protection policies and plans. Besides, through the regularperformance evaluation of consumer protection works done by agencies of the centraland local governments, DCP could review and decide improvement actions.◎ 消 費 者 保 護 團 體 Consumer Protection Groups消 費 者 保 護 之 推 動 , 除 政 府 部 門 外 , 民 間 消 費 者 保 護 團 體 的 功 能 亦 不 容 忽 視 。 政 府 部 門 每 年將 依 法 設 立 登 記 之 消 費 者 保 護 團 體 之 相 關 資 料 彙 整 公 告 , 並 對 消 費 者 保 護 團 體 給 予 獎 勵 與 補 助 ,以 扶 植 其 成 長 。 同 時 , 也 透 過 定 期 舉 辦 聯 繫 會 報 進 行 意 見 溝 通 , 並 聽 取 消 費 者 保 護 團 體 對 消 費 者保 護 法 規 或 行 政 措 施 的 建 言 。◎ 本 處 消 費 者 中 心 、 地 方 政 府 消 費 者 服 務 中 心 及 消 費 爭 議 調 解 委 員 會Consumer Center of DCP, Consumer Service Centers of Local Governments, andConsumer Dispute Mediation Committees為 推 行 消 費 者 教 育 、 辦 理 消 費 者 諮 詢 服 務 及 協 助 處 理 消 費 爭 議案 件 , 各 直 轄 市 、 縣 ( 市 ) 政 府 依 法 均 設 有 消 費 者 服 務 中 心 及 消 費爭 議 調 解 委 員 會 。 本 處 亦 設 有 消 費 者 中 心 辦 理 消 費 者 諮 詢 服 務 及 協助 消 費 爭 議 之 受 理 。To carry out the work of consumer education, provideconsumers counseling services, and assist in dealing consumerdisputes, every municipality and county/city government allsets up Consumer Service Centers and Consumer DisputeMediation Committees in conformity with the laws. DCP alsosets up a Consumer Center which offers counseling services toconsumers and to assist in dealing consumer disputes.規 範 體 系 Regulatory Scheme為 了 保 障 消 費 者 權 益 , 提 升 消 費 生 活 品 質 , 我 國 於 1994 年 1 月11 日 公 布 施 行 消 費 者 保 護 法 , 也 代 表 我 國 在 推 動 消 費 者 保 護 工 作上 , 邁 入 一 個 新 的 里 程 碑 。 該 法 為 消 費 者 保 護 之 基 本 法 , 其 他 與 消費 者 保 護 有 關 之 中 央 法 規 包 括 : 商 品 檢 驗 法 、 商 品 標 示 法 、 食 品 衛生 管 理 法 、 藥 事 法 等 , 分 別 由 各 中 央 目 的 事 業 主 管 機 關 主 管 及 執法 。 另 , 地 方 政 府 亦 可 自 行 訂 定 與 消 費 者 保 護 有 關 之 自 治 法 規 。Aside from government agencies, the functions of nongovernmentalconsumer protection groups cannot be neglected.Every year the government collects and announces informationabout the consumer protection groups that have been set up andregistered in conformity with the laws, and offers these groups rewardsand subsidies to help them develop. Meanwhile, the governmentholds regular meetings with them to communicate, and listens totheir recommendations for consumer protection regulations oradministrative measures.On January 11, 1994, the Consumer Protection Law was promulgated in orderto protect consumer interests and to improve the quality of consumer life. It alsorepresents that Taiwan enters into a new milestone on making efforts to promoteconsumer protection work. The Consumer Protection Law is the basic law of consumerprotection. The other laws and regulations related to consumer protection includeCommodity Inspection Act, Commodity Labeling Law, Act Governing Food Sanitation,Pharmaceutical Affairs Act, etc. They are administered and enforced by the authoritiesof the central government respectively. Furthermore, the local governments could alsoenact municipal laws and regulations relevant to consumer protection.◎ 消 費 者 保 護 官 Consumer Ombudsmen為 處 理 消 費 爭 議 及 行 使 行 政 監 督 , 以 維 護 商 品 及 服 務 的 安 全 與 交 易 公 平 , 本 處 及 各 地 方 政 府均 設 置 有 消 費 者 保 護 官 。6In order to cope with consumerdisputes and exercise administrativesupervision to maintain the safety ofgoods and services and fair trade,DCP and each local government allhave consumer ombudsmen.7
