Get the Best Out of FIM2015
If you are thinking of starting your own franchise, that is a great decision. Where is the best
place to start looking for that franchise? Where else but at FIM2015.
A franchise expo is a great way to learn about different franchises and speak to the different
franchisors in person. Since they are all in one place it is easier to compare the different
franchises available to you. However you must be on guard when you attend a franchise expo.
You see, often franchise expos and business opportunity shows are filled with fast talking
sales people. It’s nice to go in to see what’s available, but you need to take it all with a
grain of salt. As with any other business, be wary of frauds going on with many of the verbal
promises the salesman on franchise expos make (although we’re sure MFA would have
screen the exhibitors). An alert person can fairly easily weed out the smooth talkers, and the
commission based salesman, from the legitimate franchisors which are really looking for high
quality future franchise owners.
However, even with all the ‘dangers’, it’s still worth taking a trip to a franchise expo, spending
the day, collecting business cards, brochures, and doing a little research on some of the
companies because it’s hard to know what is, and what isn’t a good investment merely by
walking about an expo listening to sales pitch.
Having warned you, we also want to reiterate that there are many legitimate franchisors of
reputable companies who are interested to have you in their stable of successful franchisees.
And the FIM2015 could be the big break that you’ve been looking for.
To your franchising success,
Franchise Viewpoint
Too Pedantic with the “P”?
Brands play a key role in franchising your business - it is the face of the entire franchise. Choosing a
unique brand is therefore essential. The more the brands stands out as distinctive, one in a billion and
exceptional, the better. The main reason for this is that the public will view it as a brand and not a
generic word or phrase to describe the goods and services it represents.
By Geetha K.
That is mostly like the reason why Pirelli chose to elongate the
first letter in their brand
– to make their brand unique.
That they tried to prevent another party from using the unique
elongated P is understandable.
was the other brand and the dispute arose in Singapore.
Were the marks substantially similar? Is the letter “P” the
dominant part in both marks? Are they so dominant that the
other elements in the mark are negligible? Are the marks
visually, aurally and conceptually similar? These were some
of the questions the Intellectual Property Office of Singapore
(“IPOS”) had to contend with when faced with an opposition
by Pirelli & C.S.P.A (“Opponent”) against Tao, Hsiu-Chih
(“Applicant”).
The Applicant owns CSL Sunmaster Enterprises Co., Ltd
(“Sunmaster”), a Taiwanese company that designs and supplies
curtains, blinds, sunshades and parts thereof. The Applicant
claimed that she coined her trademark from her English name,
“Tao, Sheena”. The Applicant has registered her mark in Class
20 (Bamboo curtains; indoor blinds of reed, rattan or bamboo
(sudare); curtain hooks and related products) and Class 24
(Woven fabrics and knitted fabrics; non-woven textile fabrics;
curtains of textile or plastic; shower curtains; curtains and such)
in the European Union and Australia.
The Opponents, founded in 1872, initially started out with a
factory producing rubber articles and eventually diversified
into many industries (which are not related to the Applicant’s
industry). The Opponents have 19 tyre industrial plants in four
continents, are the fifth largest operator in the world in the
premium tyre sector, and were the exclusive tyre supplier for
Formula 1 from 2011 to 2013. In addition to the “PIRELLI”
trademark above, the Opponents relied on the following
trademarks filed in Singapore to support their opposition:
Although the opposition failed (sadly for the Opponents), the
decision by the Hearing Officer from IPOS was interesting for
many reasons.
6 Franchise Asia • 2015 Vol 27
Franchise Viewpoint
Obviously, the Opponents’ point of contention was in relation
to the use of the Elongated P by the Applicant in its mark. The
Opponents submitted that the Elongated P is the dominant
component of the Opponents’ Marks and this brought similarity
between the Opponents’ Marks and the Applicant’s mark,
causing a likelihood of confusion in the public, and argued that
the use of the mark by the Applicant is an act of passing off.
Interestingly, the Opponents decided to initiate this opposition
in Singapore although it had failed in two jurisdictions in the
past. The adage “once bitten, twice shy” certainly did not apply
here! In fact, that the Opponents lost the opposition in EU and
Australia was advantageous to the Applicant here as excerpts
from the decisions in EU and Australia were used in this case.
According to the Applicant, the question to ask is whether the
common element of the competing marks is so dominant as
to render the different elements ineffective in eliminating the
similarity between the marks.
While answering in the negative, the Applicant provided that the
hearing officer in Australia opined that, inter alia, “the overall
impression of the trade marks is one of dissimilarity rather than
resemblance” and that the Elongated P was not the portion
of the trade mark “which will so overwhelm a person’s mind
that they will not remember the word “Project” or “Pirelli” and
confuse these two trademarks.”
A similar decision was delivered in EU, where the marks were
held to be visually similar to a very low degree and were not
phonetically, or conceptually similar.
The Hearing Officer in IPOS concurred with the Australian and
EU hearing officers and found that the marks in dispute (shown
below) are not visually, aurally and conceptually similar:
Opponents’ Marks
Application Mark
the decision in Matratzen 2 whereby the European Court of First
Instance dismissed the contention that a consideration of the
dominant and distinctive components of a mark would mean a
failure to consider the mark as a whole.
Aurally and conceptually, the marks were found different. As for
visually, the Hearing Officer held that, in verbatim, “the marks are
visually similar in that they have one component, the Elongated
P, in common. However, this is not sufficient to make an overall
finding of visual similarity as the Application Mark contains other
components that are not of negligible significance”.
The Opponents’ argument for passing off failed as well as the
Opponents did not have sufficient evidence to prove they had
goodwill in Singapore at the relevant time.
Tapering to an end here, the business nuggets a franchise owner
could walk away with from this case are as follows:
1. When creating a brand for your franchise business, use
elements that is not common (letters are found to be
common); and
2. Understand that decisions and arguments used in other
jurisdictions (where the decisions are comprehensive and
well-thought out) will be used to the Applicant’s advantage.
1.
Sabel BV v. Puma AG (Case C-251/95), 1998 R.P.C. 199, 1998
E.T.M.R. 1 (1997)
2.
Matratzen Concord GmBH v OHIM, Case T-6/01 [2002] ECR II-4335
The known “overall assessment test” was relied upon
whereby “visual, aural or conceptual similarity of the marks in
question, must be based on the overall impression given by
the marks, bearing in mind, in particular, their distinctive and
dominant components”. 1
With regard to the part of considering the “distinctive and
dominant components” of the mark, the Hearing Officer relied on
Franchises You
Probably Don’t
Know About
It’s 1948, you’re in Baldwin, CA and you’re hungry. A friend suggests going to the In-N-Out
drive through burger shack for fast drive-up service. You simply drive up to the window
and get your food with very little or no delay. Such things were probably looked upon as
crazy ideas destined to fail at the time, but now drive-thrus are everywhere. Banks have
been using them since the 1920s. You have to wonder what kind of ideas, we view as crazy
or short-termed now, will be a big deal in 10, 20 or 50 years from now. Let’s look at some
unique franchise opportunities that may seem a bit off the wall.
Special
A Lice-squad
House-Call
The Canadian
franchise Lice Squad
makes housecalls.
Based in
Cookstown, Ontario,
the franchise
uses a device
that dehydrates
nits. Someone suffering from lice can visit a clinic for
treatment or they’ll come to your home to help rid you of
lice. The process is chemical free.
A Fishy Situation
Amelia Island, Florida based Captain Mac Danial offers
a flounder gigging franchise. You read that right. Using
aluminum boats, headlamps and a trident or multipronged
spear, clients are treated to a boat ride into
shallow saltwater mashes and inlets to skewer flounder
lying on the bottom of the marsh or inlet. It’s probably a
great experience and you get fresh fish to boot.
You Will Wake Up and Be A Chicken
There are few opportunities in the franchise world to
take a nap on location. You can, but you will probably
get evicted. Dublin, OH based Positive Change Hypnosis
is the opposite. At their locations they use a six-point
hypnosis method to help clients improve their life. It may
be kicking a bad habit or as simple as correcting your
short game at the golf course. Either way, they want you
to go to sleep and help you do it.
For Those About to Rock … We’re Not
AC/DC
Everyone, except maybe grandma, loves a music festival.
Most of us have been to one at some point and it’s likely,
if we can remember it, we had a great time. Putting
together your own music festival is no easy task and most
people would avoid the trials if they thought about it long
enough. However, if you are in the UK there’s a franchise
for music festival planning.
Fake Festivals help you set
up a local music festival
complete with a stage, food
vendors and a play area
for children. Tribute bands,
rather than the actual
superstars, will come to put
on shows and organisers
keep all the profit.
Elite K9 Goose Patrol
David Marcks of Howell, NJ offers a unique franchise
involving dogs and geese. Geese Police employs trained
dogs to run geese off the golf course, out of the park
and away from your business. The well-trained dogs are
brought to the location several times until the geese
surrender and stop coming back.
A Naked Proposition
Robert Burck, dubbed the naked cowboy by either
himself or people that have seen him in New York’s
Times Square, has a franchise opportunity for you. It’s a
franchise opportunity that leads to standing in a public
place in your underwear, a cowboy hat and boots while
playing a guitar. The guitar aids in the naked illusion. It
may sound far-fetched, but over a dozen people from
Nashville, TN to Los Angeles, CA to Paris, France have
signed up. The cowboys are also available for photo
opportunities and to officiate weddings.
Should You Sell Franchises
Or Build A Chain?
How to decide which expansion
plan is right for you
By Mark C. Siebert
The owner of an actively growing business may be contemplating
on whether to franchise it or build it up to a giant business. When
making decision on whether to franchise your business or to
expand your business yourself, you need to consider if it favors
you or not. You need to determine if the business will thrive well
in your care or go worse. There are three groups of talents when
it comes to expanding a business:
• The first are those who are talented in growing a business
to a certain level. Beyond this level, they might be declared
bankrupt. In few years, this set of people can easily develop
their business up to the level that they are matured to be
franchised, but they can’t go beyond that.
• The second sets of talents are not creative enough to start up
a business from the scratch but they can handle bigger ones.
They are the “big players” in the business. I called them big
players because they have the money to buy franchises.
• The last are those that have all it takes to build a business
from scratch to big business, and even take it public. These
set of people are usually those who are in love with their
products or services and have all it takes to build it to a very
large business. Apart from the profit they generate from the
business, they have sound knowledge about their business
Special
Notwithstanding, the above are also
factors to consider when deciding on
whether to franchise a business or expand
it yourself. Of course, there are other
factors that you need to consider when
it comes to franchising or expanding a
business yourself.
The Advantages of
Franchising
There are many advantages attached
to franchising over a company-owned
expansion. Many business owners resort
to franchising for four main reasons which
include:
• Capital: Expanding a business
requires large capital. A business that
is being operated with low capital will
certainly take far more years to develop
than the one that is funded with huge
capital. The advantage is that the
franchisor watches the business as it
grow without spending any part of his
money.
• Motivated management: It’s a
common truth that a business that
is managed by motivated staff will
surely do well. The franchisees will do
everything necessary to see that the
business expands. They see to the
welfare of their staff. They also train
their staff to become professionals in
their jobs. The staff are trained to work
towards the goals of the business.
While the franchisee works eminently
to expand the business, you are
relaxed and yet, still get compensated.
• Speed of growth: The franchisee
invests huge capital into the
business. A business filled with
motivated staff and funded with huge
capital is expected to do well. This
makes the business to expand rapidly
if properly managed.
• Reduced risk: Since the business is
franchised, most of the risk goes to the
franchisee. The most interesting part
here is that, despite not spending any
of your capital in the business, you are
still compensated. You grow by using
other people’s money and at the same
time, you are operating without risks.
Debunking the Myths
There are some wide held beliefs about
franchising which are far from the truth.
One of them is that, franchising is a
system of dealing with franchisors legally.
The reason for this belief is that America
is a litigious society in which someone can
sue anybody just for anything.
Franchising is actually less prone to
litigation. The reason is that a franchise
contracts is a one-sided document. You
can be protected if it is being handled by a
professional attorney that specializes in law.
Many litigation practices such as cases
involving the proper use of advertising
funds and that of territorial encroachment
have been bypassed. There are now much
fewer lawsuits than they were in the past
couple of decades.
The major issues that often lead to lawsuit
are actually violations of franchise law
and fraud in the document of selling a
franchise. In order to prevent the former
from happening, it’s important that you
hire a professional franchise attorney
and train all your staff on franchise law.
Make sure that each and every one of
your staff is honest with the company.
Use a written checklist or better still,
video tape to interview every franchisee
concerning his or her sales process and
the representation made.
Franchising is a great tool that helps you to
avoid liabilities. However, as a franchisor,
each time any contract is signed by you,
you are obligated to operate according to
the terms of that document.
Let’s consider the company-owned
operations.
If you are the operating the company
yourself, you will be responsible for
everything. You will have the liability
for every lease you execute – ranging
from equipment, vehicles, buildings.
The liability also extends to all wrong
operations in the business as well as
customers and employees liabilities such
as breach of contract, sexual harassment,
personal injuries and so many others.
However, in franchising, these liabilities
are solely that of the franchisee.
Nevertheless, this doesn’t mean that
you cannot be sued. But with a good
written contract, the liability will be that
of the franchisee. In addition, you are
also insured by the franchisee against
any damage, harm and wrong operations
resulting from the business.
Franchise Asia • 2015 Vol 27
11
Special
The second big myth in franchising is
the control and the improved unit-level
performance that some argue comes with
it. Another belief is that, the ability to hire
and fire an employee at any given time is
a big advantage, where as with company
operations, it’s difficult to do this.
However, franchisors have a great deal of
control in unit operations.
Studies have shown that similar franchiseoperated
sites are better managed than
their company-owned counterparts. As
a result of this, the franchised-operated
sites outperform the company-operated
sites in almost every aspect.
Reasons
There are two reasons for this. First is
that, franchisees are highly motivated by
their money and take pride of ownership.
Secondly, franchisees usually stay put
in their business for generation. They
pass their business to members of their
families. They develop an easy-to-follow
system that can be easily understood and
followed by anyone. They then, make sure
that the system is thoroughly followed
by their staff. This easy-to-follow system
prevents them from spending money
unnecessarily in training their staff from
time to time.
However, if a franchisee is not performing
up to your expectation or standard, you
have the right to terminate the contract.
But if the franchisee is operating to
the standard of the contract, there is
absolutely no reason why you should
consider terminating the contract.
Choosing a franchisee has always
been a big problem. When choosing a
franchisee, it’s important to assess the
franchisee critically before making any
decision. In order to prevent any lawsuit
against any franchisee, it’s advisable to
choose the right franchisee.
Risk attached to franchising
Just like company-owned operation,
franchising has its own limitation. There
are some benefits that you will no longer
be entitled to.
As a franchisor, you will no longer be
entitled to all your profits. You will only
receive royalty which is a percentage of
gross revenue. Instead of being entitled
to 100% of your revenue as the business
owner, you will only be limited to only about
4 to 10% and probably some product sales,
rebates and advertising fees.
In the same vein, if the operating units
generates only about 20% profit and your
royalty is just 6 percent, you will need to
sell about four to five franchises or even
more to achieve the same level of profit
a company would have fetched you if you
owned the company. This means that
if you have enough capital to run your
business yourself, you would be entitled
to 100 percent of the profit. However, your
ROI would be higher through franchising.
Although franchisors are also highly
compensated with growth in revenue, it
is important that the franchisor possess
certain leadership style which are better
suited to franchising. As stated earlier,
it is not all business owners that have
the quality of taking a business public. If
you find out that you are better off with
developing business to a certain level
after which you cannot handle it anymore,
it’s better to put it in the hand of a right
person – the franchisee.
Should You Do Both?
Lastly, for the company trying to choose
a growth strategy, it is important to
recognize that it does not have to be a
tradeoff between building assets and
speed of growth. Most franchisors use both
company-owned strategy and franchised
strategy to run their businesses.
They choose to operate the best location
while they franchise secondary and
tertiary markets. This means that they
operate their businesses in units where
they make more profits while they sell
off less profitable units. However, others
may choose to treat company growth
and franchise growth equally. This
means taking advantage of any positive
conditions that promotes progress of any
of them.
Combining the franchise and companyowned
growth, is the best for most
companies. Even if the best strategy is
used in either of these two, it still does not
contribute to the success of the business
as combining the two would.
15 STEPS TO STARTING
A SUCCESSFUL
FRANCHISE SYSTEM
By Peter Buckingham
In my work in Franchising, I am surprised by how many
businesses decide to head into a Franchising model with no
plan on how to get there. I see businesses that have tried to do
it themselves, engaged a lawyer as a Consultant, or just tried a
shot gun approach and fired shots at where they see a problem.
My advice to any future Franchisor is to think in terms of the 15
steps to Franchising, from when they cannot spell Franchising,
until they appoint their first Franchisee - and decide how they are
going to make it all happen.
Whilst I am a Certified Management Consultant, we do not
undertake the work as Franchise Consultants; however there are
people in this area that can act as the specialist. Think of it like
an orchestra and their job is to be the Conductor, and bring in
(and out) the various instruments as and when required. In our
case I say we are the first violin – needed for Strategic Network
Planning, Site Selection policies and Territory Planning – and
then we pass our work back to the Conductor and Client to move
to the next steps.
14 Franchise Asia • 2015 Vol 27
International Focus
The Fifteen Steps to Franchising:
1Undertake a feasibility study (or just your own due diligence
to prove the concept you have can work). I become very
concerned when I hear from potential Franchisors that they
have not opened or company run the business they are planning
to Franchise – and I even have said to major international
companies intending to open in Australia, why not open a couple
of stores yourselves to prove that it works. Unfortunately many
American Franchisors say that is up to the Master Franchisor –
and do I know anyone with $5M to invest? Most of those are still
kicking tyres looking for their dream investor.
5Site selection policy – decide what type of stores you are
seeking in terms of size, where they sit in terms of Impulse
or Destination, and how you can instruct other people in
what you are looking for. Issues need to be considered include
size, traffic (vehicle or pedestrian), visibility, parking, access,
local generators (or neighbours) and many other issues.
6If you are a service franchise, you probably need to
grant territories especially if you have a central ordering
concept where leads come in by phone or computer.
What is the policy for Territories in terms of what makes up a
sufficient size territory and how many should we be looking for in
each main market? You may start with a “beer and pizza map”,
however this develops an inconsistent Franchise System.
2Understand that the costs to develop a workable
franchise system is probably $50K - $100K, and
thinking you will do it cheaper is a false economy. I am
often asked to postpone payment for my companies’ service,
and I remind the client that we are Consultants and that Banks
are Banks – and go and speak to them if you plan to make an
investment into Franchising.
7Sort out your marketing and make the necessary
decisions on who is your potential customer and how
are we going to find them? If it is a walk up customer,
then image and signs. If it is a phone in customer or web based
customer, how do we attract them, inform them and entice
them to make the call to purchase form us? Do we advertise
in magazines, websites, bus shelters or many many other
opportunities that will be thrown at you?
3Arrange the writing
of your Operations
Manuals. Your choice if
you do it yourself or work with
a Professional company who
will have templates and ways
to construct these manuals.
Ideally they may start as paper
manual, however the modern
companies are setting this up
in a digital environment – thru
the web.
4Strategic Network Planning is thinking in terms of what
the network may look like in 5 or 10 years. It is about what
type of areas you should be physically looking for sites
in. This investment may save you huge amounts in mistakes, as
there is no cheap reversal in leaving or closing a store – and less
if you lose a legal case if the store you approved turns out to be a
disaster – and you have no process you can demonstrate in how
you made the decision.
8Find your first few stores. This can be undertaken
internally, or you may want to appoint a professional
site finding company who are expert in negotiating with
Leasing agents and Real Estate agents.
Franchise Asia • 2015 Vol 27
International Focus
Franchisee now needs to undergo training in
the Franchise System. This probably needs to be
13Our
done internally, partly by our leaders and hopefully we
have some form of company operation that they can train within
to learn the ropes of the business into which we are about to
appoint them.
the opening. We need many things to come
together at the same time to open successfully. This
14Plan
can include stock, equipment, staff, vehicles and
some Local Area Marketing.
9Appoint a Law firm to write your disclosure Agreements
and Franchise Agreements. This may involve some major
decisions as the Agreements need to line up with what
you are offering a Franchisee. Decisions have to be made such
as Franchise periods and options to renew, territories or not,
exclusive or non-exclusive territories, exclusion zones and many
other issues that will govern how you operate in the future.
future franchisees. This is crucial to the future
of the business so how will this be done? Review the
10Attract
options and decide how much involvement you want
in the process of acquiring leads and selecting franchise buyers.
You can manage everything yourself, engage help along the
way with lead generation or appoint a specialist who will qualify
future franchisees on your behalf. Decide on a process to approve
franchisees. How will franchise buyers be profiled and interviewed?
our new Franchise, and support the Franchisee
who is probably taking the biggest business decision
15Open
in their lives. They may need their hand held and that
is what our Field staff and operations people need to do – even
if that is one person also holding the title of Franchisor, MD,
Development Manager and Chief Operations officer.
I can only say to a future Franchisor look at these steps and
see if you have them covered. If you are looking at going into a
newly formed Franchise System, maybe this list can form part
of the questions you need to discuss with the Franchisor to feel
comfortable that all these items are covered – before you part
with your initial Franchisee Fee.
we now have an approved Franchisee, we
need to match the Franchisee with the potential site,
11Assuming
hoping the timing is right that the Franchisee is willing
to take on the location that has been put forward, and we are
approving as suitable for our System.
store fitout now needs to occur and it is in our
interest to ensure this is done to our standards. Do
12The
we appoint a fit out company, or allow the Franchisee
to organise the store fit out themselves? Either way we need
controls so it meets our corporate standards, which hopefully are
well documented in our Operations Manuals – step 3.
Choosing the Right
Franchise Format
By Dr. Benjamin C. Litalien, CFE
The Foundations of Franchising
A shopkeeper serving customers provided the catalyst for the
historical roots of franchising. The realization that the only way
to serve more customers was by expanding, coupled with limited
capital to sustain rapid growth, led the pioneers of the franchise
model to lay a solid foundation. Much of the early development
of the franchise model was in the foodservice sector, with such
iconic brands as A & W, Kentucky Fried Chicken and Dairy Queen
leading the way. There was significant growth in the hospitality
sector with Howard Johnson, Holiday Inn and Marriott using
franchising to efficiently penetrate global markets and extend
their brands. In all these examples the common element was the
requirement for a physical premises to operate from, and many
times with particular and distinguishing appearances such as the
golden arches.
The focus of the franchise was building an attraction for customer
to visit through unique architectural themes, convenient and
prominent locations and compelling signage. And, of course a set
of operating procedures that would support a quality customer
experience once the customer arrived at the franchise location.
Franchise Asia • 2015 Vol 27
17
International Focus
While the foundations of franchising revolved around the
location, the landscape has changed dramatically over the past
two decades, opening the door to many more business concepts
and potential franchisees.
The Complexities of Fixed-Location
Franchises
Most individuals looking at a franchise to be operated from a
dedicated location do not have experience in site selection,
therefore they must rely on the franchisor for significant support.
However, the level and intensity of support can vary widely from
one franchisor to the next. Some franchisors take a “hands off”
approach and only offer candidates a modicum of information
from which to determine a location for the franchised business.
The information may be based on the physical parameters of
the concept, such as square footage, ceiling height and signage
requirements. Yet, the factors that will ultimately determine the
success of the location will have more to do with the density of
likely customers.
this information it will be difficult to determine a sale projection.
The other key complexity of a fixed-location franchise is obtaining
the space, whether through a lease or purchase. Again, many
potential franchisees have little or no experience with such
transactions, which can be very complicated. If the franchisor has
a reasonable number of existing locations then they should have
some level of support to assist new franchisees in negotiating
the key tenants of a lease or purchase. Certainly, the use of
independent outside legal and financial advisors is essential to
ensure all the risks are clearly understood. Finally, even if you
get the location and the lease right, it is often hard to predict
demographic shifts which could impact the business concept
over time. All of these important considerations have fueled
continued expansion of franchising into the service sector.
The Explosion of Service-Based
Franchises
Reflecting the dramatic shifts in technology and consumer
desires for more leisure time, franchises based on providing
essential services has grown at unparalleled pace and
encompasses hundreds of concepts. As consumers focus their
time on entertainment, they instinctively increase their interest
in reducing their commitments to “chores” such as landscaping
and yard maintenance, home services such as carpet and tile
cleaning, and technical trades such as air conditioning and
plumbing repairs and maintenance.
The franchisor should know from their experience their customer
profile(s) and should support franchisees in identifying locations
with an adequate base of qualified customer targets. Without
Increasingly, consumers require service providers to attend
to their needs wherever they may be…in their home, in their
driveway and in some cases at their place of work. This pattern
of demand has spawned innovative and exciting development
of franchises in the service sector, and for many would-be
small business owners, a more attractive model. The thought
of working from a fixed-base of operation does not appeal to a
broad cross-section of society, so the emergence of franchises
featuring flexibility and independence operationally has been
a welcomed addition of opportunity. Another key driver is
affordability given the start-up costs are dramatically lower as
are the ongoing expenses in many cases. Yet, there are distinct
challenges with a service-based franchise model to consider.
18 Franchise Asia • 2015 Vol 27
International Focus
Attracting and Keeping Customers
The name of the game in service-based franchises is customer
acquisition. Since you don’t have a location the customer is
driving by or otherwise focused on visiting the strategy for
attracting customers is significantly different. This is further
complicated by the increasingly segmented marketplace
for advertising and media as consumers are overwhelmed
with choices. The “Consumer Decision Journey” developed
by McKinsey, a leading global consulting firm, highlights this
fundamental shift whereby consumers are actively researching
and seeking information rather than waiting for companies to
feed it to them through advertising.
Although on the surface it may seem a service sector franchise
is less complicated given you don’t have to commit to a specific
location, negotiate and sign a long-term lease, and you are
susceptible to shifting demographics, the ability to acquire
customers is critically important and increasingly complicated. If
your passion is to operate a fixed-location franchise then focus
on a franchise that provides significant support for site selection
and real estate/lease negotiations. If a service-based model is a
better fit for you then focus on a franchise that has developed a
proven method for acquiring customers.
Rising Above the Ordinary
The landscape of opportunity has expanded dramatically over
the past decade in franchising, enveloping the service sector at a
rapid pace. Individuals that take the time to understand the type
of business they can be passionate about and is aligned with
their personality and interests will rise above the ordinary.
The traditional approaches to customer activation are rapidly
diminishing as results fail to produce the necessary results.
Instead, sophisticated customer profiles are created using
socioeconomic modeling so that service-based franchise brands
can target high-profile consumers with valuable information.
This approach leads consumers to accept the brand in their
consideration set of options. Once the customer experiences the
service it can either solidify their loyalty, which is of tremendous
value, or drive the brand out of their future consideration. Unlike
a restaurant, hotel or retail franchise where the attraction is the
location, service-based franchises need to proactively seek out
customers to survive and they need to ensure an exceptional
experience to thrive.
Finding the Right Fit
There has never been a more exciting or opportunistic time to
engage in franchising given all the changes that are underway in
the global society. Many developing countries are experiencing
economic growth due to the emergence of franchise brands,
primarily in fixed-location concepts, which is opening the door
for many local entrepreneurs. The expansion of service-based
concepts has fundamentally shifted the focus of franchising in
the U.S. and many major economies around the globe. The key for
would-be entrepreneurs is finding the right fit and it begins with
taking a personal assessment. Investing in a franchise requires
a commitment to the business model and the brand, so making
sure the type of business, the work environment and the concept
category are aligned with your personality, your market and your
investment capabilities is essential to a successful outcome.
Suit up for your
“A Game”
By Harish Babla, Managing Director, Franchise Mind USA.
“Eight percent of success is showing up.”
—Woody Allen
Just wishing for great things to happen, just hoping for what you
want and need, just dreaming about success isn’t going to just
happen unless you suit up and get ready to play your “A Game”.
In his book “GO FOR THE GOLD” Eric Harvey writes “If you don’t
fully show up, neither will success” He elaborates that showing
up means:
1. Being Physically present
2. Being Mentally focused
3. Being Emotionally committed
most of the time disguised as activities. Most businesses and
people are constantly in reactive mode, so wound up with the
day’s fire fighting and completely oblivious to the priorities of
the business that drive success. Not being able to ‘see the
In franchising, Franchise Mind presents the concept of
‘Focused Execution’ by the franchisor: a deliberate and engaged
execution of the strategy to create success for everyone in the
franchise eco-system.
It is not merely sufficient to designate oneself as a franchisor,
or to have the necessary legal documents prepared or to even
mechanically perform activities to attract potential franchisees.
Being suited up for your “A Game” requires not just your physical
presence but being fully engaged and committed to your success.
In any business there are always multiple priorities,
opportunities, challenges and distraction. Yes, distractions
International Focus
Truly successful companies and leaders are successful because
they are:
1. Physically present. Being present and fully aware of what
is happening around them. If we were to use a tradeshow
analogy, it isn’t sufficient to just show up in an embroidered
logo shirt at the booth and expect that the tradeshow will
be successful. Yes, that is the first requirement, showing
up. However, being physically present requires being aware
of ‘things’ happening around you: are the brochures lined
up properly, is the light falling in the right place, will the
plant come in the way of people wanting to come inside the
booth and the many other things happening both inside
and outside the booth that can affect how the game is
being played.
cannot choose to show up some days and not show up on
others. You must be suited up and ready to give it your all. Are
you prepared to be world-class?
2. Mentally focused. Together with physical presence is
required focus on the outcome. Continuing the tradeshow
analogy, being prepared to answer objections from tradeshow
participants, being prepared to answer questions, being
prepared to present your offering with passion and conviction
and having multiple scenarios outlined in your head based on
the direction of the conversation with a prospect. The mental
focus is such that you are able to concentrate on achieving
the desired outcome.
3. Emotionally committed. A vast majority of people desire,
dream or hope to succeed but are not willing to do what is
required to achieve that dream. To do what is required to
succeed is much harder than wishing to succeed. Renowned
Master of Vedanta, HH Swami Chinmayananda so aptly says
“Some act till they meet obstacles, others act inspite of
obstacles, and conquer them; but some act not, fearing the
possibility of obstacles, that might arise enroute.”
In our tradeshow analogy, the fear of rejection stops many from
following up with prospects they have chatted with at the tradeshow.
Of course their actions are nicely packaged with intellectually sound
rationalizations. At the end, it is a demonstration of the lack of an
emotional commitment to success.
Being a world-class franchisor, a world-class business owner,
a world-class executive, a world-class athlete, a world-class in
anything requires you to play your “A Game” at all times. You
In any field of work success demands that you show up not
just with your body, but being fully prepared to play the game
to the best of your ability, being focused on winning and being
committed to do what is necessary to being world-class.
Franchising Opportunities:
Testing Business Innovation via Hong Kong
Hong Kong has become an important showcase for brands from around the world. This is partly
thanks to the influx of affluent tourists from the Chinese mainland over recent years. Many of the
brands showcased in Hong Kong have found favour among these tourists, with a number of them
having been impressed by the genuine quality, fashionable designs and shopping environment
on off throughout the city. Mainland tourists tend not to visit Hong Kong just to shop, but also to
experience its cosmopolitan lifestyle.
As the enduring home of a substantial number of expatriates
and a truly international city at the very heart of Asia, Hong Kong
embraces a rich diversity of cultures, talent and ideas. The city
fosters a deep sense of inclusion, connection and a commitment
to building both understanding and extensive networks with the
rest of the world. Hong Kong is, thus, well-positioned to be the
cultural gateway between the East and the West, gathering and
distilling the very best of Asian cultures for its residents and
international visitors, while also bringing the finest examples of
global culture to Asia.
Hong Kong, as the lifestyle capital of Asia and a major exporter
of many lifestyle products (including films, music, visual arts,
media, entertainment and fashion) is then the ideal place to
showcase and market franchise concepts.
Innovation and
Creativity Breed
Success
While Ronnie Cheng first came across
liquid nitrogen ice cream in England,
he quickly realised that this special
product was notably smoother than
traditional gelato. There was also a fun
element to watching it being made,
with the suffused smoke creating a
captivating and alluring atmosphere.
Ever since this initial encounter, one
tantalising question was uppermost
in Cheng’s mind – could he build a
business based around this product?
As a pharmacist with biochemical
knowledge, Cheng understood that
liquid nitrogen could be utilised to
instantly freeze different natural
ingredients into ice cream. The use
of fresh and natural ingredients to
create the ice cream ensured there
was no need for artificial colouring or
preservatives, common ingredients in
traditional ice cream. This made-toorder
ice cream also does not need to
be prepared in large batches, making
each serving fresh and quite unique.
All of these characteristics combine
to make liquid nitrogen ice cream an
appealing product, especially for those
middle class Hong Kong consumers
who are renowned as being very open
to trying new things.
After careful consideration, Cheng
decided to quit his job in England and
return to Hong Kong and fully commit
himself to this new business venture.
Cheng spent a year preparing before
his first Lab Made
shop opened in
2012. Now the
brand extends
across five outlets in
Hong Kong and two
in Shanghai. It has
also developed more
than 80 proprietary
recipes. Cheng
believes that its
variety of innovative
recipes sets Lab
Made apart from its
competitors, lures
new customers in and
results in repeated
purchases.
Not long after Lab
Made’s launch, it
became a media
favourite, winning fans
with its superior quality,
spectacular creations
and its ability to
customise each serving.
At the same time, Cheng
received considerable
interest from investors
looking at franchising
the business. Cheng now
believes the brand is ready
to be franchised, following
years of fine-tuning its
operational procedures
and training manual. To
this end, franchise rights
have now been assigned in
Shenzhen, Dongguan and
Wuhan.
With a vision to start a
truly ‘cool’ trend and open
200 shops via franchising
across the mainland by 2017,
Cheng is continuing to look for
Chinese partners. This year he
will exhibit at the World SME
Expo in Hong Kong, where
he will be able to introduce
his business concept to a
wide number of prospective
investors.
RIDE THE WAVE OF SUCCESS WITH KUMON
The World’s Largest After-School
Learning Programme
Kumon began with a parent’s love. Determined to help his eight-year-old son, a math
teacher named Toru Kumon developed the materials and guiding principles of the Kumon
Method. Today, in 48 countries and regions on six continents, Kumon is helping millions
of children succeed in the classroom and in life. Now, you’re invited to build a career
by empowering children to become self-learners, and help them to achieve more than
they ever thought they could through the Kumon Method. Franchise Asia got the Kumon
Franchise Team to tell us more.
24 Franchise Asia • 2015 Vol 27
Interview
■ Kumon is the ‘world’s largest after-school math
and reading programme’. Can you briefly explain
the uniqueness of this method?
Kumon is an academic programme like no other and we have
around 40,000 Kumon students in Malaysia to prove it. At Kumon,
we believe in the potential of each and every child and that they can
advance irrespective of their age or school grade level. As we believe
each student is an individual with different styles of learning and
abilities, even the sets of Kumon materials given to the same age
group are not always similar. Every student’s study plan is different,
and the difficulty of the levels will be similar to school level. Instead
of passively receiving instruction from teachers or tutors, Kumon
students actively develop self-learning skills.
Under the Kumon Method, every student will be required to take
an achievement test before progressing from one level to another.
The test by the way is a self-test for the Instructors to evaluate
themselves too.
At times if necessary, we even start students at an early age at
the basic levels where they’re taught to draw lines to develop their
motor skills to improve on their alignments; from simple lines to
more difficult ones. We know that alignments are important when
it comes to vertical sums, which may affect a student’s answer
when not corrected early on.
At Kumon each student progresses at his or her own pace through
an individualised programme of worksheets carefully planned
by the Instructor. The Kumon worksheets are the keys to the
Kumon Method, and to a child’s success. Kumon worksheets
are structured to allow progression in small steps, enabling each
student to advance smoothly from easy to difficult problems and
ultimately toward studying advanced high school level materials on
their own. The worksheets provide examples of how to solve each
problem, enabling students to self-learn new concepts on their
own. Information such as students’ reactions to the worksheets
and feedback from Instructors are continually taken into account
when revising worksheets.
■ Kumon is renowned for its Math Programme.
Not to be outdone, the Kumon Reading
Programme is equally well-known and result
producing. Can you briefly tell us what both
these programmes emphasise?
From counting to calculus and beyond, the Kumon Math
Worksheets enable students to progress all the way up through
high school-level math. The benefits of the Kumon Math
Programme are manifold. Kumon’s assignments progress in small
steps to build all of the critical skills needed to study high schoollevel
calculus. Each worksheet not only covers specific concepts,
but also helps students develop mental calculation and reasoning
skills and improve their problem-solving techniques.
The Kumon Math Programme simply gives students a solid
foundation and a head start, helps improve performance in
math class, increases your child’s overall math comprehension
and prepares your child for the rigours of high school and
advanced mathematics.
The Kumon Reading Programme on the other hand covers
everything from learning letter sounds to reading high school-level
literary texts. And the benefits are plenty too. Kumon’s assignments
incrementally build on each subject to develop students’ comfort
with and understanding of reading. Each worksheet not only covers
a specific concept, but also helps students interpret information,
expand their vocabulary, and enhance reading and writing ability
and overall comprehension.
25
Interview
The Kumon Reading Programme gives pre-readers and early
readers a solid foundation and a head start. It improves overall
reading and writing skills at all grade levels. It increases your
child’s vocabulary and reading comprehension, and develops a
love of reading and appreciation of great literature.
■ Kumon helps ‘children learn how to learn
on their own, and develops strong academic
skills’. Is Kumon similar to after-school tutoring
(tuition) sessions?
At Kumon, our math and reading programmes help children of all
ages and levels become eager, independent self-learners. Unlike
tutoring sessions, Kumon helps children learn how to learn on
their own, and develops strong academic skills. Our students gain
a sense of confidence that will help them in the classroom and
beyond. Kumon gives opportunity to students to study beyond
school or grade level and as to date we have more than 45 percent
of Kumon students studying advanced materials in Malaysia.
■ The Kumon Method emphasises on ‘individualised
learning method’. Can you briefly explain how this
method works, and the benefits of it?
The starting point for each Kumon student is determined
individually. That’s the reason before a student enrols with Kumon,
the student is given a diagnostic test. Students start with the level
where they can attain a perfect score by studying on their own. The
worksheets have been designed in a way that allows students to
figure out how to solve problems on their own.
If students continue to study at their own pace, they will catch up
with their school grade level and eventually advance far beyond
it. And the Kumon Instructor supports each student in developing
self-learning ability. The role of a Kumon Instructor is to bring out
the potential in each individual.
Even though Kumon worksheets are designed to allow students
to advance through self-learning, nonetheless, there are times
when students encounter problems that they don’t understand
or are unable to solve on their own. At times like these, Kumon
Instructors do not spoon-feed students with problem-solving
methods. Rather, our Instructors find out how much the students
Our students gain a sense of confidence that will
help them in the classroom and beyond
26 Franchise Asia • 2015 Vol 27
Interview
understand before giving them hints. Instructors may also show
students example problems or previously studied material to
help them solve difficult problems on their own. In doing so,
students enjoy a sense of achievement and are able to master
new material independently.
■ For those interested in Kumon franchise, you
have Kumon Franchise Orientation. What does
this orientation cover? And who can join them?
There are specific procedures to apply for Kumon Franchise. The
first step is to send an official email to enquire on the Kumon
Franchise at franchise_opportunity@kumon.com.my. Kumon
Office will send the Franchise Application Form and contact
candidates for phone interview. Selected candidates will be invited
to attend Kumon Franchise Briefing and Franchise Orientation.
Assessment of suitability to become a Kumon Franchisee will be
carried out on both days. Candidates, who have gone through
initial assessment successfully, will be required to prepare a
Franchise Business Proposal and present to the Management
during the final interview. Candidates, who have successfully gone
through all of the above steps including the final interview, will be
invited for consecutive 5-weeks New Instructor Training.
■ Must one be a Kumon Instructor to become a
Kumon Franchisee?
Kumon Franchisee is a Kumon Instructor who has the
responsibilities for the operation and development of each
student in the Kumon Centre. Kumon Instructors are devoted to
each child’s development and growth. In order to give students
appropriate instruction, the Kumon Instructors monitors the
approach and progress each student makes to ensure they are
learning at an optimal level. Through close observation and
evaluation, Kumon Instructors determine the “just right” level
for the students, ensuring that students will always experience a
sense of achievement from their studies. Individualised instruction
is given to each student to ensure their appropriate learning level
is maintained.
Kumon Instructors continually reviews how each students develop
through their studies. This is then communicated back to the
student by praising them on their efforts and achievements to
maintain the motivation and feeling of success. The Instructor
regularly reports these development points back to parents so
their achievements are noted and recognised. Thus, one must be
a Kumon Instructor in order to become a Kumon Franchisee.
■ What are the criteria a prospective Kumon
Franchisee should have to join your franchise
family?
Kumon Franchisees must have reasonable business acumen,
able to multi-task; possess strong organisational skills and the
most important traits that we look for in a Kumon Franchisee is a
person with high passion and enthusiasm in nurturing students.
We welcome like-minded person who believes that each and
every child can soar beyond any imagined limit and find joy in
nurturing children. A person who is sensitive to positive changes
in a child, celebrates his or her success and continues to nurture
the pursuit of his or her potential.
A prospective candidate doesn’t have to be a teacher or have
teaching experience. Instead any person with higher tertiary
qualification in any discipline or professional with strong
Mathematics and English skills can join the Kumon Family.
However to become a successful Kumon Franchisee, it requires
dedication and full commitment to develop the Kumon Centre.
Angie Chee (left) and Carolina Keong
28 Franchise Asia • 2015 Vol 27
Interview
■ Can you briefly describe what Eye Level
is about?
Angie Chee: Eye Level is a supplemental education program that
originated in Korea. The education is for children aged 3 to 15
tailored to an individual child’s strengths and weaknesses. We
start a child at a level where the child understands. To do this,
we give a test to the child first to see which level he or she is at
and only then assign an appropriate level for the student, at a
pace the student is comfortable with. This way, Eye Level helps
to nurture problem solvers, critical thinkers and lifelong learners
with a study path tailored to the students’ abilities. At Eye Level,
we focus on mastery of concept, speed and accuracy, as well as
mental calculation.
■ Eye Level is said to be Malaysia’s leading
Critical Thinking & Blended Learning (Online &
Offline) Education. Can you describe what is so
special about this type of education?
Angie Chee: Let’s start with Eye Level math program where we
have Critical Thinking Math (CTM) and Basic Thinking Math.
Basic Thinking Math is simply the one taught in school. CTM on
the other hand is not taught in school. The CTM program helps
to develop student’s spatial sense, problem solving, patterns and
relationships, measurements and reasoning skills. The degree of
difficulties in our program is gradual hence ensures success as
our students learn at their own pace. Through survey conducted
we found that our students are able to understand their lessons
better through our program.
To keep our programs updated according to the learning styles of
the education trend, we improvise our program from time to time.
And to help us do this is our research institute in Korea that looks
into developing all Eye Level programs’ curriculum.
Carolina Keong: Not surprising, CTM is a program that both
parents and children look forward to when attending Eye Level
classes. In our program we‘ve various teaching tools to aid
children with better learning experience; tools that the instructors
use which go hand in hand with the math work sheets that are
handed out to them.
Angie Chee: Blended learning is something new that we started in
Malaysia with the aim to provide new learning experience and to
boost students’ learning effectiveness. As the name implies, it’s a
combination of online learning and offline (face to face) learning.
In online learning, we allow the students to do their homework at
home via online so that they can repeat as many times as they
want. They can repeat four times per book, which is a lot compared
to just using physical papers. Online learning is fast and easy. Once
they finish their work, they can just press their answers, and the
results will be prompt and will be automatically calculated. This
way, children will know where they stand and this gives parents
to check results instantly and monitor them as well. On top of
that, besides learning, children also have games where they can
compete healthily with other Eye Level students worldwide with
a scoreboard showing their names and results. This new hybrid
teaching and learning methodology benefits students as we instill
excitement in students to focus for longer period of time and
curiosity in learning.
■ Eye Level is based on an educational principle
of Self-Directed Learning (SDL) where students
learn at their own paces. Why is this important?
Angie Chee: SDL has two separate “Learning” and “Thinking &
Practicing by myself” areas. Learning space is where the instructor
coaches a student after which the student will go into an individual
Thinking space to practice the lessons taught. This practice
inculcates independence which will be invaluable when the students
attend university or later in life as they will be more self-reliant.
This method is opposite to the ‘spoon-fed’ culture rampant in
today’s school children. At Eye Level, after learning a new concept,
students are encouraged to do their assignments first through
Eye Level materials that are designed in small incremental steps.
Only when they don’t understand, they ask their coach. This is
the value we want to instill in our students. What SDL does is
that it helps the child to learn, then review, examine and solve
problems by themselves, initiating their own actions guided by
instructors as coaches. The benefits are many folds, including:
• Understanding of questions and mathematical process
• Improve mathematical thinking and problem solving skills
• Master concepts each step of the way as they progress
through the curriculum
• Retain what they have learned for a longer period
• Have instructors as coaches instead of teachers
• Instill values to be proactive learner in acquiring knowledge
• To focus and think out-of-the-box
■ What are some other programs offered at
Eye Level?
Angie Chee: We offer five programs altogether. Eye Level Math
(online & offline, for 4-15 years old), Play Math (3 years old), Eye
Level English, Happy Talk (Situational English learning program –
both online & offline), as well as Eye Level Chinese Junior.
Interview
with the offline contents, thereby giving children a comprehensive,
interactive and fun learning experience. We believe that in time
to come, education will not be limited to the conventional ways
of learning which is merely through offline contents, but rather, a
solid combination with online-based contents.
To instill the self-directed learning mindset in children, our
optimized learning environment is one of a kind, where every
Eye Level classroom is equipped with the SDL desk for better
concentration. The classroom is divided into sections for 1:1
coaching and learning without being distracted by peers.
■ Why should a prospective franchisee consider
an education franchise, especially Eye Level
franchise?
Carolina Keong: Firstly, an education business is evergreen.
Parents will always place main priority on their children’s education
regardless of any economic situation. Why Eye Level franchise?
Well, for over 30 years in 17 countries, Eye Level has nurtured
millions of young minds to excel academically in both Math and
English and we’re still going strong with these two proprietary
programs internationally.
Our learning methodology has produced over 2.5 million students
worldwide to date, and still counting. In Malaysia we have almost
12,000 students. The best part is, we are always improving
our programs and adding on new programs to sustain and stay
relevant in the industry. Internationally recognized, we are one of
the world’s top educators in Self-Directed Learning and Critical
Thinking Math.
In short, firstly, Eye Level is the only supplemental education
program that offers a unique learning system that combines
a wholesome learning environment, learning materials and
management system to instill and impart critical thinking skills
and self-directed learning in children. Secondly, being the pioneer
in blended learning, which is a perfect balance in learning which
combines offline and online contents, we nurture young minds to
become problem solvers, critical thinkers and lifelong learners.
The offline contents comprise colorful worksheets and various
teaching tools to aid our students in the Eye Level programs. The
online contents on the other hand, can be accessed by students,
instructors and even parents through the Learning Room, where
students are free to study and practice learning concepts and
topics. Students get to learn new concepts, do exercises, re-solve
exercises, review corrections and results, compete with others and
advance to the next stage. The online contents go hand-in-hand
■ Can you briefly mention some of the support and
rewards provided by Eye Level for its franchisees?
Carolina Keong: For new franchisees we’ll assign an Area
Management System comprising Area Managers and Area
Trainers. For the first 12 months initial support, new franchisees
will be guided in overall center operations, management and
marketing by the Area Manager. Other guidance includes program
knowledge, consultation skills, student progress management,
and other areas related to our programs. The Area Trainer on the
other hand, will concentrate on training the franchisees, monitor
the centers, students’ progress and other matters related with
the program. Area Manager and Area Trainer often visit in pairs
so that a cohesive and constructive advice can be given to new
franchisees to take their business to the next level.
We also offer a reward scheme for new franchisees to enjoy
incentives when they achieve a certain target in the 3 rd , 6 th and
10 th month. This applies to new franchisees in the first 12 months
of operations. Incentives include marketing subsidies and royalty
waivers if they achieve their target.
Angie Chee: As for existing franchisees, we support them through
Area Management System where Area Managers will assist outlets
in Malaysia nationwide on constantly improving and growing their
centers, and Area Trainers will look into their teaching curriculum
whether they are following the guidelines given. Eye Level Center
Development Fund (ECD Fund) is a marketing fund that we offer
for existing franchisees to implement marketing initiatives to build
their business. The ECD Fund will be reviewed from time to time.
■ Eye Level also organizes a monthly Business
Orientation workshop. What is this about?
Carolina Keong: In this session we share on the Eye Level franchise
opportunity with those who are interested to find out more about
our franchise business. At the end of the session, there will be a
Math and English test for us to gauge the candidate’s knowledge
in both subjects, as well as to determine if the candidate passes
on to the next stage, which is the Business Proposal Presentation
and Interview with Country Manager. Our next Business Orientation
workshop is on 3 rd July, 7 th and 8 th August and 4 th and 5 th September
Interview
■ What was your feeling in SoulKids winning
the ‘Licensor of the Year Award’ ‘ 2014 award?
We were all delighted when the announcement was made. We
felt that 10 years of inspiring work had paid off. We were very
proud that all our processes, systems, training, content and
results were recognized.
Children from 5.5 years ok age all the way to 15 benefit from SoulKids
We knew that our vision “to Inspire children the world over to be
happy and successful in life “and to the known as the “brand of
excellence in Life-Skills for children “was supported at the highest
level by the FLA.
■ Can you name some of the factors that
contributed to SoulKids’ exciting growth?
SoulKids ® is the brand of excellence in teaching essential life
skills such as happiness, success, leadership, teamwork to name
a few. Our methodology and training content is fun and inspiring.
Children learn and apply the teachings immediately and it really
makes a difference in their lives.
Parents see the difference and then want to learn the techniques
themselves. We provide support for the parents and so it’s an allinclusive
training for the family.
■ How does SoulKids stand out from the
competitors?
SoulKids ® offers our proprietary transformational programs that
develop positive, balanced, self assured and confident children.
Children from the ages of 5.5 to 15 all benefit. SoulKids ®
training is inspiring, powerful and fun. SoulKids ® was recently
voted best in class for life skills by Harpers Bazaar readers for
the following reasons;
Children Love SoulKids
Our highly trained Mentors walk the talk. They have undergone
rigorous training with the founder himself and have applied this
training in their own lives first.
SoulKids ® works with small groups of children and we have strict
ratios of children per Mentor. This ensures each child receives the
necessary attention. Parents are educated and supported too!
We create a community where children feel loved and connected;
reunions, blogs and inspirational messages are all part of the offer.
We support the training with a professional retail offering - our range
of best selling SoulKids ® books, DVD’s, notebooks, badges.
SoulKids Coaches are able to offer one on one support for children
Both the founders Vikas Malkani and Sally Forrest are qualified
CFE graduates.
1. Helping children to become more confident, empowered, happy
and successful in all aspects.
2. Teaching children how their mind works and how they are
responsible for their own choices.
3. Modules that encourage learning through actual life
experiences.
4. Fun essential Life-Skills Programs taught in a happy, safe
environment, with lots of attention for each child.
■ What are some of the setbacks and
challenges faced by SoulKids when starting
out in licensing? And how did you overcome
them?
We always see challenges as opportunities. One of the initial
considerations was our intellectual property and how we go
about protecting this in 37 countries. Time, energy, effort and
substantial investment went into securing the correct intellectual
property protection.
Another consideration was how to document all the processes and
systems that we have been using successfully for so many years.
Manuals, videos and training processes had to be created in a
professional manner.
Interview
Learning through fun and games
The SoulKids programs are offered in different formats to suit
different timings and client preferences. Full day, half day, extra
curricular and tuition programs are all available. Group programs
and one on one coaching are available. The brand is IP protected
Unique retail products support the brand. Full business and
communication training is offered to all licensees. Constant R&D
of training programs. Impactful branding and unique content are
all part of the license.
■ What is in the pipeline for SoulKids?
Our mission is to inspire everyone we meet to be the best that
they can be. So we focus on inspiring each and every child that
comes through the SoulKids program.
There is a phase in growth where you simply have to take time
out to set the foundation. If you enjoy procedures and processes
then this can be an exciting period, however many find it a little
laborious and tedious documenting each and every aspect of
the brand. However its time well invested and necessary for
future growth.
■ If you had to start over, would you do anything
differently?
I think there is always a danger initially that you try and do
everything yourself. One moment you are inspiring children and
parents, the next you put on the hat of an accountant, then a
marketing manager, then an IT specialist… and so on. This is
natural as small companies try to keep costs down. However on
reflection I feel it would be more efficient in the long run to have
key functions of the business staffed from the outset. Invest in the
best staff you possibly can find. Do not compromise.
■ Why should anyone consider a SoulKids
license?
SoulKids offers a turnkey business module that works across
boundaries and cultures. Unit, area & country licenses are
available. There are multiple streams of income available.
Our SoulKids Mentor Training program offers adults the
opportunity to work with the brand and spread the message to
children. Our growth is organic; people have been so inspired by
their training and have seen their own change, and they decide
to take the license and spread SoulKids ® through our business
models. Interested business executives are always welcomed
and we are happy to discuss options to grow the brand even
more.
■ What would your advice be for someone
starting off in the franchise business?
First decide if it truly is your passion?
Do you think about your brand/business 24/7?
Are you totally committed to making it a success?
Are you willing to invest the time, energy, effort and finance in
starting the business and in making it a success?
Are you good with people and able to manage others?
Are you able to deal with comments and advice from others?
Its exciting and fast paced and with todays technology a 24/7
operation. With this in mind are you able to balance business
and your personal life?
The JFC Tale Clocks. Our trusted companion since time
immemorial. Don’t be fooled by their delicate mechanism.
They serve a much greater purpose than the simple act of
time keeping. Today, the choice of clock defines a person. How
a person perceives time is articulately portrayed in their choice
of clocks. After all, every one of us has a unique way of seeing
and perceiving time. Some like to kill time. Some like to save
time. Some choose to race against time, while some prefer to
take their sweet time. It’s fascinating to note that this untapped
ability of being able to convey every mood and every emotion
makes clocks even more relevant in today’s digital age. And
with a vision to cater to these myriad moods & emotions, JFC
was born.
The World of Clocks
When it comes to clocks, you rarely see anything different than
the classical design. It is iconic but also boring, always telling
you the right time yet never really saying anything about you.
At JFC, we believe that clocks can be innovative yet personal.
that’s why only the most unusual and creative clocks from
all over the world find their way to JFC, making it home to the
largest collection of branded fashion clocks in the country.
From classy to sassy, quirky to witty... we give you clocks
that compliment your personality. After all every person is
unique, so should their clocks be similar?
IRISH POTATOES
From Ireland
to the World
Potato, the Irish staple food is popular in its many forms
all over the modern world. There is the famous English
Fish and Chips, the Belgian fries, the American French
Fries, the potato crisp, potato mojos, mashed potatoes, baked
potatoes and countless other forms. In recent years, Asia saw a
surge in specialty potato stores inspired by the Irish. It started
in Hongkong and quickly multiplied in Taiwan, South Korea,
Singapore, Malaysia, and now in the Philippines.
Potatoes alone could not satisfy the discriminating Filipino
taste. The traditional ketchup and salt is getting old and boring.
Irish Potatoes aim to make potatoes more exciting by adding
toppings to good old French Fries. You could drench it with
cheese sauce, dip it in sour cream and onion, bathe it in
barbecue sauce or drizzle with your go-to condiments like pink
sauce or mustard. You could go tangy with salsa, go hot with
jalapenos and a dash of Tabasco.
You could top it with beef or bacon, because bacon makes
everything better. Or you can do without, for we also have
vegetarian choices. Delve into buttered corn, button
mushrooms, and olives for a healthy lifestyle.
Like a perfect Irish gentleman, Irish Potatoes also serve ready
mixed gourmet fries for your convenience. Introducing The
Dandy: Pot o’ Gold, Celtic Storm, Ace of Hearts, Gaelic Rage,
Flash of Summer, and Irish Thunder.
Irish Potatoes does not end in fries. We also serve mashed
potatoes and upped the ante with sweet and spicy boneless
chicken and fried chicken wings. Finally, wash it all up with ice
slush or beer below zero.
If it is good enough for the long-suffering Irish, it is good enough
for you. After all, the Irish is all about freedom, and the good life.
