GOVERNMENT <strong>PROCUREMENT</strong> <strong>GUIDELINES</strong> 35(b) Post qualification criteria should also be clearly stated in theBidding documents.5.3.20 (a) If Bids based on alternative designs, materials, completionschedules, payment terms, etc., are permitted, conditions fortheir acceptability <strong>and</strong> the method <strong>of</strong> their evaluation shall beexpressly stated.(b) The disclosed criteria shall not be modified or additional criteriashall not be introduced during evaluation.5.4 Conditions <strong>of</strong> ContractDraft Contract to be issued5.4.1 (a) The draft contract shall be issued with the bidding document.(b) The draft contract document shall:(i) clearly define the scope <strong>of</strong> Works to be performed, theGoods to be supplied or the Services <strong>of</strong>fered;For details seeProcurementManual 5.4.1(ii) the rights <strong>and</strong> obligations <strong>of</strong> the PE;(iii) the rights <strong>and</strong> obligations <strong>of</strong> supplier or contractor:(iv) if the PE envisages the engagement <strong>of</strong> an engineer or aconsultant, for the purpose <strong>of</strong> contract supervision <strong>and</strong>administration, the authority <strong>and</strong> functions <strong>of</strong> the engineer orconsultant must be clearly spelt out.(v) Conditions <strong>of</strong> contract shall also stipulate that failure on thepart <strong>of</strong> the parties to perform their obligations under thecontract will not be considered a default, if such failure is theresult <strong>of</strong> an event <strong>of</strong> Force Majeure, as defined in thecontract.(vi) In addition to the general conditions <strong>of</strong> contract, any specialconditions particular to the specific Goods or Works orServices to be procured <strong>and</strong> the location <strong>and</strong> modality <strong>of</strong>the project shall be included.Terminologydetailed in theProcurementManual 5.3.19
