Political Pr<strong>is</strong>oners and Detainees<br />

Credible international NGOs estimated that there were more than 80 political<br />

pr<strong>is</strong>oners at the end of the year. Most were incarcerated under statutes banning the<br />

d<strong>is</strong>play of banned separat<strong>is</strong>t symbols (see section 2.a.). Government officials<br />

affirmed publicly that they would not tolerate the d<strong>is</strong>play of separat<strong>is</strong>t symbols.<br />

Activ<strong>is</strong>ts with the separat<strong>is</strong>t Republic of South Molucca (RMS) organization<br />

continued to be impr<strong>is</strong>oned for d<strong>is</strong>playing banned separat<strong>is</strong>t symbols. Authorities<br />

arrested RMS activ<strong>is</strong>ts in Ambon for allegedly planning to fly banned RMS flags<br />

during an August 2010 v<strong>is</strong>it by President Yudhoyono. Human rights activ<strong>is</strong>ts<br />

reported that security forces, including the police, abused these detainees during<br />

arrest and questioning.<br />

A number of Papuan independence activ<strong>is</strong>ts, including Filep Karma, were in<br />

detention or pr<strong>is</strong>on for ra<strong>is</strong>ing a banned separat<strong>is</strong>t flag. Some prominent pr<strong>is</strong>oners<br />

incarcerated for flag ra<strong>is</strong>ing offenses, such as Buchtar Tabuni, received standard<br />

rem<strong>is</strong>sions on Independence Day and were released from pr<strong>is</strong>on early. Local<br />

human rights observers noted that enforcement of flag-ra<strong>is</strong>ing laws was not always<br />

cons<strong>is</strong>tent but was widespread across Papua and West Papua provinces. These<br />

observers asserted that persons arrested for political offenses often faced harsh<br />

treatment including withholding of necessary medical care.<br />

Local human rights activ<strong>is</strong>ts reported that local activ<strong>is</strong>ts and family members<br />

generally were able to v<strong>is</strong>it political pr<strong>is</strong>oners, although some pr<strong>is</strong>oners were held<br />

far from their families on other <strong>is</strong>lands.<br />

Civil Judicial Procedures and Remedies<br />

The civil court system can be used to seek damages for victims of human rights<br />

violations; however, widespread corruption and political influence limited victims’<br />

access to th<strong>is</strong> remedy. In one example of a petitioner winning redress, on February<br />

17, the Supreme Court ruled that Garuda <strong>Indonesia</strong> Airlines must pay<br />

compensation of 3.38 billion rupiah (approximately $386,000) to Suciwati, the<br />

widow of the late human rights activ<strong>is</strong>t Munir (see section 1.a.).<br />
