The criminal procedure code does not incorporate alternative sanctions or<br />
sentencing for nonviolent offenders.<br />
The national ombudsman can advocate on behalf of pr<strong>is</strong>oners and detainees on a<br />
variety of <strong>is</strong>sues, including monitoring conditions and treatment of pr<strong>is</strong>oners;<br />
addressing the status and circumstances of confinement of juvenile offenders; and<br />
improving pretrial detention, bail, and recordkeeping procedures to ensure that<br />
pr<strong>is</strong>oners do not serve beyond the maximum sentence for the charged offense. In<br />
the past, the ombudsman has investigated pr<strong>is</strong>on <strong>is</strong>sues and communicated h<strong>is</strong><br />
findings to the min<strong>is</strong>ter of law and human rights and the Supreme Court. The<br />
Ombudsman’s Office and the Directorate General for Correctional Facilities have<br />
signed a Memorandum of Understanding on Superv<strong>is</strong>ion of Public Service for<br />
detainees and pr<strong>is</strong>oners.<br />
d. Arbitrary Arrest or Detention<br />
The law prohibits arbitrary arrest and detention but lacks adequate enforcement<br />
mechan<strong>is</strong>ms. Some authorities violated these prov<strong>is</strong>ions.<br />
Role of the Police and Security Apparatus<br />
The president appoints the national police chief, subject to confirmation by the<br />
DPR. The police chief reports to the president but <strong>is</strong> not a full member of the<br />
cabinet. The <strong>Indonesia</strong>n National Police (INP) has 415,557 personnel deployed in<br />
31 regional commands in 33 provinces. The police maintain a centralized<br />
hierarchy; local police units formally report to the national headquarters. The<br />
military <strong>is</strong> responsible for external defense but also has a residual obligation to<br />
support the police with domestic security responsibilities. In Aceh the Sharia<br />
Police, a provincial body, <strong>is</strong> responsible for enforcing Sharia.<br />
The Internal Affairs Div<strong>is</strong>ion and the National Police Comm<strong>is</strong>sion within the INP<br />
investigated complaints against individual police officers. Additionally, Komnas<br />
HAM and NGOs conducted external investigations with the knowledge and<br />
cooperation of the police. During the year, 207 officers were charged criminally<br />
and 3,429 received d<strong>is</strong>ciplinary infractions.<br />
In 2009 the Min<strong>is</strong>try of Law and Human Rights approved the Use of Force Police<br />
Action Policy, which among other things requires that whenever force <strong>is</strong> used or<br />
whenever a citizen or police officer <strong>is</strong> injured as a result of use of force, a Use of<br />
Force Res<strong>is</strong>tance Control Form must be completed. Since the approval of the Use<br />
