confirmed that Nadiya Savchenko, being a delegate to PACE, enjoys immunity from prosecution.<br />
Also, on 29 April, 2015, <strong>the</strong> European Parliament adopted a special resolution on <strong>the</strong> case <strong>of</strong><br />
Nadiya Savchenko, which reads that Russia, in accordance with international obligations, should<br />
respect Savchenko’s immunity and release her immediately. 6<br />
Russia refused to comply with <strong>the</strong> decision <strong>of</strong> PACE, citing that Savchenko ‘had committed<br />
a crime’ before receiving parliamentary immunity. In response, PACE prepared a special report<br />
which stated that ‘<strong>the</strong> immunity <strong>of</strong> Assembly members also applies to all cases <strong>of</strong> prosecution,<br />
carried out against <strong>the</strong>m before <strong>the</strong>ir parliamentary authorities’. 7<br />
Also, in accordance with international norms, Nadiya Savchenko is a prisoner <strong>of</strong> war and,<br />
<strong>the</strong>refore, her detention constitutes a violation <strong>of</strong> <strong>the</strong> Geneva Convention on <strong>the</strong> part <strong>of</strong> Russia.<br />
On 12 December, 2014, Nadiya<br />
Savchenko addressed formal statements to<br />
<strong>the</strong> International Committee <strong>of</strong> <strong>the</strong> Red Cross,<br />
as well as <strong>the</strong> head <strong>of</strong> <strong>the</strong> Investigative<br />
Committee <strong>of</strong> <strong>the</strong> Russian Federation<br />
Aleksandr Bastrykin, in which she stated<br />
that he considers her to be a prisoner <strong>of</strong> war.<br />
In this regard, she requested that all investigative<br />
actions in which she is involved be<br />
suspended until such time that a court rules<br />
on her status. 8 Thus far, no special judicial<br />
decisions have been issued on <strong>the</strong> status <strong>of</strong><br />
Nadiya Savchenko in Russia; <strong>the</strong>refore, in accordance<br />
with international standards, she is<br />
a prisoner <strong>of</strong> war (Article 45 <strong>of</strong> <strong>the</strong> Additional<br />
Protocol to <strong>the</strong> Third Geneva Convention).<br />
As a result, all proceedings against her are<br />
prohibited (until a court rules that she is not<br />
a prisoner <strong>of</strong> war). The bringing <strong>of</strong> charges<br />
against her and <strong>the</strong> implementation <strong>of</strong> a preventive<br />
measure are also unlawful.<br />

On 13 December, 2014, Nadiya Savchenko<br />
went on hunger strike in protest against her<br />
illegal detention. In a statement addressed<br />
to <strong>the</strong> Director <strong>of</strong> <strong>the</strong> Federal Penitentiary Nadiya Savchenko’s statement on her hunger strike<br />
Service <strong>of</strong> <strong>the</strong> Russian Federation Gennadiy<br />
Kornilenko, Nadiya Savchenko declared that she would continue her hunger strike ‘until <strong>the</strong><br />
day <strong>of</strong> her return to Ukraine or <strong>the</strong> last day <strong>of</strong> her life in Russia’. 9 The hunger strike lasted 82<br />
days before Nadiya Savchenko was forced to end it.<br />
