<strong>the</strong> number <strong>of</strong> people killed by each <strong>of</strong> <strong>the</strong>m during mopping-up operations”. According to <strong>the</strong><br />
case file, Igor Kolomoyskiy “personally delivered <strong>the</strong> money to soldiers”. 63 Lytvynov was charged<br />
with <strong>the</strong> murder <strong>of</strong> two or more people (Art. 105, section 2 <strong>of</strong> <strong>the</strong> CC <strong>of</strong> <strong>the</strong> RF), and <strong>the</strong> use <strong>of</strong><br />
prohibited means and methods <strong>of</strong> warfare (Art. 356, section 1 <strong>of</strong> <strong>the</strong> CC <strong>of</strong> <strong>the</strong> RF), and he faced<br />
life imprisonment.<br />
On 10 November, 2014, after a meeting with Ukrainian consul, Lytvynov recanted his previous<br />
testimony, claiming that he had been subjected to torture. He also refuted <strong>the</strong> allegations about<br />
his involvement in <strong>the</strong> battalion ‘Dnepr‐1’, which was confirmed by <strong>the</strong> statement <strong>of</strong> <strong>the</strong> Armed<br />
Forces <strong>of</strong> Ukraine. 64<br />
| | Fabrication <strong>of</strong> <strong>the</strong> charges<br />
Following <strong>the</strong> examination and <strong>the</strong> obtainment <strong>of</strong> additional data from <strong>the</strong> competent authorities<br />
<strong>of</strong> Ukraine, <strong>the</strong> indictment base was severely fractured. The fabrication <strong>of</strong> <strong>the</strong> criminal case<br />
against Lytvynov was confirmed by <strong>the</strong> following facts:<br />
• The defence puts into question <strong>the</strong> au<strong>the</strong>nticity <strong>of</strong> <strong>the</strong> protocols <strong>of</strong> interrogation <strong>of</strong> <strong>the</strong><br />
accused. Serhiy Lytvynov, who only completed 7 years <strong>of</strong> primary school and is barely<br />
able to provide his personal data, suddenly begins to employ complex grammatical<br />
structures with <strong>the</strong> use <strong>of</strong> specific criminological lexicon in <strong>the</strong> interrogation protocol.<br />
