Under Russian law, if <strong>the</strong><br />
accused faces life imprisonment,<br />
he may apply to <strong>the</strong> court<br />
for trial by jury.<br />
Realising that <strong>the</strong> case on ‘war<br />
crimes’ is not based on conclusive<br />
evidence, and in <strong>the</strong> case<br />
<strong>of</strong> its consideration by <strong>the</strong> jury,<br />
Lytvynov will be acquitted, <strong>the</strong><br />
investigating authorities <strong>of</strong> <strong>the</strong><br />
Russian Federation didn’t submit<br />
<strong>the</strong> indictment to <strong>the</strong> court.<br />
However, in order to prevent<br />
<strong>the</strong> release <strong>of</strong> Lytvynov, on 10<br />
September, 2015, <strong>the</strong> IC <strong>of</strong> <strong>the</strong><br />
RF brought charges <strong>of</strong> robbery<br />
against Lytvynov. According to investigators,<br />
Lytvynov, along with<br />
two armed accomplices, allegedly<br />
stole two used cars from a Russian<br />
citizen, who, at that moment, was<br />
on <strong>the</strong> territory <strong>of</strong> <strong>the</strong> so-called<br />
‘People’s Republic <strong>of</strong> Lugansk’. 66<br />

Results <strong>of</strong> psychological and psycho-physiological<br />
examinations<br />
According to Counsel Viktor<br />
Parshutkin, <strong>the</strong> case <strong>of</strong> robbery is<br />
also fabricated, as <strong>the</strong> nationality<br />
<strong>of</strong> <strong>the</strong> victim raises doubts, and<br />
<strong>the</strong> fact <strong>of</strong> <strong>the</strong> commission <strong>of</strong> <strong>the</strong><br />
crime has not been fully established.<br />
There is no single piece <strong>of</strong> evidence to corroborate <strong>the</strong> victim’s account, apart from his<br />
own testimony. Evidence <strong>of</strong> unjustifiability <strong>of</strong> robbery charges were provided to investigators at<br />
<strong>the</strong> end <strong>of</strong> November 2015.<br />
According to <strong>the</strong> General Prosecutor’s Office <strong>of</strong> Ukraine and <strong>the</strong> Prosecutor’s Office <strong>of</strong><br />
Lugansk Province, <strong>the</strong> victim <strong>of</strong> <strong>the</strong> <strong>the</strong>ft <strong>of</strong> <strong>the</strong> car is a Russian citizen who owns a private<br />
house on <strong>the</strong> territory <strong>of</strong> Lugansk Province; during <strong>the</strong> commission <strong>of</strong> <strong>the</strong> alleged ‘crime’, he was<br />
not in <strong>the</strong> house. At that time, his house was abandoned and boarded up. In addition, <strong>the</strong> stolen<br />
car had actually been registered in <strong>the</strong> name <strong>of</strong> a Ukrainian citizen; in 1997, it was removed from<br />
<strong>the</strong> register <strong>of</strong> <strong>the</strong> traffic police and, currently, its registration number is assigned to a car <strong>of</strong> a<br />
different make, which was stolen and is yet to be found. The victim has presented his insurance<br />
policy, issued in <strong>the</strong> name <strong>of</strong> a different citizen <strong>of</strong> Ukraine, as evidence regarding <strong>the</strong> second car,<br />
allegedly stolen by Lytvynov. 67<br />
