4.3. THE CASE OF HAYSER DZHEMILEV<br />

On 27 May, 2014, <strong>the</strong> Kyiv Appellate<br />

Court ruled that <strong>the</strong> period <strong>of</strong> Hayser<br />

Dzhemilev’s detention in a detention<br />

facility is excessive, and ordered his release<br />

from custody. 47 In July 2014, <strong>the</strong><br />

European Court <strong>of</strong> Human Rights ordered<br />

that Russia “ensure freedom for<br />

Dzhemilev’s son”. 48 The Russian side has<br />

ignored <strong>the</strong> decision <strong>of</strong> <strong>the</strong> ECHR, thus<br />

violating international treaties with <strong>the</strong><br />

EU. According to Mustafa Dzhemilev,<br />

Russian investigative authorities have<br />

promised Hayser that he would be released<br />

under amnesty if he agrees to accept<br />

Russian citizenship, but Dzhemilev<br />

Jr. refused to do so, wishing to retain <strong>the</strong><br />

citizenship <strong>of</strong> Ukraine. 49<br />

On 10 April, 2015, <strong>the</strong> Dniprovskiy<br />

District Court <strong>of</strong> Kyiv deemed Hayser<br />

Dzhemilev guilty <strong>of</strong> embezzlement, illegal<br />

possession <strong>of</strong> weapons and ammunition,<br />

as well as negligent homicide. The<br />

court sentenced him in absentia to 3<br />

years and 8 months in prison. The sentence<br />

came into force in May 2015.<br />

On 21 May, 2015, <strong>the</strong> Ministry <strong>of</strong><br />

Justice <strong>of</strong> Ukraine, in accordance with<br />

<strong>the</strong> European Convention on Extradition<br />

Document <strong>of</strong> Ukraine’s Ministry <strong>of</strong> Justice, confirming<br />

that <strong>the</strong> Ukrainian side addressed Russia with a<br />

request for <strong>the</strong> extradition <strong>of</strong> Hayser Dzhemilev<br />

<strong>of</strong> 1957, appealed to <strong>the</strong> General Prosecutor’s Office <strong>of</strong> <strong>the</strong> Russian Federation with a request that<br />

Hayser Dzhemilev be subjected to extradition in order to serve <strong>the</strong> sentence, handed down by<br />

<strong>the</strong> district court. 50 The Russian side has not yet responded to <strong>the</strong> request.<br />

On 27 May, 2015, <strong>the</strong> Krasnodar Regional Court <strong>of</strong> <strong>the</strong> RF rejected <strong>the</strong> request <strong>of</strong> Counsel<br />

Nikolay Polozov, regarding <strong>the</strong> dismissal <strong>of</strong> <strong>the</strong> criminal case against Hayser Dzhemilev due to<br />

his previous sentencing. 51 Thus, ano<strong>the</strong>r important legal principle was violated, as no one may<br />

be convicted twice for <strong>the</strong> same <strong>of</strong>fence.<br />
