4.3. THE CASE OF HAYSER DZHEMILEV<br />

Hayser Dzhemilev did commit a criminal <strong>of</strong>fence, but his pursuit by <strong>the</strong> law<br />

enforcement bodies <strong>of</strong> Russia is politically motivated and linked to his fa<strong>the</strong>r’s<br />

status as a figurehead. His fa<strong>the</strong>r is <strong>the</strong> leader <strong>of</strong> <strong>the</strong> Crimean Tatars, Mustafa<br />

Dzhemilev, who openly opposes Russia’s occupation <strong>of</strong> <strong>the</strong> peninsula.<br />

On 27 May, 2013, Hayser Dzhemilev, with his fa<strong>the</strong>r’s rifle, shot and killed 43-year-old Fevzi<br />

Edemov, who worked in <strong>the</strong> Dzhemilevs’ house and was considered a friend <strong>of</strong> <strong>the</strong> family.<br />

According to Hayser’s family members, he had previously suffered from mental<br />

illness which could have contributed to <strong>the</strong> tragedy’s occurrence. A psychiatric examination,<br />

carried out prior to <strong>the</strong> judicial proceedings, recognised Hayser Dzhemilev as<br />

mentally sane. 39<br />

In November 2013, <strong>the</strong> Crimean Bakhchisarai District Court began to examine <strong>the</strong> merits <strong>of</strong><br />

<strong>the</strong> criminal case against Hayser Dzhemilev. The public prosecutor accused him <strong>of</strong> murder, <strong>the</strong><br />

<strong>the</strong>ft <strong>of</strong> a firearm and illegal possession and storage <strong>of</strong> a firearm. Dzhemilev himself pleaded<br />

guilty to one only count — illegal possession <strong>of</strong> a weapon. “I admit that I took <strong>the</strong> gun without<br />

permission, but I do not admit that I stole it; I admit that I illegally stored it, but I don’t agree<br />

that <strong>the</strong> shot was intentional”, 40 — Hayser Dzhemilev stated in court. He also said that he shot<br />

Fevzi Edemov by mistake: “On <strong>the</strong> day when Fevzi came once again, I had a shotgun. I helped<br />

him around <strong>the</strong> house, <strong>the</strong>n I went to watch TV, and <strong>the</strong>n I began to load and unload <strong>the</strong> gun<br />

and look around through <strong>the</strong> sight <strong>of</strong> <strong>the</strong> gun. I thought that <strong>the</strong> gun was locked. When <strong>the</strong><br />

sight focused on Fevzi, <strong>the</strong> window moved, causing <strong>the</strong> gun to fire…”. 41<br />

<strong>the</strong> occupation <strong>of</strong> Crimea by Russia<br />

Hayser Dzhemilev was held in a Bakhchisarai detention centre in Crimea and, following <strong>the</strong> occupation<br />

<strong>of</strong> <strong>the</strong> peninsula by Russia, he found himself under <strong>the</strong> jurisdiction <strong>of</strong> law enforcement<br />

and prison authorities <strong>of</strong> <strong>the</strong> Russian Federation. In April 2014, an ‘investigation’ into <strong>the</strong> case <strong>of</strong><br />

Dzhemilev began anew under Russian law. At <strong>the</strong> same time, <strong>the</strong> court extended his detention.<br />

In September 2014, Hayser Dzhemilev was transferred to <strong>the</strong> Krasnodar Krai <strong>of</strong> <strong>the</strong> Russian<br />

Federation. Mustafa Dzhemilev labelled such actions by Russia as ‘an attempt to put pressure on<br />

him personally’: “He is now being taken to Russia, to Krasnodar Krai. This is designed to cause<br />

me more pain because <strong>the</strong>re is no access to him, and <strong>the</strong>y don’t even allow counsels to see him.<br />

It turns out that <strong>the</strong>y will appoint a counsel for him”. 42<br />
