The disclaimer does not apply for damages or harm to life, body or health or any other damage resulting from the
deliberate or negligent breach of duty, and not for any other damage resulting from the breach of a material
contractual obligation committed by the group of persons released from liability. In the case of damages resulting
from a slightly negligent breach of duty of a material contractual obligation, the liability for financial loss and for
damage to property is limited to the typical foreseeable damage.
The disclaimer applies to claims for any legal reason whatsoever, so in particular to claims for damages based on
contractual and non-contractual liability and to claims from tortuous acts.
Responsibility of the participants
Competitors, drivers/passengers, car owners and registered keepers take part in the event at their own risk. They
bear the sole responsibility under civil and criminal law for any damage caused by them or by the car they are using
unless a liability renunciation has been agreed.
General contractual statements of competitors, drivers (competitors and drivers including several drivers
entered for one car = Participant)
Participants shall be jointly and severely liable for all obligations resulting from the entry contract.
The participants confirm that
- The specifications made on this entry form are correct and complete.
- They fully meet the requirements of the event (= untimed and timed practice, qualifying, warm-up, races to
achieve maximum speeds or shortest driving times)
- The car complies with all applicable regulations in all points.
- All parts of the car are available for inspection by the scrutineers at any time, and
- They will use the car only in a technically and visually perfect condition during the event.
Furthermore, they confirm with their signature that they have studied the content of the present Regulations as well
as this entry form including appendices, the FIA International Sporting Code (ISC) and its Appendices, the FIA
Judicial and Disciplinary Rules, the Anti-Doping Rules of the International and the National Anti Doping Agencies
(WADA/NADA Code), the applicable DMSB Regulations, the DMSB Legal and Procedural Rules (“RuVO”), the
DMSB Environmental Guidelines and all the other FIA and DMSB Regulations and they agree that all these
provisions are binding for them and that they will respect them. They are aware that the start may be refused in the
case of a missing signature. In the case of a refusal of the start as a consequence of non-compliance with the formal
requirements, the entry fees paid shall be declared forfeit and will not be refunded.
Any dispute in this context shall be settled among each other.
They acknowledge in particular that
- Any facts inherent in the person or the conduct of a team member (competitor, driver, mechanic, assistant etc.)
that affect the contractual relationship with the organiser or result in a claim for damages shall be treated as
his/her own
- The DMSB, its jurisdiction, the Stewards and the organisers – each party within the scope of their responsibilities
– are authorised, in addition to other procedures, to also inflict penalties for infringements of the sporting
regulations, the legal sporting provisions and contractual obligations, as provided for in the ISC, the RuVO, the
Regulations, Supplementary Regulations and other provision, irrespective of the right to take legal action as
provided for in the ISC, the RuVO and the regulations,
- They will not take any substances or apply any methods included in the list of prohibited substances and methods
of the WADA World Anti Doping Code and in the FIA Anti Doping Regulations.
Protest and appeal proxy
With the submission of the entry form, participants (refers also to several drivers entered for one car) authorize each
other to represent the other party/ies in any protest or appeal hearing. They authorise each other in particular to
submit protests, to withdraw them, to notify of the intention of appeal, to submit an appeal, to confirm, withdraw
appeals and to submit all applications in connection with a protest or appeal hearing as well as to submit and to
receive all statements.
For reasons of organisation, the entry confirmation will only be sent to the competitor or to one of the drivers. The
legally binding nomination of the authorized person to receive shall be made to the ADAC Nordrhein e.V. by all
parties involved in the entry on the entry form. All the parties involved in the entry herewith confirm their full and
binding agreement that the entry confirmation shall be sent to this person, that written or verbal enquiries, if any shall
be exclusively addressed to this person and that any such enquiry responded by this person shall be legally binding
for all parties involved in the entry.
The parties involved in the entry confirm that they have understood that the organiser is not obliged to recover
vehicles that have stopped beside the track

are an integral part of the entry. All persons and parties involved have taken note of those, confirm their correctness
as to the contents and by their signature accept the person nominated to represent all persons and parties involved in
their entry.
