(7)The forms, registers, returns or reports approved by the State Government or in vogue under<br />

any other law for the time being in force, but not provided in these rules, <strong>and</strong> is not inconsistent with the<br />

provisions of the Act or these rules, shall apply as if such forms, registers, returns or reports are part of<br />

these rules.<br />

(8)The Accounts Officer of the <strong>Zilla</strong> <strong>Parishad</strong> or the <strong>Panchayat</strong> <strong>Samiti</strong>, shall monitor <strong>and</strong> supervise all<br />

jobs relating to maintenance of accounts <strong>and</strong> other related work with respect to the <strong>Zilla</strong> <strong>Parishad</strong> or the<br />

<strong>Panchayat</strong> <strong>Samiti</strong> Fund, as the case may be, in the manner as may be directed by the State Government, by<br />

order.<br />

10. (1) There shall be a common seal bearing the name of the <strong>Zilla</strong> <strong>Parishad</strong> or the <strong>Panchayat</strong><br />

<strong>Samiti</strong>. The common seal shall be kept under the personal custody of the Sabhadhipati, Sabhapati,<br />

Executive Officer, <strong>and</strong> such office bearers as may be authorized by the Artha Sthayee <strong>Samiti</strong>, <strong>and</strong> shall<br />

be used in their presence in the following official records <strong>and</strong> transactions of the <strong>Zilla</strong> <strong>Parishad</strong> or the<br />

<strong>Panchayat</strong> <strong>Samiti</strong>: -<br />

(a) Receipt Book used for collection.<br />

(b) All lease documents or any other deed relating to l<strong>and</strong> or ferry, or any other immovable<br />

property or proprietorial right.<br />

(c) Agreement to which <strong>Zilla</strong> <strong>Parishad</strong> or <strong>Panchayat</strong> <strong>Samiti</strong> is a party.<br />

(d) All correspondences <strong>and</strong> documents where use of such common seal is required for<br />

transaction of business by the <strong>Zilla</strong> <strong>Parishad</strong> or the <strong>Panchayat</strong> <strong>Samiti</strong> as the case may be.<br />

(2) Facsimile of any office bearer or officer shall always be kept in the custody of the person<br />

concerned.<br />

11. (1) If any loss of money, stores or movable property held by or on behalf of the <strong>Zilla</strong><br />

<strong>Parishad</strong> or the <strong>Panchayat</strong> <strong>Samiti</strong> is caused by defalcation or otherwise, <strong>and</strong> is detected in the<br />

Treasury or in the <strong>Zilla</strong> <strong>Parishad</strong> or the <strong>Panchayat</strong> <strong>Samiti</strong> or elsewhere, shall be immediately<br />

reported by the officer concerned to his immediate superior as well as to the Executive<br />

Officer of the <strong>Zilla</strong> <strong>Parishad</strong> or the <strong>Panchayat</strong> <strong>Samiti</strong>, as the case may be, even when such loss<br />

has been made good by the party responsible<br />

for it. The District Magistrate, Director, the State Government <strong>and</strong> the Examiner of Local<br />

Accounts through the State Government shall also be kept informed of such incident.<br />

(2) The Executive Officer on receiving a report submitted to him under sub-rule<br />

shall bring the matter to the notice of the Sabhadhipati or Sabhapati, as the case may be, <strong>and</strong><br />

through him to the Artha Sthayee <strong>Samiti</strong> with such comment as may be appropriate. A<br />

departmental inquiry or investigation shall be made on the circumstances leading to defalcation<br />

or loss <strong>and</strong> a detailed report shall be submitted to the Artha Sthayee <strong>Samiti</strong> through the<br />

Sabhadhipati or Sabhapati, for consideration within one month from the date of such<br />

submission. The Executive Officer shall then report to the State Government, along with a<br />

copy of the resolution of the Artha Sthayee <strong>Samiti</strong>, particularly showing the steps taken to<br />

prevent its recurrence <strong>and</strong> disciplinary action including lodging of First Information Report in<br />

the local police Station , if <strong>Zilla</strong> <strong>Parishad</strong> or the <strong>Panchayat</strong> <strong>Samiti</strong> against the person<br />

responsible. The State Government shall send a report to the Examiner of Local Accounts<br />

along with copies of the enquiry report of the Executive Officer of the <strong>Zilla</strong> <strong>Parishad</strong> or<br />

<strong>Panchayat</strong> <strong>Samiti</strong>s, as the case may be, so received by him<br />

(3) Any loss of immovable property such as building or other works caused by fire, flood, cyclone<br />

or any other natural calamity or as a result of any civil commotion shall be reported at once to the<br />

Director.
