Track access charges: overly complicated, and a potential hindrance to competition<br />

89. Un<strong>de</strong>r the EU legal framework for rail operations, an infrastructure manager (a separate<br />

entity from the rail operator) must allow any operator to use the rail tracks if they contribute<br />

to the costs of maintaining them. These track access charges have different impacts on the<br />

sustainability of the network. Depending on the level they are set at, they can help to<br />

recover a share of the infrastructure investment costs, and if they are set low enough, they<br />

may also encourage on-track competition by allowing new market entrants to participate.
