If you’re like me, the new year can<br />

be as stressful as it is rejuvenating.<br />

All around you, people are motivated.<br />

Whether their goals are to<br />

lose weight, conquer fears or travel<br />

to exotic lands, everyone seems to<br />

be making big plans for the future.<br />

Every year, it’s a cacophony of “new<br />

year, new me!” Funny how that chorus<br />

fades by February.<br />

Business Insider claims that 80<br />

percent of people who make New<br />

Year’s resolutions fail within six<br />

weeks. On average, it takes 66 days<br />

to form a new habit, just over two<br />

months. Which means, all those resolution<br />

resigners who strive to make<br />

life changes fall short only a couple<br />

of weeks before their new routines<br />

become habit. Others, who vow to<br />

try new things, save money or make<br />

new friends, simply develop a convenient<br />

form of amnesia about their<br />

once-adamant goals.<br />

If you’re one of those who typically<br />

lets your resolutions fade, don’t be<br />

ashamed. I’m right there with you.<br />

Last year, I wrote a list of 10 things I<br />

wanted to do during 2018. I utterly<br />

failed. Not this year. This is my year.<br />

This is our year. We can do this —<br />

together!<br />

Realistic Resolutions<br />

As the saying goes: How do you<br />

eat an elephant? One bite at a time.<br />

I’m not saying to fulfill your goal<br />

of trying new foods with a taste of<br />

Dumbo. What that means is, when<br />

faced with a seemingly impossible<br />

or overwhelming task, the best way<br />

to tackle it is by taking small steps.<br />

New Year’s resolutions are no different.<br />

The first step to setting and accomplishing<br />

your goals for 2019 is<br />

to set realistic resolutions.<br />

Be honest with yourself, and give<br />

yourself permission to adjust your<br />

goals if your January enthusiam went<br />

a little overboard. Instead of saying<br />

you want to lose 30 pounds, aim for<br />

10. If you start a new regimen too<br />

eagerly, you’ll burn out just as quickly<br />

as you began. Don’t try to change<br />

your entire life overnight. Instead of<br />

cutting out all junk food, choose one<br />

meal each day to be your healthy<br />

meal. Take the pressure off of yourself<br />

to become an entirely different<br />

person just because it’s the start of a<br />

new year.<br />

If you want to travel to exotic places,<br />

try taking a solo day trip to a city<br />

you’ve never been before. Florida has<br />

some great one-day getaway destinations.<br />

to make new friends, try joining an<br />

app. Bumble isn’t just for dating.<br />

It also has a feature to find friends.<br />

Reward Good Behavior<br />

Did you go to the gym today?<br />

Did you order a side salad instead<br />

of fries? Maybe you went to dinner<br />

by yourself or bought a book or<br />

signed up for a new class. Whatever<br />

steps you took to follow through on<br />

your resolution, reward yourself!<br />

You deserve it. Change is hard.<br />

If keeping resolutions was easy,<br />

most of us wouldn’t give up in under<br />

two months. So, no matter how<br />

small your progress was, give yourself<br />

points for sticking to your goal<br />

and take a moment to congratulate<br />

yourself.<br />

We are often our own worst critics,<br />

and how sad is that? Make sure the<br />

voice in your head is a positive one.<br />

Be your own cheerleader and make<br />

sure you are rewarded for good behavior.<br />

Just don’t allow your reward<br />

to derail you from your resolution. If<br />

you’re trying to eat healthier, maybe<br />

don’t buy an entire chocolate cake<br />

as a reward. One slice, however,<br />

might be just the motivation you need<br />

to keep going.<br />

Allow Setbacks but Don’t Give Up!<br />

Since we are all human and not<br />

perfect, expect that you aren’t always<br />

going to be on track for your<br />

resolution. It’s OK to have setbacks.<br />

or avoiding taking those chances<br />

you promised yourself you would,<br />

don’t stress. Take a day off from<br />

pushing yourself, so you don’t burn<br />

out. Use that cheat day to its fullest,<br />

but get right back on track the next<br />

day.<br />

When the new year’s motivation<br />

starts to fade, remind yourself of your<br />

goals. Look at where you started and<br />

the progress you’ve already made,<br />

no matter how great or small that<br />

progress is. Keep moving forward to<br />

reach the goals you set for yourself.<br />

Don’t give up when it gets hard —<br />

that’s the exact point between who<br />

you were last year and who you<br />

want to be this year.<br />

I wish you the best of success<br />

“Poof ” It’s All Gone<br />

Lost Legacy<br />

Like magic, first you see it,<br />

think it’s real and “Poof ” It’s All<br />

Gone. Law firms are often asked<br />

the following question. If my mother or father remarries and dies before<br />

their new spouse, what happens to any assets they acquired and owned<br />

before they remarried? The answer lies in whether or not they commingled<br />

their assets.<br />

We spend our entire lives ignoring or not accepting the inevitable, that we<br />

all die. The only thing that survives us is the legacy we leave behind consisting<br />

of property, assets, photos, videos, writings, memorabilia, memories and more.<br />

When a person remarries and then dies, often everything they worked for their<br />

entire life may be lost to the surviving spouse simply because they failed to<br />

prepare sufficient estate or legacy planning before their death.<br />

Law firms see this scenario played out time, and time again. Regardless of<br />

who may be hurt and because you failed to prepare any legacy planning before<br />

your death, attorneys and courts must comply with probate law. Consider the<br />

following example.<br />

Sara owned a home, a car, bank accounts and investments. From her first<br />

marriage to Ted, Sara had 4 children. After 21 years of marriage, Ted died in<br />

an automobile accident. Two years later Sara married Bill. Bill had 3 children<br />

from a previous marriage. Bill brought no tangible assets to the marriage but<br />

he did bring a substantial income. During their marriage, Sara and Bill decided<br />

to commingle their assets and earnings as couples typically do. Three years later<br />

Sara suddenly fell ill and died.<br />

Because Sara and Bill had commingled their assets as joint property,<br />

which included all of the assets Sara had acquired before her marriage to<br />

Bill, as the surviving spouse, Bill now owned everything. In Florida, all<br />

assets jointly owned by a married couple pass to the surviving spouse.<br />

Two years following Sara’s death, Bill died suddenly. Furthermore, Bill<br />

Meet Amelia Hunter. Amelia is a master<br />

In a landmark decision, the Florida<br />

Supreme Court upheld the will of<br />

Orange County voters to hold nonpartisan<br />

elections for county constitutional<br />

officers, including clerk<br />

of the circuit court, comptroller,<br />

property appraiser, sheriff, supervisor<br />

of elections and tax collector.<br />

On Aug. 19, 2014, the Orange<br />

County Board of Commissioners<br />

enacted an ordinance giving voters<br />

an opportunity to decide if<br />

they wanted to amend the Orange<br />

County Charter to provide for term<br />

limits and nonpartisan elections for<br />

the six constitutional officers. Prior<br />

to the election, three constitutional<br />

officers challenged the validity of<br />

the ordinance. The ballot question<br />

appeared on the Nov. 4, 2014, ballot<br />

and passed by 71 percent. After<br />

the election, the trial court upheld<br />

the portion of the charter amendment<br />

providing term limits, but struck<br />

down the portion providing for nonpartisan<br />

elections. On appeal, the<br />

Fifth District Court of Appeal upheld<br />

the decision of the trial court.<br />

In November 2016, the Orange<br />

County Charter Review Commission<br />

placed essentially the same question<br />

on the ballot, and it passed<br />

again, this time by 70.5 percent. An<br />

n Increased rainfall causes<br />

flooding problems<br />

As the Southwest community<br />

grows, traffic and water-drainage issues<br />

can present challenges for residents<br />

and governments.<br />

Residents on Gotha Road recently<br />

experienced the flooding of<br />

a private pond, with dead fish in<br />

the pond and on its shores. Orange<br />

County installed pumps to drain the<br />

water, sending it to Lake Olivia, even<br />

though the water was not coming<br />

from a county road. This property<br />

experienced a similar problem in<br />

2004, according to Orange County.<br />

“It’s landlocked, and it periodically<br />

fills up over the years, so there’s not<br />

a lot of outfall opportunity, making<br />

had about 12 inches of rain per year<br />

above normal. Basically, we need<br />

to just wait for evaporation, which<br />

is happening — but slower than<br />

anticipated.”<br />

Residents told WFTV-Channel 9<br />

that the flooding first occurred when<br />

the Florida Turnpike was expanded.<br />

The Florida Turnpike denied<br />

responsibility.<br />

“This Turnpike project was designed<br />

to meet all FDOT [Florida<br />

Department of Transportation] and<br />

SJRWMD [St. Johns River Water<br />

Management District] criteria,”<br />

wrote Chad Huff, public information<br />

manager for Florida’s Turnpike<br />

Enterprise, in an email. “This is documented<br />

in SJRWMD Permit 4-095-<br />

20358-12, issued Oct. 7, 2003. The<br />

project included floodplain compensation<br />

and a design that did<br />

not increase roadway runoff to any<br />

adjacent roads, homes or developments.<br />

a larger, newly built facility at West<br />

Oaks Mall in Ocoee. The move will<br />

expand the tax collector’s presence in<br />

growing west Orange County, increasing<br />

the number of frontline employees<br />

percent and overall square footage by<br />

more than 9,000 square feet.<br />

As we enter 2019, it would be a good<br />

idea to reflect on your life and its related<br />

medical and mental health status. We<br />

make it a point to get a yearly physical<br />

from our family physician but have we<br />

ever thought of getting a yearly mental<br />

health exam? The answer is probably<br />

“no.” Maybe it’s time to begin this year<br />

to help yourself and others in society. As<br />

the suicide and homicide rates go up every<br />

year, it is important for to introspect<br />

and be proactive in getting help, if needed.<br />

The following are some of the basic<br />

tips to recognize and resolve if there is<br />

something in your life that warrants help.<br />

For children: Problems with sleep; appetite;<br />

anger; irritability; aggression;<br />

poor hygiene; poor social and communication<br />

skills; obsession with electronics<br />

and video games; temper tantrums; poor<br />

grades in school, either due to mood or<br />

concentration issues; having no friends;<br />

fears or phobias; truancy; repeated<br />

suspensions or detentions in school; issues<br />

with sexuality; violence; self-harm<br />

behaviors and/or substance use.<br />

For adults: Problems with sleep, mood<br />

and behaviors, loss of interest, excessive<br />

guilt, isolation, skipping work and making<br />

excuses, avoiding people, fear of being<br />

in public places and social settings,<br />

low self-esteem, feeling incomplete or not<br />

accomplished in life, constantly arguing<br />

with others, getting angry with people<br />

easily, gambling, impulsive behaviors,<br />

excessive consumption of alcohol or<br />

substance use, marital and relationship<br />

issues, and/or legal problems.<br />

Let’s give ourselves some credit and<br />
