Arbitrary Arrests<br />

Accord<strong>in</strong>g <strong>to</strong> Human Rights <strong>Watch</strong>, Venezuelan government authorities arrested many<br />

<strong>in</strong>nocent people. <strong>The</strong>y stated that "the government rout<strong>in</strong>ely failed <strong>to</strong> present credible<br />

evidence that these protesters were committ<strong>in</strong>g crimes at the time they were arrested,<br />

which is a requirement under Venezuelan law when deta<strong>in</strong><strong>in</strong>g someone without an<br />

arrest warrant". <strong>The</strong>y also expla<strong>in</strong>ed that "Some of the people deta<strong>in</strong>ed, moreover, were<br />

simply <strong>in</strong> the vic<strong>in</strong>ity of protests but not participat<strong>in</strong>g <strong>in</strong> them. This group of deta<strong>in</strong>ees<br />

<strong>in</strong>cluded people who were pass<strong>in</strong>g through areas where protests were tak<strong>in</strong>g place, or<br />

were <strong>in</strong> public places nearby. Others were deta<strong>in</strong>ed on private property such as<br />

apartment build<strong>in</strong>gs. In every case <strong>in</strong> which <strong>in</strong>dividuals were deta<strong>in</strong>ed on private<br />

property, security forces entered build<strong>in</strong>gs without search orders, often forc<strong>in</strong>g their way<br />

<strong>in</strong> by break<strong>in</strong>g down doors." One man was <strong>in</strong> his apartment when government forces<br />

fired tear gas <strong>in</strong><strong>to</strong> the build<strong>in</strong>g. <strong>The</strong> man went <strong>to</strong> the courtyard for fresh air and was<br />

arrested for no reason after police broke <strong>in</strong><strong>to</strong> the apartments.<br />

Violent Protests<br />

Apart from peaceful demonstrations, an element <strong>in</strong> some protests <strong>in</strong>cludes burn<strong>in</strong>g<br />

trash, creat<strong>in</strong>g barricades and have resulted <strong>in</strong> violent clashes between the opposition<br />

and state authorities. Human Rights <strong>Watch</strong> said that protesters "who committed acts of<br />

violence at protests were a very small m<strong>in</strong>ority—usually less than a dozen people out of<br />

scores or hundreds of people present". It was reported that barricades were the most<br />

common form of protest and that occasional attacks on authorities with Molo<strong>to</strong>v<br />

cocktails, rocks and sl<strong>in</strong>gshots occurred. In rare <strong>in</strong>stances, homemade mortars were<br />

used by protesters. <strong>The</strong> use of Molo<strong>to</strong>v Cocktails <strong>in</strong> some cases caught authorities and<br />

some government vehicles on fire. President Maduro has stated that some protests<br />

"have <strong>in</strong>cluded arson attacks on government build<strong>in</strong>gs, universities and bus stations."<br />

<strong>The</strong> National Guard alleged that they had prevented some violent students from the<br />

University of the Andes (ULA) from enter<strong>in</strong>g a premises. <strong>The</strong> governor of Aragua<br />

state, Tarek El Aissami, claimed that six opposition protesters were arrested for hav<strong>in</strong>g<br />

firearms with one of the arrested be<strong>in</strong>g accused of allegedly shoot<strong>in</strong>g an officer with El<br />

Aissami say<strong>in</strong>g, "He's a fascist. We ordered the Public M<strong>in</strong>istry and the entire judiciary<br />

application of all penalties" <strong>The</strong> article 68 of the constitution also states that "citizens<br />

have the right <strong>to</strong> demonstrate" as long as it is "peacefully and without weapons".<br />

Barricades<br />

Throughout the protests, a common tactic that has divided op<strong>in</strong>ions among<br />

Venezuelans and the anti-government opposition has been erect<strong>in</strong>g burn<strong>in</strong>g street<br />

barricades, colloquially known as guarimbas. Street barricades, which s<strong>to</strong>p vehicles<br />

from pass<strong>in</strong>g, violate the 50th article of the constitution of Venezuela, which grants the<br />
