long as you left the UK no<br />

more than 15 years ago.<br />

An overseas registration<br />

expires after 12 months. You<br />

must renew your registration<br />

each year, and should have<br />

been reminded to do so by<br />

Ryanair<br />

rapped<br />

A SPANISH court ruled<br />

on Wednesday that low<br />

cost carrier Ryanair’s<br />

policy of charging an<br />

extra fee for hand luggage<br />

was “abusive”<br />

and could no longer be<br />

levied in Spain.<br />

The ruling stemmed<br />

from a passenger complaint<br />

over the policy<br />

which charges most people<br />

an additional fee for<br />

bringing anything more<br />

than one personal item<br />

into the cabin.<br />

The passenger, travelling<br />

from Madrid to<br />

Brussels, went to court<br />

after airline staff forced<br />

her to pay 20 euros to<br />

bring her 10 kilo luggage<br />

on board.<br />

The court ordered Ryanair<br />

to refund her the<br />

20 euros plus interest,<br />

but rejected her demand<br />

for compensation of a<br />

further 10 euros for the<br />

suffering she experienced,<br />

according to court<br />

documents.<br />

The judge ruled that<br />

the hand luggage, by<br />

size and weight, could be<br />

easily carried in the cabin,<br />

pointing to a Spanish<br />

regulation that allows<br />

passengers to take hand<br />

luggage on board at no<br />

additional cost.<br />

The judge characterised<br />

the charge as abusive,<br />

adding that it “curtailed<br />

the rights that the<br />

passenger has recognised<br />

by law”, and declared it<br />

invalid in Spain.<br />

New race- track gets off the blocks<br />

AFTER a failed first attempt, Denia’s<br />

proposed new athletics track project<br />

has successfully gone to tender.<br />

Mondo Iberica SA were the winning<br />

bidders for the €750,000 project after<br />

the first bidding process was abandoned<br />

in May after protests from some<br />

of those firms taking part.<br />

The existing track has long been in<br />

a poor state of repair and users have<br />

been requesting a new one for several<br />

years.

Animal welfare on the local agenda<br />

THE Compromis political<br />

party in Denia have called<br />

for the formation of an official<br />

Animal Welfare Board<br />

in the Marina Alta town.<br />

The motion was presented<br />

by Rafa Carrio at a council<br />

meeting this week, saying<br />

I often wonder how people get drawn in<br />

by scammers, you hear of it all the time<br />

but how does it happen? How do people<br />

allow it to happen?<br />

I was recently approached by a couple<br />

who were considering investing their<br />

life savings. They had recently sold<br />

their house here in Spain and wanted<br />

a low risk investment which would<br />

provide them with a steady income. In<br />

the past this could have been achieved<br />

by depositing cash with your bank and<br />

getting a reasonable return on your<br />

savings, however with interest rates at an<br />

all-time low, people are being forced to<br />

shop around.<br />

So where do you start on your search for<br />

an investment product? Well my clients<br />

understandably googled ‘safe’, ‘low risk’<br />

investments and were overloaded with<br />

many different options. Not knowing<br />

where to start, they postponed their<br />

research and opted to speak with a<br />

professional who can at least explain in<br />

simple terms how investments work and<br />

what would be most suitable. Days later,<br />

my client was on his laptop checking<br />

his emails when he noticed a ‘low risk’,<br />

‘safe’, ‘capital protected’ advert appear<br />

on the top of his screen. Inquisitively<br />

he clicked on the advert and it took him<br />

through to a professional looking website<br />

where he discovered they had a fixed<br />

interest savings plan which was capital<br />

guaranteed and offered a set 6% return<br />

for the next 5 years with NO FEES! This<br />

is exactly what they were looking for so<br />

they completed the form to receive further<br />

information.<br />

Days later they received a phone call<br />

that it should involve animal<br />

experts in fields such as<br />

health as well as groups like<br />

the police, local charities and<br />

even hunters.<br />

welfare and also communication<br />

to residents on<br />

Are scammers becoming more sophisticated?<br />

from the company who were based in<br />

Malaga where a seemingly professional<br />

adviser gave them confirmation that they<br />

could have guaranteed returns of 33.82%<br />

over 5 years with no risk to their original<br />

capital. In fact he went as far as putting it<br />

in writing to them, illustrating that if they<br />

were to invest £50,000 in 5 years it would<br />

be worth £66,910!! Being sensible they<br />

started to research the company, and this<br />

fixed interest, risk free savings plan. They<br />

were re-assured by the professionalism<br />

of the product, the company boasted that<br />

they were operating in 189 countries<br />

including UK, Spain, Hongkong, Thailand<br />

and many more. Struggling to find<br />

anything negative the couple agreed to<br />

meet with their ‘so-called’ professional<br />

adviser.<br />

Having already made an appointment<br />

to see me prior to this they popped into<br />

the office to see what Chorus could offer<br />

and it wasn’t long before the clients<br />

were telling me all about the ‘risk-free’,<br />

guaranteed returns that they were about<br />

to sign up to, asking whether we had<br />

anything similar.<br />

Straight away I knew this was a scam! As<br />

an independent adviser constantly looking<br />

for the best options for my clients, and as<br />

someone with nearly 10 year’s experience<br />

advising here in Spain, all the alarm bells<br />

began to ring.<br />

As I started to investigate the product<br />

in more detail, it became very clear,<br />

very quickly that this was a completely<br />

unregulated product, the capital guarantee<br />

was about as useful as a chocolate teapot<br />

and all over its literature were the words<br />

‘for professional investors only’ (these<br />

matters ranging from stray<br />

cats to regulations regarding<br />

dangerous dogs.<br />

There will also be specific<br />

policies regarding matters<br />

such as dog parks, feral cat<br />

colonies, hunting, reporting<br />

animal abuse and dealing<br />

with abandoned pets and<br />

other domestic creatures.<br />

I’m sorry to say, but in a world where<br />

central bank interest rates are effectively<br />

0%, it is impossible to guarantee returns.<br />

The idea of a guaranteed, capital protected<br />

knows their stuff, and truly understands<br />

Yes, there are low risk, highly diversified<br />

investment funds out there that have<br />

consistently achieved growth over many<br />

years, but they are not guaranteed and the<br />

risks need to be properly discussed with<br />

an independent professional to assure<br />

for Denia has the unlikely<br />

name of Stan Tug 1004,<br />

and ferry company Balearia<br />

have revealed plans<br />

for the new vessel.<br />

It will be 11 meters long and<br />

have a beam of 4.5 meters and<br />

a 220 horsepower engine.<br />

The engine is the key to<br />

its green credentials, being<br />

more eco-efficient than the<br />

were out on the streets, markets<br />

and in shopping centres<br />

across the UK and many European<br />

countries including<br />

here in Spain.<br />

Although local branches<br />

have been busy raising funds<br />

for those ‘needy’ ex-servicemen<br />

and their dependants<br />

since the beginning of the<br />

year, their activities have<br />

increased dramatically in recent<br />

weeks as they set out on<br />

their final fundraising ‘efforts’<br />

of the year with the ‘Poppy<br />

Appeal’ in the knowledge that<br />

all of the monies collected will<br />

be used to support cases here<br />

in Spain.<br />

Currently the members<br />

from 28 branches, 12 on the<br />

Costa del Sol, and the remainder<br />

from the areas that make<br />

up Spain District North,<br />

predominantly the Costa<br />

Blanca, Calida and Almeria,<br />

have also been busy during<br />

recent weeks, collecting your<br />

thousands of donations.<br />

With poppies and collection<br />

boxes distributed to over<br />

600 bars, restaurants and<br />

other locations across the region,<br />

the four local branches<br />

mobilised their ‘armies’ of<br />

volunteers, in Mid-October.<br />

They were active at <strong>Alicante</strong><br />

airport, as well as pounding<br />

the streets at local markets,<br />

supermarkets and shops, in<br />

addition to many dozens of<br />

other venues and collection<br />

outlets.<br />

Last year the Branches<br />

in La Marina/Gran Alacant,<br />

Hondón Valley, Torrevieja<br />

and the Orihuela Costa,<br />

raised over 80,000 euro,<br />

an amount which they will<br />

be hoping to surpass when<br />

totals are tallied up in the<br />

coming days.<br />

The appeal in Spain North<br />

was launched by District<br />

Chairman Don Cubbon and<br />

the mayor of Benidorm, Antonio<br />

Pérez, on 18 October, a<br />

little earlier that the UK.<br />

On the Orihuela Costa it<br />

was boosted by the presence<br />

of two Chelsea Pensioners,<br />

Wayne Campbell and Skippy<br />

Teasdale, who were collecting<br />

at La Zenia Boulevard and in<br />

the Plaza at Villamartin. Neither<br />

of the two venues have<br />

been used for some years but<br />

the amounts collected in both<br />

locations suggest that they<br />

will, in future, be important<br />

additions to the annual list,<br />

as also will all Overseas Supermercados<br />

stores who were<br />

once again kind enough to<br />

allow collectors to sit inside<br />

their entrances.<br />

In some branches many of<br />

the poppy collection tins are<br />

still to be emptied and the<br />

monies counted, so the final<br />

figure for the District will not<br />

be released for some time,<br />

however the major Orihuela<br />

Costa and District count took<br />

place yesterday, Sunday’ at<br />

the Olympia Restaurant in<br />

Mil Palmeras.<br />

When speaking to the<br />

Leader, local appeal organiser<br />

Eddie Coleman seemed<br />

in buoyant mood. “We have<br />

done most of the counting<br />

but we still have the banking<br />

to do. I hope, nevertheless,<br />

that we will have the final<br />

figure in the next couple of<br />

weeks,” he said.<br />

“Our volunteers have been<br />

amazing and we raised just<br />

under 50,000 euro last year<br />

so anywhere approaching<br />

that amount will be an excellent<br />

achievement. Watch<br />

this space!”<br />

Sorting out your Spanish tax<br />

We all hate paying tax, but<br />

it is a fact of life in every<br />

country including Spain,<br />

and we at Sun Lawyers<br />

Tax in Spain can be a<br />

complicated issue because if<br />

you fail to make a declaration<br />

or don’t pay the correct<br />

amount, you can end up with<br />

a severe fine.<br />

frequently change their tax<br />

Spanish tax residents<br />

are liable to pay income<br />

tax on their worldwide income,<br />

which is split into two<br />

categories:<br />

1. Income from general<br />

activities – this includes<br />

income from employment,<br />

pension, and<br />

rental income<br />

2. Income from savings –<br />

this includes interest<br />

from savings, dividend<br />

payments, income from<br />

life insurance policies<br />

and gains made from<br />

the disposal or transfer<br />

of assets.<br />

Tax Allowances – As a<br />

resident you will receive a<br />

personal allowance for your<br />

Spanish income tax (from<br />

both savings and general<br />

income). These allowances<br />

include age allowance, married<br />

couple allowance and<br />

disability allowance.<br />

Since 2013, If you are a tax<br />

resident in Spain and own assets<br />

in excess of 50,000 euros<br />

outside of Spain, you are required<br />

to declare these assets<br />

under Spanish Law.<br />

An example of these assets<br />

includes:<br />

1. Assets held in any bank<br />

account.<br />

2. Property.<br />

3. Shares.<br />

4. Life insurance policies.<br />

Non-residents tax<br />

If you own a property in<br />

Spain, you must pay two<br />

taxes:<br />

1. IBI or council tax – This<br />

is a council tax that is<br />

based on the rateable<br />

value of your property<br />

(the open market<br />

annual rental value).<br />

2. Notional income tax<br />

or rental income tax.<br />

Income tax is paid by<br />

non-residents who own<br />

a property whether<br />

rented out or not.<br />

NOTE – the Spanish tax office<br />

does not send notifications<br />

of IBI tax addresses outside<br />

Spain. It is therefore advisable<br />

for a non-resident who has a<br />

property in Spain, to appoint<br />

a Fiscal Representative.<br />

Points to keep in<br />

mind<br />

1. You will not necessarily<br />

be reminded that you<br />

owe tax.<br />

2. It is your responsibility<br />

to make sure all your<br />

taxes are paid.<br />

3. Any overdue taxes<br />

must be settled before<br />

you sell or inherit a<br />

property.<br />

4. Failure to pay taxes on<br />

time can result in late<br />

payment interests and<br />

sanctions.<br />

Bare bones blow<br />

The European Union's<br />

trade chief has declared<br />

that Boris Johnson will<br />

only get a "bare-bones"<br />

trade deal next year — or<br />

none at all.<br />

The prime minister has insisted<br />

that the United Kingdom<br />

will leave the EU in<br />

January next year and have<br />

time to secure a comprehensive<br />

free trade deal by the<br />

end of the transition period<br />

in December 2020.<br />

But Sabine Weyand, the<br />

EU's Director-General for<br />

Trade, said there was only<br />

time to negotiate a "barebones"<br />

deal with the UK<br />

next year, as the transition<br />

period will give negotiators<br />

less than 12 months of talks.<br />

The other alternative,<br />

Weyand said, is a no-deal<br />

by a number of British newspapers<br />

and are said to have<br />

been made during a breakfast<br />

meeting with the Transatlantic<br />

Policy Network in Brussels<br />

The official's comments<br />

flatly contradict those of<br />

Johnson. He said on Monday<br />

that there was "absolutely<br />

no reason" why the UK could<br />

not wrap up all negotiations<br />

for a comprehensive deal in<br />

December 2020.<br />

The UK can extend the<br />

transition period, under<br />

which the UK must abide by<br />

all EU rules, for two years<br />

to December 2022, but the<br />

prime minister has repeatedly<br />

vowed not to.<br />

The Liberal Democrats<br />

said Weyand's comments underlined<br />

the risk that a Conservative<br />

government would<br />

pursue a no-deal Brexit next<br />

year.<br />

Chuka Umunna, the Lib<br />

Dems foreign affairs spokesperson,<br />

said: "It's clear the<br />

Canada-style free trade<br />

agreement that the PM seeks<br />

cannot be negotiated within<br />

the next the next year.”<br />

An EU Commission<br />

spokesperson did not deny<br />

the comments but said they<br />

would not comment on a<br />

private meeting.<br />

EU wage gap growing<br />

where wages are higher –<br />

but generally find that the<br />

cost of living is significantly<br />

the price of butane gas<br />

bottles rose by 5% last<br />

Tuesday (19 November).<br />

The set price jumped from<br />

€12.15 to €12.74 for a standard<br />

household 12.5 kilo bottle,<br />

the first price increase of<br />

2019.<br />

Suppliers have blamed a<br />

big international rise in raw<br />

high of €15.33 but have<br />

possible “green tariff” that<br />

from countries that<br />

have lower environmental<br />

your bets<br />

GARDEN enthusiasts are<br />

being urged to go green<br />

and swap their walls and<br />

fences for eco-friendly<br />

hedges.<br />

Growing a hedge can give<br />

your property a vibrant<br />

splash of colour and create<br />

an ideal habitat for birds<br />

and bees.<br />

And while they give you<br />

as much privacy and protection<br />

as bricks or wooden<br />

fencing, they can also bring<br />

you closer to nature.<br />

Experts at the Royal Horticultural<br />

Society (RHS), who<br />

are behind the hedge-growing<br />

call, say planting hedges<br />

can help turn urban concrete<br />

corners into thriving green<br />

spaces.<br />

As well as capturing pollutants<br />

and providing protection<br />

against wind, they<br />

can also act as efficient<br />

sound barriers, according<br />

to RHS research. Thick, impenetrable<br />

hedges can also<br />

be a great security feature.<br />

Hedge species in urban<br />

environments were found to<br />

provide a “crucial resource”<br />

for a wide diversity of animal<br />

species – giving them shelter,<br />

nest sites, food resources<br />

and corridors for movement.<br />

The varying structure of<br />

hedges makes them well<br />

suited for a range of specific<br />

roles, gardening experts say.<br />

Yew is extremely popular<br />

when it comes to hedgemaking.<br />

As well as being<br />

slow growing, a yew canopy<br />

can act as an effective sound<br />

barrier, while also taking<br />

pollution out of the air.<br />

Western red cedar, with its<br />

large and dense canopy, was<br />

also found to be a top performing<br />

sound barrier. Cypress<br />

is described as another<br />

good hedging plant.<br />

The RHS says that planting<br />

a mixture of species, to<br />

extend flowering or fruiting<br />

periods, or using a range of<br />

plant species to provide “a<br />

more diverse structure” can<br />

help support wildlife.<br />

the RHS, says: “In a world<br />

that is rapidly urbanising<br />

and where there is pressure<br />

on land use through the increased<br />

densification of cities,<br />

the relatively compact<br />

nature of the urban hedge<br />

may have a pivotal role in<br />

ensuring our cities remain<br />

‘liveable’, through its various<br />

ecosystem benefits.”

CHRISTMAS is coming<br />

and with it the chance to<br />

choose the perfect festive<br />

plant to bring a dash<br />

of colour to your Yuletide<br />

A competition to find everyone’s<br />

favourite Christmas<br />

plant has unveiled this<br />

year’s winner. And it is no<br />

surprise that the poinsettia<br />

has taken the 2019 title.<br />

A selection of five flowering<br />

winter plants made the<br />

shortlist. The cyclamen, the<br />

Christmas cactus, the azalea<br />

and the amaryllis joined the<br />

poinsettia as finalists.<br />

The final decision was left<br />

to a panel of expert judges,<br />

brought together by the<br />

plants@work association,<br />

which promotes the use and<br />

benefits of interior plants.<br />

And here’s the judges’ top<br />

three:<br />

• Poinsettia<br />

• Amaryllis<br />

• Christmas cactus<br />

Matthew Appleby, of Horticulture<br />

Week magazine,<br />

picked the poinsettia as his<br />

number one choice, describing<br />

it is “an iconic Christmas favourite,<br />

with new colours and<br />

sizes growing the appeal”.<br />

Award-winning garden designer<br />

Claudia de Yong also<br />

named the poinsettia as her<br />

favourite. She said: “I prefer<br />

the paler coloured ones.<br />

They look great as part of<br />

the table decoration in large<br />

bowls topped by moss.”<br />

The poinsettia was originally<br />

recognised for its mass<br />

of bright red bracts but now it<br />

comes in a variety of colours -<br />

from white and cream through<br />

greens to pinks, bronzes and<br />

yellows, pinks and of course<br />

the original shades of red.<br />

This makes it an extremely<br />

versatile plant and perfect<br />

for any Christmas theme or<br />

scheme. And it even has its<br />

own day on December 12.<br />

The amaryllis got Rona<br />

Wheeldon of Flowerona and<br />

Jane Perone’s votes. Jane<br />

said: “I just love these OTT<br />

flower bulbs! So dramatic<br />

and easy to grow, they offer<br />

value for money, gorgeous<br />

blooms and really make an<br />

impact on a room.”<br />

The amaryllis is also versatile<br />

when it comes to shape<br />

and colours, from whites<br />

through pinks and red. Each<br />

tall stem holds three large<br />

flower heads from double<br />

flowers to spidery ones.<br />

Coming in third place was<br />

the popular Christmas cacti.<br />

Matthew Appleby described it<br />

as a “retro favourite making a<br />

comeback”.<br />

for Green Buildings, voted<br />

for it, describing it as a<br />

“hearty beauty”.<br />

you around an hour or so to<br />

make the full circuit along<br />

the battlements, stopping to<br />

You may well get lost in<br />

the Old Town while exploring<br />

(I know I did many a<br />

time!), the charming little<br />

twisting streets and alleys<br />

of Dubrovnik will have you<br />

discovering mouth-watering<br />

restaurants, sweet shops<br />

and many other fascinating<br />

shops to get a souvenir from.<br />

Depending on where you<br />

stay (and how fit you are),<br />

this can dictate where you<br />

will stay. Some of the accommodation<br />

set on the hillside<br />

have the best views of the<br />

town, but be warned the walk<br />

back can sometimes prove to<br />

challenging (we got a<br />

taxi on a few occasions!).<br />

If you decide to stay somewhere<br />

slightly easier to get in<br />

and out of the town then don’t<br />

pass up the chance to travel<br />

on the cable car, this will take<br />

you to the crest of Mount<br />

Srd which looms 412 metres<br />

above the city and undoubtedly<br />

has the best views over<br />

the city and beyond.<br />

There are plenty of<br />

churches, monasteries and<br />

curious monuments of the<br />

old town, including the city’s<br />

Cathedral which is most definitely<br />

worth a visit, it is one<br />

of Dubrovnik’s large ensemble<br />

of baroque architecture,<br />

the interior artworks are a<br />

must see.<br />

If you have time, take a<br />

day tour to Kravica waterfalls,<br />

this tour typically also<br />

includes a visit to a quaint<br />

town in Bosnia called Mostar,<br />

where you can enjoy<br />

some of the local food, shop<br />

at the many bazars and also<br />

discover the UNESCO-listed<br />

Old Bridge area.<br />

But first you will visit the<br />

stunning Kravica Waterfalls<br />

where you can sightsee and<br />

swim at your leisure.<br />

Or take a tour to the Blue<br />

Cave - a tour on a boat that<br />

will take you to the most<br />

beautiful underwater caves<br />

and some of the best hidden<br />

snorkelling areas around<br />

Dubrovnik.<br />

On sale in local travel<br />

agents and hotels, there are<br />

plenty of excursions offering<br />

you the best way to explore<br />

the area.<br />

And as for nightlife! At<br />

night there is an abundance<br />

of bars and restaurants to<br />

explore, one in particular<br />

located on the outside of the<br />

city wall called the Buza Bar<br />

(although I imagine there<br />

are many other similar ones<br />

as well). A hidden gem, this<br />

bar is difficult to find, but<br />

once you are in, be prepared<br />

to chill in an exclusive setting,<br />

cocktail in hand and<br />

stunning sunset to watch.<br />

Well worth the effort of finding<br />

the door to this little secret!<br />

The buyer’s quick checklist<br />

IF you are first-time property<br />

buyer in Spain, or looking to upsize<br />

or down-size, then there are<br />

four absolutely basic things that<br />

you should review when going for<br />

something that you fancy, and have<br />

it as a checklist during a viewing.<br />

1. Check the paperwork!<br />

You should acquire a nota simple, a<br />

condensed report of the property details<br />

including a brief description of<br />

the land and property features, as<br />

well as telling you who the owner is.<br />

By having one of these, you can<br />

have peace of mind that the person<br />

selling you the house is the real owner<br />

and that the sale is legal.<br />

You should also be sure about what<br />

comes with the property: any mortgages<br />

or extra hidden fees of any<br />

kind.<br />

For example, all buildings in Spain<br />

over 20-years-old need a special inspection<br />

certificate, the Inspección<br />

Técnica de Edificios (ITE) which<br />

should be renewed every 10 years.<br />

2. Know the price per<br />

square metre and square<br />

foot<br />

The local council keeps track of and<br />

sets the minimum sale price according<br />

to the area, and use this to work out<br />

It all started rather<br />

tamely though, with Monte<br />

looking somewhat jaded<br />

and sluggish, perhaps the<br />

early start had affected<br />

up. This was the biggest field<br />

of the year, and there was<br />

some great golf played today.<br />

We had three guests playing<br />

with us today, and they<br />

were Ann Reilly, Chris Reilly<br />

and Graham Radford, and<br />

all were warmly welcomed<br />

by the captain and by the<br />

other members.<br />

Balls in the water today<br />

was a mammoth 143 and that<br />

figure was guessed correctly<br />

by Chris Reilly, and the only<br />

person to have a two today,<br />

and in the competition, was<br />

John Snelling.<br />

Nearest at hole five, with<br />

their second shot, was Michel<br />

Grin, with a very creditable<br />

2.14 metres, and at hole<br />

another excellent cross-field<br />

ball found Maccan (23) who<br />

jinked and turned, shook off<br />

his marker and laid the ball<br />

on a plate for Gonzalo (22) to<br />

thump it in the net emphatically.<br />

The deadlock having<br />

been broken, the game returned<br />

to its previous ebb<br />

and flow in the middle (although<br />

again, the finicky<br />

refereeing arguably got in<br />

the way of a decent contest<br />

there) with neither side having<br />

what could be termed a<br />

gilt-edged chance to increase<br />

their existing score.<br />

At the final blast, it was<br />

Montesinos who looked the<br />

more relieved. They had<br />

started badly, but clawed<br />

their way back against a<br />

more than decent Torre<br />

side, who simply lacked the<br />

quality and guile to make a<br />

telling difference. I’ve previously<br />

mused here that good<br />

(championship winning?)<br />

sides will always find a way<br />

to win and on this occasion,<br />

happily, Monte did. Here’s<br />

a tip for the team though,<br />

switch on and focus from<br />

that it will return to the<br />

Mar Menor region next<br />

year to La Manga Club, as<br />

ECL20 between May 31st<br />

and June 7th.<br />

The inaugural tournament<br />
