Texas Law Now<br />

Provides Choice,<br />

Diversity in Housing<br />

Area homebuyers grappling with affordability<br />

challenges and lack of diversity in housing<br />

choices now have significant relief thanks<br />

to the Texas legislature. HB 2439 passed by<br />

overwhelming majorities in the House (133 to<br />

9) and Senate (26 to 5) became effective on<br />

September 1, 2019.<br />

The law prevents local governments from<br />

enforcing regulations that artificially make<br />

housing less attainable for working families by<br />

forcing them to choose more expensive products<br />

in the design and construction of their homes.<br />

HB 2439 also helps local material suppliers<br />

and contractors who were previously limited or<br />

prohibited from doing business in some of the<br />

area’s fastest growing cities.<br />

In the hearings that preceded the bill’s passage,<br />

much of the opposing testimony came from<br />

suppliers and contractors who contended their<br />

business depended on local product mandates.<br />

Testimony in favor of the bill came from those<br />

whose business was correspondingly crippled by<br />

them.<br />

Housing advocates noted that these zoning<br />

restrictions disproportionately impact groups<br />

with lower median incomes struggling to<br />

afford the wealth-creating opportunities<br />

of homeownership. Additionally, consumer<br />

preferences for housing were, in many cases, out<br />

of step with officials who inaccurately stigmatize<br />

less expensive products.<br />

Sound policy must promote diversity, not<br />

exclusion. Intended or not, the result of these<br />

restrictions has as much to do with who can<br />

afford to live in the home as they do with what<br />

products go on the home. The ultimate form of<br />

local control is what you as a consumer get to<br />

choose. After all, it’s your home, it should be your<br />

decision so long as safety standards remain in<br />

line with code requirements.<br />

Specifically, HB 2439 prohibits a governmental<br />

entity from enforcing a regulation prohibiting,<br />

directly or indirectly, the use or installation of a<br />

product or standard permitted in the last three<br />

code cycles. The law applies to residential and<br />

commercial buildings, new construction and<br />

remodeling. This will encompass all existing or<br />

proposed restrictions in base zoning, planned<br />

development (PD) districts or any density<br />

and zoning incentives that favor the use of a<br />

particular product or construction method.<br />

The legislature carved out specific exceptions for<br />

homes located in historic districts and potentially<br />

conflicting standards for federal or state<br />

funding such as the Texas Windstorm Insurance<br />

Association. Also exempt are locally designated<br />

historic or conservation districts established prior<br />

to April 1, 2019.<br />

Municipalities that are a certified local<br />

government under the National Historic<br />

Preservation Act or have an applicable<br />

landmark ordinance that meets Texas Historical<br />

Commission standards are not subject to the<br />

new law. Under the Texas Local Government<br />

Code, cities, such as <strong>Dallas</strong>, that meet these<br />

qualifications continue to have broad latitude<br />

to regulate the appearance of areas deemed<br />

to be historically, culturally or architecturally<br />

significant. Other exceptions, pertaining to<br />

outdoor lighting, were added to address concerns<br />

from military and scientific interests.<br />

Like many new laws, the exact parameters of HB<br />

2439 are not entirely clear and may not be until<br />

they are tested in the legal arena. Other than<br />

an aggrieved party filing suit, the law allows the<br />

attorney general to stop a violation or threatened<br />

violation and recover related attorney’s fees and<br />

court costs.<br />

The outright product mandates via zoning and<br />

PD are quite clearly not allowed. Less obvious<br />

is at what point a performance or installation<br />

standard becomes onerous enough that a<br />

product is essentially prohibited or limited<br />

and the law is invoked. For example, our area’s<br />

current energy code air leakage standard can be<br />

attained with foam or batt insulation. Making that<br />

more stringent would effectively mandate foam.<br />

The law also references aesthetic methods, so<br />

some think that may impact items such as garage<br />

locations and front facade projections. Code is<br />

largely silent on those, so they are likely outside<br />

the scope of HB 2439. Arm’s length development<br />

agreements and HOA restrictive covenants are<br />

also not covered. Quite a bit of these things will<br />

be negotiated contractually between parties.<br />

Many cities never enacted exclusionary<br />

restrictions on housing products yet still offer<br />

diverse neighborhoods and homes that are<br />

desirable and attainable. Now, these same<br />

choices are opening similar doors for thousands<br />

of families seeking access to great communities<br />

and schools.<br />

awards more than $500 billion in contracts. Of those prime contracts, the federal government must set<br />

aside 23 percent for small businesses. This includes:<br />

least 51 percent owned and controlled by a U.S. citizen(s), a Community Development Corporation,<br />

an agricultural cooperative, or an Indian tribe; 2) be located within a HUBZone, which includes Indian<br />

reservations and military facilities closed by the Base Realignment and Closure Act. Enter your address<br />

In addition, for those businesses that want additional assistance to sell products or services to federal,<br />

state, or local governments can receive one-on-one counseling and training at Procurement Technical<br />

Assistance Centers (PTAC), free or low cost. How can a procurement assistance center help you? A<br />

center adviser can help you determine if your business is ready for government contracting. Can<br />

help you register in the System for Award Management (www.sam.gov ). Your adviser will help you<br />

see if you are eligible for any small business certifications and programs. Federal contracting can be<br />

Besides Federal Contracts SBA, also, has surety bonds for small businesses. Surety bonds help<br />

small businesses win construction, supply and service contracts by providing the customer with a<br />

guarantee the work will be completed. Many contracts require surety bonds, which are offered by<br />

surety companies. The SBA guarantee provides an incentive for surety companies to work with small<br />

businesses that would normally not be able to obtain the bond. Eligible small businesses can receive<br />

the bonding assistance necessary to compete for contracting and subcontracting jobs using the Surety<br />

<strong>Dallas</strong> and surrounding areas have obviously<br />

experienced remarkable growth over the last few<br />

years, especially with commercial construction<br />

and multifamily. Residential development<br />

struggles to keep pace with builders primarily<br />

focusing on infill lots and small scale shared<br />

access projects. <strong>Dallas</strong> permitted just over 2,000<br />

homes last year.<br />

<strong>Dallas</strong> is also not exempt from the impact of<br />

rising housing costs. It is well documented that<br />

the city needs 20,000 affordable housing units. In<br />

the single-family context, new affordable housing<br />

needs to be priced around $250,000 to $350,000.<br />

Getting there is especially difficult in <strong>Dallas</strong> with<br />

land prices and, in some cases, neighborhood<br />

opposition to new affordable homes.<br />

While some factors are out of our control, we<br />

need to take ownership of what we can. The<br />

stakes are too high not to. Homeownership<br />

remains the number one path to wealth creation<br />

for the American family, and the attainability<br />

of that dream here in DFW remains a primary<br />

impetus to job creation. However, for too many<br />

people homeownership is becoming less<br />

attainable, the drive to work is getting longer<br />

and the options for safe, quality homes at a<br />

reasonable price are getting fewer.<br />

A major barrier to affordable housing in <strong>Dallas</strong><br />

is the city itself. Development processes are not<br />

operating as efficiently and effectively as they<br />

should. Attempts to build attainable housing suffer


disproportionately from these unforced errors.<br />

This is not a new issue. Builders, developers and<br />

small business owners have bemoaned <strong>Dallas</strong>’s<br />

lack of transparency and predictability for years,<br />

yet <strong>Dallas</strong> has succeeded in spite of itself.<br />

Staff have to balance property owner desires with<br />

the public good while grappling with turnover and<br />

incomplete submittals from those not familiar<br />

with the city’s processes. They must do all of this<br />

without losing sight of their primary objective of<br />

protecting public safety.<br />

No place is this problem more evident than at<br />

the Oak Cliff Municipal Center, where a majority<br />

of these processes take place. There you will<br />

find a few familiar faces hanging around for<br />

hours each day. These people do not work for<br />

the city (some of them used to), but they have<br />

the expertise needed to navigate the tangled web<br />

that is the review and permitting process. “<strong>Dallas</strong><br />

is different,” they say. I say, it’s time to change<br />

“<strong>Dallas</strong> is different” into “<strong>Dallas</strong> is better.”<br />

That goal is infinitely more easily stated than<br />

achieved. First, we need the city council fully<br />

committed to improving performance and fully<br />

supportive of city staff’s efforts to increase<br />

predictability, transparency, efficiency and<br />

effectiveness. Past efforts failed to achieve this<br />

level of synergy and, accordingly, never made it<br />

beyond the planning/wishful thinking phase.<br />

Focus should then turn to the pre-development<br />

phase of the review process. This requires<br />

extensive interdepartmental communication and<br />

coordination particularly with engineering, fire,<br />

water and building inspections.<br />

The current landscape is littered with silos<br />

that need to be toppled by a combination<br />

of technology and a project management<br />

team empowered to provide comprehensive<br />

feedback on how to enhance pre-development<br />

functions. The group should espouse a culture<br />

of collaboration with the overall goal of ensuring<br />

that outcomes are reliable, efficient and wellcommunicated;<br />

responding appropriately when<br />

they are not.<br />

The scale of workforce required to run an<br />

organization the size of the City of <strong>Dallas</strong><br />

presents inherent communication and<br />

coordination challenges. As do nearly 1,000<br />

planned development districts, each with their<br />

own set of zoning regulations.<br />

All of these factors explain, but do not excuse the<br />

current situation. Residential developers in <strong>Dallas</strong><br />

go into a project with no idea how long approvals<br />

will take or how expensive unexpected surprises<br />

will be along the way. This is not the case in<br />

many surrounding cities. Even ones with tough<br />

regulations.<br />

Unlike many other cities, <strong>Dallas</strong> has a<br />

commitment to and policy for facilitating<br />

affordable and attainable homeownership.<br />

Successfully installing the comprehensive<br />

housing policy playbook first involves getting the<br />

fundamentals right. The proverbial “blocking and<br />

tackling” in the housing context are development<br />

processes that are predictable, transparent,<br />

efficient and effective.<br />

To this point, <strong>Dallas</strong> may have succeeded in spite<br />

of itself, but it has not succeeded in providing<br />

sufficient housing options for those who need<br />

it most. With leadership from council, staff<br />

expertise and industry input we can get to the<br />

point where we say “<strong>Dallas</strong> is better.” When we do,<br />

thousands of working families will finally be able<br />

to say “<strong>Dallas</strong> is home.”<br />

COMMUNTIY<br />

The National Association of Women in <strong>Construction</strong><br />

(NAWIC) is an association of women founded<br />

upon the idea of creating a support network for<br />

tradeswomen – building a community with the core<br />

purpose of strengthening and amplifying the success<br />

of women in the construction industry. In order to<br />

serve this purpose, we do our best to keep our fingers<br />

on the pulse of the industry in order to address the<br />

“pain points” – the areas requiring new approaches to<br />

keep us relevant in an ever-changing world.<br />

One of the largest issues facing the construction<br />

industry today is the skills gap – we simply don’t<br />

have enough skilled workers entering the trades to<br />

fill the available positions and meet industry demand.<br />

A huge source of potential for filling that gap is the<br />

largely untapped resource of today’s youth. Why is<br />

that resource untapped? One of the key contributing<br />

factors is that trades simply aren’t being shared with<br />

youth as viable, profitable and respectable paths for<br />

their futures.<br />

So how can we help to restore what has been lost in<br />

our current culture when it comes to how the trades<br />

are seen, while still meeting our core purpose of<br />

enhancing the success of women in the construction<br />

industry? I think that most of us can agree that<br />

improving perception of what we do and bolstering<br />

success of our industry as a whole is vital to<br />

enhancing our own successes. A key way to achieve<br />

this goal is through mentorship. In supporting young<br />

people looking to enter the trades, we create a new<br />

generation of both young men in the industry who<br />

recognize our viability in the field and young women<br />

who see the potential for their own futures.<br />

This is an integral part of what NAWIC does. We<br />

show girls and young women that they have a place<br />

in the industry, that being a tradeswoman is an<br />

honorable and viable career option, and that there are<br />

women in the workforce who are willing to mentor<br />

them and help them get their boots under them in<br />

a world where the ground can often be rocky and<br />

uncertain to start. More than that, we offer a place for<br />

them to turn for continued networking throughout<br />

their careers.<br />

Another huge “pain” point in the industry is<br />

technology and the requisite continued education<br />

to stay on top of current trends and skills. Thus, in<br />

addition to mentorship and networking, NAWIC<br />

offers education, training, and certification. Our<br />

committees provide webinars to help members learn<br />

more about specific areas of interest, and our partner<br />

and sponsor companies also often offer webinars and<br />

in-person training opportunities to our members.<br />

We have also established the NAWIC Education<br />

Foundation (NEF), which provides – in addition to<br />

several exciting and innovative programs for children<br />

ages K-12 – adult education and certification<br />

programs that are recognized by the American<br />

Council for <strong>Construction</strong> Education (ACCE).<br />

By offering our members opportunities for<br />

professional development, education, networking,<br />

leadership training, public service and more, NAWIC<br />

not only creates a support network to enhance the<br />

success of our members, but also builds community<br />

and champions women to impact the direction of the<br />

construction industry as a whole.<br />

Working in Outdoor<br />

and Indoor Heat<br />

Environments<br />

Millions of U.S. workers are exposed to heat<br />

in their workplaces. Although illness from<br />

exposure to heat is preventable, every year,<br />

thousands become sick from occupational<br />

heat exposure, and some cases are fatal.<br />

Most outdoor fatalities, 50% to 70%, occur<br />

in the first few days of working in warm or<br />

hot environments because the body needs<br />

to build a tolerance to the heat gradually<br />

over time. The process of building tolerance<br />

is called heat acclimatization. Lack of<br />

acclimatization represents a major risk<br />

factor for fatal outcomes.<br />

Occupational risk factors for heat illness<br />

include heavy physical activity, warm or<br />

hot environmental conditions, lack of<br />

acclimatization, and wearing clothing that<br />

holds in body heat.<br />

Hazardous heat exposure can occur indoors<br />

or outdoors, and can occur during any season<br />

if the conditions are right, not only during<br />

heat waves.<br />

In a warm environment, especially when<br />

physically active, the human body relies on<br />

its ability to get rid of excess heat (i.e., heat<br />

dissipation) to maintain a healthy internal<br />

body temperature. Heat dissipation happens<br />

naturally through sweating and increased<br />

blood flow to the skin. Workers cool down<br />

more rapidly if the external (environmental)<br />

heat and physical activity (metabolic heat) are<br />

reduced.<br />

If heat dissipation does not happen quickly<br />

enough, the internal body temperature<br />

keeps rising and the worker may experience<br />

symptoms that include thirst, irritability, a<br />

rash, cramping, heat exhaustion, or heat<br />

stroke.<br />

Heat stroke is the most severe heat-related<br />

illness. Workers suffering from heat stroke<br />

experience mental dysfunction such as<br />

unconsciousness, confusion, disorientation,<br />

or slurred speech. Cool these workers<br />

immediately and call 911!<br />

Heat-related illness is preventable, especially<br />

with management commitment to providing<br />

the most effective controls. An effective<br />

heat-related illness prevention program<br />

is incorporated in a broader safety and<br />

health program and aligns with OSHA’s<br />

Recommended Practices for Safety and<br />

Health Programs core elements.<br />

Workers who have not spent time recently<br />

in warm or hot environments and/or being<br />

physically active will need time to build<br />

tolerance (acclimatize or, less frequently<br />

Working in Heat... continued<br />

first few days in warm or hot environments,<br />

employers should encourage workers to:<br />

• Consume adequate fluids (water and<br />

sport drinks)<br />

• Work shorter shifts,<br />

• Take frequent breaks, and<br />

• Quickly identify any heat illness<br />

symptoms.<br />

Engineering controls such as air conditioning,<br />

with cooled air, and increased air flow,<br />

leading to increased evaporative cooling,<br />

can make the workplace safer. Other<br />

options for keeping body temperatures<br />

down in warm environments include making<br />

changes to workload and schedules. For<br />

example, empower supervisors and workers<br />

to slow down physical activity like reducing<br />

manual handling speeds or scheduling<br />

work for the morning or shorter shifts with<br />

frequent rest breaks in the shade or at least<br />

away from heat sources. Supervisors can<br />

encourage workers in warm environments<br />

to drink hydrating fluids. At a minimum,<br />

all supervisors and workers should receive<br />

training about heat-related symptoms and<br />

first aid.<br />

Heat-related illnesses can have a substantial<br />

cost to workers and employers. Heat stress<br />

can cause fine motor performance (like rebar<br />

tying or keyboarding) to deteriorate even<br />

in acclimatized individuals. Heat illness can<br />

contribute to decreased performance, lost<br />

productivity due to illness and hospitalization,<br />

and possibly death. OSHA encourages water,<br />

rest, and shade as prevention as well as<br />

treatment for heat-related illness.<br />

OSHA CAN HELP. This year, OSHA and<br />

its State Plan partners have launched a<br />

nationwide campaign to raise employer and<br />

worker awareness of the dangers of heat and<br />

other resources on preventing heat illness,<br />

CELEBRATE YOUR<br />

ARCHITECTURAL<br />

STYLE!<br />

Recently there has been debate over a proposal<br />

that would require new federal buildings to be<br />

designed and built only in a classical architectural<br />

style. In the place of diverse architectural styles<br />

used in federal buildings for decades, the order<br />

would mandate a single national style. Some<br />

people think this would ensure that all new<br />

federal buildings were harmonious to some of<br />

the older governmental buildings in Washington,<br />

D. C. such as the Supreme Court building and<br />

the traditionally designed West Building of<br />

the National Gallery of Art. Others prefer that<br />

architectural design be allowed to continue to<br />

progress to reflect current times, and reference<br />

the National Museum of African American<br />

History and Culture by David Adjaye, and the<br />

East Building of the National Gallery of Art,<br />

designed by I M Pei, who also designed the<br />

Meyerson Symphony Center and <strong>Dallas</strong> City Hall.<br />

Those in favor of more diverse and contemporary<br />

architectural styles would point out that our<br />

legislators no longer dress in knee britches and<br />

powdered wigs – just as styles of dress have<br />

evolved, so should styles of architecture.<br />

There are many architectural styles, and people<br />

may admire more than one of them. Some of<br />

the major types of residential architecture styles<br />

popular for today’s homes are:<br />

Cape Cod - A classic Cape Cod style home<br />

is a smaller home with a simple symmetric<br />

design. They are generally 1.5 stories with a<br />

moderately steep pitched roof with gables<br />

and a large chimney, generally in the center of<br />

the home. Stylistically, Cape Cod homes have<br />

simple exteriors and are commonly covered<br />

in cedar shingles or clapboard. They tend to<br />

have windows flanking a central front door and<br />

double-hung symmetric windows with shutters.<br />

The shape of this home typically means there is a<br />

formal, center-hall floor plan, with a master suite<br />

on the ground floor and additional bedrooms<br />

upstairs.<br />

Craftsman - Bungalow and Craftsman style<br />

homes emphasize natural materials — wood,<br />

stone, and brick. Wide front porches and lowpitched<br />

roofs are typical. The interior’s open floor<br />

plan features built-in furniture, big fireplaces,<br />

and exposed beams. Craftsman styles houses<br />

place an emphasis on natural materials and tend<br />

to be symmetrical structures. They often have<br />

low-pitched roofs with gables (often hipped),<br />

overhanging eaves, and wide front porches with<br />

tapered columns or pedestals that extend to the<br />

ground level.<br />

Modern Farm House uses common elements<br />

from traditional pastoral buildings—timber<br />

cladding, A-frame roofs, and lofted spaces—and<br />

puts a sleeker spin on them for a home that’s<br />

streamlined but still connected to its natural<br />

surroundings.<br />

Contemporary - architecture seeks to connect<br />

indoors and outdoors, with an emphasis on<br />

energy efficiency, sustainable materials, lack of<br />

unnecessary detail, lots of natural light and the<br />

use of glass, steel, and reinforced concrete.<br />

Mid-Century Modern denotes a style of design<br />

that was popularized from the 1930s through the<br />

1960s and continues to inspire both renovations<br />

and new builds today. Characterized by a<br />

contemporary, seemingly futuristic aesthetic<br />

and an emphasis on function, the Mid-Century<br />

Modern movement influenced many types of<br />

design. The style extends to include interior,<br />

product, industrial, and graphic design, as<br />

epitomized in the TV show Mad Men.<br />

Ranch - The ranch home, sometimes called a<br />

rambler, is typically a single-story home with a<br />

long horizontal footprint. The ranch home was<br />

initially popularized in the 1950s, a postwar<br />

style that utilized the profusion of cheap land in<br />

newly developed suburbs. Ranches are usually<br />

one-story, with a long, low roofline and simple,<br />

open layouts. Ranches are typically rectangular,<br />

L-shaped, or U-shaped, and the long horizontal<br />

structure allows for easy connection to the<br />

outdoors.<br />

Spanish and Tuscan share many of the<br />

same characteristics, with features<br />

that include curves and arches, stucco<br />

exteriors and often interior walls,<br />

terracotta roof tiles, painted interior<br />

tiles, tower-like chimneys, balconies,<br />

ornamental ironwork, arcades, and<br />

interior courtyards.<br />

Tudor homes are all about indoor living,<br />

and these homes are usually asymmetric with<br />

dominating roof lines. Tudor homes tend to be<br />

made of sturdy, ‘noble’ materials, and hold up<br />

well against time and the elements. At least one<br />

room has a large fireplace that invites families<br />

to gather around the stone hearth. The interiors<br />

are traditionally filled with dark wood paneling,<br />

exposed timbers, and many separate rooms.<br />

Victorian homes are elaborate homes with<br />

intricate details inside and out. Typically two<br />

stories, Victorian homes are built more for beauty<br />

than functionality. They have asymmetrical floor<br />

plans, steep roof pitches with dormers, large<br />

ornate porches, and grand towers and turrets.<br />

Stylistically, these homes often have ornate trim,<br />

bright, whimsical colors, eyebrow windows, and<br />

decorative railings.<br />

All of these architectural styles can produce<br />

amazing residences that truly create special<br />

homes for those who live in them. The <strong>Dallas</strong><br />

Architecture Forum celebrates the best in design<br />

and invites you to join us to learn more about<br />

architecture, landscape architecture, interior<br />

design, and public spaces and parks. Our nonprofit<br />

is for everyone, not just those in the design<br />

Panel Discussions The Forum organizes<br />

panel discussions about topics and<br />

and design professionals, and feature panelists<br />

recognized as experts in their fields. Panels have<br />

focused on Deck Parks in <strong>Dallas</strong>, Affordable<br />

Housing, the Future of Sports Stadiums, and<br />

Architectural Photography. In addition, The<br />

Forum highlights regional design talent focusing<br />

on both their design inspirations and awardwinning<br />

projects. <strong>Dallas</strong> area design leaders who<br />

have presented as part of these Panels include<br />

Emily Summers, Lionel Morrison, Max Levy,<br />

Gary Cunningham, David Hocker, Cliff Welch,<br />

Design Symposium The <strong>Dallas</strong> Design<br />

Symposium brings thought leaders from<br />

architecture, art, and design together to explore<br />

the intersection of these fields for thoughtful<br />

and critical conversation. Past participants have<br />

included: environmental artist Christo, New York<br />

Times architecture critic Michael Kimmelman,<br />

Aaron Betsky, Leo Marmol, Tom Kundig, Brad<br />

Oldham, Johnston Marklee, Terrence Riley, Karim<br />

Rashid, artists Walead Beshty and Jorge Pardo,<br />

365 Modern Living Receptions “365 Modern<br />

Living” is a series of receptions hosted by The<br />

Forum focused around living with great design<br />

every day of the year. “365 Modern Living”<br />

features some of <strong>Dallas</strong>’ most architecturally<br />

significant modern and contemporary residences<br />

and explore the ideas surrounding design,<br />

inspiration, and innovation. Attendees have the<br />

opportunity to converse with the homes’ design<br />

teams of architects, interior designers, and<br />

landscape architects as well as owners.<br />

<strong>Dallas</strong> Modern is a monograph published<br />

by The Forum featuring twenty of the most<br />
