Texas Law Now
Provides Choice,
Diversity in Housing
By Phil Crone, Executive Officer, Dallas Builders Association
Area homebuyers grappling with affordability
challenges and lack of diversity in housing
choices now have significant relief thanks
to the Texas legislature. HB 2439 passed by
overwhelming majorities in the House (133 to
9) and Senate (26 to 5) became effective on
September 1, 2019.
The law prevents local governments from
enforcing regulations that artificially make
housing less attainable for working families by
forcing them to choose more expensive products
in the design and construction of their homes.
HB 2439 also helps local material suppliers
and contractors who were previously limited or
prohibited from doing business in some of the
area’s fastest growing cities.
In the hearings that preceded the bill’s passage,
much of the opposing testimony came from
suppliers and contractors who contended their
business depended on local product mandates.
Testimony in favor of the bill came from those
whose business was correspondingly crippled by
them.
Housing advocates noted that these zoning
restrictions disproportionately impact groups
with lower median incomes struggling to
afford the wealth-creating opportunities
of homeownership. Additionally, consumer
preferences for housing were, in many cases, out
of step with officials who inaccurately stigmatize
less expensive products.
Sound policy must promote diversity, not
exclusion. Intended or not, the result of these
restrictions has as much to do with who can
afford to live in the home as they do with what
products go on the home. The ultimate form of
local control is what you as a consumer get to
choose. After all, it’s your home, it should be your
decision so long as safety standards remain in
line with code requirements.
Specifically, HB 2439 prohibits a governmental
entity from enforcing a regulation prohibiting,
directly or indirectly, the use or installation of a
product or standard permitted in the last three
code cycles. The law applies to residential and
commercial buildings, new construction and
remodeling. This will encompass all existing or
proposed restrictions in base zoning, planned
development (PD) districts or any density
and zoning incentives that favor the use of a
particular product or construction method.
The legislature carved out specific exceptions for
homes located in historic districts and potentially
conflicting standards for federal or state
funding such as the Texas Windstorm Insurance
Association. Also exempt are locally designated
historic or conservation districts established prior
to April 1, 2019.
8 CONSTRUCTIONMONTHLY.COM
Municipalities that are a certified local
government under the National Historic
Preservation Act or have an applicable
landmark ordinance that meets Texas Historical
Commission standards are not subject to the
new law. Under the Texas Local Government
Code, cities, such as Dallas, that meet these
qualifications continue to have broad latitude
to regulate the appearance of areas deemed
to be historically, culturally or architecturally
significant. Other exceptions, pertaining to
outdoor lighting, were added to address concerns
from military and scientific interests.
Like many new laws, the exact parameters of HB
2439 are not entirely clear and may not be until
they are tested in the legal arena. Other than
an aggrieved party filing suit, the law allows the
attorney general to stop a violation or threatened
violation and recover related attorney’s fees and
court costs.
The outright product mandates via zoning and
PD are quite clearly not allowed. Less obvious
is at what point a performance or installation
standard becomes onerous enough that a
product is essentially prohibited or limited
and the law is invoked. For example, our area’s
current energy code air leakage standard can be
attained with foam or batt insulation. Making that
more stringent would effectively mandate foam.
The law also references aesthetic methods, so
some think that may impact items such as garage
locations and front facade projections. Code is
largely silent on those, so they are likely outside
the scope of HB 2439. Arm’s length development
agreements and HOA restrictive covenants are
also not covered. Quite a bit of these things will
be negotiated contractually between parties.
Many cities never enacted exclusionary
restrictions on housing products yet still offer
diverse neighborhoods and homes that are
desirable and attainable. Now, these same
choices are opening similar doors for thousands
of families seeking access to great communities
and schools.
GOVERNMENT
CONTRACTING
Is it for you?
Make sure to include the Government in your target audience
The U.S. government is the largest single purchaser of goods and services in the world. Every year it
awards more than $500 billion in contracts. Of those prime contracts, the federal government must set
aside 23 percent for small businesses. This includes:
• 5 percent for small disadvantaged businesses
• 5 percent for women-owned small businesses
• 3 percent for HUBZone-certified small businesses
• 3 percent for service-disabled veteran-owned small businesses
The federal government sets aside contracts for small business, and these certification programs are
designed to help you compete for and win federal contracts. Listed below are the programs and links
to get further information.
Besides Federal Contracts SBA, also, has surety bonds for small businesses. Surety bonds help
small businesses win construction, supply and service contracts by providing the customer with a
guarantee the work will be completed. Many contracts require surety bonds, which are offered by
surety companies. The SBA guarantee provides an incentive for surety companies to work with small
businesses that would normally not be able to obtain the bond. Eligible small businesses can receive
the bonding assistance necessary to compete for contracting and subcontracting jobs using the Surety
SPECIAL DALLAS SHOW EDITION 2020 15
Dallas
Can’t Keep
Succeeding
By Phil Crone, Executive Officer,
Dallas Builders Association
in Spite
of Itself
Dallas and surrounding areas have obviously
experienced remarkable growth over the last few
years, especially with commercial construction
and multifamily. Residential development
struggles to keep pace with builders primarily
focusing on infill lots and small scale shared
access projects. Dallas permitted just over 2,000
homes last year.
Dallas is also not exempt from the impact of
rising housing costs. It is well documented that
the city needs 20,000 affordable housing units. In
the single-family context, new affordable housing
needs to be priced around $250,000 to $350,000.
Getting there is especially difficult in Dallas with
land prices and, in some cases, neighborhood
opposition to new affordable homes.
While some factors are out of our control, we
need to take ownership of what we can. The
stakes are too high not to. Homeownership
remains the number one path to wealth creation
for the American family, and the attainability
of that dream here in DFW remains a primary
impetus to job creation. However, for too many
people homeownership is becoming less
attainable, the drive to work is getting longer
and the options for safe, quality homes at a
reasonable price are getting fewer.
16 CONSTRUCTIONMONTHLY.COM
A major barrier to affordable housing in Dallas
is the city itself. Development processes are not
operating as efficiently and effectively as they
should. Attempts to build attainable housing suffer
disproportionately from these unforced errors.
This is not a new issue. Builders, developers and
small business owners have bemoaned Dallas’s
lack of transparency and predictability for years,
yet Dallas has succeeded in spite of itself.
Staff have to balance property owner desires with
the public good while grappling with turnover and
incomplete submittals from those not familiar
with the city’s processes. They must do all of this
without losing sight of their primary objective of
protecting public safety.
No place is this problem more evident than at
the Oak Cliff Municipal Center, where a majority
of these processes take place. There you will
find a few familiar faces hanging around for
hours each day. These people do not work for
the city (some of them used to), but they have
the expertise needed to navigate the tangled web
that is the review and permitting process. “Dallas
is different,” they say. I say, it’s time to change
“Dallas is different” into “Dallas is better.”
That goal is infinitely more easily stated than
achieved. First, we need the city council fully
committed to improving performance and fully
supportive of city staff’s efforts to increase
predictability, transparency, efficiency and
effectiveness. Past efforts failed to achieve this
level of synergy and, accordingly, never made it
beyond the planning/wishful thinking phase.
Focus should then turn to the pre-development
phase of the review process. This requires
extensive interdepartmental communication and
coordination particularly with engineering, fire,
water and building inspections.
The current landscape is littered with silos
that need to be toppled by a combination
of technology and a project management
team empowered to provide comprehensive
feedback on how to enhance pre-development
functions. The group should espouse a culture
of collaboration with the overall goal of ensuring
that outcomes are reliable, efficient and wellcommunicated;
responding appropriately when
they are not.
The scale of workforce required to run an
organization the size of the City of Dallas
presents inherent communication and
coordination challenges. As do nearly 1,000
planned development districts, each with their
own set of zoning regulations.
All of these factors explain, but do not excuse the
current situation. Residential developers in Dallas
go into a project with no idea how long approvals
will take or how expensive unexpected surprises
will be along the way. This is not the case in
many surrounding cities. Even ones with tough
regulations.
Unlike many other cities, Dallas has a
commitment to and policy for facilitating
affordable and attainable homeownership.
Successfully installing the comprehensive
housing policy playbook first involves getting the
fundamentals right. The proverbial “blocking and
tackling” in the housing context are development
processes that are predictable, transparent,
efficient and effective.
To this point, Dallas may have succeeded in spite
of itself, but it has not succeeded in providing
sufficient housing options for those who need
it most. With leadership from council, staff
expertise and industry input we can get to the
point where we say “Dallas is better.” When we do,
thousands of working families will finally be able
to say “Dallas is home.”
NAWIC: BUILDING
COMMUNTIY
The National Association of Women in Construction
(NAWIC) is an association of women founded
upon the idea of creating a support network for
tradeswomen – building a community with the core
purpose of strengthening and amplifying the success
of women in the construction industry. In order to
serve this purpose, we do our best to keep our fingers
on the pulse of the industry in order to address the
“pain points” – the areas requiring new approaches to
keep us relevant in an ever-changing world.
One of the largest issues facing the construction
industry today is the skills gap – we simply don’t
have enough skilled workers entering the trades to
fill the available positions and meet industry demand.
A huge source of potential for filling that gap is the
largely untapped resource of today’s youth. Why is
that resource untapped? One of the key contributing
factors is that trades simply aren’t being shared with
youth as viable, profitable and respectable paths for
their futures.
“The desire to build is primal to what it means to
be human. Something good happens to a person’s
soul when they work with their hands in the raw
elements of earth, wood and metal…But something
has been lost (or at least retreated to the shadows),
and the current culture does not esteem or
reward tradecraft as much as it used to.” Hayes,
Jeremiah. “Two Techniques to Connect the Next
Generation to the Trades.” Construction Executive,
18 September, 2019, https://constructionexec.
com/article/two-techniques-to-connect-the-nextgeneration-to-the-trades
So how can we help to restore what has been lost in
our current culture when it comes to how the trades
are seen, while still meeting our core purpose of
enhancing the success of women in the construction
industry? I think that most of us can agree that
improving perception of what we do and bolstering
success of our industry as a whole is vital to
enhancing our own successes. A key way to achieve
this goal is through mentorship. In supporting young
people looking to enter the trades, we create a new
generation of both young men in the industry who
recognize our viability in the field and young women
who see the potential for their own futures.
This is an integral part of what NAWIC does. We
show girls and young women that they have a place
in the industry, that being a tradeswoman is an
honorable and viable career option, and that there are
women in the workforce who are willing to mentor
them and help them get their boots under them in
a world where the ground can often be rocky and
uncertain to start. More than that, we offer a place for
them to turn for continued networking throughout
their careers.
Another huge “pain” point in the industry is
technology and the requisite continued education
to stay on top of current trends and skills. Thus, in
addition to mentorship and networking, NAWIC
offers education, training, and certification. Our
committees provide webinars to help members learn
more about specific areas of interest, and our partner
and sponsor companies also often offer webinars and
in-person training opportunities to our members.
We have also established the NAWIC Education
Foundation (NEF), which provides – in addition to
several exciting and innovative programs for children
ages K-12 – adult education and certification
programs that are recognized by the American
Council for Construction Education (ACCE).
By offering our members opportunities for
professional development, education, networking,
leadership training, public service and more, NAWIC
not only creates a support network to enhance the
success of our members, but also builds community
and champions women to impact the direction of the
construction industry as a whole.
them and get business from your involvement. The single greatest way to find grouped customers and network contacts is right in
Construction sales is an ever moving target. Techniques that worked years ago are less effective, yet some
traditional sales methods still produce. Which do and which don’t? How do you know which? What new
technologies and sales systems do you adopt? Does social media really produce opportunity in construction sales?
Where do you put your sales time and attention? These are all great questions and will be answered.
• What new technologies should I incorporate
• What truly works in construction sales
• How do I manage my sales effort
• What is working currently in regards to construction selling
Common Construction Sales Mistakes
THURSDAY :: 9:30AM - 11:00AM
Target Audience: Architects, General Contractors, Subcontractors, Builders, and Remodelers
Many in the construction industry consistently make the same mistakes that kill their opportunity. There are many common errors
and mentalities that hinder sales success. We’ll put a light on these problems and give the behaviors that counter them. Make
sure your approach to the customer base is the most effective possible.
These errors are often made without the contractor even realizing they’re making them. This cripples their chances of winning
profitable projects.
Impact of Social Media & Brand Identity
WEDNESDAY :: 11:30AM - 12:30PM
Target Audience: All Building and Construction Professionals
Mastering Social Media is on the top of the agenda for almost all business executives. They are constantly working to identify ways in
which their firms can make profitable use of the popular Social Media platforms: Instagram, Facebook, Twitter, LinkedIn and YouTube.
Consumers traditionally use Social Media and the Internet to simply expend content: they read it, watch it, and use it to make
informative buying decisions. They are able to use these platforms for a variety of purposes because they have immediate access to this
information in the palm of their very hands.
This represents the social media phenomenon. This phenomenon is known to have significant impact a firm’s reputation, sales, and
even survival. Yet, many executives neglect this form of media because they do not understand what it is, the various purposes it
serves or how to engage with it. When used correctly, Social Media can monetize your sales and business growth. Platforms such as
Instagram, Facebook and Twitter enable the creation of virtual customer environments (VCEs), online communities of interest formed
around specific firms, brands, or products. In today’s market we see this as the instant gratification sale.
Increasing your engagement and strengthening your brand identity is vital to the success of this process. I am here to provide you
with the steps necessary to develop this type of presence. In this presentation I will coach you through the process of establishing
your business’ brand identity across a variety of social media platforms and show you the impact it will have on your sales strategy and
overall business goals.
Fiberglass Fenestration in Commercial Buildings
WEDNESDAY :: 9:30AM - 10:30AM
Target Audience: Architects, Specifiers, or Long Term Building Owners/Developers.
Whether designing sustainable commercial or institutional building types, architects carefully consider the
qualities and long-term advantages of fenestration materials. Windows and doors provide essential protection and
architectural character to a building, and must also respond to owner-driven requirements like aesthetics, cost,
performance, maintenance, and life cycle.
Fiberglass composite is suitable for windows and doors in any climate or building type. More durable than
aluminum or vinyl, with the thermal efficiency of wood, fiberglass composite windows are an economically competitive
alternative to aluminum and vinyl windows. The multiple advantages and benefits of fiberglass composite make it a versatile
fenestration choice because of its strength, durability, low maintenance, energy efficiency, and sustainable qualities, as well as its
resistance to corrosion, dents, and scratches.
Learning Objectives:
• List the evaluation design criteria used by architects and owners when researching, designing, and specifying windows and
doors for sustainable buildings.
• Describe how the strength, durability, energy efficient, and sustainable qualities of fiberglass composite make it a suitable
material choice for windows and doors.
• Compare the environmental attributes of fiberglass composite with aluminum and vinyl windows.
• Design appropriate window installation details for new construction projects that meet human safety and welfare
requirements while contributing to an energy efficient building envelope.
Construction Project Acceleration Part 2:
A numerical example for calculating the least-duration (crash duration) and least-cost duration
THURSDAY :: 9:30AM - 10:30AM
Target Audience: Builders and Contractors
Construction project compression is an extremely important issue for contractors and owners, yet it is one of the most
misunderstood concepts leading to tremendous waste of resources and money. It can even get worse when an acceleration
effort backfires and causes a delay in addition to the extra cost. The relationship between project cost and duration is intimate
and interesting. Some projects have a “must” completion date while other projects have the least cost as the #1 objective.
Contractors need to understand this relationship: Sort out and calculate all options, and then allow the owner to make an
educated decision. This seminar explains the cost-time relationship and the process of calculating the optimum durations; cost
wise and time wise.
Working in Outdoor
and Indoor Heat
Environments
Millions of U.S. workers are exposed to heat
in their workplaces. Although illness from
exposure to heat is preventable, every year,
thousands become sick from occupational
heat exposure, and some cases are fatal.
Most outdoor fatalities, 50% to 70%, occur
in the first few days of working in warm or
hot environments because the body needs
to build a tolerance to the heat gradually
over time. The process of building tolerance
is called heat acclimatization. Lack of
acclimatization represents a major risk
factor for fatal outcomes.
Occupational risk factors for heat illness
include heavy physical activity, warm or
hot environmental conditions, lack of
acclimatization, and wearing clothing that
holds in body heat.
Hazardous heat exposure can occur indoors
or outdoors, and can occur during any season
if the conditions are right, not only during
heat waves.
In a warm environment, especially when
physically active, the human body relies on
its ability to get rid of excess heat (i.e., heat
dissipation) to maintain a healthy internal
body temperature. Heat dissipation happens
naturally through sweating and increased
blood flow to the skin. Workers cool down
34 CONSTRUCTIONMONTHLY.COM
more rapidly if the external (environmental)
heat and physical activity (metabolic heat) are
reduced.
If heat dissipation does not happen quickly
enough, the internal body temperature
keeps rising and the worker may experience
symptoms that include thirst, irritability, a
rash, cramping, heat exhaustion, or heat
stroke.
Heat stroke is the most severe heat-related
illness. Workers suffering from heat stroke
experience mental dysfunction such as
unconsciousness, confusion, disorientation,
or slurred speech. Cool these workers
immediately and call 911!
Heat-related illness is preventable, especially
with management commitment to providing
the most effective controls. An effective
heat-related illness prevention program
is incorporated in a broader safety and
health program and aligns with OSHA’s
Recommended Practices for Safety and
Health Programs core elements.
Workers who have not spent time recently
in warm or hot environments and/or being
physically active will need time to build
tolerance (acclimatize or, less frequently
used, acclimate) to the heat. During their

Working in Heat... continued
first few days in warm or hot environments,
employers should encourage workers to:
• Consume adequate fluids (water and
sport drinks)
• Work shorter shifts,
• Take frequent breaks, and
• Quickly identify any heat illness
symptoms.
Engineering controls such as air conditioning,
with cooled air, and increased air flow,
leading to increased evaporative cooling,
can make the workplace safer. Other
options for keeping body temperatures
down in warm environments include making
changes to workload and schedules. For
example, empower supervisors and workers
to slow down physical activity like reducing
manual handling speeds or scheduling
work for the morning or shorter shifts with
frequent rest breaks in the shade or at least
away from heat sources. Supervisors can
encourage workers in warm environments
to drink hydrating fluids. At a minimum,
all supervisors and workers should receive
training about heat-related symptoms and
first aid.
Heat-related illnesses can have a substantial
cost to workers and employers. Heat stress
can cause fine motor performance (like rebar
tying or keyboarding) to deteriorate even
in acclimatized individuals. Heat illness can
contribute to decreased performance, lost
productivity due to illness and hospitalization,
and possibly death. OSHA encourages water,
rest, and shade as prevention as well as
treatment for heat-related illness.
OSHA CAN HELP. This year, OSHA and
its State Plan partners have launched a
nationwide campaign to raise employer and
worker awareness of the dangers of heat and
how to protect workers. Visit www.osha.gov
for worker fact sheets, worksite posters, and
other resources on preventing heat illness,
in both English and Spanish. If you have
questions, call OSHA. It’s confidential. Call
CELEBRATE YOUR
ARCHITECTURAL
STYLE!
Recently there has been debate over a proposal
that would require new federal buildings to be
designed and built only in a classical architectural
style. In the place of diverse architectural styles
used in federal buildings for decades, the order
would mandate a single national style. Some
people think this would ensure that all new
federal buildings were harmonious to some of
the older governmental buildings in Washington,
D. C. such as the Supreme Court building and
the traditionally designed West Building of
the National Gallery of Art. Others prefer that
architectural design be allowed to continue to
progress to reflect current times, and reference
the National Museum of African American
History and Culture by David Adjaye, and the
East Building of the National Gallery of Art,
designed by I M Pei, who also designed the
Meyerson Symphony Center and Dallas City Hall.
Those in favor of more diverse and contemporary
architectural styles would point out that our
legislators no longer dress in knee britches and
powdered wigs – just as styles of dress have
evolved, so should styles of architecture.
There are many architectural styles, and people
may admire more than one of them. Some of
the major types of residential architecture styles
popular for today’s homes are:
Cape Cod - A classic Cape Cod style home
is a smaller home with a simple symmetric
design. They are generally 1.5 stories with a
moderately steep pitched roof with gables
and a large chimney, generally in the center of
the home. Stylistically, Cape Cod homes have
simple exteriors and are commonly covered
in cedar shingles or clapboard. They tend to
have windows flanking a central front door and
double-hung symmetric windows with shutters.
The shape of this home typically means there is a
formal, center-hall floor plan, with a master suite
on the ground floor and additional bedrooms
upstairs.
Craftsman - Bungalow and Craftsman style
homes emphasize natural materials — wood,
stone, and brick. Wide front porches and lowpitched
roofs are typical. The interior’s open floor
plan features built-in furniture, big fireplaces,
and exposed beams. Craftsman styles houses
place an emphasis on natural materials and tend
to be symmetrical structures. They often have
low-pitched roofs with gables (often hipped),
overhanging eaves, and wide front porches with
tapered columns or pedestals that extend to the
ground level.
Modern Farm House uses common elements
from traditional pastoral buildings—timber
cladding, A-frame roofs, and lofted spaces—and
puts a sleeker spin on them for a home that’s
streamlined but still connected to its natural
surroundings.
Contemporary - architecture seeks to connect
indoors and outdoors, with an emphasis on
energy efficiency, sustainable materials, lack of
unnecessary detail, lots of natural light and the
use of glass, steel, and reinforced concrete.
Mid-Century Modern denotes a style of design
that was popularized from the 1930s through the
1960s and continues to inspire both renovations
and new builds today. Characterized by a
contemporary, seemingly futuristic aesthetic
and an emphasis on function, the Mid-Century
Modern movement influenced many types of
design. The style extends to include interior,
product, industrial, and graphic design, as
epitomized in the TV show Mad Men.
Ranch - The ranch home, sometimes called a
rambler, is typically a single-story home with a
long horizontal footprint. The ranch home was
initially popularized in the 1950s, a postwar
style that utilized the profusion of cheap land in
newly developed suburbs. Ranches are usually
one-story, with a long, low roofline and simple,
open layouts. Ranches are typically rectangular,
L-shaped, or U-shaped, and the long horizontal
structure allows for easy connection to the
outdoors.
Spanish and Tuscan share many of the
same characteristics, with features
that include curves and arches, stucco
exteriors and often interior walls,
terracotta roof tiles, painted interior
tiles, tower-like chimneys, balconies,
ornamental ironwork, arcades, and
interior courtyards.
Tudor homes are all about indoor living,
and these homes are usually asymmetric with
dominating roof lines. Tudor homes tend to be
made of sturdy, ‘noble’ materials, and hold up
well against time and the elements. At least one
room has a large fireplace that invites families
to gather around the stone hearth. The interiors
are traditionally filled with dark wood paneling,
exposed timbers, and many separate rooms.
Victorian homes are elaborate homes with
intricate details inside and out. Typically two
stories, Victorian homes are built more for beauty
than functionality. They have asymmetrical floor
plans, steep roof pitches with dormers, large
ornate porches, and grand towers and turrets.
Stylistically, these homes often have ornate trim,
bright, whimsical colors, eyebrow windows, and
decorative railings.
All of these architectural styles can produce
amazing residences that truly create special
homes for those who live in them. The Dallas
Architecture Forum celebrates the best in design
