Question: It has now been more than a month since<br />

Mr. Corell made a ra<strong>the</strong>r categorical statement<br />

closing <strong>the</strong> door on <strong>the</strong> trial <strong>of</strong> <strong>the</strong> Khmer Rouge. A<br />

lot <strong>of</strong> people have said <strong>the</strong>y are very unhappy with<br />

that. Have you reopened <strong>the</strong> dossier, and do you see<br />

any chance <strong>of</strong> coming to an agreement with <strong>the</strong><br />

<strong>Cambodia</strong>n Government?<br />

The Secretary-General: About a dozen ambassadors<br />

came to see me on this issue, and <strong>the</strong>y felt that we<br />

should reconsider. I advised <strong>the</strong>m that I thought it<br />

would be more effective if <strong>the</strong>y undertook a<br />

démarche in Phnom Penh and persuaded Prime<br />

Minister Hun Sen to change his position and attitude,<br />

and to send <strong>the</strong>m a clear message that he is interested<br />

in a credible tribunal which met international<br />

standards - that <strong>the</strong>y needed to start <strong>the</strong>re.<br />

STATEMENT FROM THE ROYAL<br />

GOVERNMENT OF CAMBODIA TASK FORCE<br />

ON THE KHMER ROUGE TRIAL<br />

The statement on <strong>the</strong> Khmer Rouge trials by<br />

<strong>the</strong> Secretary-General <strong>of</strong> <strong>the</strong> United Nations on<br />

Wednesday, 13 March 2002 reflects certain<br />

misunderstandings <strong>of</strong> <strong>the</strong> <strong>Cambodia</strong>n government<br />

position, which we would like to clarify in <strong>the</strong> belief<br />

that <strong>the</strong>re is every basis <strong>for</strong> <strong>the</strong> negotiations to resume.<br />

The Secretary-General is quoted as saying that<br />

<strong>Cambodia</strong> must show that it desires credible war<br />

crimes trials and that <strong>Cambodia</strong> was obstructing<br />

ef<strong>for</strong>ts to create a framework that would guarantee a<br />

fair trial that meets international standards.<br />

But it was precisely in order to assure a<br />

credible trial on <strong>the</strong> basis <strong>of</strong> internationally accepted<br />

standards that <strong>Cambodia</strong> in 1997 sought UN<br />

assistance and participation in <strong>the</strong> trial, and this<br />

continues to <strong>for</strong>m <strong>the</strong> basis <strong>of</strong> <strong>Cambodia</strong>’s good-faith<br />

negotiations.<br />

The Khmer Rouge Law, which was itself <strong>the</strong><br />

product <strong>of</strong> those negotiations, provides checks and<br />

balance between <strong>the</strong> numbers and decision-making<br />

powers <strong>of</strong> <strong>the</strong> <strong>Cambodia</strong>n and <strong>for</strong>eign judges,<br />

investigating judges and prosecutors; and provides<br />

specific guarantees <strong>of</strong> <strong>the</strong> legal rights <strong>of</strong> defendants.<br />
