Through a different lens: Benny Sullivan’s truck
is rolling tribute to his son and others who have
been diagnosed with Lowe Syndrome
Waylon Sullivan was almost a year old when
he was diagnosed with Lowe Syndrome, a
disease that mainly affects the brain, eyes and
kidneys and affects one out of every 5,000 males.
His father, truck driver Benny Sullivan,
said Waylon was born with cataracts in his
eyes, which is highly irregular with babies.
After Waylon went through a round of initial
surgeries, he was referred to the University
of Alabama at Birmingham, where they
discovered that his acids and proteins were
really high.
“That’s when we put everything together and
he was able to be diagnosed,” Benny Sullivan
said. “Normally the mother is a carrier of this
syndrome, but they don’t usually know until
they have a child.
“My wife, Wendy, was tested and she was
not a carrier of the gene … I wouldn’t be able
to explain what caused it, because we don’t
know,” he continued. “God chose us to take
care of this special guy.”
Sullivan has been in the trucking industry
for 12 years. He drives a 2015 Kenworth
T680 and is leased to Kaplan Trucking Co.
in Cleveland, Ohio, where he mostly hauls
steel. Sullivan’s truck is decorated with large
eyeglasses with more than 194 names of
children who have been diagnosed with Lowe
Syndrome printed in each lens. The truck also
features custom-made lights in the shape of an
“X” to represent the chromosome children that
suffer from Lowe Syndrome are missing.
Sullivan displays the truck at different
shows, which gives him an opportunity to tell
others about the Lowe Syndrome. Sullivan said
he has been able to spread some awareness,
thanks to local newspaper coverage and when
people ask him questions at truck stops, and
that he likes talking to others about the issue
because it shows they care and are interested
in helping.
“It shows me that the truck is doing what
it is designed to do — making people aware,”
he said. “There are less than 1,000 kids in the
world with Lowe Syndrome. To make people
aware (of this) means a lot to me. These kids
still need help, because there is still more
research to be done and things like that.”
Sullivan said he has had the opportunity to
“A lot of these families have already gone
through the early stages that we are currently
in, so it has been a good support group for us,”
he said.
In an effort to raise money for the Lowe
Syndrome Association, a nonprofit that
supports research into Lowe Syndrome
and provides resources for individuals and
families affected by the syndrome, Sullivan
was planning to host a truck and motorcycle
show in Hamilton, Alabama, Aug. 1, but the
show was canceled due to the COVID-19
pandemic. He said he is considering planning
another event in April or May 2021. For
“We are hoping (a show) will be a great
event,” Sullivan said.
Sullivan also said he hopes enough people
will take part in the first event and that their
participation will lay the groundwork for
future events.
“It will be a good opportunity to talk
to people and raise money for the Lowe
Syndrome Association, and hopefully they get
some more info about (the illness),” he said.
Waylon goes to therapy twice a week in
Jasper, Alabama. Sullivan said that for the
most part, Waylon is a happy baby, although a
little moody — a symptom of Lowe Syndrome.
At 17 months, Waylon only weighs 18 pounds
due to slow muscle development.
Lawsuit against California
city, police department claims
discrimination against minority
trucking contractors
Independent Contractor Staff — More
than 50 minority truckers are planning to
file a petition in support of a lawsuit against
the Oakland Police Department (OPD) and
the City of Oakland.
The taxpayer lawsuit filed by Steven Fajardo,
a retired Hispanic police officer, seeks
declaratory and injunctive relief to prevent
the expenditure and waste of public funds in
the unauthorized process used by the OPD,
alleging that the department favors Dreisbach
Enterprises, a single, large trucking
More than 50 minority truckers
say they will support a lawsuit
against the City of Oakland,
California, and the Oakland Police
Department. The lawsuit alleges
that the police department issued
“secret permits, giving the Port
of Oakland’s corporate partner
unlawful advantage.
partner of the Port of Oakland. The OPD
allegedly issued Dreisbach secret, noncompliant
permits needed for the operation of
heavyweight trucks on the streets of West
Oakland and within the Port of Oakland. The
lawsuit, filed in the Alameda Superior Court,
is before Judge James Reilly in Case No. RG
20061840.
According to the lawsuit, a former OPD
police officer, who is Caucasian, violated
Oakland city ordinances when he unilaterally
changed critical “trailer safety requirements”
from four tires per axle to only two
tires per axle, even though neither the current
chief of police or any predecessor had
formally established any new or additional
safety and equipment criteria for use in determining
whether an operator’s overweight
truck satisfies the safety requirements mandated
by law. The lawsuit further alleges that
neither the public or any independent truck
driver was notified of this potential or actual
change, and that the change was not posted
on the Port of Oakland’s website until four
years after the fact.
According to the filing, the “secret”
change occurred after the Port of Oakland
entered into a lucrative arrangement for the
construction of a cold-storage facility at the
port through a joint venture between Dreisbach
and conglomerate Lineage Logistics.
These changes, made without public hearings
and comment, allegedly allowed Dreisbach
alone to receive special permits from
the OPD to use specialized chassis, giving
Dreisbach a disproportionate economic advantage
over African American, Mexican
American and other racial minority truckers
at the port.
Ignacio De La Fuente, a former member
of the Oakland City Council and a truckingindustry
expert, summed up the concerns
of the more than 50 independent minority
truckers supporting the lawsuit as follows:
“As if local law-enforcement agencies have
not done enough damage to the African-
American, Mexican-American and minority
communities, the OPD has clandestinely
and unfairly rigged the system in favor of
the city’s partner (Dreisbach) at the expense
of small, minority, independent truckers trying
to get by in this already economically
challenging time.”
Fajardo is represented by Eduardo G.
Roy, a Bay Area attorney.
“It is time for the Oakland City mayor
and acting police chief to immediately put
the brakes on the Dreisbach’s illegal special
permits and the improper favoritism,
and investigate the systemic unfairness and
disproportionate impact these illegal and
unsafe policies and practices are having on
our African American, Mexican American,
and minority communities,” Roy said. “We
have uncovered much evidence to show the
city before any further changes or policies
are considered by the acting police chief.”
Roy is also representing a Dreisbach
competitor, PCC Logistics/Pacific Transload
Systems, in a separate lawsuit against
Dreisbach that has been pending since December
2018 and is set for trial in February
Trump reins in major
environmental law to speed big
projects; ATA says ‘this is good
news for truckers’
The Associated Press — President Donald
Trump announced Wednesday, July 15, that
he is rolling back a foundational Nixon-era
environmental law that he says stifles infrastructure
projects but that is credited with ensuring
decades of scrutiny of major projects
and giving local communities a say.
Trump was in Atlanta to announce changes
to the National Environmental Policy Act’s
regulations for how and when authorities
must conduct environmental reviews, making
it easier to build highways, pipelines, chemical
and solar plants, and other projects. The
1970 law changed environmental oversight in
the U.S. by requiring federal agencies to consider
whether a project would harm the air,
land, water or wildlife, and giving the public
the right of review and input. The president
said the final rule will promote the rebuilding
of America.
“Together we’re reclaiming America’s
proud heritage as a nation of builders and a
nation that can get things done,” Trump said.
The American Trucking Associations
(ATA) praised the Trump administration for
finalizing the proposed rule, which the ATA
said will speed up the review process for
critically needed investments in the country’s
roads and bridges.
“This is good news for truckers, the motoring
public, our economy and the environment,”
said Chris Spear, ATA president and
CEO. “It currently takes an average seven
years for a highway construction project
to get through federal permitting, which is
counterproductive in the extreme. This cumbersome
review process presents an enormous
obstacle to modernizing our outdated
infrastructure, contributing to more traffic
congestion and the harmful emissions that
come with it.”
ATA noted that the trucking industry loses
$74.5 billion every year to traffic congestion
on the national highway system, which
equates to 425,000 truck drivers sitting idle
for an entire year — emitting a staggering 67
million tons of CO2.
“Infrastructure investment is a surefire way
to reduce our nation’s environmental impact,
and this action by President Trump will help
accelerate construction projects that reduce
waste and result in a more efficient and resilient
supply chain and transportation system
for decades to come,” said Randy Guillot,
ATA chairman and president of Triple G Express
and Southeastern Motor Freight.
“Of course, streamlining project approvals
won’t matter if states don’t have the fund-
12 INDEPENDENT CONTRACTOR 2020 HUNDREDS OF JOBS www.TheTrucker.com/jobs
Independent Contractor
NEWS
ing needed to plan projects and break ground.
COVID-19 has caused a 14% drop in Highway
Trust Fund revenue, widening the investment
gap and hurtling us closer to the
funding cliff,” Guillot said. “If Congress
fails to act this year on its constitutional responsibility,
it risks derailing our economic
recovery.”
Critics called the Republican president’s
efforts a cynical attempt to limit the public’s
ability to examine and influence proposed
projects under one of the country’s bedrock
environmental protection laws.
“This may be the single biggest giveaway
to polluters in the past 40 years,” said Brett
Hartl, government affairs director at the Center
for Biological Diversity, an environmental
group that works to save endangered species.
Trump has made slashing government regulation
a hallmark of his presidency and held
it out as a way to boost jobs. Environmental
groups say the regulatory rollbacks threaten
public health and make it harder to curb global
warming. With Congress and the administration
divided over how to increase infrastructure
investment, the president is relying on his
deregulation push to demonstrate progress.
Among the major changes are limiting
when federal environmental reviews of
projects are mandated and capping how long
federal agencies and the public have to evaluate
and comment on any environmental impact
of a project.
“We won’t get certain projects through
for environmental reasons. They have to be
environmentally sound. But you know what?
We’re going to know in a year. We’re going
to know in a year and a half. We’re not going
to know in 20 years,” Trump said.
Opponents say the changes will have an
inordinate impact on predominantly minority
communities. More than 1 million African
Americans live within a half-mile of natural
gas facilities and face a cancer risk above the
Environmental Protection Agency’s level of
concern from toxins emitted by those facilities,
according to a 2017 study by the Clean
Air Task Force and the National Association
for the Advancement of Colored People.
“Donald Trump is taking away the last
lines of defense for front-line communities
and continues to demonstrate a total disregard
for our environment and for those demanding
racial and environmental justice,”
said Senate Minority Leader Chuck Schumer
(D-N.Y.).
For his announcement, Trump chose Georgia,
a swing state in the general election.
Trump won the Republican-leaning state by
5 percentage points in 2016, but some polls
show him trailing former Vice President Joe
Biden, the presumptive Democratic nominee.
This was Trump’s ninth trip to Georgia and his
sixth visit to Atlanta during his presidency.
The White House said the administration’s
efforts will expedite the expansion
of Interstate 75 near Atlanta, an important
freight route where traffic can often slow to
a crawl. The state will create two interstate
lanes designed solely for commercial trucks.
The state announced last fall, before the
White House unveiled its proposed rule, that
it was moving up the deadline for substantially
completing the project to 2028.
Trump, who spoke at a UPS facility, said
the project will save the company and its
drivers an extraordinary number of hours a
year.
New DEF product can help reduce deposits
in exhaust systems, manufacturer says
Independent Contractor Staff — Old World Industries
LLC, the manufacturer of BlueDEF, has
launched a new premium product, BlueDEF Platinum,
which the company describes as a “breakthrough
innovation” in diesel exhaust fluid.
Ten years ago, the federal government tasked
manufacturers with reducing the emitted nitrogen
oxide (NOx) levels of diesel vehicles, which resulted
in the development of selective catalytic reduction
(SCR) systems that use diesel exhaust fluid
(DEF). Since the inception of SCR, there have
been issues with deposit build-up especially with
low-quality DEF, which can lead to back pressure,
resulting in increased fuel consumption as well
as reduced engine power. Because these deposits
cannot be removed and can lead to costly repairs,
the industry has been looking for a breakthrough
for the past several years — until now.
BlueDEF Platinum is a mixture of high-purity
synthetic urea, deionized water and a proprietary
formulation featuring Old World Industries’ new
Advanced System Shield Technology, which
significantly reduces harmful deposits that commonly
build up in modern diesel-exhaust systems
with SCR. With regular use of BlueDEF Platinum,
these harmful deposits can be significantly
reduced, providing optimum fuel economy, saving
money on costly repairs and sustaining the life of
the system.
