Public Comment Period and Public Hearing for<br />

Draft Solid Waste Management Plan<br />

The North Central Ohio Solid Waste District (District) is establishing a 30-day written comment period<br />

(Wednesday, March 1, <strong>2023</strong>, until Thursday, March 30, <strong>2023</strong>) on the draft solid waste management plan (Ohio<br />

Revised Code Section 3734.55). The District has prepared a draft solid waste management plan as required<br />

by Section 3734.54 of the Ohio Revised Code. Once the 30-day written comment period is over, the District<br />

will hold two public hearings to obtain oral comments regarding the draft Solid Waste Management Plan Update<br />

on Monday, April 3, <strong>2023</strong>, at the Union County Office Building, 233 West 6th Street, Commissioners Hearing<br />

Room, Marysville, Ohio at 9:00 am, and at the Allen County Court of Appeals, 204 N. Main Street, 1st Floor<br />

Conference Room, Lima, Ohio at 11:30 am.<br />

The District will accept written comments, as required by Ohio Revised Code Section 3734.55, on the draft<br />

Plan Update from March 1, <strong>2023</strong> – March 30, <strong>2023</strong>. Written comments must be submitted by March 30, <strong>2023</strong>,<br />

to Mr. Jack DeWitt, NCO Solid Waste District, 815 Shawnee Road, Suite D, Lima, Ohio 45805, or by email to:<br />

jack@ncowaste.org. Please call (419) 228-8278 with any questions about the draft Plan Update, public comment<br />

period or public hearing.<br />

The draft Plan Update includes a budget and fees to finance the Plan, a solid waste facility inventory, projections<br />

and strategies, facilities and programs to be used, and an analysis of the progress made toward achieving<br />

state solid waste reduction goals. The Plan Update includes six chapters that are prepared specifically for the<br />

public’s review. They include: Introduction, District Profile, Waste Generation, Waste Management, Waste Reduction<br />

and Recycling and Budget.<br />

This draft is an update to a previously approved solid waste plan. This Plan Update details the following: Recycling<br />

Infrastructure Inventory, Population Data, Disposal Data, Residential/Commercial/Industrial Recycling<br />

Data, Waste Generation Data, a Strategic Evaluation of Old and New Proposed District Programs, Methodology<br />

to Select Program Priorities, Achievement of State Recycling Goals, Education and Outreach Programs, Greenhouse<br />

Gas Emissions Calculations, Financial Data, Designation of Facilities, and a updated Siting Strategy.<br />

The draft plan includes a demonstration of access to capacity that determines there is more than fifteen years<br />

of landfill capacity available to the District. Under this plan, the Board of Commissioners is authorized to designate<br />

facilities in accordance with Section 343.014 of the Ohio Revised Code.<br />

The draft Plan Update complies with State Plan Goal #1: Providing infrastructure for recycling to over 80% of<br />

the population in each county of the District. The District is committed to maintaining its achievement of<br />

Goal 1. The District funds plan programs and current operations through a contract fee with designated facilities<br />

that accept solid waste from the District.<br />

Public Notice<br />

The City of London Building Department this day made and entered upon its records the following order:<br />

The premises affected by this order is known or described at 5 Stewart Street, London, OH 43140.<br />

A structure on this premises has been declared unsafe and dangerous and shall be abated by construction<br />

or demolition. Further Sections 109.4 and 113.2 of the 2019 Residential Code of Ohio requires: “Residential<br />

buildings, structures and the building equipment shall be maintained in a safe and sanitary condition...” You<br />

can bring the structure in compliance in one of the two following ways:<br />

Compliance by Construction:<br />

1. Submit construction documents prior to commencing construction.<br />

(2019 Residential Code of Ohio) 105.1 Approval Required.<br />

Any owner or authorized agent who intends to construct, enlarge, alter, repair, move or change the occupancy of<br />

a residential building or structure, or portion thereof, or to erect, install, enlarge, alter, repair, remove, convert or<br />

replace any electrical, gas, mechanical, plumbing system, other residential building service equipment, or piping<br />

system, the installation of which is regulated by this code, or to cause any such work to be done, shall first make<br />

application to the building official and obtain the required approval.<br />

Compliance by Demolition:<br />

1. The removal of all structure and non-structural members, including the foundation from the site.<br />

2. The filling in of all excavations relating to the removal of said structure.<br />

3. The removal of all storage or debris in conjunction with the demolition process.<br />

4. The safe and adequate elimination of all utility connections.<br />

5. Secure necessary demolition permits and approvals.<br />

This order must be complied with within thirty (30) days from the date of order. Failure to comply with this<br />

Order will result in demolition of the property. Additionally, any person who fails to obey an order of the<br />

Building Official is guilty of a misdemeanor, and shall be fined not more than $300.00 for each offense as<br />

provided in Ohio Revised Code Sections 307.37 and 307.99 (c). Each day during which a violation of these<br />

regulations occurs shall be a separate offense.<br />

In accordance with Chapter 119 of the ORC, you have 30 days from the mailing date of appeal the adjudication<br />

order. To request an appeal hearing, submit and complete an Residential Building Appeal application along<br />

with a check or money order for $200.00 made payable to:<br />

The written request shall include the items from the Correction Letter being appealed, the reasons for the<br />

appeal and relief sought. A copy of this notice shall be attached to your request.<br />

At an appeal hearing you have the right to be represented by counsel. You may present arguments orally or<br />

in writing. You may also present evidence and examine witnesses appearing for or against you.<br />

Further, as provided in O.R.C. Section 307.37 in the event any building is being maintained in violation of<br />

these regulations, the City Council, the Prosecuting Attorney for the City of London, or the Building Official<br />

or any adjacent neighboring owner who would be especially damaged by such violations may institute a<br />

suite for injunction, abatement or other appropriate action to prevent such a violation.<br />
