Intestate<br />

Recent research has indicated<br />

approximately 65% of<br />

New Zealanders do not have a<br />

will, and as <strong>September</strong> is Wills<br />

month, we thought it fitting to<br />

remind you of the consequences<br />

of dying without a will, also<br />

known as dying intestate.<br />

When someone dies without a<br />

valid will, the distribution of their<br />

assets is determined by the laws<br />

of intestacy, as set out in the<br />

Administration Act 1969.<br />

Intestacy rules allocate the<br />

deceased’s estate among their<br />

family members in a specific<br />

hierarchy. Generally, the spouse,<br />

civil or de-facto partner and<br />

children are given precedence.<br />

If there is no spouse or children,<br />

the estate may be distributed to<br />

parents, siblings, or more distant<br />

relatives. These rules might not<br />

align with your personal wishes<br />

and could potentially lead to<br />

conflict among family members.<br />

The estate administration<br />

process for intestate succession<br />

is likely to be more timeconsuming<br />

and complex than<br />

distributing assets according<br />

to a valid will. To avoid the<br />

complications associated with<br />

dying intestate, it’s crucial to<br />

create a legally valid will. This<br />

document helps ensure that your<br />

assets are distributed according<br />

to your wishes, minimises the<br />

potential for family disputes, and<br />

provides a smoother transition<br />

for your loved ones during an<br />

already difficult time.<br />

A will may also include your<br />

preference for burial/cremation.<br />

This can help to reduce the stress<br />

for loved ones allowing them to<br />

honour you in the way you wish<br />

to be honoured.<br />

Seeking legal advice when<br />

creating a will (or checking if your<br />

existing Will is still valid e.g. on<br />

marriage or separation) helps<br />

ensure its validity and accuracy.<br />

Taking this step will provide you<br />

with the peace of mind that your<br />

loved ones will be provided for in<br />

the way you intend.<br />

ROLLESTON COLLEGE student Shaun<br />

Kempton took full advantage of his<br />

first appearance for the New Zealand<br />

schools side by scoring a try in the team’s<br />

57-22 win over the Barbarians on Saturday.<br />

Two weeks ago, the <strong>Selwyn</strong> <strong>Times</strong> reported<br />

on Kempton’s selection to the side. It<br />

was a big moment for the 17-year-old, who<br />

lost his dad in a tragic workplace incident<br />

earlier this year.<br />

Kempton, the first Rolleston College<br />

student to be selected for the team, came<br />

on in the second half when NZ Schools had<br />

established a convincing lead.<br />

Despite the fulltime score, it was a<br />

competitive match that saw the Barbarians<br />

trailing by just five (17-12) after 20 minutes.<br />

Captain Oli Mathis crashed over for two<br />

tries in the game, with No 8 Mosese Bason<br />

also scoring two.<br />

The match at St Paul’s Collegiate in<br />

Hamilton was the first of three fixtures for<br />

the NZ Schools team.<br />

They will now turn their focus to meeting<br />

the Australian under-18 team tomorrow<br />

in Canberra before facing off against them<br />

again on Monday.<br />
