<strong>Birds</strong> <strong>in</strong> <strong>the</strong> <strong>European</strong> <strong>Union</strong>: a status assessment – Results<br />

■ <strong>Birds</strong> as <strong>in</strong>dicators for wider biodiversity and<br />

environmental objectives<br />

The EU Heads of State committed <strong>the</strong>mselves to halt<strong>in</strong>g <strong>the</strong><br />

loss of biodiversity by 2010, <strong>in</strong> Go<strong>the</strong>nburg <strong>in</strong> 2001. To measure<br />

<strong>the</strong> progress towards <strong>the</strong>se goals and <strong>the</strong> impacts of EU policies,<br />

which may ei<strong>the</strong>r support or underm<strong>in</strong>e <strong>the</strong>se targets, it is<br />

necessary to measure changes of biodiversity. However,<br />

biodiversity is a complex phenomenon and we need simple<br />

<strong>in</strong>dicators, which provide us with <strong>in</strong>formation about <strong>the</strong> ma<strong>in</strong><br />

trends <strong>in</strong> order to take <strong>the</strong>m <strong>in</strong>to account <strong>in</strong> political decision<br />

mak<strong>in</strong>g.<br />

<strong>Birds</strong> are ideal <strong>in</strong>dicators of <strong>the</strong> trends <strong>in</strong> overall biodiversity<br />

because:<br />

<strong>the</strong>y usually occupy a high trophic level (thus <strong>in</strong>dicat<strong>in</strong>g<br />

environmental changes occurr<strong>in</strong>g at lower trophic levels),<br />

<strong>the</strong>y live <strong>in</strong> all ecosystems,<br />

<strong>the</strong>ir taxonomy and identification is well resolved,<br />

<strong>the</strong>ir conspicuous behaviour allow <strong>the</strong>m to be readily<br />

censused,<br />

it is possible to collect large quantities of data <strong>in</strong> a highly<br />

efficient manner us<strong>in</strong>g skilled volunteer enthusiasts,<br />

importantly, birds have great public resonance across<br />

<strong>European</strong> cultures.<br />

Regular monitor<strong>in</strong>g of bird populations can yield trend<br />

<strong>in</strong>formation for birds. This can <strong>the</strong>n be summarised to produce<br />

relatively simple, transparent <strong>in</strong>dicators of ecosystem function<br />

and health, and might act as a model to develop <strong>in</strong>dicators for<br />

o<strong>the</strong>r taxa. Scientific evidence exists to l<strong>in</strong>k changes <strong>in</strong> bird<br />

numbers to policy and environmental changes, <strong>the</strong>refore birds<br />

are ideal subject of develop<strong>in</strong>g policy relevant <strong>in</strong>dicators.<br />

■ Measur<strong>in</strong>g <strong>the</strong> effectiveness of <strong>the</strong> SPA network<br />

The SPA network aims to ma<strong>in</strong>ta<strong>in</strong> a coherent network of sites<br />

for species listed on Annex I and o<strong>the</strong>r migratory species not<br />

listed on Annex I. The key issues for assessment are:<br />

Coherence of <strong>the</strong> network.<br />

Ecological status of sites.<br />

Coherence of <strong>the</strong> network concerns two ma<strong>in</strong> aspects: (a) <strong>the</strong><br />

extent <strong>the</strong> network provides protection to <strong>the</strong> population of a<br />

species (secur<strong>in</strong>g viable populations) and (b) <strong>the</strong> extent to which<br />

<strong>the</strong> sites form a network along flyways (m<strong>in</strong>imis<strong>in</strong>g losses dur<strong>in</strong>g<br />

annual movements). A key <strong>in</strong>dicator for <strong>the</strong> coherence of <strong>the</strong><br />

network <strong>in</strong> relation to (a) can be <strong>the</strong> percentage of <strong>the</strong> species’<br />

population covered by <strong>the</strong> site network (SPAs and for<br />

comparison by IBAs). In case of (b) a more functional<br />

assessment is needed to identify key gaps along a flyway.<br />

Ecological status of sites can be assessed <strong>in</strong> relation to <strong>the</strong> species<br />

<strong>the</strong>y are classified for (qualify<strong>in</strong>g species). The key response<br />

<strong>in</strong>dicator is related to management. In this context <strong>the</strong> existence<br />

of management plans and <strong>the</strong> level of <strong>the</strong>ir implementation<br />

deserve attention and can be assessed by us<strong>in</strong>g a qualitative<br />

scor<strong>in</strong>g system. However, <strong>the</strong> effectiveness of <strong>the</strong> conservation<br />

measures can be ultimately assessed through changes <strong>in</strong> site<br />

conditions. Conditions can be assessed as favourable or<br />

unfavourable based on changes <strong>in</strong> abundance of <strong>the</strong><br />

qualify<strong>in</strong>g species on <strong>the</strong> site. It is recognised however that<br />

<strong>in</strong> some cases abundance cannot be used because numbers<br />

with<strong>in</strong> sites can change due to external factors (e.g. wea<strong>the</strong>r<br />

conditions, overall decl<strong>in</strong>e of <strong>the</strong> species). In this case habitat<br />

suitability should be used <strong>in</strong>stead. This approach is more<br />

practical for stopover sites and sites, which are qualified for<br />

forest/marshland birds. Percentage of sites with favourable<br />

conditions can be an <strong>in</strong>dicator of assess<strong>in</strong>g <strong>the</strong> effectiveness<br />

of <strong>the</strong> directive <strong>in</strong> relation to protect<strong>in</strong>g <strong>in</strong>dividual elements of<br />

<strong>the</strong> SPA network.<br />

■ Engag<strong>in</strong>g citizens<br />

Tens of thousands of citizens are already engaged <strong>in</strong> monitor<strong>in</strong>g<br />

of birds <strong>in</strong> <strong>the</strong> <strong>European</strong> <strong>Union</strong> and beyond already for decades.<br />

<strong>Birds</strong> are attractive to people and <strong>the</strong>ir conservation can mobilise<br />

millions of <strong>European</strong> citizens. The comb<strong>in</strong>ed membership of<br />

<strong>BirdLife</strong> partners exceeds 1.5 million people <strong>in</strong> Europe.<br />

Experience with <strong>the</strong> Pan-<strong>European</strong> Common Bird<br />

Monitor<strong>in</strong>g Scheme and <strong>the</strong> <strong>International</strong> Waterbird Census<br />

shows that monitor<strong>in</strong>g activities are not so much related to <strong>the</strong><br />

level of economic development <strong>in</strong> a country ra<strong>the</strong>r to <strong>the</strong> state<br />

of organisational development of bird conservation NGOs,<br />

which is, <strong>in</strong> turn, related to <strong>the</strong> level of collaboration between<br />

government and non-governmental organisations. Welldeveloped<br />

schemes exist e.g. <strong>in</strong> <strong>the</strong> UK, <strong>the</strong> Ne<strong>the</strong>rlands, but<br />

also <strong>in</strong> <strong>the</strong> Czech Republic and Hungary.<br />

The key issue <strong>in</strong> sett<strong>in</strong>g up and ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g monitor<strong>in</strong>g<br />

schemes for birds is to reach out to potential volunteers and to<br />

provide <strong>the</strong>m with adequate feedback about <strong>the</strong> results of<br />

<strong>the</strong>ir work.<br />

This always requires basic capacity to co-ord<strong>in</strong>ate<br />

recruitment of volunteers, co-ord<strong>in</strong>at<strong>in</strong>g <strong>the</strong> data collection<br />

process, as well as analys<strong>in</strong>g and communicat<strong>in</strong>g <strong>the</strong> results.<br />

Bird conservation NGOs are <strong>in</strong> a unique position compared to<br />

government agencies and scientific <strong>in</strong>stitutions <strong>in</strong> this respect<br />

because <strong>the</strong>y have <strong>the</strong>ir own membership that is already<br />

committed to birds and have basic knowledge of species<br />

identification. In many countries, work<strong>in</strong>g groups exists<br />

which are specialised on certa<strong>in</strong> group of species and which<br />

carry out specialised monitor<strong>in</strong>g. The ma<strong>in</strong> limitation is <strong>in</strong> many<br />

cases, however, <strong>the</strong>ir often limited ability to fund <strong>the</strong> coord<strong>in</strong>ation<br />

work.<br />

Conclusion:<br />

Most of <strong>the</strong> work on monitor<strong>in</strong>g of species and sites<br />

is currently done by NGOs, like <strong>BirdLife</strong><br />

<strong>International</strong>, with only small support by<br />

governments. This has to change <strong>in</strong> <strong>the</strong> future.<br />

<strong>Birds</strong> are good <strong>in</strong>dicators for biodiversity and<br />

bird trends are appropriate <strong>in</strong>dicators to use at high<br />

political levels.<br />

THE IMPLEMENTATION OF THE BIRDS<br />

DIRECTIVE: JUDGEMENTS AND<br />

INFRINGEMENT PROCEDURES<br />

The judgements of <strong>the</strong> <strong>European</strong> Court of Justice (ECJ) related<br />

to <strong>the</strong> implementation of <strong>the</strong> <strong>Birds</strong> Directive so far have been<br />

essential <strong>in</strong> clarify<strong>in</strong>g some important aspects of <strong>the</strong> Directive<br />

and <strong>in</strong> show<strong>in</strong>g <strong>the</strong> way for its better implementation <strong>in</strong> <strong>the</strong><br />

future. Accord<strong>in</strong>g to <strong>the</strong> Commission’s 2002 annual report on<br />

<strong>the</strong> application of Community law, <strong>the</strong> environment sector<br />

covered one third of all <strong>in</strong>fr<strong>in</strong>gement cases <strong>in</strong>vestigated by <strong>the</strong><br />

Commission <strong>in</strong> that year. A large number of <strong>the</strong>se cases are<br />

related to <strong>the</strong> nature Directives. So far, <strong>the</strong>re have been 33<br />

judgements related to <strong>the</strong> <strong>Birds</strong> Directive, mostly on<br />

shortcom<strong>in</strong>gs related to both habitat protection (Articles 3 and<br />

4 of <strong>the</strong> Directive) and species protection (Article 5–9) issues.<br />

Especially large numbers of cases relate to site designation and<br />

<strong>the</strong> protection system to be applied to SPAs, as well as to<br />

hunt<strong>in</strong>g and exemptions from <strong>the</strong> species protection<br />

requirements. It is important to note that <strong>in</strong> many cases<br />

conflicts between conservation and development objectives have<br />

been resolved without hav<strong>in</strong>g to resort to national courts or<br />

<strong>the</strong> ECJ. These cases illustrate best that <strong>the</strong> Directive can work<br />

effectively to promote susta<strong>in</strong>able development tak<strong>in</strong>g <strong>in</strong>to<br />

account various <strong>in</strong>terests.<br />

Infr<strong>in</strong>gement procedures, however, take a long time to reach<br />

<strong>the</strong>ir conclusions, which requires a lot of time <strong>in</strong>vestment from<br />

NGOs with limited resources, but also from Commission<br />

services. The Commission has <strong>in</strong>itiated some new work<strong>in</strong>g<br />

methods to improve <strong>the</strong> performance of Member States <strong>in</strong><br />

implement<strong>in</strong>g Community law, such as preparation of<br />

guidel<strong>in</strong>es and <strong>in</strong>terpretative texts, l<strong>in</strong>k<strong>in</strong>g Community fund<strong>in</strong>g<br />

to correct implementation of environmental legislation and
